{Ketubot 19a}

רב אשי אמר לעולם דקאמרי עדים ודאין כתב ידן יוצא ממקום אחר
ודקאמרת אמאי לא מהימני כדרב כהנא
דא"ר כהנא אסור לאדם שישהה שטר אמנה בתוך ביתו שנאמר אל תשכן באהליך עולה
Rav Ashi said: In truth, it is where witnesses stated {that it was a deed of trust}, and it was where their handwriting did not come from another place. And when you say "why are they not believed?" it is like Rav Kahana. For Rav Kahana said: It is forbidden for a man to retain a deed of trust within his house, for it is stated {Iyyov 11:14}:
יד אִם-אָוֶן בְּיָדְךָ, הַרְחִיקֵהוּ; וְאַל-תַּשְׁכֵּן בְּאֹהָלֶיךָ עַוְלָה. 14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--

אמר רב שישא בריה דרב אידי ש"מ מדרב כהנא עדים שאמרו אמנה היו דברינו אינן נאמנים
מאי טעמא כיון דעולה היא אעולה לא חתימי

א"ר יהושע ב"ל אסור לאדם שישהה שטר פרוע בתוך ביתו שנאמר אל תשכן באהליך עולה

איתמר ספר שאינו מוגה א"ר אמי עד ל' יום מותר להשהותו אחר שלשים יום אסור להשהותו שנאמר אל תשכן באהליך עולה:
Rav Shisha son of Rav Idi said: We deduce from Rav Kahana that witnesses who said "our words were a deed of trust" are not believed. What is the reason? Since it is avla {unrighteousness}, upon avla they do not sign.

Rabbi Yehoshua ben Levi said: It is forbidden for a man to retain within his house a paid-off bill of indebtedness, for it is stated {Iyyov 11:14}:
יד אִם-אָוֶן בְּיָדְךָ, הַרְחִיקֵהוּ; וְאַל-תַּשְׁכֵּן בְּאֹהָלֶיךָ עַוְלָה. 14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--

It was stated {by Amoraim}: A {Biblical} book which is not corrected:
Rabbi Ami said: Until 30 days it is permitted to retain it; after thirty days it is forbidden to retain it, for it is stated {Iyyov 11:14}:
יד אִם-אָוֶן בְּיָדְךָ, הַרְחִיקֵהוּ; וְאַל-תַּשְׁכֵּן בְּאֹהָלֶיךָ עַוְלָה. 14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--

אמר רב נחמן עדים שאמרו אמנה היו דברינו אינם נאמנים מודעה היו דברינו אינם נאמנים
מר בר רב אשי אמר אמנה היו דברינו אינם נאמנים מודעה היו דברינו נאמנים
מאי טעמא האי ניתן ליכתב והאי לא ניתן ליכתב
וכן הלכתא
Rav Nachman said: Witnesses who said "our words were on a deed of trust" are not believed. "Our words were on a matter of protest" {that the seller protested he was being forced to sell} they are not believed.

Mar son of Rav Ashi said: "Our words were on a deed of trust," they are not believed. "Our words were on a matter of protest," they are believed.
What is the reason? This is not given over to be written, while that is given over to be written.
And so is the halacha {like Mar bar Ravina}.

עדים שאמרו תנאי היו דברינו נאמנים וכי אתו לקמן אמרינן להו קיימו תנאייכו וחותו לדינא
עד אומר תנאי ועד אומר אין תנאי
א"ר פפא תרוייהו בשטרא מעליא קמסהדי והאי דאמר תנאי הוה ליה חד ואין דבריו של אחד במקום שנים
מתקיף לה רב הונא בריה דרב יהושע אי הכי אפי' תרוייהו נמי אלא אמרינן הני למעקר סהדותייהו קאתי האי נמי למעקר סהדותיה קאתי
והלכה כרב הונא בריה דרב יהושע
Witnesses who said "our words were on a condition," they are believed. And when they {the people involved} come before us, we say to them "fulfill your condition and then come to court."
If one witness says it was subject to a condition and one witness says there was no condition --
Rav Pappa said: They each are testifying that it is a fine contract, and this one who said there was a condition is a single witnesses, and the words of one do not stand in place of two {witnesses}.
Rav Huna son of Rav Yehoshua objected to this: If so, even if both of them {say it was on condition} also {since they first testified the contract was valid}! Rather we say, these are coming to uproot their testimony {and thus they are believed}. Here too {with only one witness}, he is coming to uproot his testimony.
And the halacha is like Rav Huna son of Rav Yehoshua.

ת"ר עדים שהיו חתומין על השטר ומתו ובאו שנים ואמרו כתב ידן הוא זה אבל אנוסין היו קטנים היו פסולי עדות היו הרי אלו נאמנים ואם יש עדים אחרים שהוא כתב ידם או שהיה כתב ידן יוצא ממקום אחר משטר שקרא עליו ערער והוחזק בב"ד אינן נאמנין
The Sages learnt {in a brayta}: Witnesses who were signed on a contract and died, and two come and say that "it was their {=the deceased} handwriting, but they were forced; they were minors; they were invalid as witnesses" they are believed. And if there are other witnesses that it is their handwriting, or if their handwriting {sample} comes from some other place, that is from a contract which was complained about and subsequently established in bet din, they are not believed.
