THE ORDER OF CHALITZA

The order of chalitza: In the beginning, Bet Din requires to establish a place in the daytime and make {/get} a sandal which has a heel and straps, and which is not sewn with flax and place it on his right leg, and read out for the yevama מֵאֵן יְבָמִי לְהָקִים לְאָחִיו שֵׁם בְּיִשְׂרָאֵל--לֹא אָבָה, יַבְּמִי -- "My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me" in those words in the Holy Tongue {=Hebrew}. And they read out for the levir לֹא חָפַצְתִּי לְקַחְתָּהּ -- "I like not to take her." And the levir must press his foot on the ground, and the yevama comes and loosens the straps of the sandal and removes it from his foot, and casts spittle on the ground from her mouth in front of the levir. And the judges must see the spittle as it leaves her mouth. And after this they read out for her כָּכָה יֵעָשֶׂה לָאִישׁ אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו -- "So shall it be done unto the man that doth not build up his brother's house" {and} וְנִקְרָא שְׁמוֹ, בְּיִשְׂרָאֵל: בֵּית, חֲלוּץ הַנָּעַל -- "And his name shall be called in Israel The house of him that had his shoe loosed."
And all sitting there exclaim after her "him that had his shoe loosed, him that had his shoe loosed, him that had his shoe loosed," three times. And when he writes a document certifying the chalitza, he needs to draw lines on it with a tracer {a reed used to trace these lines} and not with ink, and he needs to write "in a sitting of three as one {=together} we were," and the three of them sign on it, so long as they know how to read.

ומדאתעביד עובדא דנא קדמנא שרינוה לפלונית דא למהך להתנסבא לכל מאן דתציבי ואינש לא ימחה בידה מן יומא דנן ולעלם ובעית מיננא פלונית דא גיטא דחליצותא דנא וכתבנא וחתמנא ויהבנא לה לזכות כדת משה וישראל:
וחתמין תלתא עליה. ולא בעיא לאמתוני בתר חליצה תלתא ירחי אלא שריא לאלתר לאינסובא לכל מאן דבעיא ואין אומר דבריו אלא בעמידה:
And this is {the text of} the document certifying chalitza:
{Note: I use Plonit and Ploni for the yevama and yavam, and letters otherwise.}
On {weekday} day X which is day Y to month Z, which is such-and-such {year} to the count that we are used to counting in city A, we the judges some of whom are signed below {presumably because three sign and the chalitza is best done with five judges} in a sitting of three as one were sitting in the court, and there came out before us Plonit daughter of C {her father} the widow of D {her deceased husband}. And she brought before us a certain man whose name is Ploni son of F {his father}, and so did this Plonit say to us:
D {the deceased} son of G {his father}, the brother of this Ploni {the yavam} from his father {thus, a paternal brother} -- I was married to him and he died, and he left life to the Sages and all of Israel, and a son or daughter as heir to inherit and establish a name in Israel he did not leave, and this Ploni {the yavam} his brother is fit to perform yibbum upon me.
Now, Sages, judges, say to him that if he wishes to perform yibbum upon me, he should perform yibbum, and if not, let me loosen for myself before you his right foot and free his shoe from upon his foot, and I will spit before him.
And we knew this Plonit that she was the wife of the deceased D, and we knew that this Ploni was the paternal brother of D. And we said to him {Ploni}, "If you wish to perform yibbum upon her, perform yibbum, and if not, she shall loosen before us your right foot and release your shoe from upon your foot, and she shall spit before you." And he spoke up and he said "I do not wish to perform yibbum upon her."
Immediately, we read out for this Plonit מֵאֵן יְבָמִי לְהָקִים לְאָחִיו שֵׁם בְּיִשְׂרָאֵל--לֹא אָבָה, יַבְּמִי -- "My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me."
And even to this Ploni, we read out for him לֹא חָפַצְתִּי לְקַחְתָּהּ -- "I like not to take her." And she loosened his right foot and released his shoe from upon his foot, and spat before him spittle which was seen by us, from her mouth, upon the ground. And we further read out for this Ploni[t] {based on the word da rather than dein, and based on the verse which says that she says it, it must be Plonit, rather than Ploni here} : כָּכָה יֵעָשֶׂה לָאִישׁ, אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו -- "So shall it be done unto the man that doth not build up his brother's house" and we further read out for her וְנִקְרָא שְׁמוֹ, בְּיִשְׂרָאֵל: בֵּית, חֲלוּץ הַנָּעַל -- "And his name shall be called in Israel The house of him that had his shoe loosed." And we the judges, and all who were sitting before us, spoke up after her "him that had his shoe loosed, him that had his shoe loosed, him that had his shoe loosed," three times.
And once this ceremony was done before us, we permitted this Plonit to go to marry anyone she desires, and no man may protest her from doing this, from this day and forever.
And this Plonit requested this document certifying chalitza from us, and we have written it and signed it, and given it to her for benefit, like the law of Moshe and Israel.

And three sign upon it.

And she does not need to wait three months, but rather is permitted immediately to marry anyone she wishes to. And he only says his words while standing.

מצות יבום: אילו מאן דשכיב בלא זרעא ואית ליה אחא מן אבוהי דה"ל ישיבה בעולמו כדכתיב כי ישבו אחים יחדו מחייב איהו ליבומי לאנתתיה וכד בעי ליבומי ליקדיש והדר מיבם דאמר רב מצות יבום מקדש והדר בועל שנאמר ולקחה לו לאשה ויבמה ומקמי הכי הוה כתובת יבמה על נכסי בעלה הראשון והשתא תקינו לה רבנן משני שלא תהא קלה בעיניו להוציאה:
The commandment of yibbum:
If there is a man who died without children, and he has a paternal brother who had "dwelling" in his world {that is, he lived the same time as him}, as is written {Devarim 25:5}
ה כִּי-יֵשְׁבוּ אַחִים יַחְדָּו, וּמֵת אַחַד מֵהֶם וּבֵן אֵין-לוֹ--לֹא-תִהְיֶה אֵשֶׁת-הַמֵּת הַחוּצָה, לְאִישׁ זָר: יְבָמָהּ יָבֹא עָלֶיהָ, וּלְקָחָהּ לוֹ לְאִשָּׁה וְיִבְּמָהּ. 5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
then he {=the levir} is required to perform yibbum on his {deceased brother's} wife. And when he wishes to perform yibbum, he first betrothes and then performs yibbum {via intercourse}, for Rav said that the precept of yibbum is to first betroth and then have intercourse, for it is written
ה כִּי-יֵשְׁבוּ אַחִים יַחְדָּו, וּמֵת אַחַד מֵהֶם וּבֵן אֵין-לוֹ--לֹא-תִהְיֶה אֵשֶׁת-הַמֵּת הַחוּצָה, לְאִישׁ זָר: יְבָמָהּ יָבֹא עָלֶיהָ, וּלְקָחָהּ לוֹ לְאִשָּׁה וְיִבְּמָהּ. 5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
And before this, the ketuba of the yevama was on the assets of her first husband, and now the Sages established for her from the second one, so that she will not be easy in his eyes to send out.

The ketuba of levirate marriage:
On {week}day X which is such-and-such to month Y ... how Ploni son of A came before us, and so did he say to us:
My paternal brother died, and left life to the Sages and all of Israel, and a son or daughter to be an heir and to inherit and to establish a name in Israel he did not leave, and he left a woman {/wife} whose name is Plonit daughter of B from the city of C, and she is fit Biblically to perform yibbum upon her, as is written in the book of the Torah of Moshe:
ה כִּי-יֵשְׁבוּ אַחִים יַחְדָּו, וּמֵת אַחַד מֵהֶם וּבֵן אֵין-לוֹ--לֹא-תִהְיֶה אֵשֶׁת-הַמֵּת הַחוּצָה, לְאִישׁ זָר: יְבָמָהּ יָבֹא עָלֶיהָ, וּלְקָחָהּ לוֹ לְאִשָּׁה וְיִבְּמָהּ. 5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
And this Plonit desires to undergo yibbum to Ploni son of A her brother-in-law, in order to establish the name {of the deceased} in Israel, as is written
ו וְהָיָה, הַבְּכוֹר אֲשֶׁר תֵּלֵד--יָקוּם, עַל-שֵׁם אָחִיו הַמֵּת; וְלֹא-יִמָּחֶה שְׁמוֹ, מִיִּשְׂרָאֵל. 6 And it shall be, that the first-born that she beareth shall succeed in the name of his brother that is dead, that his name be not blotted out of Israel.
And this is the nedunia {dowry} that this Plonit brings from her father's house, such-and-such {value}. And Ploni writes to Plonit his sister-in-law 25 zuz which are fit to her, which were written in her ketuba which her first husband wrote to her. And he adds of his own such-and-such {value}. And this Ploni accepts upon himself responsibility and the additional amounts of this ketuba and upon his heirs after him, from his land and movable property, and even from the shirt off his back, etc...
as we write in the general case of ketuba.

Mishna:
בית שמאי אומרים אין ממאנין אלא ארוסות ובה"א ארוסות ונשואות

בש"א בב"ד ובה"א בב"ד ושלא בב"ד
אמרו ב"ה לב"ש ממאנת והיא קטנה אפילו ד' או ה' פעמים אמרו להן ב"ש אין בנות ישראל הפקר אלא ממאנת וממתנת עד שתגדיל ותמאן ותנשא:

Bet Shammai say: We do not allow "refusal" except for betrothed women {who were married off by mother/brother when they were minors}.
And Bet Hillel say: Betrothed and married.

Bet Shammai say: With the husband {they may refuse}.
And Bet Hillel say: With the husband or with the levir.

Bet Shammai say: Before him.
And Bet Hillel say: Before him and not before him.

Bet Shammai say: In Bet Din.
And Bet Hillel say: In Bet Din and not in Bet Din.

Bet Hillel said to Bet Shammai: She may refuse when a minor, even four or five times.
Bet Shammai said to them: The daughters of Israel are not ownerless. Rather, she may refuse and wait until she grows up, and then refuse {when an adult} and then marry.

Gemara:
אמר ר' הושעיא ממאנת למאמרו ואינה ממאנת לזיקתו
לומר דאע"ג דממאנת למאמרו ולא בעיא גיטא צריכה חליצה לזיקתו
מ"ט מאמר וביאה דאיהו עבד בה מציא עקרה זיקה דרחמנא רמא עלה לא מציא עקרה
עולא אמר ממאנת אף לזיקתו ולא בעיא חליצה מ"ט נשואין קמאין קא עקרה
והלכת' כותיה
Rabbi Hoshaya said: She may refuse to his {the levir's} maamar {that is, after his Rabbinic betrothal} but may not refuse to his levirate bond.
This is saying that even though she may refuse his maamar {and in a non-levirate case this would sever it entirely} and does not require a get, she {still} needs chalitza for his levirate bond.
What is the reason? Maamar and intercourse that he performs with her, it can thus uproot, but levirate bond which the All-Merciful casts upon her, it is not able to uproot.

Ulla said: She may even refuse to his levirate bond.
What is the reason? She is uprooting her initial marriage {to the deceased}.
And the halacha is like him. {like Ulla.}
