ת"ר כל הנבדקות נבדקות על פי נשים
וכך היה ר' אליעזר מוסר לאשתו ורבי ישמעאל מוסר לאמו
רבי יהודה אומר לפני הפרק ולאחר הפרק נשים בודקות אותן תוך הפרק אין נשים בודקות אותן שאין משיאין ספקות על פי נשים
רבי שמעון אומר אף תוך הפרק נשים בודקות אותן ונאמנת אשה להחמיר אבל לא להקל
כיצד גדולה היא שלא תמאן קטנה היא שלא תחלוץ אבל אין נאמנת לומר קטנה היא שתמאן או גדולה היא שתחלוץ

The Sages learnt {in a brayta}: All examinations are conducted by women.
And so did Rabbi Eliezer give over to his wife {to examine}, and Rabbi Yishmael gave over to his mother.
Rabbi Yehuda says: Before the period {=of 11 years and a day} and after the period {=of 12 years and a day}, women examine them. Within the period, women do not examine them, for we do not allow doubtful women to marry based on a woman's testimony.
Rabbi Shimon says: Even within the period, women examine them.
And a woman is believed stringently, but not leniently.
How so? To say that she is an adult such that she cannot refuse or that she is a minor such that she cannot perform chalitza, but she is not believed to say that she is a minor such that she may refuse or that she is an adult such that she can perform chalitza.

בשלמא לפני הפרק בעיא בדיקה דאי משתכחי לאחר הפרק שומא נינהו
אלא לאחר הפרק למה לי?

כי אמר רבא חזקה למיאון אבל לחליצה בעיא בדיקה

רש"א אף תוך הפרק נשים בודקות אותן קסבר תוך הפרק כלפני הפרק ובעיא בדיקה דאי משתכחי לאחר הפרק שומא נינהו
Master said {above}: "Rabbi Yehuda says: Before the period {time span between 11 and a day and 12 and a day} and after the period, women examine them" --
This is fine before the period, she requires examination, for if they find {hairs} then after the period they are considered a mole. But after the period, why do I need? For did not Rava say that a minor who reaches her years does not require examination, because of an assumption that she brought forth signs?! When did Rava say this assumption, as regards refusal, but for chalitza she requires an examination.
"Within the period, women do not examine them" -- he holds that within the period is like after the period. After the period, where there is the assumption of Rava, we rely upon woman and so women examine. Within the period, where there is not the assumption of Rava, we do not rely upon woman and so women do not examine.
"Rabbi Shimon says even within the period, women examine them" -- he holds that within the period is like before the period, and they require examination, for if they find them, after the period they would be considered a mole.

ונאמנת אשה להחמיר אבל לא להקל
הא מאן קתני לה אי בעית אימא רבי יהודה ואתוך הפרק
ואי בעית אימא רבי שמעון ולאחר הפרק ולית ליה חזקה דרבא
"And a woman is believed stringently but not leniently":
Who is the one who teaches this? If you wish to say so, it is Rabbi Yehuda, and within the period.
And if you want say that it is Rabbi Shimon, and after the period, and he does not hold by the assumption of Rava.

אשכחן לחד מרבוואתא דכתב הכי קיימא לן בהא כרבי שמעון דסבר תוך זמן כלפני זמן דסוגיין דפסקינא הלכתא תוך זמן כלפני זמן וכיון דר' שמעון דקיימא לן כותיה דחי חזקה דרבא שמע מינה הא חזקה דרבא דחויה היא ולא סמכינן עלה
ותו האמר רב נחמן אמר שמואל בודקין למיאונין וקיימא לן כותיה אלו דבריו של מפרש זה
We have found one of the {post-Talmudic} Rabbis who has written as follows, that we establish in this like Rabbi Shimon, who holds that within the time is like before the time, for our sugya rules that the halacha is that within the time is like before the time. And since Rabbi Shimon, who we hold like, pushes off the assumption of Rava, we deduce that this assumption of Rava is pushed off and that we do not rely upon it.
And furthermore, behold that Rav Nachman cited Shmuel that we examine for refusals, and we establish like him.
These are the words of this commentator.

ואנן לא סבירא לן הכי
חדא דהאי חזקה דרבא הלכה היא וליכא לדחוייה
דהא קא מותבינן מינה תיובתא לדרבי יהודה ופריק כי אמר רבא חזקה למיאון אבל לחליצה בעיא בדיקה ואי לאו הלכה היא לא הוה מותבינן מינה תיובתא

ועוד דהא קי"ל דר' יהודה ורבי שמעון הלכה כר' יהודה וכיון דר' יהודה אית ליה חזקה דרבא ממילא שמעי' דחזקה דרבא הלכה היא
וכ"ש דסתם מתני' ורבי אליעזר ור' ישמעאל ור' יהודה כולהו קיימי בחדא שיטתא וסבירא להו דלאחר הפרק נשים בודקות אותן דאיכא חזקה דרבא והוה ליה ר' שמעון יחיד אצל רבים וקיימא לן דאין הלכה כיחיד אצל רבים
הילכך ליתא לדר' שמעון אלא לענין תוך זמן כלפני זמן בלחוד ולא אמרינן כיון דהלכתא כותיה בהא הויא הלכתא נמי כותיה בהא דלאו מילי דתליאן בהדדי נינהו
אלא כל מילתא מינייהו קיימא באנפי נפשה ולא שייכא בחברתה
And we do not hold like this, for one thing, this assumption of Rava is halacha, and one should not reject it. For they use it to pose a rejection to Rabbi Yehuda, and they resolve that when Rava said there was an assumption, it was for refusal, but for chalitza she requires an examination, and if it were not halacha, they would not have attempted to pose from it a rejection.
And furthermore, we establish that {in case of dispute between} Rabbi Yehuda and Rabbi Shimon, the halacha is like Rabbi Yehuda. And since Rabbi Yehuda holds by the assumption of Rava, it is apparent that we deduce that the assumption of Rava is halacha.
And certainly since the plain Mishna, and Rabbi Eliezer, and Rabbi Yishmael, and Rabbi Yehuda all stand in one opinion and hold that after the period, women examine them, for there is the assumption of Rava, and Rabbi Shimon is an individual against the many. And we establish that the halacha is not like the individual against the many.
Therefore, we do not hold like Rabbi Shimon except in the case of within the period being like before the period and that it all {we hold like him}, and we do not say that since the halacha is like him in this, the halacha will also be like him in this, for they are not matters which depend upon one another. Rather, each matter among them we establish by itself and it has no relation to its fellow.

תדע דהא רבא הוא דאמר קטנה שהגיעה לכלל שנותיה אינה צריכה בדיקה חזקה הביאה סימנים והוא דפסק הלכתא תוך זמן כלפני זמן והואיל וכך ליכא למשמע מהאי דסבירא לן דתוך זמן כלפני זמן למידחי חזקה דרבא אלא ודאי האי טעמא פריכא הוא וליכא למיסמך עליה
אלא ודאי מדרבי יהודה אית ליה חזקה דרבא וקיימא לן דרבי יהודה ורבי שמעון הלכה כר' יהודה
שמעינן דחזקה דרבא הלכה היא
Know that this is so, for behold, Rava is the one who said that a female minor who reached her years does not require an examination, because of an assumption that she brought forth signs. And it is he who ruled the halacha that within the period is like before the period {that is, like Rabbi Shimon}. And since this is so, we cannot infer from the fact that we hold that within the period is like before the period in order to push off the assumption of Rava. Rather, certainly this reason is answerable, and one should not rely upon it.
Rather, certainly, Rabbi Yehuda holds by the assumption of Rava, and we establish that {in case of dispute between} Rabbi Yehuda and Rabbi Shimon, the halacha is like Rabbi Yehuda. We therefore deduce that the assumption of Rava is indeed halacha.

וכ"ש דלא איתברר דרבי שמעון לית ליה חזקה דרבא אלא בדרך אפשר יש לומר הא דאמרינן לית ליה חזקה דרבא
דהכי קא אמרינן הא מאן קתני לה אי בעית אימא ר' יהודה ואתוך הפרק ואי בעית אימא ר"ש ולאחר הפרק ולית ליה חזקה דרבא
וכיון דאפשר דרבי יהודה קתני לה אתוך הפרק לא איתברר דר"ש לית ליה חזקה דרבא
ומכל מקום בין דסבירא ליה לרבי שמעון חזקה דרבא בין דלא סבירא ליה חזקה דרבא הלכתא היא מהני טעמי דאמרינן
And all the more so that it is entirely not clear that Rabbi Shimon does not hold by the assumption of Rava, but rather in a way of possibility, one could say this which we said that he does not hold of the assumption of Rava. For this is what we said: Which person said this Tannaitic statement in the Mishna? If you wish you can say that it is Rabbi Yehuda and is going on within the period. And if you wish you can say that it is Rabbi Shimon and going on after the period, and that he {Rabbi Shimon} does not hold by the assumption of Rava.
And since it is possible that Rabbi Yehuda taught it about within the period, it is not clear that Rabbi Shimon does not hold by the assumption of Rava.
And in any case, whether Rabbi Shimon holds by the assumption of Rava or whether he does not hold by the assumption of Rava, it {=the assumption} is halacha, for all the reasons we have said.

הילכך כל הנבדקות נבדקות על פי נשים הלכה היא בין לחליצה בין למיאון דסמכינן אחזקה דרבא
Therefore, all those undergoing examinations do so based on women, and this is the halacha, whether for chalitza or for refusal, for we rely upon the assumption of Rava.

והא דאמר רב נחמן אמר שמואל בודקין לגיטין ולקידושין ולחליצה ולמיאונין ודאי איכא לאקשויה אדרבא דאמר קטנה שהגיעה לכלל שנותיה אינה צריכה בדיקה חזקה הביאה סימנין
דאמרינן הכי הא דאמר רב נחמן אמר שמואל בודקין למיאונין וקי"ל דהלכה היא היכי משכחת לה אי קודם זמן ותוך זמן הא קיימא לן דשומא נינהו ולא עבדינן בהו עובדא ואי לאחר זמן האמר רבא קטנה שהגיעה לכלל שנותיה אינה צריכה בדיקה חזקה הביאה סימנין ואע"ג דבדקנוה לאחר זמן ולא אשכחן בה מידי הא איפסיקא הלכתא דחיישינן שמא נשרו
ואם כן הא דאמר רב נחמן אמר שמואל בודקין למיאונין היכי משכחת לה
And this that Rav Nachman cited Shmuel, that we examine for get and for betrothal, for chalitza and for refusal, it certainly is so that one can ask from this on Rava, who said that a female minor who reached her years does not require examination, because of an assumption that she brought forth her signs.
For we say as follows: This that Rav Nachman cited Shmuel that we examine for refusal, and we establish that this is halacha, how do we find this case? If it is before the time or within the time, we establish that it is a mole and we do not act based on it; and if after the time, Rava said that a female minor who reached her years does not require examination, because of an assumption that she brought forth hairs. And even though they examine her after a time and do not find anything, we rule that the halacha is that we worry lest they fell out.
And if so, this that Rav Nachman cited Shmuel that we examine for refusal, how do we find such a case?

ואנן עיינינן בה ואשכחנא פירוקא בסיעתא דשמיא
והדין הוא פירוקא דהאי קושיא
האי דאיפסיקא הלכתא דחיישינן שמא נשרו לא איפסיק הכי אלא היכא דקדיש תוך זמן ובעל לאחר זמן דהוה ליה ספיקא דאורייתא כדכתבינן לעיל
אבל היכא דלא בעל אחר זמן דהוו להו נישואין דרבנן לא אמרינן חיישינן שמא נשרו ולא אמר רבא דלא בדקינן לה דלא אמר רבא חזקה הביאה סימנין אלא לענין איסורא דאורייתא דעבדינן לחומרא ולא בדקינן דחיישינן שמא נשרו אבל בספיקא דרבנן בדקינן
ואי משכחינן שתי שערות לא ממאנה דהויא לה גדולה ואי לא משכחינן שתי שערות לא חיישינן שמא נשרו אלא אמרינן קטנה היא וממאנת
והיינו דאמר רב נחמן אמר שמואל בודקין למיאונין היכא דקדיש לפני זמן או תוך זמן ובעל בתוך זמן ולא בעל לאחר זמן דלאו נישואין דאורייתא נינהו אלא נישואין דרבנן נינהו
ואיפריק קושיאן כהוגן הדין הוא סברא דילן וסברא תריצא ומעליא הוא
וחזינן למקצת רבוואתא בהאי ענינא דכתבין מילי דלא מיסתברן ומשום הכי לא כתבינן להו

And we have delved into it, and we have found a resolution, with the aid of Heaven. And here is the resolution of this difficulty:
This that we rule the halacha that we worry lest they fell out, we do not rule so except where he betrothed within the time and had intercourse after the time, in which case it is a Biblical doubt, as we have written above. But, where he did not have intercourse after a time, such that the nuptials {nisuin} is Rabbinic, we do not say that we worry lest they fell out. And Rava did not say that we do not examine he, for Rava does not say that there is an assumption that she brought forth signs except by a Biblical prohibition, where we conduct ourselves stringently, and we do not examine, for we worry lest they fell out. But by a Rabbinic doubt, we examine. And then, if we find two hairs she may not refuse, for she is an adult, and if we do not find two hairs, we do not worry lest they fell out, but rather we say that she is a minor and may refuse.

And this is what Rav Nachman said in the name of Shmuel, that we examine for refusals, where he betrothed before the time or within the time, and had intercourse within the time, and did not have intercourse after the time, for in this way it is not Biblical nuptials {nisuin} but rather Rabbinic nuptials.

And we have resolved the difficulty appropriately.
This is our opinion, and it is an excellent opinion which answers.

And we have seen a few of the {post-Talmudic} Rabbis in this matter who write things which are not logical, and because of this we have not written them.
