א"ר צדוק עד שפותחין לו בכבוד אביו ואמו יפתחו לו בכבוד המקום א"כ אין נדרים
ומודים חכמים לר"א בדבר שבינו לבין אביו ואמו שפותחין לו בכבוד אביו ואמו
RABBI ELIEZER SAYS: ONE MAY SUGGEST TO A MAN AS AN OPENING {FOR ABSOLUTION} THE HONOR OF HIS FATHER AND MOTHER, BUT THE SAGES FORBID.
RABBI TZADOK SAID: BEFORE SUGGESTING AN OPENING TO HIM OF THE HONOR OF HIS FATHER AND MOTHER, LET US SUGGEST THE HONOR OF THE OMNIPRESENT AS AN OPENING. IF SO, THERE ARE NO VOWS!
AND THE SAGES ADMIT TO RABBI ELIEZER BY A MATTER BETWEEN HIMSELF AND HIS FATHER AND HIS MOTHER THAT THEY SUGGEST FOR HIM AN OPENING BASED ON THE HONOR OF HIS FATHER AND HIS MOTHER.

What is meant by "there are no vows?"
Abaye said: If so, vows are not properly revoked.

Rava said: If so no one will seek a Sage's absolution for his vow.

We learn above, in the beginning of perek Arba'a Nedarim {=3rd perek of Nedarim, daf 22a}:
We do not suggest an opening based on that which Rabba bar bar Channa cited Rabbi Yochanan, "Rabban Gamliel suggested an opening to a certain old man:
{Mishlei 12:18}:
יח יֵשׁ בּוֹטֶה, כְּמַדְקְרוֹת חָרֶב; וּלְשׁוֹן חֲכָמִים מַרְפֵּא. 18 There is that speaketh like the piercings of a sword; but the tongue of the wise is health.
Anyone who speaks {a vow} is worthy of being pierced by the sword, but that the tongue of the wise {=absolution} health.
Nor to we suggest an opening in this other one. For they learnt {in a brayta}: Rabbi Natan says: Anyone who vows is as if he built a private altar, and one who fulfills it is as if he sacrificed an offering upon it.
In the first part {of the brayta} we do not suggest.
In the latter part:
Abaye said: We do suggest; Rava said: We do not suggest.
And the halacha is that we do not suggest, neither based on the former part nor based on the latter part.
And we do not suggest an opening as well from this that Shmuel said: Whoever vows is called an evildoer, even though he fulfills it.

HOW SO? IF HE SAID, 'KONAM THAT I BENEFIT NOT FROM SO AND SO,' AND HE [THE LATTER] THEN BECAME A SCRIBE, OR WAS ABOUT TO GIVE HIS SON IN MARRIAGE, AND HE DECLARED, 'HAD I KNOWN THAT HE WOULD BECOME A SCRIBE OR WAS ABOUT TO GIVE HIS SON IN MARRIAGE, I WOULD NOT HAVE VOWED;' [OR IF HE SAID,] 'KONAM, IF I ENTER NOT THIS HOUSE,' AND IT BECAME A SYNAGOGUE, AND HE DECLARED, HAD I KNOWN THAT IT WOULD BECOME A SYNAGOGUE, I WOULD NOT HAVE VOWED: R. דאמר רבה בר בר חנה א"ר יוחנן כל המשתמש בכתרה של תורה נעקר מן העולם
ק"ו מבלשצר ומה בלשצר שנשתמש בכלי קודש שנעשו חול שנאמר ובאו בה פריצים וחללוה כיון שבאו בה פריצים נעשו חול נעקר מן העולם
דכתיב ביה בלילא קטיל בלשצר
המשתמש בכתרה של תורה שהיא קיימת לעולם עאכ"ו
For Rabba bar bar Chana cited Rabbi Yochanan: Whoever makes use of the crown of Torah is uprooted from the world. As a kal vachomer from Belshatzar. If Belshatzar made use of the holy vessels which had become profane, as it stated {Yechezkel 7:22}:
כב וַהֲסִבּוֹתִי פָנַי מֵהֶם, וְחִלְּלוּ אֶת-צְפוּנִי; וּבָאוּ-בָהּ פָּרִיצִים, וְחִלְּלוּהָ
22 I will also turn My face from them, and they shall profane My secret place; and robbers shall enter into it, and profane it. {P}
-- thus, one robbers came, it was made profane. and yet he was uprooted from the world -- for it is written about him {Daniel 5:30}

ל בֵּהּ, בְּלֵילְיָא, קְטִיל, בֵּלְאשַׁצַּר מַלְכָּא כשדיא (כַשְׂדָּאָה). {פ} 30 In that night Belshazzar the Chaldean king was slain.
one who makes use of the crown of Torah, which endures forever, all the more so.

והאמר רבה שרי ליה לאינש לאודועי נפשיה באתרא דלא ידעין ליה
דכתיב ועבדך ירא את ה' מנעוריו
שאני ר"ט שהיה עשיר גדול דה"ל לפייסו בדמים.
But Rabba {our gemara: Rava} said: A person is permitted to make himself known in a place where they do not know him? For it is written {Melachim Aleph, 18:12}:
יב וְהָיָה אֲנִי אֵלֵךְ מֵאִתָּךְ, וְרוּחַ ה יִשָּׂאֲךָ עַל אֲשֶׁר לֹא-אֵדָע, וּבָאתִי לְהַגִּיד לְאַחְאָב וְלֹא יִמְצָאֲךָ, וַהֲרָגָנִי; וְעַבְדְּךָ יָרֵא אֶת-ה, מִנְּעֻרָי. 12 And it will come to pass, as soon as I am gone from thee, that the spirit of the LORD will carry thee whither I know not; and so when I come and tell Ahab, and he cannot find thee, he will slay me; but I thy servant fear the LORD from my youth.
{And this is Ovadiah speaking to Eliyahu, and since Eliyahu does not know who is he, is is informing him.}

Rabbi Tarfon was different, for he was very wealthy. For he should have pacified him with money.

ר"א בר' צדוק אומר עשה דברים לפועלם ודבר בהם בשמם ואל תעשה עטרה להתגדל בהם ולא קרדום להיות עודר בהם וקל וחומר מבלשצר כדלעיל.
Rabbi Eliezer beRabbi Tzaddok says: Do {good} deeds for their Maker {=for God who decreed them; alternatively, for the sake of doing them}, and speak of them {=words of Torah} for their own sake, and do not make them a crown to magnify yourself with, nor a spade to dig with. And we may draw a kal vachomer from Belshatzar, as above.

תנו רבנן לאהבה את ה' אלהיכם שלא יאמר אקרא שיקראוני חכם אשנה שיקראוני רבי אשנה שאהיה זקן ויושב בישיבה אלא למוד מאהבה וסוף הכבוד לבא שנאמר קשרם על אצבעותיך כתבם על לוח לבך ואומר קשרם על לבך תמיד ואומר דרכיה דרכי נועם וכל נתיבותיה שלום ואומר עץ חיים היא למחזיקים בה.
The Sages learnt {in a brayta}: {Devarim 30:20}:
כ לְאַהֲבָה אֶת-ה אֱלֹהֶיךָ, לִשְׁמֹעַ בְּקֹלוֹ וּלְדָבְקָה-בוֹ: כִּי הוּא חַיֶּיךָ, וְאֹרֶךְ יָמֶיךָ--לָשֶׁבֶת עַל-הָאֲדָמָה אֲשֶׁר נִשְׁבַּע ה לַאֲבֹתֶיךָ לְאַבְרָהָם לְיִצְחָק וּלְיַעֲקֹב, לָתֵת לָהֶם. {פ} 20 to love the LORD thy God, to hearken to His voice, and to cleave unto Him; for that is thy life, and the length of thy days; that thou mayest dwell in the land which the LORD swore unto thy fathers, to Abraham, to Isaac, and to Jacob, to give them. {P}

That one should not say "I will read Scripture that I may be called a Sage"; I will learn {perhaps Mishna, or Talmud} so that they will call me Rabbi. I will study, so that I will be an elder and sit in the yeshiva {assembly of elders}. Rather, one should learn out of love, and in the end, honor will come. For it is stated {Mishlei 7:3}
ג קָשְׁרֵם עַל-אֶצְבְּעֹתֶיךָ; כָּתְבֵם, עַל-לוּחַ לִבֶּךָ. 3 Bind them upon thy fingers, write them upon the table of thy heart.

and it says {Mishlei 6:21}:
כא קָשְׁרֵם עַל-לִבְּךָ תָמִיד; עָנְדֵם, עַל-גַּרְגְּרֹתֶךָ. 21 Bind them continually upon thy heart, tie them about thy neck.
and it says {Mishlei 3:17}:
יז דְּרָכֶיהָ דַרְכֵי-נֹעַם; וְכָל-נְתִיבוֹתֶיהָ שָׁלוֹם. 17 Her ways are ways of pleasantness, and all her paths are peace.
and it says {next verse}:
יח עֵץ-חַיִּים הִיא, לַמַּחֲזִיקִים בָּהּ; וְתֹמְכֶיהָ מְאֻשָּׁר. 18 She is a tree of life to them that lay hold upon her, and happy is every one that holdest her fast. {P}

אמר רבא שרי ליה לצורבא מרבנן למימר צורבא מרבנן אנא שרו לי תיגראי ברישא שנא' ובני דוד כהנים היו מה כה"ג נוטל חלק בראש אף ת"ח נוטל חלק בראש.
וכהן מנלן דכתיב וקדשתו כי את לחם אלהיך הוא מקריב ותנא דבי ר"י וקדשתו לכל דבר שבקדושה לפתוח ראשון ולברך ראשון וליטול מנה יפה ראשון.
Rava said: A Torah scholar is permitted to say "I am a Torah scholar, so attend to my business first." For it is stated {II Shmuel 8:18}:
יח וּבְנָיָהוּ, בֶּן-יְהוֹיָדָע, וְהַכְּרֵתִי, וְהַפְּלֵתִי; וּבְנֵי דָוִד, כֹּהֲנִים הָיוּ. {ס} 18 and Benaiah the son of Jehoiada was over the Cherethites and the Pelethites; and David's sons were chief ministers. {S}
Just as the High Priest {our gemara: just kohen} takes his portion first, so too a Torah scholar takes his portion first.
And the kohen, from where do we know? For it is written {Vayikra 21:8}
ח וְקִדַּשְׁתּוֹ--כִּי-אֶת-לֶחֶם אֱלֹהֶיךָ, הוּא מַקְרִיב; קָדֹשׁ, יִהְיֶה-לָּךְ--כִּי קָדוֹשׁ, אֲנִי ה מְקַדִּשְׁכֶם. 8 Thou shalt sanctify him therefore; for he offereth the bread of thy God; he shall be holy unto thee; for I the LORD, who sanctify you, am holy.
And they taught in the academy of Rabbi Yishmael:
{Nedarim 62b}
וְקִדַּשְׁתּוֹ -- for every matter of holiness: to commence {reading the Torah} first, to bless {before and after a meal} first, and to take a good portion first.

וא"ר אשי צורבא מרבנן שרי ליה למימר צורבא מרבנן אנא לא יהיבנא כרגא דכתיב מנדה בלו והלך לא שליט למרמי עליהון וא"ר יהודה מנדה זו מנת המלך בלו זו כסף גלגולתא והלך זו ארנונא.
And Rav Ashi said: A Torah scholar is permitted to say, "I am a Torah scholar, so I will not pay a poll-tax," for it is written {Ezra 7:24}:
כד וּלְכֹם מְהוֹדְעִין, דִּי כָל-כָּהֲנַיָּא וְלֵוָיֵא זַמָּרַיָּא תָרָעַיָּא נְתִינַיָּא, וּפָלְחֵי, בֵּית אֱלָהָא דְנָה--מִנְדָּה בְלוֹ וַהֲלָךְ, לָא שַׁלִּיט לְמִרְמֵא עֲלֵיהֹם. 24 Also we announce to you, that touching any of the priests and Levites, the singers, porters, Nethinim, or servants of this house of God, it shall not be lawful to impose tribute, impost, or toll, upon them.
And R' Yehuda said: מִנְדָּה -- this is the king's portion {of the crops}; בְלוֹ -- this is the head tax; הֲלָךְ -- this is arnona {produce tax}.

ואמר רבא שרי ליה לצורבא מרבנן למימר עבדא דנורא אנא ולא יהיבנא כרגא מ"ט לאברוחי אריא מיניה קאמר.
And Rava said: A Torah scholar is permitted to say, "I am a 'servant of fire,' and I will not give the poll tax." {To the Persians this would connote a fire-worshiper, who was exempt. But the Torah scholar might mean it otherwise.}
What is the reason?
Because it is {only} said in order to drive away a lion away from him.

רב אשי ה"ל ההוא אבא זבניה לנורא
א"ל רבינא לר"א והא איכא לפני עור לא תתן מכשול
א"ל רוב עצים להסקה ניתנו:
Rav Ashi had a forest which he sold for flame. {Our gemara: a fire-temple.}
Ravina said to Rav Ashi: But there is the injunction of "place not a stumbling-block before a blind man."
He said to him: Most wood is for heating {rather than idolatry}.

הכל לפי מקום הנודר:
תנא הנודר מן הקיץ בגליל וירד לעמקים אע"פ שהגיע הקיץ בעמקים אסור עד שיגיע הקיץ בגליל
"All is according to the location of the vower":
A tanna taught: One who vows off {until} the fruit-harvest while in Galilee and then descends to the valleys, even though the fruit-harvest has arrived in the valleys, he is forbidden until the fruit-harvest arrives in Galilee.

עד הגשמים עד שיהו גשמים עד שתרד רביעה שנייה
רשב"ג אומר עד שיגיע זמנה של רביעה
עד שיפסקו הגשמים עד שיצא ניסן כולו דברי ר"מ

[IF HE VOWS,] 'UNTIL THE RAINS,' [OR], 'UNTIL THE RAINS SHALL BE', [IT MEANS] UNTIL THE SECOND RAINFALL DESCENDS. {There are three periods of rainfall in Eretz Yisrael.}
R' Shimon ben Gamliel says: UNTIL THE [NORMAL] TIME FOR THE [FIRST] RAINFALL IS REACHED.

[IF HE VOWS,] 'UNTIL THE RAINS CEASE,' [IT MEANS] UNTIL THE END OF NISSAN: THESE ARE THE WORDS OF RABBI MEIR. RABBI YEHUDA SAYS: UNTIL PASSOVER IS PAST.

ואמרינן עלה כמאן אזלא הא דתניא רשב"ג אומר גשמים שירדו ז' ימים זא"ז אתה מונה רביעה ראשונה ושניה כמאן כר' יוסי ההיא דאמר עד הגשמים:
Rabbi Zera said: The dispute is where he said "until the rains," but if he said "until the rain," until the time of rain he meant. {Rashi: until the time of the first rain.}
{Nedarim 63a}
They objected: What is the time of the rainfall?The earliest is on the third {of Marcheshvan}; the middle one is on the seventh, and the last {אפילה} is on the 23rd. These are the words of Rabbi Meir. Rabbi Yehuda says: On the seventh, the seventeenth, and the twenty-third. Rabbi Yossi says: On the 17th, on the 23rd, and on Rosh Chodesh Kislev.
And so did Rabbi Yossi say: The individuals do not fast until Rosh Chodesh Kislev passes.
And we say: All is fine in terms of the first rain {period} to ask, and the third to fast. But the second, for what purpose?
And Rabbi Zera said: For one who vows.
And we said upon it: Like whom does this go, that we learnt {in a brayta}: R' Shimon ben Gamliel says: Rains which fell seven consecutive days, you count it as the first rain and the second?
Like whom? Like whom? Like Rabbi Yossi.
This is where he said, "until the rains." {rather than rain}

קונם יין שאני טועם כל השנה נתעברה השנה אסור בה ובעיבורה
עד ר"ח אדר עד ר"ח אדר הראשון עד סוף אדר עד סוף אדר ראשון
ר' יהודה אומר קונם יין שאני טועם עד הפסח אינו אסור אלא עד לילי פסח שלא נתכוון זה אלא עד שעה שבני אדם שותין יין אמר קונם בשר שאני טועם עד שיהא הצום אינו אסור אלא עד לילי הצום שלא נתכוון זה אלא לשעה שדרך בני אדם לאכול בשר

[IF HE VOWS,] 'KONAM THAT I TASTE NOT WINE FOR A YEAR', IF THE YEAR IS INTERCALATED, HE IS FORBIDDEN DURING THE YEAR AND ITS EXTENSION. [IF HE SAYS.] 'UNTIL THE BEGINNING OF ADAR,' [IT MEANS] UNTIL THE BEGINNING OF THE FIRST ADAR; 'UNTIL THE END OF ADAR,' UNTIL THE END OF THE FIRST ADAR.

RABBI YEHUDA SAYS: [IF ONE VOWS] 'KONAM THAT I TASTE NO WINE UNTIL PASSOVER SHALL BE,' HE IS FORBIDDEN ONLY UNTIL THE PASSOVER NIGHT, FOR HE MERELY MEANT, UNTIL THE EVENING OF PASSOVER, UNTIL THE HOUR WHEN MEN ARE WONT TO DRINK WINE.
IF HE SAID 'KONAM THAT I TASTE NO MEAT UNTIL THE FAST SHALL BE,' HE IS FORBIDDEN ONLY UNTIL THE EVE OF THE FAST {Yom Kippur}, FOR HE MERELY MEANT, UNTIL PEOPLE USUALLY EAT MEAT.

Rav Yirmeya said: At nightfall he must obtain absolution from a Sage.
What is the reason?
Rav Yosef said: As a decree for "today" because of "one day."

Ravina said: Meremar said to me: So did your father say to me in the name of Rav Yosef: In accordance with who does this statement of Rav Yirmeyah bar Abba go? Like Rabbi Natan. For Rabbi Natan said: One who vows is as if he built a private altar, and one who keeps it {=the vow} is as if he sacrificed a sacrifice upon it {our gemara: offered incense}.

This is obvious!
I would have said that he meant the {week-}days of the week. Therefore it informs us.

This is obvious!
No, it is necessary, for a deficient month {with 29 days}. I would have said that the new month belongs to the past. Therefore it informs us that behold, people call it the beginning of the month.

Is that to say that Rabbi Meir holds that a man does not place himself {Nedarim 61b} in a doubtful position, while Rabbi Yossi holds that he does place himself in a doubtful position?
But this contradicts it: If a man has two groups of daughters by two wives, and he declares, 'I have given one of my elder daughters in betrothal, but do not know whether it was the eldest of the senior group or of the junior group, or the youngest of the senior group, who is older than the eldest of the junior group': they are all forbidden, except the youngest of the junior group. These are the words of Rabbi Meir. Rabbi Yossi says: They are all permitted except the eldest of the senior group.

A tanna taught: The basket referred to is the basket of figs, not of grapes.

They learnt {in a brayta}: He who vows [abstinence] from summer fruits, is forbidden only figs.
R' Shimon ben Gamliel says: Grapes are included in figs.

What is the reason of the first Tanna? He holds that figs are plucked off by hand, while grapes are not plucked off by hand.
And R' Shimon ben Gamliel held that grapes too are plucked off by hand when quite ripe.

A tanna taught: If most of the knives have been put away, they {the remaining figs} are permitted {to strangers} as far as theft is concerned, and are exempt from tithes.

Rabbi Tarfon was found by a man eating {of the figs} when most of the knives had been folded, {whereupon} he threw him into a sack and carried him, to cast him in the river.
He {=Rabbi Tarfon} said: Woe to Tarfon, that this one is killing him.
This man heard him, abandoned him, and fled.

Rabbi Abahu said in the name of Rabbi Chanina ben Gamliel: All the days of this righteous man {=Rabbi Tarfon}, he was aggrieved over this matter, and said "Woe to me, for I made use of the crown of Torah."

Yishmael, resident of Kefar Yama, and some say, of Kefar Dima, brought in his hands {or perhaps idiomatically, propounded} an onion which was uprooted in the 7th year {shemitta} and planted in the 8th, and its growth was more than its stock, and this was his question:
Its growth is permitted and its stock is forbidden, and since the growth was more than its stock, the permitted growth comes and removes the prohibition, or no?
He came before Rabbi Ammi, and he {=Rabbi Ami} did not have it {=the answer} in his hand.
He came before Rabbi Yitzchak Nafcha {=the smith}, who resolved it for him from this that Rabbi Chanina of Torata said citing Rabbi Yannai: An onion of teruma which was planted, and its growth was more than its stock, it is permitted.
Rabbi Yirmeya, and some say, Rabbi Zerika, said to him: Is master abandoning two and acting like one?

מאן נינהו תרין דאמר רבי אבהו אמר רבי יוחנן ילדה שסבכה בזקנה ובה פירות אע"פ שהוסיפה מאתים אסור
ואמר רבי שמעון בר נחמני אמר ר' ינאי בצל שנטעו בכרם ונעקר הכרם אסור
Who are these two? For Rabbi Abahu cited Rabbi Yochanan: If a young tree {=less than 3 years old, such that its fruit is orlah} already with fruit is grafted on an old one, even if it multiplies two hundredfold, it {the original fruit} is forbidden.
And Rabbi Shimon {our gemara: Shmuel} bar Nachmani cited Rabbi Yannai: If an onion is planted in a vineyard and the vineyard is {subsequently} removed, it {=the onion} is forbidden.

He once again came before Rabbi Ammi, and he {=Rabbi Ami} resolved it for him from this, which Rabbi Yitzchak cited Rabbi Yochanan: If a litra {=a roman pound} of onions of onions was tithed and then planted, the whole of it must be re-tithed. Thus it is clear that the yield nullifies the stock.
Perhaps stringently is different.
Rather, he resolved it from here {or: rather, resolve it from here}: For they learnt {in a brayta}: Rabbi Shimon says:
{Nedarim 58a}
For everything [forbidden] which can become permitted, such as tevel, second tithe, hekdesh, and chadash Sages declared no limit {at which point nullification happens, since it is possible to remove the prohibition}. But for everything which cannot become permitted, such as terumah, the terumah of the tithe, challah, orlah, and kil'ayim of the vineyard, the Sages declared a limit.
They said to him {=to Rabbi Shimon}: But seventh year produce cannot become permitted, yet the Sages set no limit to it.
For we learn {in a Mishna}: Seventh year produce of no matter what quality renders its own kind forbidden!
He said to him {should be to them}: I too, only said this in respect of removal, but as for eating, {it renders it forbidden} only if sufficient to impart its taste thereto.
But perhaps this too is because it is stringent {in terms of the nullification}.
Rather from here, etc.
And they conclude that permitted yield lifts out the prohibition, even for something that its seed does not perish, and even if it is not crushed with a mortar, and even if not via a mixture.

And we ask: Let us say this is a refutation of Rabbi Yochanan and Rabbi Yonatan.
Rabbi Yitzchak said: The Sabbatical year is different; since the prohibition is through the ground, its nullification too is through the ground.
But the prohibition of the tithe is likewise through the soil {by replanting}, yet it is not nullified by the soil.
For they learnt {in a brayta}: If a litra of tithe, itself tebel, is sown in the soil and it improves [= increases}, and is the equivalent of ten litras, it {=all of it} is liable to tithe and the Sabbatical year, while for the {original} litra, a tithe thereof must be separated from elsewhere, according to calculation.

{Nedarim 59a}
Say: The tithe obligation, it is the the storing up {of the grain} which causes it.

Rami bar Chama objected: "'KONAM BE THESE FRUITS TO ME, 'BE THEY KONAM FOR MY MOUTH, OR 'BE THEY KONAM TO MY MOUTH,' HE IS FORBIDDEN [TO BENEFIT] FROM WHAT IS EXCHANGED FOR THEM, OR WHAT GROWS FROM THEM, [etc.,] IN A THING OF WHICH THE SEED ITSELF PERISHES; BUT IF THE SEED DOES NOT PERISH, EVEN THAT WHICH GROWS OF THAT WHICH [FIRST] GREW FROM IT IS FORBIDDEN."
Konamot {=vows expressed by "konam"} are different, for since if he wishes, he can ask absolution on it, it is like something which has a way of becoming permitted, and it is not nullified in the majority.
But there is teruma, that if he wants he can ask absolution {if he declared it teruma in error} and
yet it is nullified in a majority?


אלא שאני קונמות דמצוה לאתשולי עליה משום דר' נתן
דאמר רבי נתן כל הנודר כאילו בנה במה והמקיימו כאילו הקריב עליה קרבן אבל תרומה מאי מצוה איכא לאתשולי עלה:
Rather, konamot are different because it is a precept to ask absolution on them, because of Rabbi Natan. For Rabbi Natan said: Anyone who vows is as if he built a private altar, and one who fulfills it is as if he sacrificed upon it an offering. But terumah, what precept is there to ask absolution upon it?

We learn earlier, in perek haShutfin {perek 5, Nedarim 47a}:
Rami bar Chama inquired: If he vows, 'Konam be these fruits to (* my mouth *) [ So-and-so'], what of their exchange? Do we say, With respect to oneself, since he can forbid to himself {even} his neighbour's property, he can {likewise} forbid to himself what is not yet in existence; but as for his neighbour, since one cannot prohibit another's produce to his neighbour, he likewise cannot prohibit what is non-existent.

Or perhaps, since what is taken in exchange is the same as what grows from its seed, there is no difference between oneself and his neighbor?

Rav Acha bar Minyumi said: Come and hear: If a man says to his wife, 'Konam, if I benefit thee,' she may borrow {money}, and the creditors come and exact it from him.
What is the reason that the creditors may come and extract it from him? Is it not because exchange is not like what grows from them?
Rava said to him: Perhaps it is ab initio, but after the fact, it has been done?
Come and hear: If a man betroths {a woman} with orlah or the forbidden mixtures of the vineyard, she is not betrothed. But if he sells it and betroths her with the money thereof, she is betrothed.
Here as well, it is ab initio that no, but after the fact, he has done.

ONE WHO VOWS [NOT TO BENEFIT] FROM A HOUSE IS PERMITTED THE UPPER STORY. {Our gemara: These are the words of Rabbi Meir.}
AND THE SAGES SAY: THE UPPER STOREY IS INCLUDED IN 'HOUSE'.
HE WHO VOWS [NOT TO HAVE THE USE OF] THE UPPER STORY IS PERMITTED [THE USE OF] THE HOUSE.

Gemara:
כמאן אזלא הא דאמר רב הונא בר חייא משמיה דעולא בית בביתי אני מוכר לך מראהו עלייה

In accordance with whom is that which Rav Huna bar Chiyya said in the name of Ulla? "a house within my house I sell to you?,' he can give him an upper story."
Let us say it is Rabbi Meir.
One might even say it is the Sages. What is an "aliyah?" The "best" of the assets.

From where do we know that the outskirts of the town are like the town?
Rabbi Yochanan said: The verse stated {Yehoshua 5:13}:
יג וַיְהִי, בִּהְיוֹת יְהוֹשֻׁעַ בִּירִיחוֹ, וַיִּשָּׂא עֵינָיו וַיַּרְא, וְהִנֵּה-אִישׁ עֹמֵד לְנֶגְדּוֹ וְחַרְבּוֹ שְׁלוּפָה בְּיָדוֹ; וַיֵּלֶךְ יְהוֹשֻׁעַ אֵלָיו וַיֹּאמֶר לוֹ, הֲלָנוּ אַתָּה אִם-לְצָרֵינוּ. 13 And it came to pass, when Joshua was by {lit. in} Jericho, that he lifted up his eyes and looked, and, behold, there stood a man over against him with his sword drawn in his hand; and Joshua went unto him, and said unto him: 'Art thou for us, or for our adversaries?'

Now is it possible to say so? But it is written {Yehoshua 6:1}:
א וִירִיחוֹ סֹגֶרֶת וּמְסֻגֶּרֶת, מִפְּנֵי בְּנֵי יִשְׂרָאֵל: אֵין יוֹצֵא, וְאֵין בָּא. {ס} 1 Now Jericho was straitly shut up because of the children of Israel: none went out, and none came in.-- {S}
Rather, it was in the outskirts of the city.
And say it was in its techum?
The verse states {Bemidbar 35:5}
ה וּמַדֹּתֶם מִחוּץ לָעִיר, אֶת-פְּאַת-קֵדְמָה אַלְפַּיִם בָּאַמָּה וְאֶת-פְּאַת-נֶגֶב אַלְפַּיִם בָּאַמָּה וְאֶת-פְּאַת-יָם אַלְפַּיִם בָּאַמָּה וְאֵת פְּאַת צָפוֹן אַלְפַּיִם בָּאַמָּה--וְהָעִיר בַּתָּוֶךְ; זֶה יִהְיֶה לָהֶם, מִגְרְשֵׁי הֶעָרִים. 5 And ye shall measure without the city for the east side two thousand cubits, and for the south side two thousand cubits, and for the west side two thousand cubits, and for the north side two thousand cubits, the city being in the midst. Rabbi Yochanan said: All admit by one who vowed off tevuah that he is only forbidden the five species.
This is obvious!
I would have said that tevuah implies all matters. Therefore it informs us.
A brayta also says so: And they are alike in that one who vows off tevuah is only forbidden the five species.

The son of Mar Shmuel ordered that thirteen thousand zuz worth of alalta {=the Aramaic equivalent of tevuah} from Nehar Pekod {our gemara: Nehar Pania} should be given to Rava. Rava sent to Rav Yosef: What is called alalta?
Rav Yosef said: It is a brayta: And they are alike that if one vows off tevuah, he is only forbidden the five species {of grain}.
Abaye said to him: Is it really comparable? Tevuah only implies the five species. Alalta implies everything.
This returned to before Rava.
He said: This I was not inquiring, whether alalta implied everything. What was a question to me? The rent for houses and the hire of ships. What {is the law}?
Do we say that since they depreciate, they are not alalta. Or perhaps, since their depreciation is not known {perceptible?}, it is alalta?
This was told over before Rav Yosed. He became upset and said, "if he does not require us, why did he send to us?"

{Nedarim 55b}
תניא הנודר מן הדגן אסור אף בפול המצרי יבש ומותר בלח ומותר באורז ובחלקא ובטרגיס ובטיסנא
הנודר מפירות השנה אסור בכל פירות השנה ומותר בגדיים וטלאים ובחלב ובביצים ובגוזלות ואם אמר גידולי השנה עלי אסור בכולן
הנודר מפירות הארץ אסור בכל פירות הארץ ומותר בכמהין ופטריות ואם אמר גידולי קרקע עלי אסור בכולן:
They learnt {in a brayta}: If one vowed off dagan {grain}, he is forbidden even dry Egyptian beans, and he permitted the moist ones, and is permitted rice, grist, groats, and pearl-barley.
One who vowed off fruits of that year, he is forbidden all the fruits of that year, and is permitted goats, lambs, milk, eggs, fledgling chicks. And if he said "that which grows this year upon me," he is forbidden all of them. One who vowed off the fruits of the earth, he is forbidden all the fruits of the earth, but is permitted mushrooms and truffles. And if he said "the growth of the earth upon me," he is forbidden all of them.

They learnt {in a Mishna} there, in perek bechol meArvin: One who vows off food {mazon}, he is permitted milk and salt.
It is water and salt which are not called mazon, but all else is called mazon! Let us say that this is a refutation of Rav and Shmuel, for both of them say that we do not make the blessing of mezonot except upon the five species {of grain}.
Rav Huna said: {The case in the Mishna is} where he said "all that nourishes {zan} upon me."

IF HE SAYS, 'KONAM, IF WOOL COMES UPON ME,' HE MAY COVER HIMSELF WITH WOOL FLEECES;
[KONAM] IF FLAX COMES UPON ME', HE MAY COVER HIMSELF WITH FLAX BUNDLES.
RABBI YEHUDAH SAYS: IT ALL DEPENDS UPON THE PERSON WHO VOWS, [THUS:] IF HE IS LADEN [WITH WOOL OR FLAX] AND PERSPIRES AND HIS ODOUR IS OPPRESSIVE, AND HE VOWS 'KONAM' IF WOOL OR FLAX COME UPON ME,' HE MAY WEAR THEM, BUT NOT THROW THEM [AS A BUNDLE] OVER HIS BACK.

The Sages learnt {in a brayta}: He who vows [not to benefit] from garments is permitted sack-cloth, curtain, and blanket wrapping. But he is forbidden a belt, fascia, scortea, a leather spread, shoes, knee breeches breeches and a hat.

What is a scortea?
Rabbah bar bar Chana said: a leather coat.

תנא יוצאין בשק עבה ובסגוס עבה וביריעה ובחמילה מפני הגשמים
אבל לא בקופה ולא במחצלת מפני הגשמים
הרועים יוצאים בשקים
ולא רועים בלבד אלא אף כל אדם שדברו חכמים בהוה
A tanna taught: One may go out {on Shabbat} wearing a thick sack-cloth, a coarse blanket, a curtain, and a blanket wrap, to keep off the rain; but not with a box, basket or matting to keep off the rain.
Shepherds may go out with sacks.
Not only shepherds, but all men, but that the Sages spoke of what is usual.
ר' יהודה אומר כו'.
תניא כיצד אמר רבי יהודה הכל לפי הנודר היה לבוש צמר והיצר ואמר קונם צמר עולה עלי אסור ללבוש ומותר לטעון היה טעון פשתן והזיע ואמר קונם פשתן עולה עלי מותר ללבוש ואסור לטעון
"RABBI YEHUDAH SAYS...":
They learnt {in a brayta}: How did Rabbi Yehuda say that all depends upon the person who vows? If he is wearing wool, and he is irritated and he vows 'Konam, if wool comes upon me,' he is forbidden to wear, but permitted to carry it; if he is laden with flax and perspires and vows, 'Konam, if flax comes upon me, he may wear but must not carry it.

'[Konam,] if I taste chittim,' he may not chew them raw, but if baked, they are permitted;
'If I taste chittah, chittim', he may neither eat them baked nor chew them raw.
[If he says. 'Konam,] if I taste geris', it is forbidden cooked, but may be chewed [raw];
'[Konam], if I taste gerrissin', he is forbidden raw but permitted cooked.
'[Konam], if I taste geris, gerrissin', he is forbidden either to chew them raw or eat them cooked.

HE WHO VOWS [TO ABSTAIN] FROM VEGETABLES IS PERMITTED GOURDS. R. AKIBA FORBIDS THEM. THE [SAGES] SAID TO HIM, BUT WHEN A MAN SAYS TO HIS AGENT 'FETCH ME VEGETABLES, HE REPLIES, I COULD OBTAIN ONLY GOURDS. HE ANSWERED, EXACTLY: BUT WOULD HE SAY, 'I COULD OBTAIN ONLY PULSE?' BUT THAT GOURDS ARE INCLUDED IN VEGETABLES, WHILST PULSE IS [DEFINITELY] NOT. HE IS [ALSO] FORBIDDEN FRESH EGYPTIAN BEANS. BUT PERMITTED THE DRY [SPECIES].

But he vowed [to abstain] from vegetables!
Ulla said: This refers to one who vows. 'Vegetables that are cooked in a pot [he forbidden] to me.'

In what do they argue?
The Sages maintain that whatever an agent must inquire about does not belong to the same species; but Rabbi Akiva maintains, Whatever the agent needs inquire about is of the same species.

And Rabbi Akiva admits in respect to punishment that he is not flagellated.

{Nedarim 54b}

Who is the Tanna who argues upon Rabbi Akiva? It is R' Shimon ben Gamliel.
For they learnt {in a brayta}: He who vows [to abstain] from meat, is forbidden every kind of meat; he is also forbidden the head, feet, windpipe, liver, heart, and fowl; but he is permitted the flesh of fish and locusts.
R' Shimon ben Gamliel says: He who vows [to abstain] from meat is forbidden every kind of meat, but permitted the head, feet, windpipe, liver, heart and fowl, and it is superfluous to mention the flesh of fish and locusts.
And thus R' Shimon ben Gamliel used to say: The entrails are not meat, and he who eats them is no man.

{Nedarim 55a}
Mishna:

But the Sages are identical with the first Tanna? They differ in respect of the following which was taught {in a brayta}: Rabbi Shimon ben Eleazar said the following general rule: Whatever is eaten itself, and what comes from it too is eaten, such as dates and the honey of dates, and he vowed [abstinence] from the substance itself, he is forbidden that which comes from it; but if he vows [abstinence] from what comes from it, he is also forbidden the substance itself.
But if the substance is not eaten itself, whilst what comes from it is eaten, and he vowed [abstinence] from the substance, he is forbidden only what comes from it, because he only meant that which comes from it.

In a place where they are both commonly used, he is forbidden in this and that.
This is obvious!
No, it is necessary, for where the majority is taken from one of them. I would have said that we should go after the majority. Therefore it informs us that by doubt of prohibition, we rule stringently.

Regarding "these," do not ask us whether it is specific.
Where should you ask us? Regarding "that I taste; and that I eat." Is it specific or not?
Come and hear: Dag {masculine singular for fish}, Dagim {masculine plural for fish} that I eat (* of them *), he is forbidden, whether large or small, whether raw or cooked, and he is permitted hashed terith and brine.
Rava said: And this is where they already left them {=the brine left fish before the vow}.

Gemara:

They learnt {in a brayta}: Rabbi Yoshia forbade roasted. And even though there is no proof to the matter, there is an indication of the matter, for it is stated II Divrei Hayamim 35:13:
יג וַיְבַשְּׁלוּ הַפֶּסַח בָּאֵשׁ, כַּמִּשְׁפָּט; וְהַקֳּדָשִׁים בִּשְּׁלוּ, בַּסִּירוֹת וּבַדְּוָדִים וּבַצֵּלָחוֹת, וַיָּרִיצוּ, לְכָל-בְּנֵי הָעָם. 13 And they roasted the passover with fire according to the ordinance; and the holy offerings sod they in pots, and in caldrons, and in pans, and carried them quickly to all the children of the people.
{and note that it states וַיְבַשְּׁלוּ but what is meant is that they roasted it.}

Let us say that they argue in respect to the following: Rabbi Yoshiya holds that we go after the language of the Torah {in interpreting vows} and the Sages hold that in vows, we go after the language of people.
No. Really everyone holds that by vows we go after the language of people, and each one is following the pattern of his place. In the place of our Tanna, they call roasted roasted and seethed seethed. And in the place of Rabbi Yoshiya, they even call roasted seethed.
But he took a verse {as proof}!
The verse is a mere asmachta {support}.

קונם תבשיל שאני טועם כו':
והא מתבשיל נדר
אמר אביי האי תנא כל מידי דמתאכיל ביה רפתא תבשיל קרי ליה

But he vowed from a cooked dish {which would include solidly prepared}!
Abaye said: For this Tanna, anything which can be eaten with bread is called a tavshil. {And this excludes solidly prepared.}
A brayta also says so: One who vowed from a tavshil is forbidden all types of cooked dishes, and is forbidden roasted, seethed, and boiled. And he is forbidden soft preserves with which the sick eat their bread.

They learnt {in a brayta}: One who vowed from that which descends into a boiling pot is forbidden that which descends into a stew-pot, for it already descended into a boiling pot before it descended into the stew-pot.
{If he vowed} From what descends into the stew-pot, he is permitted that which descended into the boiling pot.
From that which is made in a boiling pot, he is permitted that which was made in the stew-pot. From that which is made in the stew pot, he is permitted that which was made in the boiling pot.
One who vowed from that which descends into the oven, he is only forbidden bread. If he said "everything made in an oven is forbidden upon me," he is forbidden all that is made in an oven.

They learnt {in a brayta}: Rabbi Shumon ben Eleazar said: {One who said Konam} fish, fishes {but specifically dag, dagim, the masculine singular and plural} that I taste, he is forbidden large ones and permitted small ones.
Daga {feminine singular, used in the collective sense} that I taste, he is forbidden the small ones and permitted the large ones.
Dag, Daga that I taste, he is forbidden both large and small.

For the language of people is that dag {masculine} connotes large and daga {feminine} connotes small.
But now, {Shemot 7:21}:
כא וְהַדָּגָה אֲשֶׁר-בַּיְאֹר מֵתָה, וַיִּבְאַשׁ הַיְאֹר, וְלֹא-יָכְלוּ מִצְרַיִם, לִשְׁתּוֹת מַיִם מִן-הַיְאֹר; וַיְהִי הַדָּם, בְּכָל-אֶרֶץ מִצְרָיִם 21 And the fish that were in the river died; and the river became foul, and the Egyptians could not drink water from the river; and the blood was throughout all the land of Egypt.
Now did the small ones die and the large ones not die? Rather, daga implies both large and small, and in vows we go after the language of people.

One who vowed off cheese is permitted milk; from milk is permitted cheese. From broth, he is permitted sediments of boiled meat; from sediments of boiled meat, he is permitted broth.
If he said, "the meat upon me {is forbidden}," he is forbidden it, its broth, and its sediments.

There was a certain man who had a son who used to carry off bundles of flax. Thereupon his father forbade his property to him. They said to him, "But what if the son of your son is a scholar?" He said to them, "Let him acquire it, and if my grandson be a scholar, it shall be his."

Those {scholars} of Pumbedita said: This is acquisition in order to give over possession, and any acquisition in order to give over possession is not effective.
And Rav Nachman said: Acquisition in order to give over possession is not effective.
For this kerchief {=chalipin} is an acquisition in order to give over possession, and it is a valid acquistion.
Rav Ashi said: And who told us that the kerchief, if he held on to it, it is not now his? And furthermore, a kerchief is a case of "acquire now in order to give over possession from now," and it is {thus} a valid acquisition. But these assets of this person, when will he acquire them? When his grandson is a Torah scholar, the kerchief will have already been returned to its owner.

Rava said to Rav Nachman: But the gift of Bet Choron was a case of acquisition in order to give over possession, and it was not a valid acquistion.
Sometimes he {=Rav Nachman} said to him: The feast proves his intent.
And sometimes he said to him: It is Rabbi Eliezer, who said that even extra {given by a vendor to a customer} is forbidden to one forbidden benefit by vow.

"'KONAM, IF I ENTER YOUR HOUSE'...":
Avimi inquired: {What if one says to his neighbour,} 'Konam, if you enter this house,' and then he sells it or dies: Can one prohibit that which he owns {for the prohibition} to be effective even when it leaves his ownership, or not?

Come and hear: One who said to him son, "konam that you benefit from me." If he dies, he inherits him. But if he specified in his life and in his death, then if he dies, he does not inherit him.

We derive from this that a man may forbid {upon another} something which is in his domain for when it leaves his domain. We so deduce from this.

{Nedarim 48a}
ואין לו מה יאכל כו'.
אמר רבא לא תימא טעמא דאמר ואינן לפניך אבל אמר לו הן לפניך ויבא אבא ויאכל שרי אלא אפילו אמר הן לפניך נמי אסור מ"ט סעודתו מוכחת עליו
"And he has nothing to eat...":
Rava said: Do not say that the reason is that he said, "and they are not before you," but if he said to him, "they are before you, and father will come and eat," it is permitted. Rather, even if he said "they are before you," they would also be forbidden.
What is the reason? Because the banquet proves his intention.

Rabba cited Ze'eira: {Nedarim 46b} The dispute is where there is in it {=the courtyard} enough to have a division, but if there is not in it enough to have a division, all agree it is forbidden. {our gemara actually has "permitted," but Rav Yosef citing Ze'eira that all agree it is forbidden.}
Rav Huna said: The halacha is like Rabbi Eliezer ben Yaakov.
And so did Rabbi Eliezer say: The halacha is like Rabbi Eliezer ben Yaakov.

מעשה באחד בבית חורון שהיה אביו מודר הימנו הנאה והיה משיא לבנו אשה ואמר לחברו הרי החצר והסעודה נתונין לך במתנה ואינם לפניך שיבא אבא ויאכל עמנו בסעודה
אמר אם שלי הם הרי הן מוקדשין לשמים
אמר ליה לא נתתי לך את שלי שתקדישם לשמים
אמר ליה לא נתת לי את שלך אלא כדי שתהא אתה ואביך אוכלין ושותין ומתרצין זה לזה ויהא העון תלוי בראשי
וכשבא מעשה לפני חכמים אמרו כל מתנה שאינה אם הקדישה אינה מקודשת אינה מתנה
IF ONE IS FORBIDDEN BY VOW TO BENEFIT FROM HIS NEIGHBOR AND HAS NOTHING TO EAT, THE LATTER CAN GIVE IT [FOOD] TO A THIRD PARTY, AND THE FORMER IS PERMITTED TO USE IT.
IT HAPPENED TO SOMEONE IN BETH CHORON THAT HIS FATHER WAS FORBIDDEN TO BENEFIT FROM HIM. NOW HE [THE SON] WAS GIVING HIS SON IN MARRIAGE; SO HE SAID TO HIS NEIGHBOUR, 'THE COURTYARD AND THE BANQUET BE A GIFT TO YOU, BUT THEY ARE YOURS ONLY THAT MY FATHER MAY COME AND FEAST WITH US AT THE BANQUET. THEREUPON HE ANSWERED, 'IF THEY ARE MINE, LET THEM BE CONSECRATED TO HEAVEN!' 'BUT I DID NOT GIVE YOU MY PROPERTY TO CONSECRATE IT TO HEAVEN, HE PROTESTED. YOU GAVE ME YOURS SO THAT YOU AND YOUR FATHER MIGHT EAT AND DRINK TOGETHER AND BECOME RECONCILED TO ONE ANOTHER, WHILST THE SIN [OF A BROKEN VOW] SHOULD DEVOLVE UPON HIS HEAD,' HE RETORTED. [WHEN THE MATTER CAME BEFORE] THE SAGES, THEY RULED: EVERY GIFT WHICH IS NOT [SO GIVEN] THAT IF HE [THE RECIPIENT] CONSECRATES IT, IT IS CONSECRATED, IS NO GIFT [AT ALL].

Rav Nachman said: A half, third, or a quarter, but not less.
Abaye said: Even for less, he is forbidden.
And in what situation is he permitted? If he {the lessee} rents it in return for {the payment of} the land-tax.

Rif Nedarim 14b {43b; 45a - 46a}

14b

{Nedarim 43b}

תניא המפקיר שדהו כל שלשה ימים יכול לחזור בו מכאן ואילך אינו יכול לחזור בו

They learnt {in a brayta}: One who declares his field hefker {ownerless}, all the first three days he is able to retract. From then on, he is not able to retract.

{Nedarim 45a}
אמר רבי יוחנן משום רבי שמעון בן יהוצדק המפקיר בפני שלשה הוי הפקר בפני שנים לא הוי הפקר
ומאי טעמא אמרו בפני שלשה כדי שיהא אחד זוכה ושנים מעידין
Rabbi Yochanan said in the name of Rabbi Shimon ben Yehotzadak: One who declares something hefker before three people, it is hefker. Before two, it is not hefker.
And for what reason did they say "before three?" So that one would {be able to} take possession and two would testify.

If partners vowed off benefit, one from the other, they are forbidden from entering the {shared} courtyard.
Rabbi Eliezer ben Yaakov says: This one can enter his and this one may enter his; {Nedarim 46a} and both are forbidden to set up a mill-stone or an oven, or to breed fowl therein.

IF A MAN FROM THE STREET WAS FORBIDDEN BY VOW TO BENEFIT FROM ONE OF THEM, HE MAY NOT ENTER THE COURTYARD.
RABBI ELIEZER BEN YAAKOV SAYS: HE CAN MAINTAIN, 'I AM ENTERING INTO YOUR FELLOW'S, AND I AM NOT ENTERING INTO YOURS.'

Gemara:
איבעיא להו בנדרו פליגי הדירו מאי
מי אמרינן בנדרו הוא דפליגי רבנן אבל בהדירו זה את זה מודו ליה רבנן לר' אליעזר בן יעקב דכי אנוסין דמי
או דלמא אפילו בהדירו זה את זה פליגי נמי רבנן
It was a question to them: Where it was there own vow {which they imposed upon themselves} is the argument. Where each imposed the vow on his fellow {partner}, what {is the law}?
Do we say that it was in his own vow that the Sages argued, but where he imposed the vow {on his partner}, the Sages would admit to Rabbi Eliezer ben Yaakov, for they are involuntarily prohibited? Or perhaps, even where each imposed the vow on the other, the Sages would also argue?

הכי נמי מסתברא מדקתני סיפא וכופין את הנודר למכור חלקו ואי אמרת דאדריה אמאי כופין והא מינס אניס
Come and hear: "If {only}one of them was forbidden in benefit from his fellow," and still the Sages argue!
Read instead "vowed off benefit from his friend."
This is also logical, from the fact that they teach in the sefa, "and they force the one who vowed to sell his portion." And if you say that the vow was imposed upon him, why do they force him? He was involuntarily prohibited!

נדר הימנו מאכל לפני שביעית יורד לתוך שדהו ואינו אוכל מן הפירות ובשביעית יורד ואוכל:
IF HE WAS [MERELY] FORBIDDEN IN RESPECT OF FOOD [BUT NOT ALL BENEFIT], [AND THE VOW WAS IMPOSED] BEFORE THE SEVENTH YEAR, HE MAY ENTER HIS FIELD, BUT MAY NOT EAT OF ITS FRUITS; BUT [IF IT WAS IMPOSED] IN THE SEVENTH YEAR, HE MAY ENTER [HIS FIELD] AND EAT [OF ITS FRUITS].

המודר הנאה מחברו לא ישאילנו ולא ישאל ממנו לא ילונו ולא ילוה ממנו לא ימכור לו ולא יקח ממנו:

אמר קונם שדי שאני חורש בה לעולם אם היה דרכו לחרוש הוא אסור ואחרים מותרין
ואם אין דרכו לחרוש הוא וכל אדם אסורין
IF ONE SAYS TO ANOTHER, 'LEND ME YOUR COW, TO WHICH THE OTHER REPLIES, 'IT IS NOT FREE'; WHEREUPON HE EXCLAIMS, 'KONAM, IF I EVER PLOW MY FIELD WITH IT', IF HE GENERALLY PLOWED HIMSELF, HE IS FORBIDDEN, BUT OTHERS ARE PERMITTED.
BUT IF HE DID NOT GENERALLY PLOW HIMSELF, HE AND ALL MEN ARE FORBIDDEN.

IF ONE IS FORBIDDEN BY VOW TO BENEFIT AUGHT FROM HIS NEIGHBOR, AND HE HAS NAUGHT TO EAT, HE [THE MADDIR] CAN GO TO THE SHOPKEEPER AND SAY, SO-AND-SO IS FORBIDDEN BY VOW TO BENEFIT AUGHT FROM ME, AND I DO NOT KNOW WHAT TO DO'. THE SHOPKEEPER MAY THEN SUPPLY HIM, AND COME AND RECEIVE PAYMENT FROM HIM [THE MADDIR].

היה ביתו לבנות גדרו לגדור ושדהו לקצור הולך אצל הפועלים ואומר להם איש פלוני מודר הנאה ממני ואיני יודע מה אעשה לו והן עושין עמו ובאין ונוטלין שכר מזה
IF HE HAD HIS [THE MUDDAR'S] HOUSE TO BUILD, OR HIS FENCE TO ERECT, OR HIS FIELD TO REAP, HE [THE MADDIR] MAY GO TO LABORERS, AND SAY, 'SO-AND-SO IS FORBIDDEN BY VOW TO BENEFIT AUGHT FROM ME, AND I DO NOT KNOW WHAT TO DO.' THERE UPON THEY WORK FOR HIM [THE MUDDAR]. AND COME AND RECEIVE WAGES FROM HIM [THE MADDIR].

היו מהלכין בדרך ואין לו מה יאכל נותן לאחר לשום מתנה והלה מותר בה ואם אין עמהם אחר מניח על הסלע או על הגדר ואומר הרי הן מופקרין לכל מי שירצה והלה נוטל ואוכל ור' יוסי אוסר
IF THEY ARE WALKING TOGETHER ON THE ROAD, AND HE [THE MUDDAR] HAS NOTHING TO EAT, HE [THE MADDIR] CAN MAKE A GIFT TO A THIRD PERSON, AND HE [THE MUDDAR] IS PERMITTED [TO HAVE] IT. IF THERE IS NO OTHER WITH THEM, HE PLACES IT ON A STONE OR A WALL, SAYING, 'THIS IS FREE TO WHOMEVER DESIRES IT'; AND THE OTHER TAKES AND EATS IT. BUT R. JOSE FORBIDS THIS.

ור' יוחנן וריש לקיש דאמרי תרוייהו נכסי עליך לפני שביעית אינו יורד לתוך שדהו ואינו אוכל מן הנוטות הגיע שביעית אינו יורד לתוך שדהו אבל אוכל הוא מן הנוטות
ומסיק דכ"ע אדם אוסר דבר שברשותו אפילו לכשיצא מרשותו ורב ושמואל בנכסים אלו ור"י ור"ל בנכסי ולא פליגי:
"HE MAY NOT ENTER HIS FIELD":
Rav and Shmuel both said that {if he says to his neighbor} "these assets are {forbidden} upon you" before sheviit, he does not descend into his field and he does not eat from the overhanging fruits, even though sheviit arrives. And if he vowed on sheviit, he does not descend into his field, but he may eat of the overhanging fruits.
And Rabbi Yochanan and Resh Lakish both say that {if he says to his neighbor} "these assets are {forbidden} upon you" before sheviit, he does not descend into his field and he does not eat from the overhanging fruits, but once sheviit arrives, he may not descend into his field but he may, however, eat of the overhanging fruits.
And we conclude that all agree that a man may forbid something within his domain even for after it leaves his domain. And Rav and Shmuel are dealing with {his words being} "these assets," while Rabbi Yochanan and Resh Lakish are dealing with "my property," and they do not argue.

{Nedarim 43a}
ולא ילונו כו' ולא ישאילנו כו'.
גזירה לשאול אטו להשאיל וכן כולהו משום גזירה:
"HE MAY NOT ADVANCE HIM ... NOR MAY HE LEND TO HIM":
A decree of borrowing lest he lend, and so too all of them as a decree.

ור' יוסי אוסר:
מאי טעמא דר"י אמר רבא גזירה משום מתנה דבית חורון
"And Rabbi Yossi forbids":
What is the reason of Rabbi Yossi?
Rava said: As a decree because of the gift of Bet Choron. {See Mishna on Nedarim 48a. This is a gift which is an obvious evasion. So too here, his declaration of hefker appears to be evasion.}
