Rif Gittin 32a {65b - 66a}

32a

{Gittin 65b}
Gemara:

תנו רבנן
שלחוה שבקוה תרכוה הרי אלו יכתבו ויתנו
פטרוה פרנסוה עשו לה כנימוס עשו לה כראוי לא אמר כלום
The Sages learnt {in a brayta}: 'Send her away,' 'Let her go,' {abandon her}, 'Drive her out,' then they should write and give her.
'Release her,' 'provide for her,' 'Do the customary thing for her,' 'Do the proper thing for her,' his words are of no effect.

Mishna:
בראשונה היו אומרים היוצא בקולר ואמר כתבו גט לאשתי הרי אלו יכתבו ויתנו
חזרו לומר אף המפרש והיוצא בשיירא
רבי שמעון שזורי אומר אף המסוכן
ORIGINALLY THEY LAID DOWN THAT IF A MAN GOES OUT IN CHAINS {=WAS BEING LED OUT TO EXECUTION} AND SAID 'WRITE A GET FOR MY WIFE,' THEY MAY WRITE AND GIVE [IT TO HER].
LATER THEY ADDED, ALSO IF HE WERE LEAVING FOR A SEA VOYAGE OR FOR A CARAVAN JOURNEY.
RABBI SHIMON SHEZURI SAYS: ALSO IF HE WERE DANGEROUSLY ILL.


Gemara:
והלכתא כר"ש שזורי דגרסינן בשחיטת חולין א"ר יוחנן הלכה כר' שמעון שזורי במסוכן ובתרומת מעשר של דמאי:
And the hlacha is like Rabbi Shimon Shezuri, for we learn in shechitat Chullin: Rabbi Yochanan said: The halacha is like Rabbi Shimon Shezuri in terms of a dangerously ill person, and in terms of the terumat maaser of demai.

גניבא יוצא בקולר הוה
כי קא נפיק אמר להו הבו ארבע מאה זוזי לרבינא מחמרא דנהר פקוד
קשיא ליה לרבי אבא חמרא לא אמר דמי חמרא לא אמר מחמרא קאמר
ואידך מחמרא כדי ליפות את כחו
שלחו מתם מחמרא כדי ליפות את כחו

Geniva was being led out in chains {to execution}. As he went out, he said to them "Give 400 zuz to Ravina of the wine {I have} in Nehar Pekod.

Rabbi Abba's difficulty was that he did not say "wine" and he did not say "the money for the wine," but rather he said "of the wine."
And the other one {in context, Rabbi Zera}: "of the wine" was to improve his title to it {so that he would have a lien on all the wine if, e.g., some of the wine went sour or the money from the sale was lost}.
They sent from there {Eretz Yisrael}: "of the wine" improves his title.

א"ר הונא גיטו כמתנתו מה מתנתו אם עמד חוזר אף גיטו אם עמד חוזר
ומה גיטו אע"ג דלא פירש כיון דאמר כתובו אע"ג דלא [אמר תנו אף מתנתו כיון דאמר תנו אע"ג דלא] קנו מיניה
למימרא דהני ארבעה דתנינן במתני' כולהו כשכיב מרע דמצוה מחמת מיתה נינהו
וכן הלכתא
Rav Huna said: His get is like his gift. Just as his gift, if he recovers he may retract, so too his get, if he recovers he may retract. And just as his get, even though he did not explain {clearly}, once he said "write," even though he did not [say "give," so too his gift, once he said "give" even though they did not acquire from him {there was no token given}.
That is to say that these four which they teach in our Mishna, all of them are like a deathly ill person, where they are a command because of death.
And so is the halacha.
