Rif Ketubot 60a {Ketubot 101a - b}

60a

{Ketubot 101a}

A variant language:
And the Sages penalized them, her in hers and his in his. Hers in hers are the assets of melog, which are hers, for they remain in her domain, in that the Sages penalize her and she does not have. And his in his are the assets which are iron sheep, which are not in her domain but rathter in the domain of the husband, since if they died, they died to him, and if they increased, they increased for him -- that if they are not extant, he pays her from his own.

However, a girl who refuses, if the worn out articles are extant, whether they are assets of melog or assets which are iron sheep, both of them she takes. And if they are not extant, either way she does not get it.
And an aylonit whom he did not recognize that she was so, if they are extant, in either case she does get, and if they are not extant, then the assets of melog, which are in her domain, she does get, but the assets which are iron sheep, which are not in her domain, she does not get.
And an aylonit who he recognized as such gets her ketuba, as we learn {in the Mishna}, "and if from the start he married her as an aylonit, she does get the Ketuba."

{Ketubot 101b}

"A widow to a kohen gadol, a divorcee or a chalutza to a regular kohen...":
Rav Huna said: An aylonit is a wife and is not a wife; a widow to a kohen gadol is a full wife.

An aylonit is a wife - that if he recognized this in her {before marriage}, she does have a ketuba. And she is not a wife - that if he did not recognize this in her, she does not have a ketuba.

A widow to a kohen gadol is a full wife, whether he recognized this about her or did not recognize this about her, she has a ketuba.

And Rav Yehuda said: Both this one and that one is a wife and not a wife -- that if he recognized this in her {before marriage}, she does have a ketuba, and if he did not recognize this in her, she does not have a ketuba.

And the halacha is like Rav Yehuda, for there is a brayta like him: "If he took her in {marriage} (*and she was found to be an aylonit *) knowing this was so, she has a ketuba. If he took her in without stipulation, she does not have a ketuba.

And Rav Huna -- the Mishna caused his to err. He thought that since the Tanna makes a distinction by the aylonit and said, "if initially he married her as an aylonit, she has a ketuba," and he does not make such a distinction by the widow, we may infer that for a widow, even in the case without stipulation, she also has a ketuba.
And it is not so. When he taught the case of widow, it was along the same lines of distinction as he taught the case of aylonit.
Therefore, a widow to a kohen gadol, a divorcee or chalutza to a normal kohen, a bastardess or female descendant of Gibeonite converts to an Israelite, the daughter of an Israelite to a bastard or a male descendant of Gibeonite converts -- if he recognized this about them, they have a ketuba, whether the 100 and 200 or the addition, and they have fruits, maintenance, and worn-out articles. For since they have the ketuba, they also have the conditions of the ketuba.

And the maintenance which they have, these words are after death, that he did not have a chance to divorce before he died. But in the lifetime of the husband, since he is to stand and divorce, they do not have maintenance. For if you say that they do get, they will come to remain by him. For so we conclude in perek Yesh Mutarot leVaaleihen: If he did not recognize this in them, they do not receive the ketuba of 100 and 200, nor fruits nor maintenance not worn-out articles, but the additional amount, they do have, like Shmuel.

And these worn out articles, which we say that they do not receive, it is logical to us that since their law is like the law of the aylonit who he did not recognize this about her -- that if the worn out articles are extant, then in both cases she does get it, whether they are assets of melog or assets which are iron sheep. And if they are not extant, the assets which are melog, which are in her domain, she does get, but assets which are iron sheep, which are not in her domain, she does not get. Here as well {by a widow, etc.} the law is so.

But a woman who is a secondarily prohibited relation, it does not matter if he recognized this about her or did not recognize this about her, she does not receive the ketuba of 100 or 200; but she does have the addition; but no fruits nor maintenance; nor worn-out articles of assets which are melog, where they are not extant, but if they are extant, she does have; and assets which are iron sheep, whether they are not extant or are extant, she does have. Like Rav Kahana who said that the Sages penalized her hers in hers and his in his.

And how do we know that a woman who is a secondarily prohibited relative, whether he recognized this about her or did not recognize this about her, there is the same law that she has?

Firstly, because the Tanna made this distinction by aylonit and did not make this distinction by a woman who is secondarily prohibited, we may deduce that a secondarily prohibited woman, it does not matter whether he recognized or did not recognize, she does not have a ketuba.

And furthermore, we learn in perek yesh mutarot leVaaleihim:
The Sages learnt in a brayta: A widow to a kohen gadol, a divorcee or a chalutza to a normal kohen, they have ketuba, fruits, maintenance, and worn-out articles. And she is invalid {pasul} and her child is invalid, and we force him to divorce. Secondarily prohibited relatives, which are Rabbinic, they do not have ketuba nor fruits nor maintenance nor worn out clothing. And she is valid, and her child is valid, and we force him to divorce. Rabbi Shimon ben Eleazar said: Why do they say that a widow to a kohen gadol has a ketuba? For he is valid and she is invalid.
