{Ketubot 90b continues}

חיישינן לאינצויי
ממאי מדקתני שניה ויורשיה קודמים ליורשי ראשונה
מיקדם הוא דקדמי הא איכא שקלי
worry about quarrels.
From what? From the fact that it taught {in the Mishna}, "the second one and her heirs precede the heirs of the first one."
In what they precede them, they precede them, but if there is {a balance}, they take.

וש"מ כתובה נעשית מותר לחברתה ממאי מדלא קתני אם יש שם מותר דינר
וש"מ כתובת בנין דיכרין לא טרפא ממשעבדי דאי ס"ד טרפא ליתו בני ראשונה ונטרפינהו לבני שניה.
And we deduce from here that the ketuba {of the second wife} is regarded as surplus for its fellow. From where? From the fact that it did not teach {in the Mishna that payment is made only} "if there is surplus of a dinar."

And we deduce from here that the ketuba of male children are not grabbed from property under a lien. For if it arose in your mind that it is so grabbed, let the sons of the first ones come and grab from the sons of the second one.

אמר מר זוטרא משמיה דרב פפא הלכתא אחת בחייו ואחת במותו יש להן כתובת בנין דיכרין כתובה נעשית מותר לחברתה
והנ"מ באחת בחייו ואחת במותו אבל מתו שתיהן בחייו עד שיהא שם יתר על שתי כתובות דינר
דתנן מי שהיה נשוי שתי נשים ומתו ואחר כך מת הוא והיתומים מבקשין כתובת אמן ואין שם אלא שתי כתובות חולקות בשוה היה שם יתר דינר אלו נוטלים כתובת אמן ואלו נוטלין כתובת אמן ואם אמרו יתומים הרי אנו מעלין על נכסי אבינו יתר דינר כדי שיטלו כתובת אמן אין שומעין להן אלא שמין הנכסים בב"ד היו שם נכסים בראוי אינו כבמוחזק
ר"ש אומר אע"פ שיש נכסים שאין להן אחריות אינו כלום עד שיהיו שם נכסים שיש להן אחריות יתר על שתי הכתובות דינר.
Mar Zutra said in the name of Rav Pappa: The halacha is that whether in his {=the husband's} life or death, they have the ketuba of male children, and that the ketuba is considered as surplus for its fellow.
And these words are where one {wife died} in his lifetime and one {wife died} after he died, but if both of them died in his lifetime, only where there is a dinar surplus over the two ketubot.
For they learnt {in a Mishna -- in our gemara, this is the Mishna}: One who married two wives, and they {=the wives} died, and afterwards he died, and the orphans are requesting the ketuba of their mother, and there is only enough for the two ketubot, they split it evenly {as heirs to their father's estate}. If there is a surplus of a dinar, these take the ketuba of their mother and these take the ketuba of there mother. And if the orphans said, "behold we are adding to the assets of our father one dinar," such that they can take the ketuba of their mother, we do not listen to them. Rather, we assess the assets in Bet Din. {And in assessing} Prospective property is not considered like actually possessed property.
Rabbi Shimon said: Even though there is assets not subject to lien {movable objects}, it is nothing, until there are assets subject to lien in surplus of the two ketubot a dinar.

והיכא דאיכא בע"ח ואיכא מותר על שתי כתובות מאי דשקל בע"ח כ"ע לא פליגי דהוי מותר והני שקלי כתובת אמן והני שקלי כתובת אמן:
And where there is a creditor and there is surplus on the two ketubot, that which the creditor took, they do not argue that it is surplus, and so these take the ketuba of their mother and these take the ketuba of their mother.

ת"ר לזו אלף ולזו ה' מאות אם יש שם מותר דינר אלו נוטלין כתובת אמן ואלו נוטלין כתובת אמן ואם לאו חולקין בשוה
פשיטא מרובין ונתמעטו כבר זכו בהן יורשים
מועטין ונתרבו מאי
אמר רב נחמן כשם שמרובין ונתמעטו זכו בהן היורשין כך מועטין ונתרבו זכו בהן יורשין

The Sages learnt {in a brayta}: To this was 1000 and to this one 500, if there was a surplus of a dinar, these take the ketuba of their mother and these take the ketuba of their mother. And if not, they split it evenly.
It is obvious that if it {the estate} was large and decreased, the heirs already acquired ownership. If it was small and increased, what is the law?
Rav Nachman said: Just as where it was large and decreased, the heirs already acquired ownership, so too where it was small and increased, the heirs already acquired ownership.

ההוא גברא דהוו מסקי ביה אלפא זוזי הוו ליה תרי אפדני זבנינהו חד בה' מאה וחד בה' מאה אתא בע"ח טריף ליה לחד מינייהו והדר אתא וטריף לאידך
שקל אלפא זוזי ואזל לגביה
א"ל אי שוויא לך ההיא אלפא זוזי לחיי ואי לא שקול אלפא זוזי ואסתלק
סבר רמי בר חמא למימר היינו מתני' אם אמרו יתומים הרי אנו מעלים על נכסי אבינו יתר דינר אין שומעין להן
א"ל רבא מי דמי התם אית להו פסידא ליתמי הכא מאי פסידא איכא אלפא יהיב ואלפא קא שקיל
There was a certain man against whom there was a claim for 1000 zuz. He had two mansions which he sold, one for 500 and one for 500. The creditor came and seized one of them and turned around and seized the other one. He {=one of the purchasers} took 1000 zuz and went to him. He said to him: If this one {mansion} is worth to you 1000 zuz, well and good, but if not, take 1000 zuz and go {and give up both mansions}.
Rami bar Chama thought to say that this is our Mishna, that if the orphans say "behold we are adding to the assets of our father a surplus of a dinar, we do not listen to them."
Rava said to him: Is this indeed comparable? There, there is loss to the orphans. Here, what loss is there? He gave 1000 and received 1000.
