Rif Gittin 46a {86a}

46a

{Gittin 86a}
Mishna:

THE FOLLOWING THREE BILLS OF DIVORCE ARE INVALID BUT IF A WOMAN MARRIES ON THE STRENGTH OF THEM THE CHILD [BORN OF SUCH MARRIAGE] IS LEGITIMATE:
IF THE HUSBAND WROTE IT WITH HIS OWN HAND BUT IT WAS ATTESTED BY NO WITNESSES;
IF THERE ARE WITNESSES TO IT BUT NO DATE;
IF IT HAS A DATE BUT THE SIGNATURE OF ONLY ONE WITNESS.
THESE THREE BILLS OF DIVORCE ARE INVALID, BUT IF SHE MARRIES THE CHILD IS LEGITIMATE.

RABBI ELEAZAR, HOWEVER, SAYS THAT EVEN THOUGH IT WAS NOT ATTESTED BY WITNESSES AT ALL, SO LONG AS HE GAVE IT TO HER IN THE PRESENCE OF WITNESSES IT IS VALID, AND ON THE STRENGTH OF IT SHE MAY RECOVER HER KETHUBAH FROM MORTGAGED PROPERTY, SINCE SIGNATURES OF WITNESSES ARE REQUIRED ON THE GET ONLY FOR THE BETTER ORDERING OF THE WORLD {AS A SAFEGUARD}.

Gemara:
ותו ליכא והא איכא גט ישן
התם לא תצא הכא תצא
הניחא למ"ד הכא תצא אלא למ"ד הכא לא תצא מאי איכא למימר
התם תנשא לכתחלה הכא דיעבד:
And there are no further ones? But there is an old get {in which they secluded themselves after it was written}?
There, she does not go out {with divorce from the second husband}, while here, she does go out.
This is fine according to the one who said that here she goes out, but according to the one who said that here she does not go out, what is there to say?
There, she may marry ab initio, while here, it is only after the fact {that she may remain married}.
