שמעה אזלה ואחילתה
אמר רב נחמן עשינו עצמנו כעורכי הדיינין
מעיקרא מאי סבר ולבסוף מאי סבר
מעיקרא סבר מבשרך לא תתעלם
ולבסוף סבר אדם חשוב שאני
She heard, and went and forgave it.
Rav Nachman said: We have made ourselves into legal advisors {which is not a good thing}.
Initially, what did he think, and in the end, what did he think?
Initially, he though {Yeshaya 58:7}:
ז הֲלוֹא פָרֹס לָרָעֵב לַחְמֶךָ, וַעֲנִיִּים מְרוּדִים תָּבִיא בָיִת: כִּי-תִרְאֶה עָרֹם וְכִסִּיתוֹ, וּמִבְּשָׂרְךָ לֹא תִתְעַלָּם. 7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?

And in the end, he thought: A distinguished person is different.

ומהא נמי שמעינן דליתיה להאי טעמא דאמר עיינית בחושבנאי לא פש לי מידי
דאי מהאי טעמא אמרינן חזר ומחלו מחול ואפילו יורש מוחל לא הוה אפשר ליה לרב נחמן דליסבה עצה בכי הא מילתא דהויא לה טענתא דשיקרא וחס ליה לרב נחמן לאגמורי טענותא דשיקרא לאינשי
And from this as well we deduce that this reason is not valid, that he can say "I looked into my calculations and he does not owe me anything." For if that is the reason we say that if he turned around and forgave it, it is forgiven, and even for an heir it is forgiven, then it would not have been possible for Rav Nachman to extend advice in such a manner, such that she would have a false claim, and forfend for Rav Nachman to teach a false claim to people!

גופא אמר שמואל המוכר שטר חוב לחברו וחזרו ומחלו מחול ואפילו יורש מוחל
אמר רב הונא בריה דרב יהושע ואי פקח הוא מקרקש ליה בזוזי וכתיב ליה שטרא בשמיה
אמר אמימר מאן דדאין דינא דגרמי מגבי ביה מיניה דמוחל [דמי] שטרא מעליא ומאן דלא דאין דינא דגרמי מגבי ביה דמי ניירא בעלמא
[הוה עובדא] ואכפייה רפרם לרב אשי ואגבי ביה ככשורא לצלמי
והלכתא כוותיה
To return to the main text: Shmuel said: If one sold a bond of debt to his fellow, and then turned around and forgave it, it is forgiven, and even the heir can forgive.
Rav Huna son of Rav Yehoshua said: And if he {the buyer} is clever, he rattles for him {the debtor} some money such that he {the debtor} will write the bond in his name {before the creditor forgives the debt}.
Amemar said: He {=Rabbi Meir} who judges liability for indirect action would here allow one to collect from the one who forgave, the amount of a valid bond, and one who does not judge liability for direct action would allow collection of only the value of the paper.
[There was an incident] and Rafram compelled Rav Ashi to order collection of it as a beam fit for decorative mouldings.
And the halacha is like him.


אמר אמימר משמיה דרב חמא האי מאן דאיכא עליה כתובת אשה ובעל חוב ואית ליה ארעא ואית ליה זוזי
פירוש וליכא חד מינייהו דקדים (כגון שנשא ולוה)
לבעל חוב מסלקין בזוזי ולאשה בארעא האי כדיניה והאי כדיניה ואי ליכא אלא ארעא ולא חזיא אלא לחד לבע"ח יהבינן לאשה לא יהבינן דיותר משהאיש רוצה לישא אשה רוצה להנשא
שמעינן מהא דאמימר דכל היכא דכי הדדי נינהו וליכא דינא דקדימה לחד מינייהו כגון מטלטלי בזמה"ז וליכא אלא שיעורא דחד מינייהו לבע"ח יהבינן לאשה לא יהבינן
Amemar said: If there was one who had upon him {the claim of} his wife's ketuba and a creditor, and he has both land an money --
to explain: and there is not one of them who preceded (* such that he married and borrowed *)
To the creditor we take out with money and to the wife with land. This one according to its law {/rights} and this according tis law. And if there is only land, and it is only fit for one, then to the creditor we give but to the wife we do not give, for more than the man wishes to marry, the woman wishes to be married.

We derive from this of Amemar that wherever they are opposite each other and there is no law of precedence to either of them -- such as movable objects nowadays -- and there is only the measure for one of them, we give to the creditor but do not give to the wife,
