{Bava Kamma 115a}
קסבר עשו בו תקנת השוק
והלכתא כר' יוחנן דקסבר עשו בו תקנת השוק
אמר רבא גנב מפורסם לא עשו בו תקנת השוק:
He maintains that they did make for him the restoration of money {he paid} at the market.
And the halacha is like Rabbi Yochanan, who maintains that they did make for him the restoration of money at the market.
Rava said: By a notorious thief, they did not establish a restoration of money of the market.

איתמר גנב ופרע בחובו גנב ופרע בהקיפו לא עשו בו תקנת השוק
מאי טעמא דאמרינן ליה לאו אדעתא דהאי מידי דיהיב לך יהבת ליה זוזי:
It was stated {by Amoraim}: If he stole and paid off his debt; if he stole and paid off goods received on credit, they did not establish a restoration of money of the market.
What is the reason? For we say to him: Not for the things that he gave you {now} did you {initially} give him money.

משכנתא שוה מאתן במאה עשו בו תקנת השוק.
שוה מאה במאה
אמימר אמר לא עשו בו תקנת השוק
מר זוטרא אמר עשו בו תקנת השוק
As a pledge worth 200 for 100 {which the received}, they make for him {the person who took it as a pledge} a restoration of money of the market.
Worth 100 for 100:
Amemar said: They do not make for him a restoration of the market.
Mar Zutra said: They do make for him a restoration of the market.

זביני שוה בשוה עשו בו תקנת השוק
שוה מאה במאתן
רב ששת אמר לא עשו בו תקנת השוק
רבא אמר עשו בו תקנת השוק
As a sale for an equal amount {to their value}, they make for him a restoration of the market.
Something worth 100 for 200:
Rav Sheshet said: They do not make for him a restoration of the market.
Rava said: They do make for him a restoration of the market.

והלכתא בכולהו עשו בו תקנת השוק לבר מגנב ופרע בחובו וגנב ופרע בהקיפו דלא עשו בו תקנת השוק:
And the halacha in all of them is that they do make for him a restoration of the market, with the exception of where he stole and paid off his debt, or stole and paid off goods received on credit, where they do not make for him a restoration of the market.

אביי בר נאזי חמוה דרבי הוה מסיק ביה ארבע זוזי בההוא גברא

א"ל ארבעה זוזי קמא גנב ופרע בחובו הוא לא בעית למיתבא ליה הני ארבעה זוזי בתראי ודאי זיל הב ליה ושקול גלימך
מתקיף לה רב כהן דלמא גלימא מהנהו ארבעה זוזי קמאי יהבה ניהליה דהוה ליה גנב ופרע בחובו ארבעה בתראי הימוני הימניה כדמעיקרא
איגלגל מילתא ומטת לקמיה דרבא אמר להו הלכתא כרב כהן:
Abaye {our gemara: Avimi} bar Nazi, the father-in-law of Rabbi {our gemara: Ravina} was owed 4 zuz by a certain person. He {=that person} stole and brought him a garment, and gave it to him, and borrowed upon it another four zuz. This came before Ravina. He said: The first four zuz, since it is stealing and paying his debt, he {the owner} does not need to pay to him {to Abaye}. These last four zuz, certain go and give him, and take your garment.
Rav Kohen objected to this: Perhaps the garment was just for these first four zuz that he gave him, such that it will be a case of stealing and paying for his debt {such that the owner would be exempt}, while the four last ones he was trusting him with as at first.
The matter moved about the courts and arrived before Rava. He said to them: The halacha is like Rav Kohen.

נרשאה גנב ספרא זבנא לפפונאי בתמנן זוזי
אזל פפונא זבניה לבר מחוזא במאה ועשרים
לסוף הוכר הגנב
אמר אביי אזיל מריה דספרא יהיב ליה לבר מחוזא תמנן ושקיל סיפריה ואזיל בר מחוזא שקיל ארבעין מפפונא
מתקיף לה רבא השתא בלוקח מן הגנב עשו תקנת השוק בלוקח מן הלוקח לא כל שכן
אלא אמר רבא מרי ספרא יהיב ליה לבר מחוזא מאה ועשרים ושקיל ספרא ואזיל מארי ספרא שקיל ארבעין מפפונא ושקיל תמנן מן גנבא
וכן הלכתא:
A resident of Naresh stole a book and sold it to a resident of Papunia for 80 zuz. The resident of Papunia went and sold it to a resident of Mechoza for 120 {zuz}. It the end, the thief was recognized.
Abaye said: The owner of the book should go and give the resident of Mechoza 80 {zuz} and take his book, and the resident of Mechoza should go and take the {remaining} 40 {zuz} from the resident of Papunia.
Rava objected: Now that one who purchases from a thief, they enact for him a restoration of the money of the market, by one who purchases from a purchaser, would it not be all the more so? Rather, Rava said: The owner of the book should give to the resident of Mechoza 120 {zuz} and take the book, and the owner of the book {in order to recover some of that money} should go and take 40 from the resident of Papunia, and taken 80 from the thief.
And so is the halacha.

זה בא בחביתו של יין וכו':ש
אמאי לימא ליה אנא מהפקירא קא זכינא
כדאמר רבי ירמיה כשעקל בית הבד כרוך עליה מתני' נמי כשעקל בית הבד כרוך עליה

אמר לו אציל את שלך ואתה נותן לי דמי שלי חייב ליתן לו
ולימא ליה משטה אני בך
מי לא תניא הרי שהיה בורח מבית האסורים והיתה מעבורת לפניו ואמר לו טול דינר והעבירני אין לו אלא שכרו אלמא א"ל משטה אני בך
אמרי הא לא דמיא אלא לסיפא אמר לו טול דינר בשכרך והעבירני נותן לו שכרו משלם.

אמר רמי בר חמא סיפא בצייד ששולה דגים מן הים עסקינן דא"ל אפסדתן מיהא כוורי בזוזא:

But why? Let him say to him, "I am obtaining it from hefker" {since the honey is being lost and is then ownerless}! As Rabbi Yirmeyah said: When the bale of the press-house was twined around it {it would not become ownerless, since it would only drip out}. In our Mishna as well, {say that it is} where the bale of the press-house was twined around it.

{Bava Kamma 116a}
"{If} he says to him 'I will save yours and you pay me the value of mine,' then he {=the other} is obligated to give to him" -- But let him say 'I was merely jesting with you!' For do we not learn {in a brayta}: "Behold if one was fleeing from prison and there was a ferryman before him, and he said to him {=to the ferryman} 'take a dinar and ferry me across', he {=the ferryman} only gets his wages." Thus it is clear that he can say "I was merely jesting with you." They say that it is only comparable to the sefa {of that brayta, which reads}: "If he said to him 'take this dinar as your wages and ferry me across,' he must pay the full wages {he specified, of a dinar}."
Why are the resha and the sefa different? Rami bar Chama said: In the sefa, we are dealing with a case in which he was a fisherman catching fish from the sea, such that he can say to him, 'you caused me to lose fish amounting to a zuz {=a dinar}.'

שטף נהר חמורו וחמור חבירו וכו':ש
בעא מיניה רב כהנא מרב ירד להציל ועלה שלו מאליו מהו
א"ל ההוא משמיא הוא דרחימו עליה
כי הא דרב ספרא הוה קא אזיל בההיא שיירתא לוינהו אריה כל אורתא הוו שדו ליה חמרא דחד מינייהו
ההיא אורתא דמטא גבי רב ספרא שדייה ניהליה לחמריה לא אתא אריה קדים רב ספרא למחר זכה ביה בחמריה
א"ל רב אחא מדפתי לרבינא למה ליה לרב ספרא דאקדים זכה ביה פשיטא
"SO ALSO IF A RIVER SWEPT AWAY HIS ASS AND ANOTHER MAN'S ASS...":
Rav Kahana inquired of Rav: If he descended to save {the other person's donkey, under the stipulation that he be paid for the value of his own donkey which would be lost}, and his own donkey came up on its own, what is the law? {Should he still be paid the stipulated amount?}
He {=Rav} said to him: This is from Heaven which had mercy upon him {and so his still receives the stipulated amount}.
Like this of Rav Safra, who was traveling with a certain caravan. A lion followed them, and every night they would cast to it one of their donkeys {so as not to be attacked themselves}. That night which reached Rav Safra's turn, they cast it his donkey, and the lion did not come. The next day, Rav Safra immediately retook possession of his donkey.
Rav Acha of Difri said to Ravina: Why did Rav Safta need to immediately take possession of it? It is obvious
