Rif Yevamot 31b {Yevamot 97a-b} Marrying Relatives After Rape, Seduction; Impact of Conversion, Manumission On Yibbum and Chalitza

Mishna:

נושאין על האנוסה ועל המפותה
והאונס והמפתה על הנשואה חייב
נושא אדם אנוסת אביו ומפותת אביו אנוסת בנו ומפותת בנו
רבי יהודה אוסר באנוסת אביו ומפותת אביו

A man may marry upon {=the close relative of} a raped woman {whom he raped} and upon a woman he seduced. And one who raped or seduced upon {=a relative of} a married woman {=his wife}, he is liable.

A man may marry the woman raped by his father and the woman seduced by his father, the woman raped by his son and the woman seduced by his son.
Rabbi Yehuda forbids the woman raped by his father and the woman seduced by his father.

Gemara:
תנינא להא דתנו רבנן אנס אשה מותר לישא בתה נשא אשה אסור לישא בתה והא דתנן הנטען מן האשה אסור באמה ובבתה ובאחותה מדרבנן ומתני' דתנן נושאין לכתחילה לאחר מיתה תנא:
We have learnt this, for the Sages learnt {in a brayta}: If he raped a woman, he is permitted to marry her daughter; if he married a woman, he is forbidden to marry her daughter.
And this that they learnt {tnan}: If one is suspected of intercourse with a woman, he is forbidden to her mother and to her daughter, and to her sister -- this is Rabbinic.
And the Mishna which taught "they may marry" -- with the implication of ab initio -- is teaching this after death {of the woman}.

מנא הני מילי דמי שאנס אשה מותר לישא בתה
דת"ר בכולן נאמרה שכיבה וכאן נאמרה קיחה ואיש אשר יקח את אשה ואת אמה לומר לך דרך ליקוחין אסרה תורה
רבא אמר אנס אשה מותר לישא בתה מהכא ערות בת בנך או בת בתך לא תגלה ערותן הא בת בנה דידה ובת בתה דידה גלי וכתיב ערות אשה ובתה לא תגלה את בת בנה ואת בת בתה וגו'
הא כיצד כאן באונסין וכאן בנשואין איפוך אנא עריות שאר כתיב בהו בנשואין איכא שאר באונסין ליכא שאר:
From where are these words that one who raped a woman is permitted to marry her daughter? For the Sages learnt {in a brayta}: Regarding all of them is stated shechiva {"sleeping"} and here is stated "taking" -- Vayikra 20:14:
יד וְאִישׁ, אֲשֶׁר יִקַּח אֶת-אִשָּׁה וְאֶת-אִמָּהּ--זִמָּה הִוא; בָּאֵשׁ יִשְׂרְפוּ אֹתוֹ, וְאֶתְהֶן, וְלֹא-תִהְיֶה זִמָּה, בְּתוֹכְכֶם. 14 And if a man take with his wife also her mother, it is wickedness: they shall be burnt with fire, both he and they; that there be no wickedness among you.
To tell you that way of taking {=marrying} the Torah forbade.
Rava said: If he raped a woman, he is permitted to marry her daughter, from here: {Vayikra 18:10}:
י עֶרְוַת בַּת-בִּנְךָ אוֹ בַת-בִּתְּךָ, לֹא תְגַלֶּה עֶרְוָתָן: כִּי עֶרְוָתְךָ, הֵנָּה. {ס} 10 The nakedness of thy son's daughter, or of thy daughter's daughter, even their nakedness thou shalt not uncover; for theirs is thine own nakedness. {S}
Thus the daughter of her son and the daughter of her daughter you may uncover. But it is written {same perek}:
יז עֶרְוַת אִשָּׁה וּבִתָּהּ, לֹא תְגַלֵּה: אֶת-בַּת-בְּנָהּ וְאֶת-בַּת-בִּתָּהּ, לֹא תִקַּח לְגַלּוֹת עֶרְוָתָהּ--שַׁאֲרָה הֵנָּה, זִמָּה הִוא. 17 Thou shalt not uncover the nakedness of a woman and her daughter; thou shalt not take her son's daughter, or her daughter's daughter, to uncover her nakedness: they are near kinswomen; it is lewdness.
How so? Here where they were raped and here where they were married.
But {why not} reverse it! Regarding forbidden {incestuous} relations it is written "kin" {שאר}. By marriage there is kin, whereas by those who are raped, there are not kin {to him}.

Mishna:
הגיורת שנתגיירו בניה עמה לא חולצין ולא מיבמין ואפילו הורתו של ראשון שלא בקדושה ולידתו בקדושה והשני הורתו ולידתו בקדושה וכן השפחה שנשתחררו בניה עמה:
A convertess who sons converted with her, {if one of these sons should die} they do not perform chalitza nor yibbum, and even if the conception of the first one was not in holiness {before her conversion} and his birth was in holiness, while the second one's conception and birth was in holiness; and so too a bondwoman whose children were freed with her.

בני יודן אמתא אישתחררו
שרא להו רב אחא בר יעקב למינסב נשי דהדדי
אמר ליה רבא והא רב ששת אסר
א"ל הוא אסר ואנא שרינא
מן האב ולא מן האם כולי עלמא לא פליגי דשרי
מן האם ולא מן האב כולי עלמא לא פליגי דאסור
כי פליגי מן האב ומן האם מאן דשרי בתר אבא שדינן ליה דהא בני פלניא קרו ליה ומאן דאסר קרו ליה נמי בני פלניתא

וא"ד פליג רב אחא בר יעקב אפילו באחים מן האם
The sons of of Yudan the bondwoman were freed. Rav Acha bar Yaakov permitted them to marry each other's wives {since the previous family bond was dissolved}.
Rava said to him: But Rav Sheshet forbade.
He said to him: He forbade but I permit.

{Convert brothers} From the same father and not from the same mother, all agree that it is permitted. From the same mother and not from the same father , all agree that it is forbidden. When do they argue? From both the mother and the father. The one who permits casts him after the father, for they call him son of Ploni. And the one who forbids -- they also call him son of Plonit.

And some some that Rav Acha bar Yaakov argues even by brothers from the same mother.

מאי טעמא גר שנתגייר כקטן שנולד דאמי ואקשינן ליה לרב אחא בר יעקב ופריק ואף על פי כן כיון דלא אפסיקא הלכתא כוותיה בהדיא עבדינן לחומרא כרב ששת


What is the reason? A convert who converts is like a newborn child. And we ask on Rav Acha bar Yaakov and resolve. And even so, since we do not explicitly rule the halacha in accordance with him, we act stringently like Rav Sheshet.
