{Bava Kamma 114a}
אריא ארבעת לי אמיצראי משמתינן ליה עד דאתי ומקבל כל אונסא דאתי מחמתיה:
{he may say to him:} "You have crouched a lion at my border." We place him under the ban under he comes and accepts responsibility for any mishap which comes because of him.

המציל מן הנהר ומן הלסטים אם נתייאשו הבעלים הרי אלו שלו
אם נתייאשו אין סתמא לא
אמר רב אסי לא שנו אלא בלסטין עכו"ם דדיינו בגיותא אבל בישראל דאמרי מי יימר אפילו סתמא נמי איאושי מיאש:
If one saves {some property} from the river or from bandits, if the owners have given up hope, behold they are his.
{The implication of this is:} If they have given up hope, yes, but in the plain instance, no.
Rav Assi {our gemara: Rav Ashi} said: They only learned this regarding heathen bandits, who judge with haughtiness. But by an Israelite, where they will say "who says" {that it is as you have described? Bring witnesses}, even in the normal case, he will certainly have abandoned hope.

Mishna:
אמר רבי יוחנן בן ברוקה נאמנת אשה או קטן לומר מכאן יצא נחיל זה
ומהלך בתוך שדהו ונוטל את נחילו ואם הזיק משלם מה שהזיק
אבל לא יקוץ את הסוכה על מנת ליתן דמים
רבי ישמעאל בנו של רבי יוחנן בן ברוקה אומר קוצץ ונותן דמים:
RABBI YOCHANAN BEN BEROKA SAID: A WOMAN OR A MINOR IS TRUSTED WHEN STATING THAT THIS SWARM STARTED FROM HERE; AND HE {=THE OWNER OF BEES} IS ALLOWED TO WALK INTO THE FIELD OF HIS NEIGHBOR FOR THE PURPOSE OF RESCUING HIS SWARM, THOUGH IF HE CAUSES DAMAGE HE WOULD HAVE TO PAY FOR THE AMOUNT OF DAMAGE HE DOES. HE MAY, HOWEVER, NOT CUT OFF HIS NEIGHBOR'S BOUGH {UPON WHICH HIS BEES HAVE SETTLED} {EVEN} WITH THE INTENTION OF PAYING HIM ITS VALUE.
RABBI YISHMAEL THE SON OF RABBI YOCHANAN BEN BEROKA SAID: HE CUTS AND PAYS HIM ITS VALUE.

Gemara:
אמר רב אשי אין מסיח לפי תומו כשר אלא לעדות אשה בלבד
אמר ליה רבינא לרב אשי והא נחיל של דבורים
א"ל בקנין דרבנן
וההוא עובדא נמי
Rav Ashi said: Speaking in all innocence is not valid except for testimony on behalf of a woman {in terms of death of the husband such that she may now remarry}.
Ravina said to Rav Ashi: But there is the instance of the swarm of bees.
He {=Rav Ashi} said to him: This was a case of {only} Rabbinic aquisition {that one may own this}.
