Rif Yevamot 36b {Yevamot 108a}

36b

Gemara:

אמר רב יהודה ואמרי לה במתניתא תנא בראשונה היו כותבין גט מיאון לא רעינא ביה ולא צבינא ביה ולית אנא בעיא להתנסבא ליה
כיון דחזו דקא נפיש דיבורא אמרי אתי לאיחלופי בגיטא תקינו הכי
ביום פלוני מיאנה פלוניתא בת פלוני בפלוני בן פלוני באנפנא
Rav Yehuda said, and some say in a brayta it was taught: Initially they wrote a document {get} certifying refusal, "I don't like him and I do not want him, and I do not wish to be married to him." Once they say that it had a lot of words, they said that it may come to be confused
{Yevamot 108a}
with a bill of divorce {get}, and so they established it as follows:
On day X, Plonit daughter of A refused Ploni son of B before us.

תנו רבנן אי זהו מיאון כל שאמרה אי אפשי בפלוני בעלי אי אפשי בקדושין שקדשוני אמי ואחי
יתר על כן אמר רבי יהודה אפילו הושיבה באפריון והוליכוה מבית אביה לבית בעלה ואמרה אי אפשי בפלוני בעלי הרי זה מיאון
יתר על כן אמר רבי יהודה אפילו אורחין מסובין בבית בעלה והיא עומדת ומשקה עליהן ואמרה אי אפשי בפלוני בעלי הרי זה מיאון
יתר על כן אמר רבי יהודה אפילו שיגרה בעלה אצל חנוני להביא לו חפץ משלו והלכה והביאה החפץ משלו ואמרה אי אפשי בפלוני בעלי אין לך מיאון גדול מזה:
The Sages learnt {in a brayta}: What is "refusal?" Any {woman} who says "I do not want Ploni my husband; I do not want the betrothal which my mother and brother betrothed me."
More than this Rabbi Yehuda said: Even if while sitting in the bridal litter and they are taking her from her father's house to the house of her husband and she says "I do not want Ploni my husband," this is {valid} refusal.
More than this Rabbi Yehuda said: Even if {wedding} guests are reclining in her husband's house and she stands and gives drink to them, and she says "I do not want Ploni my husband," this is refusal.
More than this Rabbi Yehuda {our gemara: Rabbi Yossi ben Yehuda} said: Even if her husband sent her to the shopkeeper to bring him one of his objects, and she went and brought his object, and she says "I do not want Ploni my husband," there is no greater refusal than this.

רבי חנינא בן אנטיגנוס אומר כל תינוקת שאינה יכולה לשמור קדושיה אינה צריכה למאן
כלומר כמי שלא נתקדשה דמיא
אמר רב יהודה אמר שמואל הלכה כרבי חנינא בן אנטיגנוס
"Rabbi Chanina ben Antigonos says: Any {female} child who is unable to guard her token of betrothal does not need to refuse":
That is to say, she is as if she never was betrothed.
Rav Yehuda cited Shmuel: The halacha is like Rabbi Chanina ben Antigonos.

תנא קטנה שלא מיאנה ועמדה ונשאת משום רבי יהודה בן בתירא אמרו נשואיה הן הן מיאוניה
איבעיא להו עמדה ונתקדשה מאי
תא שמע דתניא קטנה שלא מיאנה ועמדה ונתקדשה משום רבי יהודה בן בתירה אמרו קדושיה הן הן מיאוניה
והלכתא כר' יהודה בן בתירה ואפילו בנשואין דקמא:
A tanna taught: A {female} minor who did not refuse and went and married {another man}, in the name of Rabbi Yehuda ben Beteira they said: Her marriage is her refusal.
It was a question to them: If she arose and betrothed {rather than married}, what?
Come and here. For they learnt {in a brayta}: A {female} child who did not refuse and arose and was betrothed {to another} -- in the name of Rabbi Yehuda ben Beteira they said: Her betrothal is her refusal.
And the halacha is like Rabbi Yehuda ben Beteira, and even where the {full} marriage to the first had taken place.

ר' אליעזר אומר אין מעשה קטנה אלא כמפותה כו':
תניא ר' אליעזר אומר אין מעשה קטנה כלום ואין בעלה זכאי במציאתה ולא במעשה ידיה ולא בהפרת נדריה ואינו יורשה ואינו מטמא לה כללו של דבר אינה כאשתו לכל דבר אלא שצריכה מיאון
רבי יהושע אומר מעשה קטנה כלום ובעלה זכאי במציאתה ובמעשה ידיה ובהפרת נדריה ויורשה ומטמא לה כללו של דבר הרי
היא כאשתו לכל דבר אלא שיוצאה במיאון
"Rabbi Eliezer says: The act of a {female} minor is only considered like a seduced woman...":
They learnt {in a brayta}: Rabbi Eliezer says: The act of a {female} minor is nothing at all, and her husband is not entitled to her find or the work of her hands, not in nullifying her vows, and he does not inherit her nor does he defile himself for her {should she die and if he is a kohen}. The general rule of the matter is that she is not like his wife in any matter, except that she requires refusal.
Rabbi Yehoshua says: The act of a {female} minor is considered something, so her husband is entitles to her find and to the work of her hands, and in nullifying her vows, and he inherits her and defiles himself for her. The general rule of the matter is that she is like his wife in every matter, except that she goes out with refusal.

והלכתא כרבי יהושע חדא דרבי אליעזר ור' יהושע הלכה כרבי יהושע
ועוד דרב ושמואל תרוייהו דחו לה להא דרבי אליעזר וסברי להא דרבי יהושע
And the halacha is like Rabbi Yehoshua, firstly because {in case of dispute between} Rabbi Eliezer and Rabbi Yehoshua, the halacha is like Rabbi Yehoshua.
And further, Rav and Shmuel both push off this of Rabbi Eliezer and hold like this of Rabbi Yehoshua.

דגרסינן בכתובות בפרק אלמנה ניזונת
רב תאני קטנה יוצאה בגט אין לה כתובה וכ"ש ממאנת ושמואל תאני ממאנת אין לה כתובה יוצאה בגט יש לה כתובה
ואזדא שמואל לטעמיה דאמר שמואל ממאנת אין לה כתובה יוצאה בגט יש לה כתובה ממאנת לא פסלה מן האחין ולא פסלה מן הכהונה יוצאת בגט פסלה מן האחין ופסלה מן הכהונה ממאנת אינה צריכה להמתין ג' חדשים יוצאה בגט צריכה להמתין ג' חדשים
מאי קמ"ל תנינא הממאנת באיש הוא מותר בקרובותיה והיא מותרת בקרוביו וכו' צריכה להמתין שלשה חדשים איצטריכא ליה דלא תנן
ואמרינן לימא כתנאי ר' אליעזר אומר אין מעשה קטנה כלום ואין בעלה זכאי במציאתה כו' ורבי יהושע אומר מעשה קטנה כלום וכו'
לימא רב דאמר כרבי אליעזר ושמואל דאמר כרבי יהושע ואמרינן אליבא דרבי אליעזר כולי עלמא לא פליגי כלומר דלית הלכתא כוותיה
אלא כי פליגי אליבא דרבי יהושע שמואל כרבי יהושע ורב עד כאן לא קאמר ר' יהושע התם אלא מדידה לדידיה אבל מדידיה לדידה לא
ושמעינן מינה דבין לרב ובין לשמואל הא דרבי אליעזר ליתא
For we learn in Ketubot, in perek Almana Nizonet {Ketubot 100b-101a}:
Rav taught: A {female} minor who went out {of marriage} with a get does not receive a ketuba, and all the more so one who refuses. And Shmuel taught that one who refuses does not receive a ketuba, but one who goes out with a get does receive a ketuba.
And Shmuel is consistent in his opinion, for Shmuel said: one who refuses does not receive a ketuba,but one who goes out with a get does receive a ketuba; one who refuses is not invalidated from the brothers nor is she invalidated from {marrying} a kohen, but one who receives a get is invalidated from the brothers and is invalidated from {marrying} a kohen; one who refuses does not need to wait three months, but one who goes out with a get needs to wait three months.
What does this inform us? We have learnt it {in a Tannaitic source}! "One {woman} who refuses a man, he is permitted to her relatives and she is permitted to his relatives..." It is needed for the fact that she needs to wait three months, which is not taught {tnan}.
And we say: Let us say that this {Amoraic dispute} goes along the lines of a Tannaitic dispute -- Rabbi Eliezer says that the act of a {female} minor is nothing at all, and her husband is not entitled to her find, etc., and Rabbi Yehoshua says that the act of a {female} minor is considered something, etc.
Let us say that Rav said like Rabbi Eliezer and Shmuel said like Rabbi Yehoshua.
And we say that according to the opinion of Rabbi Eliezer, everybody agrees. That is to say that the halacha is not like him. Rather, when do they argue? According to Rabbi Yehoshua. Shmuel holds like Rabbi Yehoshua. And Rav -- Rabbi Yehoshua only said that there from her hand to his hand {the benefits transferred, such as the rights to her find and the work of her hand} but from his hand to her hand, no.
And we deduce from it that whether according to Rav or according to Shmuel, they do not hold of Rabbi Eliezer's opinion.

ותנן נמי מאימתי יורש אדם את אשתו קטנה בית שמאי אומרים משתעמוד בקומתה ובית הלל אומרים משתכנס לחופה ורבי אליעזר אומר משתבעל
ותריצנא לדרבי אליעזר משתגדיל ותבעל וקמו להו בית שמאי וב"ה בחדא שיטתא דמעשה קטנה כלום ובעל יורשה והוה ליה רבי אליעזר יחיד במקום רבים
And we learn also: From what time does a man inherit his minor wife? Bet Shammai say: Once she stands in her height {=reaches puberty}. And Bet Hillel say: Once she enters the chuppa. And Rabbi Eliezer says: Once she has intercourse.
And we answer up for Rabbi Eliezer -- when she becomes an adult and has intercourse. And Bet Shammai and Bet Hillel stand in one position, that the act of a {female} child has some substance, and so her husband inherits her, and so Rabbi Eliezer is an individual against the many.

ותנן נמי בגיטין בפרק הניזקין העיד רבי יוחנן בן גודגדא על החרשת שהשיאה אביה שיוצאה בגט ועל קטנה בת ישראל שנשאת לכהן שאוכלת בתרומה ואם מתה בעלה יורשה
ושמעינן מהני כולהו דקטנה שלא מיאנה בעלה יורשה
וכן הלכה
And we learn also in Gittin, in perek haNizakin:
Rabbi Yochanan ben Godgada testified regarding a {female} deaf-mute whom her father married off that she goes free with a get, and regarding a {female} minor daughter of an Israelite who was married off to a kohen that she eats terma, and if she dies, her husband inherits her.
And we deduce from all of these that a {female} minor who did not refuse, her husband inherits from her.
And so is the halacha.
