Rif Yevamot 41a {Niddah 52a-b; Yevamot 112b - 113a}

41a

{Niddah 52a}
Mishna:

תינוקת שהביאה שתי שערות חייבת בכל מצות האמורות בתורה וחולצת או מתיבמת
וכן תינוק שהביא שתי שערות חייב בכל מצות האמורות בתורה וראוי להיות בן סורר ומורה משיביא שתי שערות עד שיקיף זקן התחתון ולא העליון אלא שדברו חכמים בלשון נקיה
תינוקת שהביאה שתי שערות אינה יכולה למאן רבי יהודה אומר משירבה השחור
A girl who brought forth two hairs is obligated in all the commandments stated in the Torah, and may perform chalitza or yibbum.
And so too a buy who brought forth two hairs is obligated in all the commandments stated in the Torah, and is fit to be a stubborn and rebellious son, from when he brings forth two hairs until his beard forms a circle -- the lower one and not the upper one, except that the Sages speak in clean language.
A girl who brings forth two hairs is not able to perform refusal. Rabbi Yehuda says: When the black {=pubic hair} predominates.

Gemara:
ולית הלכתא כר' יהודה
ואע"ג דאמר רבי אבהו אמר רבי אלעזר הלכה כר' יהודה לית הלכתא כוותיה
דגרסינן בפרק מי שמת ולמיאונין לאפוקי מדר' יהודה דאמר משירבה השחור
And the halacha is not like Rabbi Yehuda. And even though Rabbi Abahu cited Rabbi Eleazar that the halacha is like Rabbi Yehuda, the halacha is not like him. For we learn in perek Mi SheMeit: And for refusals - to exclude from Rabbi Yehuda who said "when the black predominates."

אמר רב הונא ב' שערות שאמרו צריך שיהא בעיקרן גומות
רב מלכיו אמר רב אדא בר אהבה גומות אף ע"פ שאין שערות
א"ר יהודה אמר שמואל שתי שערות שאמרו אפילו אחת על הכף ואחת על הביצים
Rav Huna said: The two hairs of which they spoke, there must be follicles at their roots.
Rav Malkio cited Rav Ada bar Ahava: Follicles, even though there are no hairs {suffice}.

Rav Yehuda cited Shmuel: The two hairs of which they spoke, even on one the crest and one on the testes.

תניא נמי הכי שתי שערות שאמרו ואפילו אחת בגבה ואחת בכריסה אחת על קשרי אצבעותיה של יד ואחת על קשרי אצבעותיה של רגל דברי ר"ש בן יהודה איש כפר עכו שאמר משום רבי שמעון

אמר רב אסי עד שיהו שתי שערות במקום אחד
והלכתא כרבנן
A brayta also says so: The two hairs of which they spoke is even when one is on her back and one upon her belly; one upon the joints of her fingers and one on the joints of her toes. These are the words of Rabbi Shimon ben Yehuda man of Kefar Acco who said it in the name of Rabbi Shimon {our gemara: Yishmael}.

And the Sages?

Rav Asi said: Until she has two hairs in one place.
And the halacha is like the Sages.

תנו רבנן עד מתי הבת ממאנת עד שתביא שתי שערות דברי רבי מאיר
רבי יהודה אומר עד שירבה השחור על הלבן
רבי יוסי אומר עד שתקיף העטרה
בן שלקית אומר עד שתכלכל
אמר ר"ש מצאני חנניה בן חכינאי בצידן ואמר לי כשאתה מגיע אצל ר' עקיבא אמור לו עד מתי הבת ממאנת ואם יאמר לך עד שתביא שתי שערות אמור לו והלא בן שלקית העיד במעמד כולכם ביבנה משתכלכל ולא אמרתם לו דבר
וכשבאתי אצל ר"ע אמר לי כלכול זה איני יודע [מהו] בן שלקית איני מכיר עד מתי הבת ממאנת עד שתביא שתי שערות

וכן הלכה
The Sages learnt {in a brayta}: Until when may a girl refuse? Until she brings two hairs. These are the words of Rabbi Meir.
Rabbi Yehuda says: Until the black predominates.
Rabbi Yossi says: Until a ring is formed around the nipple.
Ben Shelakit says: Until she grows hair in profusion.
Rabbi Shimon said: Chanania ben Chachinai once found me in Tzidon, and he said to me, "when you reach Rabbi Akiva say to him, 'until when may a girl refuse?' And if he says to you 'until she brings two hairs,' say to him, 'but did not Ben Shelakit testify in the assembly of all of them at Yavneh that is is when she grows hair in profusion, and they did not say anything to him {to contradict him}?' " And when I came to Rabbi Akiva, he said to me "This growing hair in profusion I do not know [what it is], and this Ben Shalakit I do not recognize. Until when does a girl refuse? Until she brings forth two hairs."

And so is the halacha.



Mishna:

שתי שערות האמורות בפרה ובנגעים והאמורות בכל מקום כמה שיעורן
כדי לכוף ראשן לעיקרן דברי רבי ישמעאל
ר"א אומר כדי לקרוץ בצפורן
ר' עקיבא אומר כדי שיהו ניטלות בזוג
The two hairs spoken about with regard to the red heifer, and by skin ailments, and those mentioned in all places, how much is there measure? In order to bend their tips to their root. These are the words of Rabbi Yishmael.
Rabbi Eliezer says: In order to be grabbed by a fingernail.
Rabbi Akiva says: Enough to be taken off with a scissors.

Gemara:
אמר רב חסדא אמר מר עוקבא הלכה כדברי כולן להחמיר
Rav Chisda cited Mar Ukva: The halacha is like all of them, stringently.

חרש שנשא פקחת ופקח שנשא חרשת רצה יוציא רצה יקיים כשם שכונס ברמיזה כך מוציא ברמיזה
פקח שנשא פקחת ונתחרשה רצה יוציא רצה יקיים נשטית לא יוציא
נתחרש הוא או נשתטה לא יוציא עולמית
A {male} deaf-mute who married a normal woman, and a normal man who married a female deaf-mute, if he wishes to send her out, he may do so, and if he wishes to maintain her, he may do so. Just as he took her in via gestures, so can he send her out via gestures.
A normal man who married a normal woman, and she became a deaf-mute -- if he wants he can send her out and if he wants he can maintain her. If she becomes an imbecile, he may not send her out.
If he becomes a deaf-mute or becomes an imbecile, he may not ever send out.

אמר רמי בר חייא מאי שנא חרש וחרשת דתקינו להו רבנן נישואין ומ"ש שוטה ושוטה דלא תקינו להו רבנן נישואין
דתניא שוטה וקטן שנשאו נשים ומתו נשיהם פטורות מן החליצה ומן היבום
חרש וחרשת דקיימא תקנתא דרבנן תקינו להו רבנן נישואין שוטה ושוטה דלא קיימא תקנתא דרבנן דאין אדם דר עם נחש בכפיפה לא תקינו להו רבנן נישואין:
Rami bar Chama said: What is the distinction between a male deaf-mute and a female deaf mute on the one hand, where the Rabbis enacted for them a marriage {nisuin}, and a male imbecile and a female imbecile on the other hand, where the Rabbis did not enact for them a marriage? For they learnt {in a brayta}: A {male} imbecile and a {male} minor who married wives and then died, their wives are exempt from chalitza and from yibbum. {So, why the distinction?}
A male deaf-mute and a female deaf-mute, where it is possible to carry out the enactment of the Rabbis {for two deaf people can lead a normal married life}, the Rabbis enacted for them married. A male imbecile and a female imbecile, where it is possible to carry out the enactment of the Rabbis -- for one cannot live with a serpent in the same basket -- the Rabbis did not enact for them marriage.

ומאי שנא חרש דתקינו ליה רבנן נישואין ומאי שנא קטן דלא תקינו ליה רבנן נישואין
חרש דלא אתי לכלל נישואין תקינו ליה רבנן נישואין קטן דאתי לכלל נישואין לא תקינו ליה רבנן נישואין
והרי קטנה דאתיא לכלל נישואין ותקינו לה רבנן נישואין התם שלא ינהגו בה מנהג הפקר:
And what is the distinction of a male deaf-mute on the one hand, that the Rabbis enacted for him marriage, and a male minor on the other hand, that the Rabbis did not enact for him marriage?
A male deaf mute, who would never come to the chapter of marriage {Biblically} otherwise, the Rabbis enacted for him marriage. A male minor, who will eventually come to the chapter of marriage, the Rabbis did not enact for him marriage.
But there is the case of a female minor, who who will eventually come to the chapter of marriage, and the Rabbis did enact for her marriage! There, it was so that people should not treat her as ownerless property {and take liberties with her}.

ומאי שנא קטנה דממאנת ומ"ש חרשת דלא ממאנת
דאם כן מימנעי ולא נסבי לה

ומאי שנא קטנה דאכלה בתרומה ומ"ש חרשת דלא אכלה בתרומה
דתנן העיד ר' יוחנן בן גודגדא וכו' ואילו חרשת לא אכלה
גזרה שמא יאכיל חרש לחרשת:
And what is the distinction between a female minor, on the one hand, who can "refuse," and a female deaf-mute on the other hand, who cannot refuse.
For if so {if we allowed her to refuse}
{Yevamot 113a}
men you refrain from marrying her {because at any point in life she could refuse}.

And what is the distinction between a female minor, on the one hand, who can eat teruma, and a female deaf-mute on the other hand, who cannot eat teruma? For they learnt {in a Mishnah}: "Rabbi Yochanan ben Godgada testified ... and if she is a deaf-mute, she may not each."
This is a decree lest a male deaf-mute feed to a female deaf-mute.

ומ"ש קטנה דאית לה כתובה ומאי שנא חרשת דלית לה כתובה
דאם כן מימנעי ולא נסבי לה
And what is the distinction between a female minor, on the one hand, who receives a ketuba, and a female deaf-mute on the other hand, who does not receive a ketuba? For if this were so, people would refrain from marrying her.

וקטנה דאית לה כתובה מנא לן דתנן הממאנת והשניה והאיילונית אין להן כתובה אבל יוצאה בגט יש לה כתובה
וחרשת דלית לה כתובה מנא לן דתניא חרש ושוטה שנשאו נשים פקחות אף על פי שנתפקח החרש ונשתפה השוטה אין להם עליו כלום רצו לקיימן יש להן כתובה מנה
פקח שנשא חרשת או שוטה אע"פ שכתב לה מאה מנה כתובתה קיימת מפני שהוא רוצה ליזוק בנכסיו
טעמא דרצה הא לא רצה לא
דא"כ מימנעי ולא נסבי לה

And the fact that a female minor receives a ketuba, from where do we know? For they learnt {in a Mishna}: "A woman who refuses, a woman who is a forbidden secondary {Rabbinic} relation, and an aylonit do not receive a ketuba." But a woman who goes out with a get {such as a female minor} has a ketuba.
And the fact that a female deaf-mute does not receive a ketuba, from where do we know? For they learnt {in a brayta}:
A male deaf-mute and a male imbecile who married normal women, even though the male deaf-mute and the male imbecile became normal, they {the women} do not have upon them anything. If they wish to retain them {henceforth} they have a ketuba of 100 {=1 maneh}.
A normal man who married a female deaf-mute or female imbecile, even if he writes her a ketuba of 100 maneh, her ketuba sustains, for he apparently wishes to damage his assets.
The reason is that he wishes. Thus, if he does not wish, no.
Because if so, people will refrain from marrying her.
