Rif Yevamot 29b {Yevamot 93b - 94a; 92a}

29b

ואיתמר משמיה דרב יהודאי גאון ז"ל שומרת יבם שנשאת בלא חליצה אם אין לה בנים תצא מזה ומזה מבעל בגט ומיבם בחליצה ואסורה להם עולמית משום דמיחלפא באשה שהלך בעלה למד"ה
אבל אם נתקדשה ולא נשאת אם היה יבמה ישראל נותן לה המקדש גט ומותרת ליבם ולמי שקידשה אסורה לו עולמית כדי שלא יהא חוטא נשכר
נשאת והיו לה בנים אם היה בעלה ישראל חולץ היבם ויושבת תחת בעלה ואפוקי לא מפקינן לה דכיון דאשה שהלך בעלה למדינת הים ונשאת הולד ממזר מזה ומזה ואם אתה אומר תצא אתה מוציא לעז על בניה ואם היה בעלה כהן ויש לה בנים ממנו אינה חולצת אלא פורש ממנה ואסור לו לבא עליה כל ימיו של יבם ואם מת היבם מותרת לבעלה ואם מתו בניה בלא זרע בחיי היבם תצא מבעל בגט ומיבם בחליצה אלו הדברים שנאמרו רב יהודאי גאון ז"ל
And it was stated in the name of Rabbi Yehudai Gaon z"l as follows:
A woman waited for her levir {to perform yibbum or chalitza} who was married {to a stranger} without first having chalitza, if she has no children she should go out from this one and from that one -- from the husband with a get and from the levir with chalitza, and she is forbidden to them forever, for she can be confused with a woman whose husband went to an overseas country. However, if she was betrothed and not married, if the levir is an Israelite, the one who betrothed her can give her a get and she is permitted to the levir, while she is forbidden to the one who betrothed her forever, so that the sinner should not profit. If she married {fully} and she had children, then if her husband is an Israelite, the levir should perform chalitza and she should stay with her husband and not be sent out, for in the case of a woman whose husband went to an overseas country and she married, the child is a bastard from this one and from that one, and if you say she should go out, you are bringing out slander on her children.
And if her {new} husband is a kohen and she has children from him, she does not undergo chalitza {for a kohen is forbidden to a chalutza}, but rather he "separates" from her and is {thus} forbidden to have intercourse with her all the days of the levir, and if the levir dies, she is permitted to her husband. And if her children die without descendants in the life of the levir, she goes out from her husband with a get and from the levir with chalitza.
These are the words which were stated by Rav Yehudai Gaon z"l.

אמר רב זבידא מתניתין מסייעא ליה לר' יוחנן הכונס את יבמתו וצרתה נשאת לאחר ונמצאת זו אילונית תצא מזה ומזה ושלשה עשר דבר בה והא מתני' בשיש לה בנים היא דקתני והולד ממזר מזה ומזה שמעינן מינה דאפילו יש לה בנים
א"ר יוחנן תצא מדאמרינן מתני' מסייע ליה
ואסיקנא אלו דברי ר' מאיר שאמר משום רבי עקיבא רביה וחכמים אומרים אין ממזר ביבמה הא לצאת מזה ומזה דברי הכל תצא ואמר ר' יוחנן תצא
ר' יוסי שאל לרבי פינחס היך רבי סבר
א"ל כר' ירמיה דאמר זה חולץ וזה מקיים
אמר ליה חזור בך דאי לא כתיבנא עלך זקן ממרא
השתא דתניא לא אפרישו בין יש לה בנים לבין אין לה בנים אלא סתם שנינו תצא ורבי יוחנן אמר תצא מנא לן להתיר מספק ומסתברא דלא אמר רבי ירמיה זה חולץ וזה מקיים אלא בשיש לה בנים
וברור הוא אילין מילי דאשכחנן למקצת רבואתא ומילי דסברא נינהו דלא שבקינן תלמוד ערוך ואזלינן בתר סברא ודאי אי איתנהו להני מילי דמר רב יהודאי לא הוה שתיק גמרא מינייהו:
And there is one who said that these words are not to be relied upon, for they are not in our gemara, and furthermore, we learn in Talmud Yerushalmi in this place and in {Talmud Yerushalmi in} masechet Gittin in perek hazorek:
A yevama who is married {to a stranger} without chalitza {first} --
Rabbi Yirmeya said: This one performs chalitza and this one keeps her.
And Rabbi Yochanan said: She goes out.
And Tabbi Ila said: She goes out.
Rav Zevida said: Our Mishna {in Gittin} supports Rabbi Yochanan: "If one takes in {via yibbum} his yevama and her rival then marries another, and then it turns out that this one {that he performed yibbum upon} is an aylonit, she goes out from this one and that one, and there are thirteen matters about her."
And this Mishna is where she had children, for they teach {in that Mishna} "and the child is a bastard from this one and from that one." We deduce from this that even if she had children, Rabbi Yochanan said that she goes out, from the fact that we say that the Mishna supports him.
And we conclude: These are the words of Rabbi Meir who said it from Rabbi Akiva his teached. And the Sages say that there is no bastard by a yevama.
This implies that to go out from this one and from that one, all agree that she should go out. And Rabbi Akiva said that she should go out.
Rabbi Yossi asked Rabbi Pinchas: How does Rabbi {=Rabbi Pinchas} hold?
He said to him: Like Rabbi Yirmeyah, who said that this one performs yibbum and this one retains her.
He said to him: Retract, for it not I will write upon you that you are a Rebellious Elder.
Now that they have learnt that they do not distinguish between whether she has children or whether she does not have children, but rather we learned plainly {without specification} that she goes out, and Rabbi Yochanan said that she goes out, how can you permit because of doubt? And it makes sense that Rabbi Yirmeya only said that 'this one performs chalitza and this one retain her' where she had children.
And it is clear that these words that we find to a few of the {post-Talmudic} Rabbis are words of sevara {logic}, and we do not abandon an ordered Talmud and go after sevara. Certainly, if it had agreed to these words which Rav Yehudai stated, the gemara would not have remained silent and not stated it.

{Yevamot 93b}
בעו מיניה מרב ששת עד אחד ביבמה מהו
מי אמרינן טעמא דעד אחד משום מילתא דעבידא לאיגלויי לא משקר הכא נמי לא משקר
או דילמא טעמא דעד אחד משום דהיא גופה דייקא ומינסבא והכא זימנין דרחמא ליה לא דייקא ומינסבא מאי
ופשט רב ששת דעד אחד מהימן
They inquired of Rav Sheshet: A single witness for a yevama, what {is the law}?
Do we say that the reason a single witness {is believed} is because it in a matter that will eventually be revealed, he will not lie, so here too as well he will not lie? Or perhaps the reason for a single witness is that she herself will be careful about it {and make inquiries} and only then marry, and here there are are times that she loves him {the levir}, she will not make careful inquiry prior to marrying. What {is the law}?
And Rav Sheshet resolved that a single witness is believed.

איכא דאמרי הא לא תיבעי לך דאפילו היא נמי מהימנא דתנן האשה שאמרה מת בעלי תנשא מת בעלי תתיבם אלא כי קא מיבעיא לי למישרי יבמה לעלמא
ופשט רב ששת דמהימן
ורבא נמי פשט דעד אחד נמי נאמן ביבמה מקל וחומר לאיסור כרת התרתה לאיסור לאו לא כל שכן
Some {versions} say that this should not be a question to you, for even she is believed, for they learnt {in a Mishna}, "a woman who says 'my husband died' may marry and {who says} 'my husband died' may undergo yibbum." Rather, if you ask me, it is permitting to yevama to marry a stranger in the general world.
And Rav Sheshet resolved that he is believed.
{Yevamot 94a}
And Rava also resolved that a single witness is also believed by a yevama from a kal vachomer {inferred a minori ad majus} -- to a prohibition carrying a penalty of karet you permit her, to a prohibitory law, wouldn't you certainly?

וקאמרי רבואתא אע"ג דדחינן להא דרב ששת ולהא דרבא הנך דחיאתה לאו דסמכא נינהו אלא קיימא לן דעד אחד נאמן ביבמה כדפשט רב ששת וכדפשט רבא
וכן הילכתא
And the {post-Talmudic} Rabbis said that even though we reject this statement of Rav Sheshet and this of Rava, these rejections are not to be relied upon, but rather we establish that a single witness is believed by a yevama, as Rav Sheshet resolved and as Rava resolved.
And so is the halacha.

{Yevamot 92a}
Mishna:
אמרו לה מת בעליך ונתקדשה ואחר כך בא בעלה מותרת לחזור לו ואע"פ שנתן לה האחרון גט לא פסלה מן הכהונה זה מדרש דרש רבי אלעזר בן מתיא ואשה גרושה מאישה ולא מאיש שאינו אישה
If they said to her "Your husband has died" and she is betrothed {to another}, and afterwards her husband comes, she is permitted to return to him, and even if the latter one gave her a get, he does not invalidate her from marrying a kohen. This midrash Rabbi Eleazar ben Matia expounded: {Vayikra 21:7}
ז אִשָּׁה זֹנָה וַחֲלָלָה לֹא יִקָּחוּ, וְאִשָּׁה גְּרוּשָׁה מֵאִישָׁהּ לֹא יִקָּחוּ: כִּי-קָדֹשׁ הוּא, לֵאלֹהָיו. 7 They shall not take a woman that is a harlot, or profaned; neither shall they take a woman put away from her husband; for he is holy unto his God.
and not from a man who was not her husband.
