Gemara:

איבעיא להו שליח כמאן
אמר רבא אמר רב נחמן שליח כדיינין
רב שמואל בר ביסנא אמר רב נחמן שליח כאלמנה
והילכתא שליח כאלמנה דאם טעה בכל שהוא מכרו בטל
It was a question to them: The agent is like who?
{Ketubot 100a}
Rava cited Rav Nachman: The agent is like the judges {allowing for an error so long as it not a sixth}.
Rav Shmuel bar Bisna said: The agent is like a widow {disallowing any error}.
And the halacha is that the agent is like a widow, that if he errs in any amount, his sale is nullified.


אמר רב הונא בר חיננא א"ר נחמן הלכה כדברי חכמים

Rav Huna bar Chinena cited Rav Nachman: The halacha is like the words of the Sages {rather than Rabban Shimon ben Gamliel}.
But does Rav Nachman not hold of the principle of "what then is the force of Bet Din?!" But Rav Nachman cited Shmuel: Orphans who came to split the assets of their father, Bet Din appoints for {each of} them a guardian, who choses for them a good portion. And if {=when} they grow up, they are able to protest {the settlement}. And Rav Nachman, for himself, said: When they grow up, they are not able to protest, for if so, what force is there to Bet Din? {Thus, we see he does hold of this principle.}

This is no contradiction {between Shmuel and Rav Nachman}. Here {=Shmuel} is where they erred, and here {=Rav Nachman} is where they did not err.
If they did not err, about what would they conceivably be able to protest? Based on the adjoining fields {in that it is distant from their other fields}.
And the halacha is like Rav Nachman.

אי מההיא הוה אמינא הני מילי שליח אבל בית דין לא קמ"ל דאפילו ב"ד
Rav Yosef said: If a widow sells {the husband's estate for maintenance or ketuba}, the responsibility for the indemnity is upon the orphans. And if the court sold, the responsibility for the indemnity is upon the orphans.

Amemar said in the name of Rav Yosef: A court which sold without {prior} public announcement, they are deemed as if making an error in a law from Mishna, and their decision is reversed.
They are "deemed?" The certainly did err! For they learnt {in a Mishna}: The assessment of {the property of} the orphans is thirty days {of prior public announcement}; the assessment of consecrated land is 60 days. And they announce in the morning and in the evening. {Thus, they did err in something plainly stated in the Mishna!}
If from that, I would have believed that those words are for an agent, but for the court, no. Therefore it informs us that even Bet Din.

Rav Ashi objected to Amemar: "If the assessment of the judges was 1/6th less, or 1/6th more, their sale is nullified." The implication is that if it was exactly equal, their sale was valid. Does this not mean where they did not announce? No, it was where they did announce.
But, if the last part {the sefa} was where they announced, the first part should be where they did not announce. For they taught in the sefa, "however if they made a bill of inspection {which involves making an announcement}, even if they sold 200 for 100, or something worth 100 for 200, their sale is valid."

לא רישא וסיפא בדאכרוז
ולא קשיא כאן בדברים שמכריזין עליהן כאן בדברים שאין מכריזין עליהן
No, both the resha and the sefa are where they announced, and it is no difficulty. Here {Soncino says this refers to Amemar's ruling, but Rif explains this to mean the sefa} is for things which should be announced, and here {=the resha} are for things which do not need to be announced.

רישא דקתני פיחתו שתות או הותירו שתות מכרן בטל ואע"ג דאכרוז בדברים שאין מכריזין עליהם אי נמי בשעה שאין מכריזין אי נמי במקום שאין מכריזין דכיון דלא בעו הכרזה בין אכרוז בין לא אכרוז חד דינא הוא ואם פיחת שתות או הותיר שתות מכרן בטל שוה בשוה מכרן קיים

{Rif explains:} The resha which taught "if they reduced by 1/6 or increased by 1/6, their sale is nullified" -- and even though they announced it -- is by things which they do not announce for, or {as the gemara proceeds to suggest} alternatively at a time that they do not announce, or alternatively, in a place where they do not announce. For since they do not require an announcement, whether they announced or did not announce, they have an identical law, and if they reduced by 1/6 or increased by 1/6, their sale is nullified, but if of equal value, their sale stands.

And the sefa which taught "if they made a bill of inspection, then even if what was worth 100 for 200, or worth 200 for 100, their sale is valid" -- is by things upon which they announce, and at a time that they announce, and in a place where they announce. For since they announce upon them, it is as if fit, and so whether they reduced or increased, their sale stands.

{Gemara resumes:}
And these are the things upon which they announce: Servants, deeds, and movable objects.
What is the reason?
Ulla said {our gemara omits this attribution}: Servants, lest they hear and run away. Deeds and movable objects, lest they be sold.
"At a time that they do not announce" -- as the residents of Nehardea say: For poll-tax, maintenance, and burial, they sell without announcement.
In a place where they do not announce: Such as in Nehardea.
For Rav Nachman said: They never made a bill of inspection in Nehardea. They assumed that this is because they were experts at assessment. Rav Yosef bar Minyumi said: Rav Nachman explained it to me: Because they called them {=the Nehardeans} people who consume the assets which are announced. {Since at such auctions, where there is a forced sale, the buyers can take advantage and buy at an extremely low price.}

אמר רב יהודה אמר שמואל מטלטלין של יתומין שמין אותן ומוכרין אותן לאלתר
ורב חסדא אמר אבימי מוליכין אותו לשוקים
ולא פליגי הא דמקרב שוקא הא דמרחק שוקא
Rav Yehuda cited Shmuel: Movable objects of the orphans, they are assessed and sold immediately.
And Rav Chisda cited Avimi: We bring them {to be sold} in markets.
And they do not argue. Here is where the market is close, while there is where the market is far.

רב כהנא הוה בידיה שכרא דרב משרשיא בר חקלא יתמא שהייה עד ריגלא
אמר אע"ג דהוה ביה איצצא מייתי זוזי חריפי
Rav Kahana has in his possession some beer that belonged to Rav Mesharshia bar Chikla the orphan. He kept it until the festival. He said: Even though it might deteriorate, it will bring quick money.

רבינא הוה בידיה חמרא דרבינא זוטא יתמא בר אחתיה הוה נמי לדידיה חמרא הוה מסיק ליה לסיכרא
אתא לקמיה דרב אשי אמר ליה מהו למשקליה בהדיה נשקליה דילמא מיתניס נשבקיה דילמא מתקיף
אמר ליה זיל לא עדיף מדידך:
Ravina has in his possession wine for Ravina the little, the orphan, the son of his sister. He also had some of his own wine, which he was bringing to Sikra. He came before Rav Ashi, and said to him: What {is the law} about bringing it with him.
For if he took it, perhaps some accident would occur to it. If he left it {at home}, perhaps it would become tough {?? deteriorate in some fashion}.
He said to him: Go {and take it} -- it is no better than your own.

תנן התם בערכין שום היתומים שלשים
They learnt {in a Mishna} there in Arachin: The assessment of {the property of} the orphans is {announced for} 30 days
