Rif Gittin 28a {60a - 61a; 62a - b}

28a

{Gittin 60a}

כותבין מגילה לתינוק להתלמד בה
וכן הלכה:
One may write a megillah {Rashi: containing one or two "parshiyot" by themselves} for a child to learn from.
And so is the halacha.

{Gittin 60b}
בור הקרוב לאמה.
איתמר בני נהרא
רב אמר תתאי שתו ברישא
ושמואל אמר עילאי שתו ברישא
במיזל כ"ע לא פליגי כי פליגי במיסכר ואשקויי
והשתא דלא איתמר הלכתא לא כמר ולא כמר מאן דאלים גבר:
"THE PIT WHICH IS NEAREST THE HEAD OF THE WATERCOURSE":
It was stated {by Amoraim}:
Where they {=the fields} adjoin a river --
Rav said: the ones lower down have the right to draw off water first.
And Shmuel said: the one higher up have the right to draw off water first.

So long as the water is allowed to flow, both agree {that no problem arises, and either can draw at any time}. Where do they argue? By damming for the purpose of watering.

{Rav Huna bar Tachlifa:} And now that the halacha is not stated either like one master or the other master, whoever is stronger prevails.

"TRAPS OF WILD ANIMALS":
If loose or close nets are used,
{Gittin 61a}
all agree {that it would be robbery, since there is a hollow in them}. Where do they argue? By fishhooks and traps. Rabbi Yossi holds that it is absolute theft, and even though {as per Rav Chisda} this means Rabbinically {it is absolute theft}, one can get it out {of the hands of the thief} via judges {by suing in court}. And the Sages say no.
And the halacha is like the Sages.

העני המנקף כו'.
תנא אם נטל ונתן ביד הרי זה גזל גמור:
"IF A POOR MAN IS GLEANING...":
A tanna taught: If the poor man had gathered the fruit and placed it on the ground with his hands, to take it is actual robbery.

אין ממחין ביד עניי עובדי כוכבים כו':
ת"ר מפרנסין עניי עובדי כוכבים עם עניי ישראל ומבקרין חולי עובדי כוכבים עם חולי ישראל מפני דרכי שלום וקוברין מתי עובדי כוכבים עם מתי ישראל מפני דרכי שלום:
"THE POOR OF THE HEATHEN ARE NOT PREVENTED...":
The Sages learnt {in a brayta}: We support the poor of the heathen along with the poor of Israel, and visit the sick of the heathen along with the sick of Israel, and bury the poor of the heathen along with the dead of Israel, in the interests of peace.

{Gittin 62a}
מחזיקין ידי עובדי כוכבים כו'.
מחזיקין
והאמר רב דימי בר ששנא משמיה דרב אין עודרין עם העובדי כוכבים בשביעית ואין כופלין שלום לעובדי כוכבים
לא צריכא למימר להו אחזוקי בעלמא
כי הא דרב יהודה אמר להו אחזוקי רב ששת א"ל אשרתא:
"HEATHENS MAY BE ASSISTED {during sheviit}...":
Assistance may be given to them? But Rav Dimi bar Sheshna said in the name of Rav: It is not right to hoe with heathens in the Sabbatical year nor to give a double greeting to heathens?
No, it is is necessary -- to say to them "Achzuki" {be strong} in general.
Like this that Rav Yehuda said to them "Achzuki." Rav Sheshet said to them "Asharta!" {strength!}

ואין כופלין שלום לעובדי כוכבים
רב חסדא הוה מקדים יהיב להו שלמא
ר"נ בר יצחק אמר להו שלמא למר
תניא לא יכנס אדם בביתו של עובדי כוכבים ביום אידו ויתן לו שלום מצאו בשוק נותן לו בשפה רפה ובכובד ראש
'Nor to give double greeting to heathens' --
Rav Chisda would give them greeting first.
Rav Nachman bar Yitzchak {our gemara: Rav Kahana} used to say: Peace {to you,} sir.

They learnt {in a brayta}: A man should not enter the house of a heathen on his feast day and give him greeting. Should he meet him in the street, he should greet him in a mumbling tone and with downcast head.'

Mishna:
האומר התקבל גט זה לאשתי או הולך גט זה לאשתי אם רצה להחזיר יחזיר
האשה שאמרה התקבל לי גיטי אם רצה להחזיר לא יחזיר
לפיכך אם אמר הבעל אי אפשי שתקבל לה אלא הולך ותן לה אם רצה להחזיר יחזיר
רשבג"א אף האומרת טול לי גיטי אם רצה להחזיר לא יחזיר:
IF A MAN SAYS [TO ANOTHER], RECEIVE THIS GET ON BEHALF OF MY WIFE, OR, CONVEY THIS GET TO MY WIFE, IF HE DESIRES TO RETRACT [BEFORE THE WIFE RECEIVES IT] HE MAY DO SO.
IF A WOMAN SAYS [TO A MAN], RECEIVE MY GET ON MY BEHALF, [AND HE DOES SO]. IF [THE HUSBAND] DESIRES TO RETRACT HE IS NOT AT LIBERTY TO DO SO.
CONSEQUENTLY [WHAT IS THE HUSBAND TO DO?] IF THE HUSBAND SAID TO HIM, I AM NOT AGREEABLE THAT YOU SHOULD RECEIVE IT ON HER BEHALF, BUT CONVEY IT AND GIVE IT TO HER, THEN IF HE DESIRES TO RETRACT HE MAY DO SO.

RABBAN SHIMON BEN GAMLIEL SAYS: EVEN IF THE WIFE SAYS [MERELY] "TAKE FOR ME," [AND HE DOES SO], HE IS NOT AT LIBERTY TO RETRACT.

Gemara:
פשיטא: איש הוי שליח להולכה שכן בעל מוליך גט לאשתו
אשה הויא שליח לקבלה שכן אשה מקבלת גיטה מיד בעלה
איש לקבלה ואשה להולכה מאי
ופשטינן דאיש הוי נמי שליח לקבלה שכן אב מקבל גט לבתו קטנה ואשה נמי הויא שליח להולכה שכן אשה עצמה מביאה גיטה
כדתנן האשה עצמה מביאה גיטה ובלבד שתהא צריכה למימר בפני נכתב ובפ"נ
ואוקימנא בהולכה
It is obvious that a man may be an agent for conveying, for a husband may convey a get to his wife; and that a woman may be an agent for receiving, for a woman may receive her get from the hand of her husband.
A man for receiving and a woman for conveying, what?
And we resolve that a man may also be an agent for receiving, for a father may indeed receive a get for his minor daughter. And a woman may also be an agent for conveying, for a woman may indeed herself bring her get, as we learn {in a Mishna}, "the woman herself may bring her get, except she needs to say 'before me it was written and before me it was signed."
And we establish this as conveying.
