Rif Ketubot 49a {89b; 90a - b}

49a

{Ketubot 89b}
Gemara:

שתי כתובות וגט אינה גובה אלא כתובה אחת
אי בעיא בהאי גביא אי בעיא בהאי גביא
לימא תהוי תיובתיה דרב נחמן
דאמר ר"נ שני שטרות היוצאין בזה אחר זה ביטל שני את הראשון
ולאו מי איתמר עלה אמר רב פפא ומודה רב נחמן דאי אוסיף ביה דיקלא לתוספת כתביה ושעבודא דקמא קאים הכי נמי בדאוסיף לה
"Two ketubot and a get, she only collects with one ketuba":
{Implying} if she wishes she can collect with this one, and if she wishes she can collect with that one. Let us say this is a refutation to Rav Nachman. For Rav Nachman said: Two bonds which go out one after the other, the second one nullifies the first one. But do we not state upon this that Rav Papa said, "and Rav Nachman admits that if he added in it a date-palm for an addition, he writes it, and the lien of the first one still stands." Here to, where he added for her.

We learn in perek naarah shenitpateta:
It was stated {by Amoraim}: If she produced upon him two ketubot, one of 200 and one of 300:
Rav Huna said: If she comes to collect the 200, she collects from the first date; 300, she collects from the second date.
And we say: Why does she not collect 500? For since he did not write to her "I am adding for you 300 upon the 200," this is what he is saying to her: "If from the first date you collect, collect 200, and if from the second date, collect 300." And from that he did not write to her as well "I am adding you 100 upon the 200," he is forgiving the first lien {within this second ketuba}. Therefore, when she collects 300, she collects from the second date.

ת"ר גט כתובה ומיתה
אם גט קודם לכתובה גובה שתי כתובות
ואם כתובה קדמה לגט אינה גובה אלא כתובה אחת
שהמגרש את אשתו והחזירה על מנת כתובתה הראשונה החזירה

והני מילי כשהחזירה סתמא אבל אי כתב לה כתובה אחריתי גביא תרוייהו
כדקתני רישא שני גיטין ושתי כתובות גובה שתי כתובות:
The Sages learnt {in a brayta}: {If she produced} A ketuba and {proof of her husband's} death,
{Ketubot 90a}
then if the get was dated before the ketuba, she collects two ketubot. And if the ketuba predated the get, she only collects a single ketuba. For one who divorces his wife and takes her back, takes her back on condition of the first ketuba {remaining in effect, rather than a second one}.

And these words are where he took her back plainly, but if he wrote for her another ketuba, she collects both of them. As we learnt in the first part: Two gets and two ketubot, she collects two ketubot.

קטן שהשיאו אביו כתובתה קיימת כו'
א"ר הונא לא שאנו אלא מנה מאתים אבל תוספת אין לה
תניא כוותיה דרב הונא חידשו נוטלין מה שחידשו לא חידשו בתולה גובה מאתים ואלמנה מנה
אבל תוספת לא
"A minor whose father married him off, her ketuba stands valid...":
Rav Huna said: They only taught this regarding the 100 and 200, but the additional amount, she does not have.
A braya in accordance with Rav Huna: If they updated it, she takes what was updated, but if they did not update it, a virgin takes 200 and a widow 100.
{Implying:} But an addition, no.

מי שהיה נשוי שתי נשים ומת הראשונה קודמת לשניה ויורשי הראשונה קודמין ליורשי שניה
נשא ראשונה ומתה נשא שניה ומת הוא שניה ויורשיה קודמין ליורשי ראשונה
IF A MAN WAS MARRIED TO TWO WIVES AND DIED, THE FIRST [WIFE] TAKES PRECEDENCE OVER THE SECOND, AND THE HEIRS OF THE FIRST WIFE TAKE PRECEDENCE OVER THE HEIRS OF THE SECOND.

IF HE MARRIED A FIRST WIFE AND SHE DIED AND THEN HE MARRIED A SECOND WIFE AND HE HIMSELF DIED, THE SECOND WIFE AND HER HEIRS TAKE PRECEDENCE OVER THE HEIRS OF THE FIRST WIFE.

Gemara:
אוקימנא בסוף כל הנשבעין שבתורה כשנשבעה ומתה אבל מתה ולא נשבעה אין יורשין של שניה נוטלין כתובה דאין אדם מוריש שבועה לבניו:
We establish this as the end of kol haNishbain sheBeTorah as where she swore and then died, but if she died without swearing, the heirs of the second one take her ketuba, for a person does not give over an oath as inheritance to his children.
