Rif Yevamot 23b {69a - 70a}

23b

Mishna:

האונס והמפתה והשוטה לא פוסלין ולא מאכילין ואם אינן ראויין לבא בקהל הרי אלו פוסלין
כיצד היה ישראל שבא על בת כהן תאכל בתרומה
עיברה לא תאכל
נתחתך העובר במעיה תאכל

היה כהן הבא על בת ישראל לא תאכל בתרומה
עיברה לא תאכל
ילדה תאכל
נמצא כחו של בן גדול משל אב
The rapist, the seducer, and the imbecile do not invalidate {her from eating teruma} and they do not feed, and if they are unfit to enter the congregation they invalidate.
How so?
If there was an Israelite who had intercourse with the daughter of a kohen, she may still eat of teruma. {Yevamot 69b} If she became pregnant, she may not eat. If the fetus is cut up in her womb, she may eat.

If there was a kohen who had intercourse with the daughter of an Israelite, she may {still} not eat of teruma. If she became pregnant she {still} may not eat. If she give birth, she may eat. Thus we find that the strength of the son is stronger than that of the father.

Gemara:
והשוטה תנינא להא דתנו רבנן שוטה וקטן שנשאו נשים ומתו נשותיהן פטורות מן החליצה ומן היבום
The imbecile, we have learnt it. For the Sages learnt {in a brayta}: An imbecile and a minor who married women and died, their wives are exempt from chalitza and from yibbum.

איתמר הבא על ארוסתו בבית חמיו
רב אמר הולד ממזר ושמואל אמר הולד שתוקי
איכא דאמרי בבא [עליה] כ"ע לא פליגי דבתריה דידיה שדינן ליה
אלא כי איתמר הכי איתמר ארוסה שעיברה רב אמר הולד ממזר ושמואל אמר הולד שתוקי
It was stated {by Amoraim}: If one had intercourse with his betrothed in his father-in-law's house {that is, before nisuin} --
Rav said the child is a bastard {and not his but of another man} and Shmuel said the child is a Shtuki {a doubtful bastard}.
There are some {variants} that say: Where he had intercourse with her, all agree that it goes after him {and the child is valid}.
Rather, where is it {this dispute} stated? Here is is stated: A betrothed woman who became pregnant. Rav said the child is a bastard {and not his but of another man} and Shmuel said the child is a Shtuki {a doubtful bastard}.

האי שמעתא קא הוינן בה בפרק עשרה יוחסין ואסיקנא הכי
רב דאמר הולד ממזר לאו ממזר ודאי הוי אלא ספק ממזר הוי ואסור בממזרת ושתוקי דאמר שמואל בדוקי הוא דבדקינן לה לאימי' ואי אמרה לכשר נבעלתי דהוא ארוס נאמנת
והלכתא בהא כשמואל דקם ליה כאבא שאול
דתנן אבא שאול היה קורא לשתוקי בדוקי ואמרינן מאי בדוקי דבדקינן לה לאימיה ואי אמרה לכשר נבעלתי נאמנת ואף על גב דרוב פסולין אצלה
ואמר רבא הלכה כאבא שאול
הילכך הלכתא כשמואל דקאי כותיה אבל ודאי אי בדקינן לה ואמרה דלא ידענא הולד ספק ממזר הוי ובהא לא פליג שמואל:
We deal with this statement in perek Asara Yuchsin {in Kedushin} and we conclude as follows:
Rav, who said that the child is a bastard does not mean a certain bastard, but rather a doubtful bastard, such that he would be forbidden to a female bastard. And the Shtuki {usually doubtful bastard} that Shmuel said is really a Beduki, that we interrogate {badkinan} his mother, and if she says that she had intercourse to a valid one, who in this case would only be her betrothed groom, she is believed.
And the halacha in this is like Shmuel, for he establishes like Abba Shaul.
For they learnt {tnan - in a Mishna}: Abba Shaul would call a Shetuki a Beduki.
And we say, what is a Beduki? That we interrogate his mother, and if she says "I had intercourse with a valid person," she is believed, even if most are invalid to her.
And Rava said: The halacha is like Abba Shaul.
Therefore, the halacha is like Shmuel who holds like him. But certainly, if we interrogate her and she says that she does know, the child is a doubtful bastard, and in this Shmuel does not argue.

א"ל אביי ובהא כי לא מודי מי מכשר ר"ג
והאמר שמואל לרב יהודה שיננא הילכתא כר"ג ואת לא תעביד עובדא עד דאיכא רוב כשרין אצלה והכא רוב פסולין אצלה
ולטעמיך תיקשי לך היא גופה הלכה ואת לא תעביד עובדא אלא הא לכתחילה והא דיעבד והכא כדיעבד היא:
We learn in Ketubot: There was a certain betrothed groom and betrothed bride who came before Rav Yosef. He said "{the child is} from me," and she said "{the child is} from him." Rav Yosef said: What should we be concerned about? Firstly, they admit. And furthermore, behold that Rav Yehuda cited Shmuel that the halacha is like Rabban Gamliel who said that she is believed.
Abaye said to him: And in this, when they do not admit, does Rabban Gamliel declare valid? But Shmuel said to Rav Yehuda: We have learnt that the halacha is like Rabban Gamliel, and you should not act in accordance with it until there are a majority of valid people {kesherim} by her. And here {continues the argument of Abaye}, there are a majority of invalid people {namely, not the groom} by her.
"And according to your reasoning it should be in internal difficulty to you. What does it mean that it is halacha yet you should not act in accordance with it? Rather, this is ab initio and this is after the fact. And here, it is like after the fact."

Mishna:
העבד פוסל משום ביאה ואינו פוסל משום זרע
כיצד בת ישראל לכהן ובת כהן לישראל וילדה הימנו בן והלך הבן ונכבש על השפחה וילדה ממנו בן הרי זה עבד היתה אם אביו בת ישראל לכהן לא תאכל בתרומה בת כהן לישראל תאכל בתרומה:
The slave invalidates her {from eating teruma} with intercourse but does not invalidate as her offspring.
How so?
The daughter of an Israelite {married} to a kohen, and the daughter of a kohen {married} to an Israelite, and she bears from him a son, and the son goes and violated a bondwoman, and she bears from him a son, this child is a slave. Thus, if his father's mother is the daughter of an Israelite {married} to a kohen, she may not eat of teruma; if the daughter of a kohen {married} to an Israelite, she may eat of teruma.

מאי טעמא אמר קרא האשה וילדיה תהיה לאדוניה:
What is the reason? Scriptures states {Shemot 20:4}:
ד אִם-אֲדֹנָיו יִתֶּן-לוֹ אִשָּׁה, וְיָלְדָה-לוֹ בָנִים אוֹ בָנוֹת--הָאִשָּׁה וִילָדֶיהָ, תִּהְיֶה לַאדֹנֶיהָ, וְהוּא, יֵצֵא בְגַפּוֹ. 4 If his master give him a wife, and she bear him sons or daughters; the wife and her children shall be her master's, and he shall go out by himself.
