Rif Gittin 11a {22b - 23a}

11a

{Gittin 22b}

והני מילי בגיטין אבל בשאר שטרות בעינן כתב שאינו יכול להזדייף כדכתבינן לעיל:
And these words are specifically by get, but by other documents, we need a document which is not able to be forged, as we wrote earlier.

Mishna:
הכל כשרין לכתוב את הגט ואפי' חרש שוטה וקטן
האשה כותבת גיטה והאיש כותב שוברו שאין קיום הגט אלא בחותמיו:
ALL [PERSONS] ARE QUALIFIED TO WRITE A GET, EVEN A DEAF-MUTE, A LUNATIC AND A MINOR. A WOMAN MAY WRITE HER OWN GET AND A MAN HIS OWN RECEIPT [FOR THE KETHUBAH], SINCE THE DOCUMENT IS MADE EFFECTIVE ONLY BY THE SIGNATURES ATTACHED TO IT.

הכל כשרין להביא את הגט חוץ מחרש שוטה וקטן וסומא ועובד כוכבים
קיבל הקטן והגדיל חרש ונתפקח סומא ונתפתח שוטה ונשתפה עובד כוכבים ונתגייר פסול
אבל פקח ונתחרש וחזר ונתפקח פתוח ונסתמא וחזר ונתפתח שפוי ונשתטה וחזר ונשתפה כשר
זה הכלל כל שתחלתו וסופו בדעת כשר
ALL [PERSONS] ARE QUALIFIED TO ACT AS BEARERS OF A GET EXCEPT A DEAF-MUTE, A LUNATIC, AND A MINOR, A BLIND MAN AND A HEATHEN.

IF AFTER BEING ENTRUSTED [WITH THE GET BUT BEFORE DELIVERING IT] THE MINOR BECAME OF AGE OR THE DEAF-MUTE RECOVERED HIS SPEECH OR THE BLIND PERSON HIS SIGHT OR THE LUNATIC HIS REASON OR THE HEATHEN BECAME A PROSELYTE, [THE GET] IS [STILL] INVALID.

BUT IF THE BEARER [BEING ORIGINALLY] OF SOUND SENSES BECAME A DEAF-MUTE AND THEN RECOVERED HIS SPEECH, OR [BEING] WITH SIGHT BECAME BLIND AND RECOVERED HIS SIGHT, OR [BEING] SANE BECAME INSANE AND RECOVERED HIS REASON, [THE GET] IS VALID.

THE GENERAL PRINCIPLE IS THAT ANY BEARER WHO COMMENCES AND FINISHES [HIS MISSION] IN FULL POSSESSION OF HIS MENTAL FACULTIES IS QUALIFIED.

Gemara:
והא לאו בני דעה נינהו
א"ר הונא והוא שהיה גדול עומד על גבן
But they {=the cheresh, shoteh, katan} do not have full mental capacity {and this will be a deficiency in lishmah}!
