Rif Ketubot 61b {102b - 103a; 104a}

לא יאמר הראשון כשתבא אצלי אזונה
אמר רב חסדא זאת אומרת בת אצל האם לא שנא גדולה ולא שנא קטנה
תניא מי שמת והניח בן קטן יורשי האב אומרים יהא גדל אצלנו והיא אומרת [יהא] גדל אצלי אין מניחין [אותו] אצל מי שראוי ליורשו מעשה היה ושחטוהו ער"ה
"The first husband is not entitled to plead, 'when she comes to me I will give her maintenance'":
Rav Chisda said: This says that the daughter must be living with her mother, with no difference whether she is an adult of a minor.
They learnt {in a brayta}: One who died and left a minor son, the heirs of the father say 'let him grow up with us,' and she says 'let him grow up with me,' we do not place him with anyone entitled to be an heir. There was an incident and they slaughtered him on the very first evening! {J: See this post on parshablog for elaboration.}

וכן לא יאמרו שניהן הרי אנו זנין אותה כאחת:
ההוא גברא דאגר ריחיא לחבריה לטחינה
לסוף איעתר זבין ריחיא וחמרא
אמר ליה לאגירא עד האידנא הוה טחיננא גבך באגר ריחיא דידי
השתא דלא צריכנא הב לי אגר ריחיא
אמר ליה לא אלא מיטחן טחינא לך באגרא דילך כדמעיקרא
סבר רבינא למימר היינו מתניתין לא יאמרו שניהן הרי אנו זנין אותה כאחת אלא אחד זנה ואחד נותן לה דמי מזונות הכא נמי כיון דלא צריך לטחינה שקיל מיניה דמי
א"ל רב עוירא מי דמי התם חדא כריס' אית לה תרתי כריסיאתה לית לה הכא אמר ליה טחון זבון טחון אותיב
ולא אמרן אלא דלית ליה לאגירא טחינה אבל אית ליה (לאגירא) טחינה כופין אותו על מדת סדום ויהיב דמי
"And so too, the two of them may not say 'we will support her together' {providing only a single maintenance}":
There was a certain man who leased his mill to his fellow man in exchange for grinding {his grain}. Eventually, he because wealthy and bought a mill and a donkey.
He {the now wealthy man} said to the renter {in our gemara, "to the renter"}: Until now, I had my grinding done by exchange for the rent of my mill. Now that I do not need this, give me the rent for my mill.
He said to him: No, but rather I will grind for you as the exchange for your rent, as initially.

Ravina thought to say that this is our Mishna: "the two of them cannot say that we will maintain her as one," but rather one feeds her and the other gives her the money equivalent to the food. So too here, since he does not require the grinding, he should take from him money.
Rav Avira said to him: Is this really comparable? There, she has one belly, but does not have two bellies. Here, he said to him: Grind {in yours} and sell; Grind {in mine} and keep.
And they only said this where the lessee does not have to grind {for others}, but if there is (* to the lessee *) sufficient grinding, we force him, because of the trait of Sodom {that he should not act with such a trait}, and make him give money.

Mishna:
אלמנה שאמרה אי אפשי לזוז מבית בעלי אין היורשים יכולים לומר לה לכי לבית אביך ואנו זנין אותך שם אלא זנין אותה ונותנין לה מדור לפי כבודה

אמרה אי אפשי לזוז מבית אבא יכולין יורשין לומר לה אם את אצלנו יש ליך מזונות ואם אין את אצלנו אין ליך מזונות

ואם היתה טוענת מפני שהיא ילדה והן ילדים נותנין לה מזונות והיא בבית אביה
SHOULD A WIDOW SAY, 'I HAVE NO DESIRE TO MOVE FROM MY HUSBAND'S HOUSE', THE HEIRS CANNOT TELL HER, GO TO YOUR FATHER'S HOUSE AND WE WILL MAINTAIN YOU', BUT THEY MUST MAINTAIN HER IN HER HUSBAND'S HOUSE AND GIVE HER A DWELLING BECOMING HER DIGNITY.

IF SHE SAID, HOWEVER, I HAVE NO DESIRE TO MOVE FROM MY FATHER'S HOUSE', THE HEIRS ARE ENTITLED TO SAY TO HER, 'IF YOU STAY WITH US YOU WILL HAVE YOUR MAINTENANCE, BUT IF YOU DO NOT STAY WITH US YOU WILL RECEIVE NO MAINTENANCE'.

IF SHE BASED HER PLEA ON THE GROUND THAT SHE WAS YOUNG AND THEY WERE YOUNG, THEY MUST MAINTAIN HER WHILE SHE LIVES IN THE HOUSE OF HER FATHER.

Gemara:
תנו רבנן משתמשת במדור שנשתמשת בו בחיי בעלה בכרים וכסתות שנשתמשת בחיי בעלה בכלי כסף וכלי זהב שנשתמשת בחיי בעלה בעבדים ושפחות שנשתמשת בחי בעלה שכך כותב לה כל יומי שמיגר אלמנותיך בביתי
The Sages learnt {in a brayta}: {A widow} may use {her deceased husband's} dwelling as she used it during his lifetime. {She may also use} the bondmen and bondwomen, the cushions and the bolsters, and the silver and gold utensils as she used them during the lifetime of her husband, for such is the written undertaking he gave her: 'And you shall dwell in my house and be maintained therein out of my estate throughout the duration of your widowhood

תני רב יוסף בביתי ולא בעקתי
אר"נ יתומים שמכרו במדור אלמנה לא עשו כלום
Rav Yosef taught: "In my house" and not "in my hovel."
Rav Nachman said: If orphans sold a widow's dwelling, their act is legally invalid.

ומ"ש מדרב אסי א"ר יוחנן דא"ר אסי א"ר יוחנן יתומים שקדמו ומכרו בנכסים מועטין מה שמכרו מכרו
התם לא תפיסה מחיים הכא תפיסה מחיים

אמר אביי נקיטינן מדור אלמנה שנפל אין היורשין חייבין לבנותו
ותנ"ה מדור אלמנה שנפל אין היורשין חייבין לבנותו ולא עוד אלא אפי' אומרת הניחו לי ואבננו משלי אין שומעין לה
בעי אביי שיפוצא מאי תיקו הילכך לא תשפץ:
And why is this different from Rav Assi citing Rabbi Yochanan? For Rav Assi cited Rabbi Yochanan: If the orphans preempted and sold a small amount of assets, what they sold, they sold?
There, she did not seize it during his lifetime, but here, she seized it during his lifetime.

Abaye said: We have a tradition that the dwelling of a widow which fell down, the heirs are not required to rebuild it.
And a brayta also says so: The dwelling of a widow which fell, the heirs are not obligated to rebuild it. And not only that, but even if she says 'Allow me and I shall rebuild it at my own expense', we do not listen to her.
Abaye said: If she repaired it, what is the law?
The question stands. Therefore, she should not repair.

אמרה אי אפשי לזוז מבית אבא:
וליתבו לה כי יתבה התם
מסייע ליה לרב הונא דאמר רב הונא ברכת הבית ברובה
וליתבו לה לפי ברכת הבית אה"נ
"IF SHE SAID, HOWEVER,'I HAVE NO DESIRE TO MOVE FROM MY FATHER'S HOUSE'":
Why should they not give her maintenance while she lives there {in her father's house}?
This supports Rav Huna, for Rav Huna said: 'The blessing of a house [is proportionate] to its size.' {Thus, it is cheaper to buy in bulk, which they cannot do if she lives elsewhere.}
Why then can they not give her according to the blessing of the house?
Indeed, they could.

{Ketubot 104a}
Mishna:
כל זמן שהיא בבית אביה גובה כתובתה לעולם
וכל זמן שהיא בבית בעלה גובה כתובתה עד כ"ה שנים
שיש בכ"ה שנים שתעשה טובה כנגד כתובתה דברי ר"מ שאמר משום ר"ג
SO LONG AS SHE LIVES IN HER FATHER'S HOUSE {A WIDOW} MAY RECOVER HER KETHUBAH AT ANY TIME.

AS LONG, HOWEVER, AS SHE LIVES IN HER HUSBAND'S HOUSE SHE MAY RECOVER HER KETHUBAH ONLY WITHIN TWENTY-FIVE YEARS, BECAUSE IN THE COURSE OF TWENTY-FIVE YEARS SHE HAS SUFFICIENT OPPORTUNITIES OF RENDERING FAVORS CORRESPONDING {IN VALUE TO THE AMOUNT OF} HER KETHUBAH; THESE ARE THE WORDS OF RABBI MEIR WHO LAID DOWN THE RULING IN THE NAME OF RABBI SHIMON BEN.
