{Bava Batra 6a}

"IF HE PUTS UP ANOTHER WALL CLOSE TO IT":
Rav Huna said: If the second wall matches half {the first wall}, it is the same as if it matched the whole.
And Rav Nachman said: where it matches it matches, and where it does not match it does not match.
And the halacha is like Rav Nachman. And Rav Nachman admits by a sustaining beam or fittings for fixing planks.

Rav Nachman {our gemara:Huna} said: Cavities for beams, this does not create a presumption that {the one who built it was assisted by the other}, even if he made the wooden lining in the cavities; for he can plead {when claiming part payment for it from the other}: The reason why I put them in was to prevent my wall becoming damaged, should you persuade me {to let you put cross beams in}.

Rav Nachman said: If a man has acquired a prescriptive right to rest small beams {upon his neighbor's wall}, that does not give him the right to {rest} large beams upon it; but if he has acquired the right to {rest} large beams, that does give him the right to {rest} small beams.

(* And Rav Yosef said: Even if he has acquired the right to {rest} small beams, he also has the right to {rest} large beams.
Some {versions} say: Rav Nachman said: Even if he has acquired the right to large beams, he has not acquired the right to small beams.
*)

And Rav Nachman said: If a man has a prescriptive right to let water drip {from his roof into his neighbor's courtyard}, he also has the right to {carry it off there by means of} a gutter-pipe; but if he has acquired the prescriptive right to {carry it off by means of} a gutter-pipe, he has not also the right to let it drip {from the roof}.
(* And some say: Rav Nachman said: Even if he acquired the prescriptive right to a gutter-pipe, he has acquired the prescriptive right to let it drip. *)
And Rav Yosef said: Even {to let it drip from} a cone-shaped roof of reeds {such that the constant dripping would be a nuisance}.
And Rav Yosef acted {, ruling} in an instance, by a cone-shaped roof of reeds.
And the halacha is like him.

Rav Nachman cited Rabba bar Avuah: If a man lets an apartment to another {Bava Batra 6b} in a large residence, he may make use of the projecting beams and the {cavities in the} walls until four cubits, and also the thickness of the wall, if this is the local custom, but not {the part of the wall facing} the front garden.
And Rav Nachman, stating his own position, said: even the side facing the front garden, but not the yard at the back of the house.
Rabba {our gemara: Rava} said: even the yard at the back.
And Ravina said: {If a man is allowed by his neighbour to support} the beam of his hut {on his wall} for thirty days

{Bava Batra 5a}
(* Runia bought land adjoining that of Ravina. Ravina thought to eject him because of the law of adjoining {that he was entitled to preempt him to buy the land. Rav Sama {our gemara: Rav Sama bar R' Yeva} said: People say "The hide costs four zuzim, and four are for the tanner."
*)

Mishna:
IF THE PARTY WALL OF A COURTYARD FALLS IN, EACH OF THE NEIGHBORS CAN BE COMPELLED BY THE OTHER TO [CONTRIBUTE TO THE COST OF] REBUILDING IT TO A HEIGHT OF FOUR CUBITS. [EACH OF THEM] IS ALWAYS PRESUMED TO HAVE GIVEN HIS SHARE UNTIL THE OTHER BRINGS A PROOF THAT HE HAS NOT GIVEN.

FOR REBUILDING HIGHER THAN FOUR CUBITS NEITHER CAN BE COMPELLED [TO CONTRIBUTE].

IF, HOWEVER, [THE ONE WHO HAS NOT CONTRIBUTED] BUILDS ANOTHER WALL CLOSE TO IT, EVEN THOUGH HE HAS NOT YET PUT A ROOFING OVER THE SPACE BETWEEN, THE [PRO RATA] COST OF THE WHOLE DEVOLVES UPON HIM, AND HE IS PRESUMED NOT TO HAVE GIVEN UNTIL HE ADDUCES PROOF THAT HE HAS GIVEN.

Gemara:

Resh Lakish said: If a lender stipulates a date for the repayment of a loan, and the borrower pleads {when the date of payment arrives} that he paid the debt before it fell due, his word is not accepted. Let him only pay when it does fall due!
{Bava Batra 5b}
And the halacha is like Resh Lakish. And even to orphans {who are his heirs}. And even though Master said "one who seeks to recover a debt from the property of orphans need not be paid unless he swears." This because the presumption is that a man does not pay a debt before it falls due.

It was a question to them: If he {=the creditor} claims payment some time after the debt falls due, and he {=the debtor} pleads, I paid it before it fell due, how do we decide? Do we say 'what motive has he to tell a lie', when there is a presumption {against him}, or not?
And this is not resolved. And any such {unresolved case} is stringent to the plaintiff and lenient to the defendant. Therefore, he swears an oath of heses {Rabbinic oath} and is exempt.

{Bava Batra 6a}
(* Come and hear: "EACH IS PRESUMED TO HAVE GIVEN HIS SHARE UNTIL THE OTHER BRINGS PROOF THAT HE HAS NOT GIVEN." When? If you say that he said "I payed it at the appropriate time," this is obvious! Rather is it not so that it is within the time? Thus, a person does pay before it becomes due!
It is different over there, for every single hour is its appropriate time.

Come and hear from the sefa {of that Mishna}: "HE IS PRESUMED NOT TO HAVE GIVEN UNTIL HE ADDUCES PROOF THAT HE HAS GIVEN."
When? If you say that he claimed payment after the time, and he {=the defendant} said "I have paid it in its proper time," why should the presumption be that he has not given? Rather, is it not that he claimed payment after the time, and he {=the defendant} said "I paid it within the time period {rather than at the due date}." Thus, we do not say "since" {he could have claimed I payed it at the time} in a place of a presumption.
It is different here, for he may say {to himself}, "How do I know that the Rabbis will compel me to pay?"

We learn in the gemara:
If one said to his fellow, "There is a maneh of mine in your possession," and the other one says "yes." {And} The next day, he says "give it to me." "I have already given it to you" -- he is exempt.
{But if he says} "I don't have of your in my possession," then he is liable.

Mishna:
IF A MAN HAS FIELDS SURROUNDING THOSE OF ANOTHER ON THREE SIDES AND FENCES THE FIRST, SECOND, AND THIRD, THE OTHER IS NOT BOUND [TO SHARE IN THE COST].
RABBI YOSSI SAYS: IF HE TAKES IT UPON HIMSELF TO FENCE THE FOURTH, THE WHOLE COST DEVOLVES UPON HIM.

Gemara:
Rav Yehuda cited Shmuel: The halacha is like Rabbi Yossi who said "IF HE TAKES IT UPON HIMSELF TO FENCE THE FOURTH, THE WHOLE COST DEVOLVES UPON HIM." It does not matter whether the encloser erects it, or whether the enclosed erects it.

It was stated {by Amoraim}:
Rav Huna said: All is {reckoned} according the material he used to fence.
And Chiyya bar Rav said: All is according to the price of reeds, at its cheapest.

{Bava Batra 5a}

Runia, Ravina enclosed him in from all four sides. {And then, he, presumably Ravina, fenced them in.}
He {=Ravina} said to him: Give me {money} for that which I fenced.
He {=Runia} said to him: No.
{Ravina said to him:} "Give me the cost of cheap reeds."
He {=Runia} said to him: No.
He {=Ravina} said to him: Then give me wages of a watchman.
He {=Runia} said to him: No.

(* One day, he {=Runia} was gathering dates. Ravina said to him sharecropper, "go and snatch for me a cluster of dates. He went to take them, and he {=Runia} raised his voice.
He {=Ravina} said: You have revealed your mind that you like this {fence}. Even if it were merely a goat, would you not need to watch it?
*)

This came before Rava. He said to him: Go and appease him (* with what he will be appeased with *), and if not, I will judge you like Rav Huna's interpretation of Rabbi Yossi {ABOUT THE FOURTH FENCE}, who said that all is {reckoned} according the material he used to fence.

And so is the halacha.

Rabbi Assi cited Rabbi Yochanan: Where he {formally} acquired it from his hand.
And where he formally acquired it from his hand, then what? It is mere words, and either may retract!
Where he acquired in from his hand in terms of sides -- X took the east side and Y took the west side.
Rav Ashi said: Such that this one went by himself and took hold of {via kinyan chazaka} his share, and this one, by himself took hold of his share. And because of this, neither is able to retract.

"IN DISTRICTS WHERE IT IS USUAL TO BUILD GEBIL, GAZITH, etc.":
Gevil are untrimmed stones. Gazit are trimmed stones. As is written {I Melachim 7:9}:

KEFISIN are half bricks. LEBENIM are whole bricks.

"In Gevil {untrimmed stones}, this one gives three handbreadths":
It was a question to them: Them and their mortar, or them without their mortar?
And we conclude: Them and their mortar.

"ALL ACCORDING TO THE CUSTOM OF THE DISTRICT":
To include what? To include places where fences are made of palm branches and branches of bay trees.

"THEREFORE IF THE WALL FALLS, THE PLACE AND THE STONES BELONG TO BOTH":
This is obvious! No, it is necessary, where it fell into the domain of one of them; alternatively, that one person cleared it into his domain. I would have said that for the other one, the principle would apply that if one wishes to take from his fellow, the burden of proof is upon him. Therefore it informs us that it is not so.
And we derive from this that as for a thing which was known to belong to two partners, even though it is not in the domain of one of them, it does not leave its presumed status of {belonging also to} the other one. What is the reason? Because partners are not so makpid {insistent} on ech other. Therefore, they have no presumed status without a proof or after division {of assets}.

BUT IN A STRETCH OF CORNFIELDS, IN A PLACE WHERE IT IS USUAL NOT TO FENCE OFF [THE FIELDS], NEITHER CAN BE COMPELLED. IF, HOWEVER, ONE DESIRES TO MAKE A FENCE, HE MUST WITHDRAW A LITTLE AND BUILD ON HIS OWN GROUND, MAKING A FACING ON THE OUTER SIDE.
CONSEQUENTLY, IF THE WALL FALLS, THE PLACE AND THE STONES [ARE ASSUMED TO] BELONG TO HIM.

(Gloss: They had thought that what is a mechiza (partition)? A wall,
{Bava Batra 2b}
and the reason {why either can be compelled} is that they agreed {to build a wall, rather than a mere fence of sticks}; thus, if they did not agree, they do not compell him. Thus it is that damage from seeing {and thus lack of privacy} is not called damage.

Come and here: "SIMILARLY WITH AN ORCHARD, IN A PLACE WHERE IT IS CUSTOMARY TO FENCE OFF." {and surely, the only reason is hezek re`iya}
An orchard is different, for Rabbi Abbahu {our gemara: Rabbi Abba} cited Rav Huna who cited Rav: It is forbidden for a person to stard at his fellow's field at the time of its standing grain.

Come and hear: 'If the wall of a courtyard falls in, he [the joint owner] can be compelled to help in rebuilding to a height of four cubits'.
If it falls, it is different. {for the owners must have previously agreed}

Come and hear: They can compel him to assist in building a gateway and a door to the courtyard.
The damage of the public {overlooking} is different.

Come and hear: '{A wall built facing} windows, whether above, below, or opposite, {must be kept} four cubits away'; and in explanation of this it was taught {in a brayta} that {if higher} it must be four cubits higher so that one should not be able to peep over and look in, and {if lower} four cubits lower so that one should not be able to stand on it and look in, and four cubits away so as not to darken the windows?
The damage for a house is different.

Come and hear: For Shmuel said {our gemara: Rav Nachman cited Shmuel}: 'If a man's roof adjoins his neighbour's courtyard, he must make a fence four cubits high.'
It is different there, for the owner of the courtyard may say to the owner of the roof: 'I do not know at what time you are coming, that I would be able to be secluded from you. For I have fixed times for using it {my courtyard}, but you have no fixed times for using it {your roof}.'

Until here {the gloss}.

and since they wish the divide it, they build they wall against their will. Thus, damage of seeing is called damage.
And if damage of seeing is called damage, why does it matter if they wish? When they don't wish as well, they must split.
Rabbi Yochanan said: Our Mishna is where there is no law {/right} of division, but if there was in it a law of division, even if only one of them wished to divide, they would divide it, because damage of seeing is called damage.
And if [our Mishna was where there was no right of division], when they agreed, what of it {that they can be compelled}? Either can retract!

Rabbi Yochanan said: Anyone who steals from his fellow {even} something worth a peruta, it is as if he took his soul {/life}. For it is stated {Mishlei 1}:
19 So are the ways of every one that is greedy of gain; it taketh away the life of the owners thereof.
and it says {II Shmuel 21}:
1 And there was a famine in the days of David three years, year after year; and David sought the face of the LORD. {S} And the LORD said: 'It is for Saul, and for his bloody house, because he put to death the Gibeonites.'
aWhat is the purpose of this "and it says" {giving an additional proof}? That if you say that there words are directly, but indirectly, no, then come and hear: 'It is for Saul, and for his bloody house..."
And where do we find by Shaul that he slew the Giveonim? Rather, because he slew Nov, the city of Kohanim, who provided them sufficient water and food, the Scriptures considers him as if he slew them {the Giveonites}.

was where he returned it to his purse which did not have zuzim in it. For since there are no zuzim in it, he will not feel in it. And therefore he has not fulfilled, for he will not feel in it. Therefore, if it is lost or stolen, it was stolen while still in the domain of the thief, and he is liable in its responsibility.

And in perek Eizehu Neshech {Bava Metzia 63b} we say: Rav Nachman said: If one borrows money from his neighbour and found a surplus therein, if it is an amount about which there could be an error, he must return it; otherwise, it is simply a gift that he gave him. {64a}
Rav Acha son of Rava said to Rav {our gemara: to Rav Ashi}: If he {=the lender} is a hard man, who never gives presents, what is the law?
He said to him: We can say that he stole from him {in the past} and is swallowing up this amount in the accounting. For they learnt {in a brayta}: If one stole from his fellow and swallowed it up in the accounting, he has fulfilled.
And so is the halacha.

we establish it as referring to a watchman who steals from his {own} domain. That Rabbi Yishmael maintains that his bailment did not end, and therefore he does not require anything, for he is in the place of the owners. And Rabbi Akiva maintains that his bailment ended, and therefore he requires the knowledge of the owners, for he is not in the place of the owners, and it is as if he did not return it, for they are still in his domain.

HE WOULD STILL BE RESPONSIBLE FOR IT.

AND IF THE PROPRIETOR KNEW NEITHER OF THE THEFT NOR OF THE RESTORATION, BUT COUNTED THE SHEEP AND FOUND [THE HERD] COMPLETE, [THE THIEF WOULD BE] EXEMPT [IN REGARD TO ANY SUBSEQUENT MISHAP].

Gemara:
Rav said: If with {the proprietor's} knowlege, he also must know {of the restoration}. Without knowledge {of the theft}, the counting exempts {the thief}. And when it states {in the Mishna} "AND COUNTED THE SHEEP, AND THEY WERE COMPLETE," this was referring to the sefa {namely, where he had no knowledge of the theft}.
And Shmuel said: Whether with his knowledge {of the theft} or without his knowledge, the counting exempts. And when it states "AND COUNTED THE SHEEP, AND THEY WERE COMPLETE," it is going on all of it {both resha and sefa}.
And Rabbi Yochanan said: With his knowledge, the counting exempts, but without his knowledge, even a counting is not required. And when it states "AND COUNTED THE SHEEP, AND THEY WERE COMPLETE," it is going on the resha.
And Rav Chisda said: With his knowledge {of the theft}, the counting exempts; without his knowledge {of the theft}, he requires knowledge {of the restoration}. And when it states "AND COUNTED THE SHEEP, AND THEY WERE COMPLETE," it is going on the resha.

Rava said: {Bava Kamma 118b} What is Rav Chisda's reason? Because living things have the habit of running out into the fields.

It is logical to us that the halacha is like Rav Chisda, because they have the habit of running out into the fields. For behold Rabba maintains like him, and furthermore, his reasoning is logical. And these words are regarding living things, because have they the habit of running out into the fields. But something which is not a living thing, such as a sela {coin} from a purse and the like, the halacha is like Rabbi Yochanan. For we establishing that in all disputes between Rav, Shmuel, and Rabbi Yochanan, the halacha is like Rabbi Yochanan. And Rav Chisda does not argue on Rabbi Yochanan except in the case of living things, because they have the habit of running out into the fields. But something which is not a living thing, he does not argue. Therefore, the halacha is like Rabbi Yochanan who said that with his knowledge {of the theft}, the counting exempts, while without his knowledge, even the counting is not required.

And this that one Tannaitic sources has that "if one stole from his fellow but {made up for it when he} swallowed it up in the accounting, he has fulfilled {his duty}" while another brayta teaches "he has not fulfilled" -- we conclude that all agree that the counting exempts, and all agree that they adopt the position of Rabbi Yitzchak, who said that a person is accustomed to feel in his purse at every hour, and this is where he was holding on to his purse, and it is no contradiction: this what he says he fulfilled is where he had zuzim in his purse, and since a person is accustomed to feel in his purse, behold he will count them after they have been returned, and therefore he has fulfilled, for counting exempts. And this that they taught that he has not fulfilled

{Bava Kamma 118a}
HE MAY NOT RESTORE IT TO HIM5 IN THE WILDERNESS;
UPON THE STIPULATION THAT HE WAS GOING INTO THE WILDERNESS, HE MAY MAKE RESTORATION EVEN WHILE IN THE WILDERNESS.

IF ONE MAN SAYS TO ANOTHER, 'I HAVE ROBBED YOU, I HAVE BORROWED MONEY FROM YOU, I RECEIVED A DEPOSIT FROM YOU BUT I DO NOT KNOW WHETHER I HAVE [ALREADY] RESTORED IT TO YOU OR NOT,' HE HAS TO MAKE RESTITUTION.

BUT IF HE SAYS, 'I DO NOT KNOW WHETHER I HAVE ROBBED YOU, WHETHER I HAVE BORROWED MONEY FROM YOU, WHETHER I RECEIVED A DEPOSIT FROM YOU,' HE IS NOT LIABLE TO MAKE RESTITUTION.

Gemara:
And they raised an objection {from a brayta}: 'A loan can be paid in all places, whereas a lost article {which was found}, or a deposit cannot be restored save in their place {=a place suitable for this.'
Abaye said: This is what it means to say: A loan can be demanded in any place, whereas a lost article {which was found} or a deposit cannot be demanded save in their {proper} place.

We deduce from here, from the Mishna and the brayta that one who loaned his fellow in a settled area has permission to collect from him in the wilderness, even against the will of the borrower. But if the lender does not wish to be paid in the wildreness, the borrower does not have permission to say to the lender "here are your zuzim which you have by me," but rather they stand under the responsibility of the borrower until he pays the lender in a settled area, when he lended to him in a settled area.

And these words are regarding a loan, but a lost article which he found in a settled area, or alternatively, a pledge which was deposited by him in a settled area, the owner of the lost article or the owner of the pledge does not have permission to demand it of his fellow when in the wilderness, when he does not have it with him. And just as his fellow is not obligated to return it to him in the wilderness when he does not have it with him, so too, if he does have it with him and the owner does not wish to accept it in the wilderness, this other one does not have permission to return it to him and to go off, but rather is obligated in its responsibility until they return to a settled area, when it was deposited with him in a settled area.

"IF ONE MAN SAYS TO ANOTHER, 'I HAVE ROBBED YOU, I HAVE BORROWED MONEY FROM YOU...'":
And this is specifically where his fellow has demanded it from him, for since he {=the defendant} is certain that he stole or borrowed, and is in doubt if he returned or did not return it, he is liable, for doubt does not take out of certainty.
And if his fellow does not demand it, but rather he says it on his own, while his fellow does not demand it of him, he is not liable, except if he comes to fulfill the requirements of Heaven.
And if his fellow does demand it of him, and says to him "I have a maneh in your possession," and he says "I do not know if I borrowed it from you or not," he is exempt. And this is what we learnt {in a Mishna}: "but if he says to him 'I do not know if I stole from you; if I borrowed from you; if you deposited by me [or you did not deposit], he is exempt."

And Rav Huna and Rav Yehuda who establish the Mishna as where he did not demand it from him, the halacha is not like them. Rather, even though he demanded it of him, he is exempt, for we establish like Rav Nachman and Rabbi Yochanan, who say {that in the case of one saying} "I have a maneh in your hand," and the other says "I do not know," he is exempt from paying, but must swear that he does not know; and if he comes to fulfill the requirements of Heaven, he is liable.

Mishna:
IF A MAN STOLE A SHEEP FROM THE HERD AND PUT IT BACK [THERE], AND IT SUBSEQUENTLY DIED OR WAS STOLEN

{Bava Kamma 117b}
Abaye said: This one is saving himself with his fellow's money.
He {=Rava} said to him: There is no greater redeeming of captives that this.

There was a certain person who got his donkey on a ferry before people left the boat. It was going to drown all the men, and one one them went and cast it in the water. The case came before Rava {our gemara: Rabba}, and he exempted him.
Abaye said: This one is saving himself with his fellow's money.
Rava said to him: This one was a rodef {threatening death}.

Rava {our gemara: Rabba} is consistent in his reasoning, for he says that a rodef who is pursuing after his fellow to kill him, and {in the process of this pursuit} broke vessels, whether of the man being pursued or of any other person, he is exempt. What is the reason? He is liable to capital punishment {and thus monetary matters fall by the wayside}. And if the man being pursued broke the vessels of the rodef, he is exempt; if of any other person, he is liable. Of the rodef, he is exempt -- for his money is not more stringent than his body {and the man being pursued can kill the rodef in self-defense}. Of any other person, he is liable -- it is forbidden for a person to save himself with his fellow's money. And if a person is pursuing a rodef {to prevent the murder} and breaks vessels, whether of the rodef, or of the nirdaf {man being pursued}, whether of any other person, he is exempt. And this is not by force of the strict law, but rather because if you do not say this, there will be no person who saves his fellow from the hand of the rodef.

{Bava Kamma 117a}

of Rav Pinchas and of Rav Mari, the sons of Rav Chisda. They {=the heathens} said to him "carry the wine and come with us." He carried the wine and came with them. The case came before Rav Ashi, and he exempted him.
The Sages said to him {=Rav Ashi}: But they learnt {in a brayta}: If he took and gave with his hand, he is liable!
He {=Rav Ashi} said to them: These words are where they were not {already} standing by it, but here, since they were already standing by it, it is as if already burnt.

{The Rif now finishes making his diyuk:} You can say well that this that they learnt {in a brayta} that he is liable, is even where he was forced, for then the Sages can ask from it upon Rav Ashi. But if you say that this that they learnt that he is liable is where he was not forced, but where he was forced, he is exempt, how can the Sages ask from it upon Rav Ashi? For that certain person Rav Ashi exempted was forced!

And furthermore, why did Rav Ashi say "these words were where they were standing by it?" Let him say to them "where he was not forced, while this one was forced!" Rather, we deduce from this that where they were not standing by it, even though he was forced, he is liable. And if you ask why showing is different from taking and giving by hand, that this is exempt and this is liable, for after all both of them are under duress -- this one is via indirect cause and this one is with his own hands.

And this line of thought is also supported from the fact that Rav Kahana {our gemara: Rabbi Abahu} objected to Rav Ashi: If a ruffian said to him "hand be this bunch of sheaves or this cluster of grapes," and he handed it to him, he is liable. And behold, here, even though he is standing by them, when he gives it to him with his hand, he is liable.
And we resolve: With what are we dealing? That they were standing on two banks of a riber, that he {=the ruffian} is not able to take them, and because of this, he is liable; and even though he is forcing him, he is liable.
And we derive from this that one who takes the money {or possessions} of his fellow and transfers him in his hands to a ruffian is liable, and even though he is under duress.

He {=Rabbi Eliezer} made lines {required for writing pesukim} and wrote to him: {Tehillim 39}:
2 I said: 'I will take heed to my ways, that I sin not with my tongue; {N}
I will keep a curb upon my mouth, while the wicked is before me.'
That even though there is a wicked one before me, I will keep a curb upon my mouth.
He {=Mar Ukva} sent to him: They are greatly oppressing me, and I do not find that I will arise from it.
He {=Rabbi Eliezer} sent to him: {Tehillim 37}:
7 Resign thyself unto the LORD, and wait patiently for Him;{N}
fret not thyself because of him who prospereth in his way, because of the man who bringeth wicked devices to pass.
{with a derasha on hitcholel with chalal, and lo meaning for him, thus meaning}
And he will cause them to fall before you as corpses.
Get up early and leave late because of them {to study} in the study hall, and they will perish of their own accord.
We derive from this that even in a case of suffering, it is forbidden to give over an Israelite to a gentile government -- and there is no difference between his body or his possessions.

who pointed out a heap of wheat of the house of the Exilarch. The case came before Rav Nachman. Rav Nachman obligated him to pay, based on this that they learnt {in a Mishna}: And if {the loss was} because of the thief, he is obligated to furnish him with a field.
And we establish that {indeed}, the case was where he merely pointed it out.

{Bava Kamma 117a}
Rav Huna bar Yehuda visited Bei Avyunei {either a poorhouse or the name of a place}. He came before Rava and said to him, "has there been any case which came to your hand?" He {=Rava} said to him: An Israelite whom Cutheans forced to show the money of his friend -- this came before me and I obligated him.
He {=Rav Huna bar Yehuda} said: Arise and reverse the matter to its owner {that he should get his money back}, for they learnt {in a brayta}: An Israelite whom Cutheans forced to show the money of his friend is exempt, though if he takes {the money} and places it with his own hand, he is liable.
And Rava {our gemara: Rabba} said: And if he shows it of his own accord, he is like one who got and gave with his own hand, and he is liable.

There is one {halachic decisor} who said that just as when an Israelite is forced to point out his fellow's money, he is exempt, so too, if an Israelite is forced to bring the money of his friend, and he goes and brings it, he is exempt.

And we do not maintain this, for when one delves into this sugya, it does not come out in accordance with this position whatsoever. For this that they learnt {in a brayta}, "and if he took and gave with his own hand, he is liable," with what are we dealing? If under duress, behold we have said that he is exempt. And if of his own accord, why should it matter if he took and gave? Even if he {merely} showed it, he would also be liable. Rather, is it not so that this is what it means to say: An Israelite whom Cutheans forced to show the money of his fellow, he is exempt. And specifically to show, but if he took and gave with his hand, he is liable -- and even though we was forced, there is no difference if they forced him and he want and brought, or if they forced him to bring and he brought.
And so it is also logical, for it stated: There was a certain person who showed the wine

He {=Rabbi} said to him: Is this a question? He only gets his wages {for his efforts, but not the value of his own lost donkey}.
An objection was raised: "If one hired a laborer
{Bava Kamma 116b} to bring a cabbage or damascene plums to a sick person, and {when he arrived} he found that he died, or that he became well, he is paid in full."
He said to him: There, the agent performed his agency, whereas here the agent did not perform his agency.

The Sages learnt {in a brayta}: If a caravan was traveling in the wilderness, and a band of robbers came upon it to plunder it {and they are going to bribe the band of robbers to go away}, they calculate {each person's contribution} in accordance with the money involved and do not calculate in accordance with the souls {people}. And if they hired a guide to go before them {so that they do not get lost in the desert, in paying his wages} they calculate even in accordance with the souls. But they do not deviate from the custom of donkey-drivers {in determining payment}. And the donkey-drivers are entitled to stipulate that whoever loses a donkey, that they should furnish him with another donkey. If it was lost by negligence, they do not furnish him with another one. Not by negligence, they furnish him with another one. And if he said "Give me and I will guard," they do not heed him.

To explain: If he said "give me the money for my donkey, for I do not wish to take a donkey, and I will guard with you just as at first," they need not heed him.

This is obvious! No, it is necessary, such as where he has another donkey. I would have said that he could say to them "behold I have another donkey among you." Therefore it informs us that they may say to him "upon two, you will commit yourself more, while upon one, you will not commit yourself more."

The Sages learnt {in a brayta}: If a boat was traveling on the sea, and a gale arose to sink it, and they lightened its load, they calculate {how much each must surrender} in accordance with the weight, and do not calculate according to the monetary calue. And they do not deviate from the custom of the sailors. And the sailors are entitled to stipulate among themselves that whoever loses a boat, they furnish him with another boat. If it is lost through negligence, they do not furnish him with one, but if not through neglicence, they furnish him. And if he went off to a place the sailors do not go, they do not furnish him.

The Sages learnt {in a brayta}: If a caravan was traveling in the wilderness, and a band of robbers came upon it and plundered it, and one arose and saved, he saved for all {such that they all split what he saved}. And if he said "I am saving for myself," he saves for himself.

How so? If they are able to save, even if he said as well, it is not worth anything! And if they are not able to save, even if he does not say, also {he is saving for himself}.
Rami bar Chama said: Here, we are dealing with partners, and in a case such as this, this partner can break up {the partnership} against the will of his fellow. If he said, then he is severing {the partnership}, but if he did not say, then he did not sever.

And Rava said: Here, we are dealing with a laborer, and like Rav.
For Rav said: A laborer is able to withdraw even in the middle of the day. If he {who saved from the robbers} said, then he is withdrawing, but if he did not say, then he is not withdrawing.

Rav Ashi said: Here, where they are able to save with great difficulty. If he did not say, then they would say to him, "If you would have said to us, we would have committed ourselves." If he said, then they have removed their intent from it.

These three explanations are {all} halacha.

"BUT IF IT WAS CAUSED THROUGH THE ROBBER HIMSELF, HE WOULD HAVE TO PROVIDE HIM WITH ANOTHER FIELD":
How so? If they confiscated all the land [of his and did not confiscate the entire land], and they confiscated this one {field} as well among them, then we derive from the resha: "IF THIS BLOW BEFELL THE WHOLE PROVINCE HE {=THE ROBBER} MAY SAY TO HIM {THE MAN ROBBED}, 'HERE IS THINE BEFORE THEE'." Thus, if it is not so, he is required to furnish him with a field.
With what are we dealing? Such as where they confiscated from him, and they said to him "show us your land," and he showed them this one as well among them. {but did not first steal the field}

He maintains that they did make for him the restoration of money {he paid} at the market.
And the halacha is like Rabbi Yochanan, who maintains that they did make for him the restoration of money at the market.
Rava said: By a notorious thief, they did not establish a restoration of money of the market.

It was stated {by Amoraim}: If he stole and paid off his debt; if he stole and paid off goods received on credit, they did not establish a restoration of money of the market.
What is the reason? For we say to him: Not for the things that he gave you {now} did you {initially} give him money.

As a pledge worth 200 for 100 {which the received}, they make for him {the person who took it as a pledge} a restoration of money of the market.
Worth 100 for 100:
Amemar said: They do not make for him a restoration of the market.
Mar Zutra said: They do make for him a restoration of the market.

As a sale for an equal amount {to their value}, they make for him a restoration of the market.
Something worth 100 for 200:
Rav Sheshet said: They do not make for him a restoration of the market.
Rava said: They do make for him a restoration of the market.

And the halacha in all of them is that they do make for him a restoration of the market, with the exception of where he stole and paid off his debt, or stole and paid off goods received on credit, where they do not make for him a restoration of the market.

He {=that person} stole and brought him a garment, and gave it to him, and borrowed upon it another four zuz. This came before Ravina. He said: The first four zuz, since it is stealing and paying his debt, he {the owner} does not need to pay to him {to Abaye}. These last four zuz, certain go and give him, and take your garment.
Rav Kohen objected to this: Perhaps the garment was just for these first four zuz that he gave him, such that it will be a case of stealing and paying for his debt {such that the owner would be exempt}, while the four last ones he was trusting him with as at first.
The matter moved about the courts and arrived before Rava. He said to them: The halacha is like Rav Kohen.

Abaye said: The owner of the book should go and give the resident of Mechoza 80 {zuz} and take his book, and the resident of Mechoza should go and take the {remaining} 40 {zuz} from the resident of Papunia.
Rava objected: Now that one who purchases from a thief, they enact for him a restoration of the money of the market, by one who purchases from a purchaser, would it not be all the more so? Rather, Rava said: The owner of the book should give to the resident of Mechoza 120 {zuz} and take the book, and the owner of the book {in order to recover some of that money} should go and take 40 from the resident of Papunia, and taken 80 from the thief.
And so is the halacha.

"IF ONE MAN WAS COMING ALONG WITH A BARREL OF WINE...":
{Bava Kamma 115b}
But why? Let him say to him, "I am obtaining it from hefker" {since the honey is being lost and is then ownerless}! As Rabbi Yirmeyah said: When the bale of the press-house was twined around it {it would not become ownerless, since it would only drip out}. In our Mishna as well, {say that it is} where the bale of the press-house was twined around it.

{Bava Kamma 116a}
"{If} he says to him 'I will save yours and you pay me the value of mine,' then he {=the other} is obligated to give to him" -- But let him say 'I was merely jesting with you!' For do we not learn {in a brayta}: "Behold if one was fleeing from prison and there was a ferryman before him, and he said to him {=to the ferryman} 'take a dinar and ferry me across', he {=the ferryman} only gets his wages." Thus it is clear that he can say "I was merely jesting with you." They say that it is only comparable to the sefa {of that brayta, which reads}: "If he said to him 'take this dinar as your wages and ferry me across,' he must pay the full wages {he specified, of a dinar}."
Why are the resha and the sefa different? Rami bar Chama said: In the sefa, we are dealing with a case in which he was a fisherman catching fish from the sea, such that he can say to him, 'you caused me to lose fish amounting to a zuz {=a dinar}.'

"SO ALSO IF A RIVER SWEPT AWAY HIS ASS AND ANOTHER MAN'S ASS...":
Rav Kahana inquired of Rav: If he descended to save {the other person's donkey, under the stipulation that he be paid for the value of his own donkey which would be lost}, and his own donkey came up on its own, what is the law? {Should he still be paid the stipulated amount?}
He {=Rav} said to him: This is from Heaven which had mercy upon him {and so his still receives the stipulated amount}.
Like this of Rav Safra, who was traveling with a certain caravan. A lion followed them, and every night they would cast to it one of their donkeys {so as not to be attacked themselves}. That night which reached Rav Safra's turn, they cast it his donkey, and the lion did not come. The next day, Rav Safra immediately retook possession of his donkey.
Rav Acha of Difri said to Ravina: Why did Rav Safta need to immediately take possession of it? It is obvious
