40a

{Niddah 47a continues}

רבי יוסי אומר משתקיף העטרה
רבי שמעון אומר משיתמעך הכף
וכן היה רבי שמעון בן יוחאי אומר שלשה סימנין נתנו חכמים באשה מלמטה וכנגדן מלמעלה פגה מלמעלה בידוע שלא הביאה שתי שערות בוחל מלמעלה בידוע שהביאה שתי שערות צמל מלמעלה בידוע שנתמעך הכף
Rabbi Yossi says: When a ring forms around the nipple.
Rabbi Shimon says: When the kaf {mons veneris} grows lower.

And so did Rabbi Shimon ben Yochai say: The Sages gave three signs in a woman below and corresponding to them above. An unripe fig above, it is known that she did not bring forth two {pubic} hairs. A ripening fig above, it is known that she brought froth two hairs. A ripe fig above, it is known that the mons veneris has grown lower.

מאי כף
אמר רב הונא מקום תפוח יש באשה למעלה מאותו מקום כיון שמתגדלה מתמעך והולך
What is the kaf {mons veneris}?
Rav Huna said: There is a rounded eminence in the woman above that place. As she matures, it continuously becomes lower.

שאלו את רבי הלכה כדברי מי
א"ל הלכה כדברי כולן להחמיר
רבי יוחנן וסביא דאמרי תרוייהו הלכה כדברי כולן להחמיר
שאם הביאה אחד מן הסימנין הללו מחזקינן לה גדולה להחמיר כלומר אם היה בה אחד מכל הסימנין הללו וקדשה עצמה בחיי אביה קידושיה קדושין וצריכה גט ואין אביה מפר נדריה ואם קדשה אביה שלא לדעתה צריכה גט
They asked Rabbi: The halacha is like whom?
He said to them: The halacha is like the words of all of them, stringently.
Rabbi Yochanan and Savia both said: The halacha is like the words of all of them, stringently -- that if she brought forth one of these signs, we assume that she is an adult, stringently.
That is to say that if she had in her one of these signs and betrothed herself {to a man} in her father's lifetime, her betrothal is a betrothal and she needs a get, and her father may not nullify her vows, and if her father betroths her without her consent, she requires a get.

Mishna:
בת עשרים שנה שלא הביאה שתי שערות יביאו ראיה שהיא בת עשרים והיא איילונית לא חולצת ולא מתיבמת
בן עשרים שלא הביא שתי שערות יביא ראיה שהוא בן עשרים והוא הסריס לא חולץ ולא מיבם אלו דברי ב"ה
ב"ש אומרים זה וזה בני י"ח שנה
רבי אליעזר אומר הזכר כדברי בית הלל והנקבה כדברי בית שמאי שהאשה ממהרת לבא לפני האיש
A woman 20 years old who did not bring forth two {pubic} hairs -- they bring proof that she is 20 years old and she is an aylonit -- she does not perform chalitza or yibbum.
A man 20 years old who did not bring forth two {pubic} hairs -- he brings proof that he is 20 years old and he is the eunuch -- he does not perform chalitza nor yibbum.
These are the words of Bet Hillel.
Bet Shammai say: Both this and that at 18 years of age.
Rabbi Eliezer says: The male like the words of Bet Hillel and the female like the words of Bet Shammai, for the female is quicker to develop than the male.

Gemara:
ורמינהו אחד בן תשע שנים ויום אחד ואחד בן עשרים שנה שלא הביא שתי שערות
א"ר שמואל בר יצחק אמר רבי והוא שנולדו בו סימני סריס
אמר רבא דיקא נמי דקתני והוא הסריס שמע מינה
And they objected: "Both a boy nine years and a day and a man 20 years who did not bring forth two hairs {both are considered a minor}."
R' Shmuel bar Yitzchak cited Rabbi {our gemara: Rav}: And this {in our Mishna} is where the signs of being a eunuch developed in him.
Rava said: One may indeed derive this {from careful analysis of the wording of the Mishna}, for it taught "and he is the eunuch."
We so derive.
וכי לא נולדו בו סימני סריס עד כמה
תאני רבי חייא עד רוב שנותיו
כי אתו לקמיה דר' חייא אי כחיש אמר להו זילו אבריוה ואי בריא אמר להו זילו אכחשוה דהני סימנין זימנין דאתו מחמת כחישותא וזימנין דאתו מחמת בריותא
אמר רב הלכה בכוליה פירקין מעת לעת
ועולא אמר דתנן תנן דלא תנן לא תנן
כלומר שנת עשרים שלא שנינן בה ויום אחד לא בעינן מעת לעת
והילכתא כעולא דתניא כוותיה
And when he did not develop the signs of being a eunuch, until how long?
Rabbi Chiyya taught {in a brayta}: Until most of his years {middle age}.
When they came {with a possible eunuch} before Rabbi Chiyya, if he was skinny he told them "go and fatten him up," and if he was fat, he told them "go slim him down." For these signs, sometimes they come as a result being too skinny and sometimes they come as a result of being too fat.
Rav said: The halacha in all of our perek is from day to day {to calculate age}.
And Ulla said: Where this was taught, it was taught, and where it was not taught, it was not taught.
That is to say -- twenty years, where we did not learn "and one day," we do not require from time to time {thus a full amount of years, but rather parts of years count, based on the calendar year}.
And the halacha is like Ulla, for there is a brayta like him:

ר' יוסי בן כיפר אמר משום ר' אלעזר שנת עשרים שיצאו ממנו שלשים יום הרי היא כשנת כ' לכל דבריה
ואמר רב יצחק בר נחמני אמר רבי אלעזר מסתברא דרבי יוסי בן כיפר מדכולה פירקין קתני יום א' והכא לא קתני שמע מינה הלכתא כוותיה
Rabbi Yossi ben Kipper said in the name of Rabbi Eleazar: The 20th year, which thirty days went out of it, it is still like the 20th year in all its respects.

And Rav Yitzchak bar Nachmani cited Rabbi Eleazar: It is logical like Rabbi Yossi ben Kipper, for throughout our perek it taught "{and} 1 day" and here it did not teach it, we deduce that the halacha is like him.

NIDDAH PEREK SIX
Mishna:
בא סימן התחתון עד שלא בא העליון או חולצת או מתיבמת
בא העליון עד שלא בא התחתון אע"פ שאי אפשר רבי מאיר אומר לא חולצת ולא מתיבמת וחכמים אומרים או חולצת או מתיבמת מפני שאמרו אפשר לבא התחתון עד שלא יבא העליון אבל אי אפשר לעליון לבא עד שלא יבא התחתון
If the lower sign came before the upper sign came, she either undergoes chalitza or yibbum.
If the upper {sign} came before the lower, even though it is not possible, Rabbi Meir says that she does not undergo either chalitza or yivvum. And the Sages say that she either undergoes chalitza or yibbum, for they said that it is possible for the lower {sign} to come before the upper, but it is not possible for the upper {sign} to come before the lower one comes.

Gemara:
אף על פי שאי אפשר והלא בא בא לרבי מאיר ואע"פ שאי אפשר לרבנן
וניתני בא עליון עד שלא בא התחתון ואנא ידענא דמשום דאי אפשר
אי לא תנא אע"פ שאי אפשר הוה אמינא רוב תחתון אתי ברישא ומיעוט עליון ור"מ לטעמיה דחייש למיעוטא והני מילי בסתמא אבל היכא דבדקן ולא אשכחן מודו לר' מאיר דעליון קדים אתי קא משמע לן דאי אפשר אלא ודאי תחתון אתי ומנתר נתר
והלכתא כרבנן דיחיד ורבים הלכה כרבים
"Even though it is not possible":
But did it not in fact come?
"It came" -- according to Rabbi Meir, "even though it is not possible" -- for the Sages.
And let us teach "if the upper {signs} develop before the lower ones" and I will know that it is because it is not possible! If it did not teach "even though it is not possible," I would have believed that the case is where the majority of the lower {signs} developed first and a minority of the upper, and Rabbi Meir is consistent in his opinion that we worry for the minority, and these words are in the general case, but where we examined and did not find, they would admit to Rabbi Meir that the upper one developed first. Therefore it informs us that it is not possible, but rather for certain the lower {signs} came and then dropped off.
And the halacha is like the Sages, for {in a case of dispute between} an individual and the many, the halacha is like the many.


דכולי עלמא מיהא אתחתון סמכינן
מנא הני מילי אמר רב יהודה אמר רב וכן תנא דבי ר' ישמעאל אמר קרא איש או אשה כי יעשו מכל חטאת האדם וגו' השוה הכתוב אשה לאיש לכל עונשין שבתורה מה איש בסימן אחד אף אשה בסימן א' ואימא או האי או האי כאיש מה איש תחתון ולא עליון אף אשה תחתון ולא עליון
תניא נמי הכי אמר ר' אליעזר בר' צדוק כך היו מפרשין ביבנה כיון שבא תחתון שוב אין משגיחין בעליון
According to everyone, however, we rely on the lower {signs}.
From where do we know this? Rav Yehuda cited Rav, and so was it taught in the academy of Rabbi Yishmael: The Scripture states {Bemidbar 5:6}:
ו דַּבֵּר, אֶל-בְּנֵי יִשְׂרָאֵל, אִישׁ אוֹ-אִשָּׁה כִּי יַעֲשׂוּ מִכָּל-חַטֹּאת הָאָדָם, לִמְעֹל מַעַל בַּיהוָה; וְאָשְׁמָה, הַנֶּפֶשׁ הַהִוא. 6 Speak unto the children of Israel: When a man or woman shall commit any sin that men commit, to commit a trespass against the LORD, and that soul be guilty;
The Scripture equates a woman to a man for all punishments in the Torah -- just as a man with just a single sign {of maturity}, so too a woman with just a single sign. And perhaps you should say "either this or this," {such that either an upper or lower sign would suffice}? Like a man. Just like a man, it is the lower sign and not the upper, so too a woman, it is the lower sign and not the upper.
A brayta also says so: Rabbi Eliezer beRabbi Tzadok said: So did they explain at Yavneh: Once the lower sign comes, they no longer pay any heed to the upper.
