Rif Yevamot 45b {Yevamot 120b continues - 121b}

45b

{Yevamot 120b continues}

And Rav Yehuda cited Shmuel: If they cut {lit. slaughtered} in him two {major organs} or the majority of two and he fled, they testify about him {that he died}.
Is this truly so? But Rav Yehuda cited Shmuel: If they cut {lit. slaughtered} in him two {major organs} or the majority of two and he indicated "write a get for my wife," they write it and give it? {But he is dead?!}
He is alive but will eventually die {from this}.

They do not testify except {if they saw the body} within three days.
To explain: They do not testify about him unless they saw him, that he died, within three days of his death. But if they did not find him until after three days, they do not testify about him, because a corpse changes and is not recognizable after three days.
And these words are on the dry land, but in the water, it is possible that it can last four or five days without change, for water, where it does not harm, preserves the body.
{Yevamot 121a}
As we say: There was a certain man who drowned in Diglat and it cast him out on the bridge of Shavistana, and Rabba married off his wife on the say-so of his groomsman after five days.
And these words are where he saw him at the time that it cast him out, but if it waits a while, it will swell and not be recognizable.

Mishna:
If he fell into water, whether it has an end or does not have an end, his wife is forbidden.
Rabbi Meir said: There was an incident in which he fell into the great cistern {with water} and he came up {alive} after three days.
Rabbi Yossi said: There was an incident with a blind man who went to a cave to ritually immerse, and his guide went in after him, and they waited long enough for their souls to depant and then married off their wives.
There was another incident in Asia with one who was lowered into the sea, and they only brought up his leg, and the Sages said: from the knee and up {recovered}, she {his wife} may remarry; from the knee down she may not remarry.

Gemara:
The Sages learnt {in a brayta}: If he fell, whether to water which has an end or to water which has no end, his wife is forbidden. These are the words of Rabbi Meir. And the Sages say: those which do not have an end, his wife is forbidden; which have an end, his wife is permitted.
And so is the halacha.

And one who rules that in water which has no end, his wife is permitted, he is in cherem. For we say: There was a certain man who drowned in the swamp of Samki, and Rav Shela permitted his wife.
Rav said to Shmuel: Come, let us place him in cherem.
He {Shmuel} said: Let us first send to him {to inquire why he did this}.
They sent to him: Water which has no end, is his wife forbidden or permitted?
"And the swamp of Samki, is it water which has an end or water which does not have an end?"
He sent to them: Water which has no end.
He {Rav Shela} sent to them: Water which has no end.
"And Master, for what reason did you act so?"
"I made a mistake. I though that since it was gathered and stationary, it was like water which had no end. And it is not so. Since there are waves, we might say that waves carried him away to another place."
Shmuel called upon Rav the verse: {Mishlei 12:21}:
21 There shall no mischief befall the righteous; but the wicked are filled with evil.
Rav called upon Shmuel the verse {Mishlei 11:14}:
14 Where no wise direction is, a people falleth; but in the multitude of counsellors there is safety.

How so, water which has no end?
Abaye said: Wherever one stands and sees from his four directions that if he would come out, they would see him.
And if you say, let us be concerned for an underground fish pond, an underground fish pond is uncommon in a water that has no end.

And they learnt {in a brayta}: Rabban Gamliel said: One time I was traveling by boat and I saw a certain ship break up in the sea, and I was aggrieved for a Torah scholar who was in it -- and who was this? Rabbi Akiva. When I came up onto dry land, he sat and judged before me in halacha. And I said to him: My son, who brought you up? And he said to me: A board of the ship I encountered and I sat upon it, and each wave which came upon me I bent my head {to blunt its force}.
From there the Sages said: If wicked men come upon a man, he should bend his head to them.
At that time, I said: How great are the words of the Sages, who say that water which has no end, his wife is forbidden, and which has an end, his wife is permitted.

They learnt {in a brayta}: Rabbi Akiva said: One time I was traveling by ship and I saw a ship which was tossed in the sea, and I was aggrieved on a Torah scholar who was in it -- and who was this? Rabbi Meir. When I came up to the country of Cappadocia, he came and sat and judged before me in halacha. I said to him: My son, who brought you up? He said to me: One wave tossed me to his fellow, and his fellow to his fellow, and it spit me out onto dry land. At that time, I said: How great are the words of the Sages who say that water which has no end, his wife is forbidden and which has an end, his wife is permitted.

The Sages learnt {in a brayta}: If he fell into a lion's den, they do not testify about him. To a digging full of snakes and scorpions, they testify about him.

{Yevamot 121b}
The Sages learnt {in a brayta}: If he fell into a burning over, they testify about him. To a boiler full of wine and oil, they testify about him.

In the name of Rabbi Acha they said: Full of oil, they testify about him, because it fuels {the fire}.
Of wine, they do not testify about him, because it extinguishes.
They said to him: In the beginning it extinguishes and in the end it fuels.
