Rif Ketubot 51a {Ketubot 92b - 93a}

51a

מיניה דינא הוא דאזיל ראובן ומפצי ליה ולא מצי א"ל לאו בעל דברים דידי את משום דא"ל אי מפקת לה מיניה עלאי דידי הדר ואיכא דאמרי אפילו שלא באחריות נמי דא"ל לא ניחא לי דליהוי לשמעון תרעומת עלאי :
from him, the law is that Reuven can come litigate with him {=the creditor}, and he {=the creditor} cannot say to him, "you are not a party to me {in a lawsuit}," for he {=Reuven} may say to him, "if you take it away from him, he will return and demand compensation from me."

And some say even without guarantee as well, for he may say to him, "I do not which for Shimon to have complaints about me."

אמר אביי ראובן שמכר שדה לשמעון שלא באחריות ויצאו עליה עסיקין עד שלא החזיק בה יכול לחזור בו משהחזיק בה אין יכול לחזור בו
מ"ט דא"ל חייתא דקיטרי סברת וקיבלת
ומשהחזיק בה מאימת מכי דייש אמצרי

Abaye said: If Reuven sold a field to Shimon without guarantee,
{Ketubot 93a}
and claimants appeared against him {=against Reuven} before he {=Reuven} took possession of it, he is able to retract from it. From when he took possession of it, he is unable to retract from it.
What is the reason? For he says to him: You have agreed to a back full of knots, and you have received it.
And when he took possession of it -- from when? From when he sets his foot on the landmarks {to level them}.
And some say: Even with guarantee as well, for he may say to him, "show your tirpha {document where this was repossessed} and I will pay you."


Mishna:
מי שהיה נשוי שלש נשים ומת כתובתה של זו {מנה} ושל זו מאתים ושל זו שלש מאות ואין שם אלא מנה חולקות בשוה
היו שם מאתים של מנה נוטלת חמשים ושל מאתים וג' מאות שלשה שלשה של זהב
היו שם שלש מאות של מנה נוטלת נ' ושל מאתים מנה ושל ג' מאות ששה של זהב
וכן ג' שהטילו לכיס אם פיחתו או הותירו כך הן חולקין
One who married three women and died, where the ketuba of this one {is 100} and that one was 200, and of this {third} one was 300, and there is only a single maneh {=100}, they split it evenly.
If there was 200, then the one with a 100 claim takes 50, that with 200 and with 300 each take three gold dinarim {=75 zuz}.
If there were 300 zuz, the one with 100 claim takes 50, and the 200 and 300 claims each take six gold dinarim {=150 zuz}.
And so too three who cast into a shared purse {for trading purposes}, if they lost or profited, so do they split.

הא מתני' וגמרא דילה שקלי וטרו בה קמאי ז"ל ולא סלקא להון כל עיקר וכיון דחזו דלא סליקא להו כהוגן הדרי לשקול הדעת ופסקי הלכתא דפלגין לפום ממונא
וסמכי להאי סברא על מימרא דרבי דאמר אין אני רואה דבריו של רבי נתן באלו אלא חולקין בשוה
וקא פרישו להא דא"ר חולקין בשוה שהוא לפי מעות
והדין סברא כי מעיינת בה בגמרא משכחת לה פריכא ולא סליק אליבא דגמרא כל עיקר ולא אליבא דמתני' דבהדיא
This Mishna and its gemara, those of blessed memory ask and answer in it before us, and they do not get out of it anything. And since they see that they do not take it our appropriately, they turn to weighing opinion, and the rule that the halacha is that they split according to the money.
And they rely in this opinion on the statement of Rabbi, who said that "we do not approve of Rabbi Natan in these matters, but rather they divide equally." And they explain this that Rabbi said that "they divide equally," that it is according to the money {owed to each person}.
And this opinion, when you consider it in the gemara, you discover that it is rejectable, and it does not arise out of the gemara at all, nor according to the Mishna. For explicitly
