Rif Ketubot 38a {Ketubot 79a continues; 79b}

38a

{Ketubot 79a continues, Mishna}

Those {fruits} which are connected to the ground, Rabbi Meir said we assess them how much they {=the land} are worth with fruits and how much they are worth without fruits, and the extra value is used to buy land, and he eats fruits {of that land}.
And the Sages say: Fruits which are connected to the land are his, while those separated from the land are hers, and with them land is purchased and her eats fruits {of that new land}.

Rabbi Shimon said: In the place where his strength is greater at her entrance {to marriage}, his strength is worse at her going out; at the place where his strength is worse at her entrance, his strength is greater at her going out.
How so? Fruits connected to the land, at her entrance are his and at her exit are hers; and those separated from the ground, at her entrance are hers and at her exit are his.

Gemara:
It is obvious that if one of them says "let us buy land" and the other says "let us buy houses," they should buy land. Houses vs. date-trees, houses. Date trees vs. other {fruit} trees, date-trees. Other {fruit} trees vs. vines, other trees. A thicket of sorb {only useful for the wood and without value after the wood is cut} and a fish pond, some say that it is fruit {with no capital for the woman, and so she can veto it} and some say it is capital {such that she cannot}. The general rule of the matter: If the stump grows new shoots, it is fruit; if it does not grow new shoots, it is capital.
Another nusach {which accords with the text in our gemara}: If the stump grown new shoots, it is capital; if the stump does not grow new shoots, it is fruit.
Therefore, wherever it teaches "land should be purchased with it," we only purchase that which its stump grows new shoots.

{Ketubot 79b}

They learnt {in a brayta}: The young born of an animal which is melog is to the husband; the child of a maidservant who is melog is to the woman. Chanania {our gemara: Chanania the son of Yoshiah's brother} says: Treat the child of the maidservant who is melog like the young of an animal which is melog, that the husband takes it.
What is the reason? For the Sages worry about the eventuality of death. Therefore, (*the young of *) the animal which is melog, which if it dies, there is still its hide, such that the principle does not disappear, the young will be to the husband. (*the young of *) The maidservant who is melog, who if she dies, the principle disappear, the child will be to the woman. And Chanania holds that we do not worry about the eventuality of death, but rather, even the child of a maidservant who is melog goes to the husband.
Rav Huna bar Chiyya cited Shmuel: The halacha is like Chanania.
Rava said: And Chanania admits that if she is divorced, she gives the value {of the children of the maidservant} and takes them, because of the pride of her father's house.

{Ketubot 79a}
Rabbi Zera cited Rabbi Yannai, and some say Rabbi Zera cited Rabbi Oshia who cited Rabbi Yannai: One who steals
{Ketubot 79b}
the young of an animal which is an asset of melog pays the double fine to the woman, according to everyone.
What is the reason? Fruits the Sages enacted for him, but they did not enact for him fruits of fruits.
And if it is difficult for you that which they learnt {in a Mishna}, "Rabbi Yehuda says that he always eats fruits, etc.," and the Sages learnt {in a brayta}, "these are fruits and these are fruits of fruits: if she brought in {to marriage} to him fruits, these are fruits; if he sold the fruits and he purchased with them land, and they made fruits, these are fruits of fruits," such that it is clear that the husband does have fruits of fruits, yet here we say that the Sages enacted for him fruits, but they did not enact for him fruits of fruits! This is no contradiction. Here is is different, for he takes the actual fruit itself, and because of that, he does not take the double fine, which would be the fruit of the fruit. But where he sold the fruit and acquired with it land, if he did not then take the fruits {of that new field}, it would end up a situation such that he did not take either the fruit or the fruit of the fruit {for he has absolutely no benefit from the field}! Therefore, he takes the fruit of the fruit, for they stand in place of the fruit.

Rava cited Rav Nachman: If she brought in {to marriage} to him a goat for milking, a sheep for shearing, a hen for its eggs, a date-tree for its fruits, he continues to eat until the capital is consumed.
To explain: Even if she only to her had the milk, shearing, and egg. And so too there is not to her in the date-tree except for his fruits.

Rav Nachman said: If she {when entering marriage} brought in to him a cloak, it is considered produce and he may continue to used it to cover himself until it wears out.

"Fruits separated from the ground":
And we establish like Shimon.
