Rif Yevamot 34a {104a continues; 104b; 105a; 104b; 105b} Spitting; Speaking; The Act of a Minor

34a

{Yevamot 104a continues}
Mishna:

חלצה ורקקה ולא קראה חליצתה כשרה
קראה ורקקה ולא חלצה חליצתה פסולה
חלצה וקראה אבל לא רקקה רבי אליעזר אומר חליצתה פסולה ר' עקיבא אומר חליצתה כשרה
אמר רבי אליעזר ככה יעשה דבר שהוא מעשה מעכב
אמר ליה רבי עקיבא משם ראיה ככה יעשה לאיש דבר שהוא מעשה באיש
If she removed the shoe and spat, but did not read {the formula of chalitza} her chalitza is valid.
If she read and spat, but did not remove, her chalitza is invalid.
If she removed and read, but did not spit, Rabbi Eliezer says her chalitza is invalid; Rabbi Akiva says her chalitza is valid.

Rabbi Eliezer said: {Devarim 25:9}:
ט וְנִגְּשָׁה יְבִמְתּוֹ אֵלָיו, לְעֵינֵי הַזְּקֵנִים, וְחָלְצָה נַעֲלוֹ מֵעַל רַגְלוֹ, וְיָרְקָה בְּפָנָיו; וְעָנְתָה, וְאָמְרָה, כָּכָה יֵעָשֶׂה לָאִישׁ, אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו. 9 then shall his brother's wife draw nigh unto him in the presence of the elders, and loose his shoe from off his foot, and spit in his face; and she shall answer and say: 'So shall it be done unto the man that doth not build up his brother's house.'
That which is an action stands in the way.
Rabbi Akiva said to him: From there you bring a proof? {Continuing to read from the same verse:}
ט וְנִגְּשָׁה יְבִמְתּוֹ אֵלָיו, לְעֵינֵי הַזְּקֵנִים, וְחָלְצָה נַעֲלוֹ מֵעַל רַגְלוֹ, וְיָרְקָה בְּפָנָיו; וְעָנְתָה, וְאָמְרָה, כָּכָה יֵעָשֶׂה לָאִישׁ, אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו. 9 then shall his brother's wife draw nigh unto him in the presence of the elders, and loose his shoe from off his foot, and spit in his face; and she shall answer and say: 'So shall it be done unto the man that doth not build up his brother's house.'
{Only} something which is an action done to the man.

Gemara:
שלחו ליה לאבוה דשמואל יבמה שרקקה תחלוץ
מכלל דאיפסלא לה מאחים
ואיכא דאמרי הכי שלחו ליה יבמה שרקקה תחלוץ ואינה צריכה לרוק פעם אחרת דכסדרן לא מעכבא
דתניא בין שהקדים חליצה לרקיקה ובין שהקדים רקיקה לחליצה מה שעשה עשוי
They sent {this ruling} to the father of Shmuel: A yevama who spits {even not part of a chalitza ceremony} must do chalitza {rather than yibbum}.
We deduce that she is thus invalidated from the brothers {for yibbum with this spit}.
And some {variants} say that they sent this to him: A yevama who spits undergoes chalitza and does not need to spit another time, for we do not require that it be in order.
For they learnt {in a brayta}: Whether removing of the shoe {chalitza} came before spitting, or whether spitting came before removing of the shoe, that which was done was done.

{Yevamot 105a}

שלחו ליה לאבוה דשמואל יבמה שרקקה דם תחלוץ שאי אפשר לדם בלא צחצוחי רוק ודוקא במוצצת אבל בשותתת לא וגידמת חולצת בשיניה דלא כתיב וחלצה בידה:
They sent to the father of Shmuel: A yavama who spat blood should do chalitza, for it is impossible to have the blood without some droplets of spit. And specifically where she casts it out, but where it flows out, no.
And a woman with amputated arms should perform chalitza with her teeth, for it is not writtenוְחָלְצָה with her hands {but just וְחָלְצָה}.

Mishna:
החרש שנחלץ והחרשת שחלצה והחולצת מן הקטן חליצתה פסולה
קטנה שחלצה תחלוץ משתגדיל ואם לא חלצה חליצתה פסולה
חלצה בשנים או בשלשה ונמצא אחד מהן קרוב או פסול חליצתה פסולה ורבי שמעון ור' יוחנן הסנדלר מכשירין
ומעשה שחלצה בינו לבינה בבית האסורין ובא מעשה לפני ר"ע והכשיר
The {male} deaf-mute who underwent chalitza and the {female} deaf-mute who performed chalitza, and she who received chalitza from a {male} minor, her chalitza is invalid.
A {female} minor who performed chalitza must perform chalitza when she becomes an adult, and if she does not perform chalitza then, her chalitza is invalid.
If she performed chalitza with two or with three {people present} and it turns out that one of them is a relative or is invalid {as a judge}, her chalitza is invalid. And Rabbi Shimon and Rabbi Yochanan haSandler validate.
And there was an incident in which she performed chalitza with just he and she present, in the prison, and the incident came before Rabbi Akiva and he validated.

Gemara

החרש שנחלץ והחרשת שחלצה חליצתן פסולה
אמרי דבי ר' ינאי לפי שאינן באמר ואמרה
ומתני' דקתני חלצה ורקקה אבל לא קראה חליצתה כשירה בדיכלה למיקרי כדר' זירא דאמר כל הראוי לבילה אין בילה מעכבת בו וכל שאינו ראוי לבילה בילה מעכבת בו
"The {male} deaf-mute who underwent chalitza and the {female} deaf-mute who performed chalitza ... her chalitza is invalid":
They said in the academy of Rabbi Yannai: Because they are not within the realm of amar and amra.
{A reference to the pesukim:
ז וְאִם-לֹא יַחְפֹּץ הָאִישׁ, לָקַחַת אֶת-יְבִמְתּוֹ; וְעָלְתָה יְבִמְתּוֹ הַשַּׁעְרָה אֶל-הַזְּקֵנִים, וְאָמְרָה מֵאֵן יְבָמִי לְהָקִים לְאָחִיו שֵׁם בְּיִשְׂרָאֵל--לֹא אָבָה, יַבְּמִי. 7 And if the man like not to take his brother's wife, then his brother's wife shall go up to the gate unto the elders, and say: 'My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me.'

And our Mishna which teaches that if she removes the shoe and spits but does not read, her chalitza is valid is where she is capable of reading, like Rabbi Zera who said that whatever is able to be mixed {for the mincha offering}, mixing does not hold back from it {s being valid} and whatever is not capable of being mixed, mixing does hold back from it.

{Yevamot 105b}
והחולצת מן הקטן חליצתה פסולה
אמר ר"י אמר רב זו דברי רבי מאיר אבל חכ"א אין חליצת קטן כלום דאפי' לגבי אחים לא פסלה אלא עדיין היא זקוקה ליבום:
"and she who received chalitza from a {male} minor, her chalitza is invalid":
Rav Yehuda cited Rav: These are the words of Rabbi Meir, but the Sages say that the chalitza of a minor is not anything -- that even in respect to the brothers, she is not invalidated but rather she is still bound for yibbum.

קטנה שחלצה תחלוץ לכשתגדיל ואם לא חלצה חליצתה פסולה
אמר רב יהודה אמר רב זו דברי ר' מאיר דאמר מקשינן אשה לאיש אבל חכ"א איש כתוב בפרשה אבל אשה בין גדולה בין קטנה
רבא אמר עד שתגיע לעונת הנדרים
והלכתא עד שתביא שתי שערות
"A {female} minor who performed chalitza should perform chalitza when she becomes an adult, and if she does not perform chalitza then, her chalitza is invalid":
Rav Yehuda cited Rav: These are the words of Rabbi Meir, who said that he link the laws of a woman to a man. But the Sages say "ish" {a man} is written in the parsha but a woman, whether an adult or a minor.
Rava said: Until she reaches the age of oaths {that her oaths take hold}.
And the halacha is until she brings forth two {pubic} hairs.
