Rif Ketubot 44a {85a - b} Other Factors In Assessing Ownership of Deposits; Which Toviah?; Forgiving a Sold Debt

נשים דבעינן כתיבה לשמה וליכא אבל בשאר שטרות מודו ליה דאמר רב אסי א"ר יוחנן שטר שלוה בו ופרעו אינו חוזר ולוה בו שכבר נמחל שעבודו טעמא דנמחל שעבודו הא לשקרא לא חיישינן:
for we require writing with her in mind, and there is not here. However, by other documents, they agree to him. For Rav Assi cited Rabbi Yochanan: a document which he used to borrow and then he repaid it, he should not turn around and borrow using it, for his lien has already been forgiven. The reason is thus that the lien has been forgiven. Thus, we are not worried about falsehood.

ההוא גברא דאפקיד שבע מרגניתא דציירין בסדיניה בי רבי מיאשא בר בריה דרבי יהושע בן לוי
שכיב רבי מיאשא ולא פקיד
אתא לקמיה דר' אמי אמר ליה חדא דידענא ביה בר' מיאשא דלא אמיד
ועוד הא יהיב סימנא
ולא אמרן אלא באיניש דלא רגיל דעייל ונפיק אבל רגיל דעייל ונפיק לא אימור איניש אחרינא אפקיד ומחזא חזא
There was a certain man deposited seven pearls wrapped in a sheet in the house of Rabbi Miasha the son of the son of Rabbi Yehoshua ben Levi. Rabbi Miasha died and he did not order {who the pearls belonged to}. He came before Rabbi Ammi. He said to him {our gemara: them}: Firstly, I know about Rabbi Miasha that he was not wealthy. And furthermore, he is giving signs {that they are his}.
And we only say this by a man who was not accustomed to enter and leave {the person's house}, but if he is accustomed to enter and leave, no. For one may say that another person deposited it, and he saw it.

וההוא גברא נמי דאפקיד כסא דכספא בי חסא שכיב חסא ולא פקיד ואתו לקמיה דרב נחמן דן להו כהאי דינא דרבי אמי
ותו ההוא גברא דאפקיד מטכסא בי רב דימי אחוה דרב ספרא שכיב רב דימי ולא פקיד אתו לקמיה דרבי אבא ודן להו כרבי אמי ורב נחמן
למימר דהלכה רווחת היא ולית בה פלוגתא
ההוא דאמר נכסאי לטוביה שכיב
אתא טוביה אמר רבי יוחנן הרי בא טוביה אמר לטוביה ואתא רב טוביה לטוביה אמר לרב טוביה לא אמר
ואי אינש דגיס ביה הוא הא גיס ביה
אתו שני טוביה שכן ות"ח ת"ח קודם קרוב ות"ח ת"ח קודם
And there was also a certain man who deposited a silver cup in the house of Chasa. Chasa died and did not order. And they came before Rav Nachman. He judged for them like this verdict of Rabbi Ammi.
And there was furthermore a certain man who deposited a silk cloth in the house of Rav Dimi the brother of Rav Safra. Rav Dimi died and did not order. They came before Rabbi Abba, and he judged for them like Rabbi Ammi and Rav Nachman.
This is to say that this is a well-established halacha, and there is not in it any dispute.

There was a person who said, "My assets to Toviah," who died. A man named} Toviah came . Rabbi Yochanan said: Behold, Toviah has come. If he had said "To Toviah and Rav Tuviah had come, then "To Toviah" he said but "to Rav Toviah" he did not say. And if he is a person who is on familiar terms with him, behold he is on familiar terms with him {so it is OK}.
If two Toviahs come, a neighbor and a Torah scholar, the Torah scholar has precedence. A relative and a Torah scholar, the Torah scholar has precedence.

איבעיא להו שכן וקרוב מאי
ת"ש טוב שכן קרוב מאח רחוק
שניהם שכנים שניהם קרובים שניהם ת"ח שודא דדייני
It was a question to them: A neighbor and a relative, what is the law?
Come and hear: {Mishlei 27:10}:
י רֵעֲךָ ורעה (וְרֵעַ) אָבִיךָ, אַל-תַּעֲזֹב-- וּבֵית אָחִיךָ, אַל-תָּבוֹא בְּיוֹם אֵידֶךָ;
טוֹב שָׁכֵן קָרוֹב, מֵאָח רָחוֹק.
10 Thine own friend, and thy father's friend, forsake not; neither go into thy brother's house in the day of thy calamity; {N}
better is a neighbour that is near than a brother far off.
If both of them are relatives, or both of them are Torah scholars -- it is up to the discretion of the judges.

א"ל רבא לבריה דרבי חייא בר אבין בר אוריין תא אימא לך מילתא מעלייתא דהוה אמר אבוה דאימך משמיה דשמואל הא דאמר שמואל המוכר שטר חוב לחבירו וחזר ומחלו מחול ואפילו יורש מוחל מודה שמואל במכנסת שטר חוב לבעלה וחזרה ומחלתו שאינו מחול מפני שידו כידה
Rava said to the son of Rabbi Chiyya bar Avin bar Uryan: Come, and I will tell you an excellent thing which your mother's father said in the name of Shmuel: This which Shmuel said that "one who sells a bond of debt to his fellow, and then turns around and forgives it {the debt}, it is forgiven, and even the heir may forgive," Shmuel admits by a woman who brings in {to marriage} to her husband a bond of debt, and then {she} turns around and forgives it, that it is not forgiven, for his hand is like her hand.
