{Ketubot 80b}
Mishna:
כנסה סתם הרי היא כאשתו לכל דבר ובלבד שתהא כתובתה על נכסי בעלה הראשון:
If he {the levir} married her plainly, she is as his wife in all respects, except that her ketuba is upon the assets of her first husband.

{Ketubot 82a}
Gemara:
לכל דבר למאי הלכתא
א"ר יוסי בר' חנינא לומר שמגרשה בגט ומחזירה דא"ק ולקחה לו לאשה כיון שלקחה נעשית כאשתו:
"In all respects":
To what halachic end?
Rabbi Yossi beRabbi Chanina said: To say that he divorces her with a get and can take her back {in marriage}.

For Scriptures stated {Devarim 25:5}:
ה כִּי-יֵשְׁבוּ אַחִים יַחְדָּו, וּמֵת אַחַד מֵהֶם וּבֵן אֵין-לוֹ--לֹא-תִהְיֶה אֵשֶׁת-הַמֵּת הַחוּצָה, לְאִישׁ זָר: יְבָמָהּ יָבֹא עָלֶיהָ, וּלְקָחָהּ לוֹ לְאִשָּׁה וְיִבְּמָהּ. 5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
that once he marries her, she is as his wife.

ובלבד שתהא כתובתה על נכסי בעלה הראשון
ואי לית לה מראשון תקינו לה רבנן משני כדי שלא תהא קלה בעיניו להוציאה
"Except that her ketuba is upon the assets of her first husband":
And if she does not have from the first one, the Sages enacted for her from the second, so that she should not be light in his eyes to divorce.

Mishna:
לא יאמר לה הרי כתובתיך מונחת על השולחן אלא כל נכסיו אחראין לכתובתה
וכן לא יאמר אדם לאשתו הרי כתובתיך מונחת ליך על השלחן אלא כל נכסיו אחראין לכתובתה
גרשה אין לה אלא כתובה החזירה הרי היא ככל הנשים ואין לה אלא כתובתה
He may not say, "Behold, your ketuba is lying on the table," but rather all his assets {inherited from his deceased brother} are pledged towards her ketuba.
And so too a man may not say, "Behold, your ketuba is lying for you on the table," but rather all his assets are pledged towards her ketuba.
If he divorced her, she only gets the ketuba. If he took her back, she is like all other women, and she only has her ketuba.

ת"ר בראשונה היו כותבין לבתולה מאתים ולאלמנה מנה והיו מזקינין ולא היו נושאין נשים התקינו שיהו מניחין אותה בבית אביה כשהיה בעלה כועס עליה אומר לה לכי אצל כתובתיך התקינו שיהו מניחין אותה בבית חמיה עשירות היו עושות אותה קלתות של כסף ושל זהב עניות היו עושות אותה עביט של מימי רגלים ועדיין כשהיה כועס אומר לה טלי כתובתיך וצאי עד שבא שמעון בן שטח והתקין שיהא כותב לה כל נכסאי אחראין לכתובתיך:
The Sages learnt {in a brayta}: Initially they {simply} wrote {rather than pledging all the land} for a virgin 200 and for a widow 100, and they {=the men} were getting old without marrying wives {because no woman would agree to this}. They enacted that they leave the ketuba amount in her father's house. But then, when her husband became angry with her, he would say "go to your ketuba" {in your father's house, and thus divorce was too easy, with the money on hand}. They then enacted that they would deposit it in her father-in-law's house. Wealthy women converted it into baskets of silver and of gold, while poor women would make of it tubs for urine {other girsaot, brass tubs}. And still, when he was angry, he would say to her, "take your ketuba and go." Until Shimon ben Shetach came and enacted that he would write to her, "all of my assets are pledged towards paying your ketuba."

והאי דקתני שאם מוכרת לאו דיעבד הוא אלא לכתחלה יש לה למכור וליתן במתנה וכל מה שהיא מוכרת בנכסים הללו שנפלו בזכותה הרי הוא קיים דהא כל היכא דלית לה למכור לכתחלה קתני לא תמכור ואם מכרה ונתנה קיים דיעבד וכל היכא דלא קתני לא תמכור אף על גב דקתני שאם מוכרת ונותנת קיים לכתחלה הוא
ובהאי פירושא ריהטא הלכתא כולה ומיבררא כהוגן בלא קושיא
"The woman to whom fell assets before she was betrothed":
[Because I have seen it closed by the Sages, and I have seen in it, to one of them, an explanation, he wrote in his writings, and this is his language:]
This Mishna and its gemara, we have seen in it many closed explanations, and behold I will explain it in a short manner in order to explain the point of doubt:
The woman to whom fell assets via inheritance or gift before she was betrothed, Bet Shammai and Bet Hillel agree about these assets that since it fell into her acquisition, even though now she is a betrothed woman, she may still, ab initio, sell and give it when she is a betrothed woman. And this which it taught "she sells" is not intended only after the fact {bedieved} but even ab initio, she has the ability to sell and give it as a gift. And all that she sells of these assets which fell to her to acquire, that transaction stands {and is valid}. For wherever it is such that ab initio she should not sell, the Mishna would state "she should not sell, and if she sold or gave it, it is valid" after the fact. And wherever it does not teach "she should not sell," even though it stated that "if she sold or gave, it is valid," what is intended is ab initio.
And with this explanation, the halacha runs swiftly in its entirety and it is elucidated appropriately, without difficulty.

And the second gate, that if assets fell to her after she was betrothed, that the matter is doubtful, for one could say that they fell to her to acquire and one could say they fell to him to acquire, then ab initio she should not sell when she is betrothed, and if she sold or gave, it is valid.

בבא תליתאה שאם נפלו לה משנשאת הכל מודים שאם מכרה ונתנה הבעל מוציא מיד הלקוחות
The third gate, that if they fell to her after she was fully married, all agree that if she sold or gave, the husband takes them out from the hands of the purchasers.

בבא רביעאה שאם נפלו לה נכסים כשהיא ארוסה ואחר כך נשאת וקאמר ר"ג שאם מכרה ונתנה קיים לפי מה שפירשו שיש לה למכור לכתחלה
The fourth gate, that if she assets fell to her when she was betrothed, and afterwards she was fully married -- Rabban Gamliel said that if she sold or gave, it is valid, according to what they explained that she can sell ab initio.

ובבא חמישאה א"ר יהודה אמרו לפני רבן גמליאל הואיל וזכה [באשה] לא יזכה בנכסים
And the fifth gate: Rabbi Yehuda said: They said before Rabban Gamliel: Since he acquired [the woman], does he not acquire the assets?

{Ketubot 78a}
ואמרינן בגמרא איבעי להו רבי יהודה לכתחלה קאי או אדיעבד קאי
פירוש ארישא קאי דקתני מוכרת לכתחלה או על בבא תניינא קאי דקתני לא תמכור לכתחלה ואם מכרה ונתנה קיים דיעבד
And we say in the gemara: It was a question to them: Is Rabbi Yehuda going on ab initio or on after the fact?
To explain: On the first part {resha} is he {Rabbi Yehuda} going, that they taught "she sell ab initio," or is he going on the second gate, that they taught "she should not sell" ab initio "and if she sold or gave, it is valid" after the fact?

ת"ש דתניא א"ר יהודה אמרו לפני ר"ג הואיל והארוסה אשתו והנשואה אשתו מה הנשואה שנפלו לה משנשאת ומכרה מכרה בטל אף הארוסה נמי שנפלו לה משנתארסה אם מכרה כשהיא ארוסה יהא מכרה בטל (ואמר להן אף זו שנפלו לה משנתארסה לכתחלה לא תמכור ואם מכרה ונתנה קיים אמרו לו הואיל וזכה באשה לא יזכה בנכסים ויהא מכרה בטל אפי' דיעבד) אמר להן על החדשים אנו בושים
Come and hear: For they learnt {in a brayta}: Rabbi Yehuda said: They said before Rabban Gamliel: Since the betrothed woman is his wife and the married woman is his wife, just as the married woman to whom they {=the assets} fell after she was married, and she sells, her sale is nullified, so too the betrothed woman as well, to whom they fell after she was betrothed, if she sold it when she was a betrothed woman, her sale should be nullified. (*And he said to them: Even this one to whom they fell after she was betrothed, she should not sell, but if she sold or gave, it is valid. They said to him: Since he acquired the woman, should he not also acquire the assets, and so her sale should be nullified even after the fact.*) He said to them: "Upon the new ones we are ashamed."

פירוש שנפלו לה משנשאת אנו בושים שביטלנו את מכירתה
אלא שאתם רוצים לגלגל עלינו את הישנים שנפלו לה עד שלא נשאת ומכרה עד שלא נשאת ש"מ אדיעבד קאי ש"מ
To explain: That they fell to her after she was married, we are ashamed, that we nullify her sale.
"But now you wish to roll upon us the old ones?" -- which fell to her before she was married and she sold them before being married.
We deduce from this that it {Rabbi Yehuda} was going on the case of after the fact {=the second gate}.

ר"ח ב"ע אומר לא כך השיבן אלא כך השיבן ר"ג היאך אתם מדמין ארוסה לנשואה לא אם אמרתם בנשואה שבעלה זכאי במציאתה ובמעשה ידיה ובהפרת נדריה יזכה נמי בנכסיה ומכרה בטל תאמרו בארוסה שאין בעלה זכאי במציאתה ומעשה ידיה ובהפרת נדריה ולפיכך מכירתה קיימת
אמרו לו רבי עד שלא נשאת ונשאת מהו
אמר להן אף זו לא תמכור לכתחלה ואם מכרה ונתנה קיים
אמרו לו הואיל ונשאת וזכה באשה לא יזכה בנכסים ואיך יהא מכרה קיים בדיעבד אפי' בדיעבד נמי יהא מכרה בטל שהרי זכה בה ויזכה נמי בנכסים
אמר להן על הראשונים אנו בושים שנפלו לה משנשאת אלא שאתם מגלגלים עלינו
Rabbi Chanina ben Akavia says: This was not how he retorted, but rather, so retorted Rabban Gamliel: How do you compare a betrothed woman to a married woman? Do you not say by a married woman that the husband has rights to her find and her handiwork, and in the nullification of her vows? He merits as well in her assets, and so her sale is invalid. But you would say by a betrothed woman that her husband does not have rights to her find, her handiwork, or nullification of her vows. Therefore, her sale is valid!
They said to him: Rabbi, if {they fell to her} before she was married, and she married, what is the law?
He said to them: Even this one should not sell ab initio, but if she sold or gave, it is valid.
They said to him: Since he married her and acquired a wife, does he not also acquire the assets. As such, why should the sale by valid after the fact? Even after the fact, the sale should be nullified, for behold he has acquired her, so he should also acquire the assets.
He said to them: Upon the first ones we are ashamed -- which fell to her after she was married -- and yet you would roll upon us
