ומי אמר רבא הכי והא אותביה רבא לרב נחמן יתומה שהשיאתה אמה ושני ליה הא דמחאי הא דלא מחאי
לא קשיא הא דמיתזנא מינייהו והא דלא מיתנזא מינייהו
And does Rava indeed say this? But Rava objected to Rav Nachman that an orphaness whose mother married her off, etc., and we learn it that here is where she objects and here is where she does not object.
This is no contradiction: Here is where she is provided for by them and here is where she is not provided for by them.

שמעינן השתא מכל הני שמעתתא היכא דבגרן או אינסיבן מיתזנן מינייהו אית להו פרנסה ואע"ג דלא מחו ואי לא מיתנזן מינייהו צריכין למחויי ואי לא מחו לית להו פרנסה
ואי לא בגרן ולא אינסיבן אע"ג דלא מיתנזן מינייהו אית להו פרנסה ולא צריכין למחויי
ואי בגרן ואינסיבן אף על גב דמיתזנן מינייהו צריכין למחויי ואי לא מחאן לית להו פרנסה
We now learn from all these statements that when they {=the females} reach adolescence or are married, if they are provided for from them, they have this support {=the 1/10th}, even though they do not object; and if they are not provided for from them, they need to object, and if they do not object, they do not have this support.
And if they do not yet reach adolescence nor marry, even though they are not supported from them, they have this support, and do not need to object.
And if they reach adolescence and marry, even though they are provided for by them, they need to object, and if they do not object, they do not have this support.

אמר רב הונא אמר רבי פרנסה אינה כתנאי כתובה
מאי אינה כתנאי כתובה כדתניא האומר אל יזונו בנותיו מנכסי אין שומעין לו אל יתפרנסו בנותיו מנכסיו שומעין לו שהפרנסה אינה כתנאי כתובה וכן הלכתא
ואיכא נוסחי דאית בהו איפכא ולהנהו נוסחי דאית בהו איפכא לית הילכתא כרבי:
Rav Huna cited Rabbi: The marriage outfit is not like a condition of the ketuba.
What does this mean that it is not like a condition of the ketuba? As we learnt {in a brayta}: If one says not to provide for his daughters from his estate, we do not listen to his. Not to give the marriage outfit from his estate, we listen to him. For the marriage outfit is not like a condition of the ketuba.
And there are nuschaot in which the opposite is stated, and according to the opposite nushchaot, the halacha is not like Rabbi.

{Ketubot 69a}

תלה ליה רב לרבי ביני חיטי האחים ששעבדו מהו הוה יתיב רבי חייא קמיה
א"ל מכרו או משכנו אמר ליה מאי נפקא לך מיניה בין מכרו בין משכנו מוציאין לפרנסה ואין מוציאין למזונות
ורבי יוחנן אמר אחד זה ואחד זה אין מוציאין
וליתא לדרבי יוחנן דקי"ל כרבי דאמר מוציאין לפרנסה ואין מוציאין למזונות:
Rav inserted the following {query} to Rabbi between the lines: The brothers have encumbered {the assets} what is the law {that is may they be seized}? Rabbi Chiyya was sitting before him. He said to him: Did they sell them or give it as a pledge {for a loan}? He said to him: What difference is there to you in this? Whether they sold it or gave it as a pledge, we take it out for the purpose of marriage outfit but do not take it out for provisions.
And Rabbi Yochanan said: Both for this and that, we do not take out.
And we do not hold like Rabbi Yochanan, for we establish like Rabbi who said that we take it out for marriage outfit but do not take it out for provisions.

איתמר מי שמת והניח שתי בנות ובן וקדמה הראשונה ונטלה עישור נכסים ולא הספיקה שניה לגבות עד שמת הבן
אמר רבי יוחנן שניה ויתרה
א"ל רבי חנינא גדולה מזו אמרו מוציאין לפרנסה (ואין מוציאין למזונות) ואת אמרת שנייה ויתרה
ומסתברא לן דהלכה כר' יוחנן בהא משום דאיכא ריוח ביתא
דהא רב אשי דהוא בתרא הכי ס"ל דאמרי' א"ל רב יימר לרב אשי אלא מעתה אשכחת מציאה בעלמא דאיכא ריוח ביתא ה"נ דלא יהבינן לה עישור נכסי א"ל אנא ריוח ביתא מהנהו נכסי קאמינא
It was stated {by Amoraim}: If one died and left two daughters and a son, and the first {daughter} preempted and took 1/10th of the assets, and the second did not get a change to take before the son died:
Rabbi Yochanan said: The second one has surrendered {her rights to this particular 1/10th, and the rest they split}.
Rabbi Chanina said to him: Greater than this they said, that they seize {the estate} for marriage outfit (*and they do not seize it for provisions *), and {yet} you say the second has surrendered?

And it is logical to us that the halacha is like Rabbi Yochanan in this, because there is a house amply provided for.
For Rav Ashi, who was later {batra} so holds, for we say: Rav Yemar said to Rav Ashi: But now, if she found any find at all, such that the house is amply provided for, would we here too say that we do not give her 1/10th of the assets. He said to him: I say, a house amply provided for from the same assets.

אבל בירושלמי פסק הלכה כרבי חנינא דגרסינן התם מי שמת והניח שתי בנות ובן אחד ונטלה הראשונה עישור נכסים ומת הבן רבי חנינא אומר אף השניה נוטלת עישור נכסים והשאר חולקות בשוה
אמר רבי טבי בשם רבי יאשיה טעמא דרבי חנינא אם מן המשועבדין גובה לא כ"ש מלפניה
ר' זעירא בעא קומי רבי אסי היך עבדן עובדא
אמר ליה כרבי חנינא וכן נפק עובדא כרבי חנינא:
However, in the Yerushalmi they rule the halacha like Rabbi Chanina. For we learn there: One who died and left two daughters and one son, and the first one took 1/10th of the assets, and the son died -- Rabbi Chanina says: Even the second takes 1/10th of the assets, and the rest they split evenly.
Rav Tavu cited Rabbi Yoshia: The reason of Rabbi Chanina is that if from the assets under lien she collects, then all the more so from that which is before her!
Rabbi Zeira asked before Rabbi Assi: How do we act in practice?
He said to him: Like Rabbi Chanina.
And so too went out an incident like Rabbi Chanina.

אמר אמימר בת יורשת הויא דאי בעיא לסלוקה בזוזי לא מצו מסלקי לה
רב אשי אמר בעלת חוב הויא ומצו מסלקי לה בזוזי
והלכתא כרב אשי
ואף אמימר הדר ביה
והשתא דאמרת בעלת חוב הויא דאבא או דאחי
למאי נפקא מיניה למיגבה מבינונית שלא בשבועה ומזיבורית בשבועה מאי
תא שמע דרבינא אגביה לברתיה דרב אשי ממר בר רב אשי בינונית שלא בשבועה וממר בריה דרב חמא בריה דרב אשי מזיבורית ובשבועה
ש"מ בעלת חוב דאחי הויא ש"מ
Amemar said: A daughter is an heir, in that if they wish to send her away with coin, they cannot send her away.
Rav Ashi said: She is a creditor, and that they are able to send her away with coin.
And the halacha is like Rav Ashi.
And even Amemar retracted.
And now that you have said that she is a creditor, is she one of the father or of the brother?
To what practical distinction? To collecting from the medium level land without an oath, and from the lowest level land with an oath. What {type of creditor}?
Come and hear. For Ravina allowed the daughter of Rav Ashi to collect from Mar bar Rav Ashi medium level land with an oath, and from Mar son of Rav Chama {our gemara: Sama} son of Rav Ashi from the lowest level land, with an oath.
We thus deduce that she is a creditor of the brother. We so deduce.

אמר רבא הלכתא ממקרקעי ולא ממטלטלי בין למזוני בין לפרנסה בין לכתובה

Rava said: The halacha is that {she may collect} from land but not movable objects, whether for provisions, marriage outfit, or ketuba.

והאידנא תקינו רבנן דמתיבתא למגבה כתובה אפילו ממטלטלי [הילכך מזוני נמי אפילו ממטלטלי] דקי"ל
And nowadays, the Sages in the Metivta enacted to collect the ketuba even from movable objects. [Therefore, provisions also even from movable objects.] For we establish
