Ketubot 52a {93a - b}

52a

מאתים היו שם ג' מאות אלא הני נמי חולקות בשוה וכל חדא מינייהו שקלה מאה הואיל וכל חדא וחדא מינייהו לית לה בציר ממאה כסברא דרבי נתן בבבא קמא והוא הדין בהיות שם מאתים דכל חדא וחדא מינייהו לא מטי לה שעבודא דילה
200, that there were 300. Rather, these also are split evenly, and each of them takes 100, since each of them does not have in it less than 100, like the opinion of Rabbi Natan in the first gate. And the same is true if there are 200, that each and every one does not got away from her claim.

ואי איכא ארבע מאה פלגין תלת מאה מינייהו בשוה דשקלה כל חדא מינייהו מאה ומאה יתירא פלגי לה דמאתים ותלת מאה בשוה
דכבר אסתלקא לה דמנה ולא פש לה מידי
וכן נמי אי איכא חמש מאה פלגי כולהו לתלת מאה בשוה ומאתים יתירתא פלגי ליה תרוייהו בשוה
ואי אשתכח בתר הכי מידי שקלה ליה הך דאית לה תלת מאה ואי לא לא
הדין סברא דרבי דסבר דאזלינן בתר מאי דשוו להדדי דכל היכא דכי פלגינן בינייהו בשוה לא מטי לחדא מינייהו טפי מדילה פלגינן בינייהו בשוה
And if there is 400, they split 300 of it equally, for each of them takes of it 100, and the extra 100, the one with the 200 claim and the 300 claim split it equally, for the one with the 100 claim is already removed, and has no connection to it.
And so too, if there are 500, all of them split the first 300 evenly, and the additional 200, the two remaining ones split evenly. {Such that the 100 got 100, the 200 got 200, the 300 got 200.}
And if there is found after this anything, the one who has the 300 claim takes it, and if there is none more, she does not.
This is the opinion of Rabbi, who holds that we go after that which they are equal to one another. Such that so long as that when they are dividing it between them equally, no one is taking more than her total portion, they divide it between themselves equally.

והכי עבדינן עד דמטי לחדא מינייהו שיעורא דאית לה וכד מטי לה שיעור מאי דאית לה מסלקינן לה

And so they act until one of them reaches her full share, and when she reaches this full measure, what is due her, we remove her. And that which remains after this, they others divide until once again another of them reaches her full share which is due her. And what is left the last one takes until the full measure of what is due to her.

אבל רבי נתן סבר דאזלינן בתר שיעורא זוטא דבכולהו דפלגי לה כולהו בשוה
ומאי דפש מממונא חזינן מאי דשוו הנך תרתי בשעבודיה פלגי ליה
ושארא שקלה ליה הך דאית לה טפי מכולהו עד דמטי שיעורא דמשתכח לשיעורא רבא דכולהו דהוא תלת מאה
ואי איכא טופיינא על תלת מאה כגון דמשתכח ארבע מאה כיון דליכא בכולהו מאן דאית לה ארבע מאה פלגי להו לתלת מאה כדמעיקרא והך מאה יתירתא הדר ביה דינא לכדמעיקרא דחזינן (מאן) דשוו ביה כולהו להדדי ומשתעבד לכולהו פלגי ליה בשוה לפום מאי דפרישנא בסברא דידיה בפלוגתא קמייתא
והכי נמי עבדינן עד דמשתכחי שית מאה דהוא כללא דממונא דכולהו ושקלא כל חדא מינייהו שיעורא דילה עד גמירא
וטעמיה דרבי עדיף וטפי מסתבר הילכך הילכתא כוותיה
ומאן סגיא ליה בהאי פירושא לעיין בסוף מסכתא בפירושא דכתיבנא ליה בלשון ערבי:
However, Rabbi Natan held that we go after the smallest measure of all of them {the original 100}, and split that between all of them equally. And what remains of the money, we see what these {remaining} two are equal to each other in the claim, and that is what they split. And the remainder, the one which had more than the others takes, until she reaches the measure, and this where the measure is the greatest of all of them, which is 300.

And if there is more than 300 {to divide}, such that 400 are found, then since there is not amongst all of them one who has a claim of 400, they split the 300 as delineated initially. And this additional 100, they return the law to as it was at first, that we see that they are all equal to one another in it, and it is owed to all of them, so they split it equally, according to what we explained within his opinion in the original dispute.

And so too we act until they find 600, which is the entire sum of the money of all of them, in which case each of them take her measure, until the end.

And the reason of Rabbi is better and more logical. Therefore, the halacha is like him.

וכן ג' שהטילו לכיס זה מנה וזה מאתים וזה שלש מאות פיחתו או הותירו כך הן חולקין.
כלומר [לפי מעות] כדאתמרי בבבא דסיפא דמתני':
"And so too, three who cast into a purse {for trading}, this one 100, this was 200, and this one 300, if it increased or decreased, so do they split":
That is to say, [according to the money], as was stated in the gate of the last part of the Mishna.

אמר שמואל שנים שהטילו לכיס זה מנה וזה מאתים והותירו או פיחתו השכר לאמצע

אמר (רבא) מסתברא מילתא דשמואל בשלקחו שור לחרישה ועומד לחרישה
אבל לקחו שור לחרישה ועומד לטביחה
פירוש כגון שנמלכו עליו להעמידו לטביחה לחלוק באיבריו ואח"כ נזדמן להם ומכרוהו חי
זה נוטל לפי מעותיו וזה נוטל לפי מעותיו הואיל ואילו טבחוהו וחלקו באיבריו היה זה נוטל שליש מגופו וזה שני שלישים

ורב המנונא אמר אפי' לקחו שור לחרישה ועומד לטביחה השכר לאמצע
הואיל וכשהוא חי מכרוהו ועדיין לא חלקו שכיון שלא חלקו עדיין השותפות קיימת ולפיכך השכר לאמצע
Shmuel said: If two cast into a purse, this one 100 and that one 200, and it increased or decreased, the profit is to the middle {=equally divided}.

(*Rava *) {our gemara: Rabba, and so too later on} said: The matter of Shmuel is logical where they acquired an ox for plowing and it stood for plowing. But, if they acquired an ox for plowing and it stood for slaughter -- to explain, such that they changed their minds about it, that they should set it up for slaughter, in order to split its limbs, and afterwards it happened to them that they were able to sell it alive -- this takes according to his money and that one takes according to his money, since if they had slaughtered it and split its limbs, this one would have taken 1/3 from the body, and this one would have taken 2/3rds.

And Rav Hamnuna said: Even if they acquired an ox for plowing and it stood for slaughter, the profit is to the middle {, divided evenly}.
Since it was sold when alive, and they had not divided it, for since they had not yet split it, the partnership still stands, and therefore the profit is to the middle.

ואותבינן עליה דשמואל מהא דתנן וכן ג' שהטילו לכיס זה מנה וזה מאתים והותירו או פיחתו כך הן חולקין
מאי לאו הותירו הותירו ממש פיחתו פיחתו ממש וחולקין לפי מעות ותיובתא דשמואל אליבא דתרוייהו בין לרבה ובין לרב המנונא
אמר רב נחמן אמר רבה בר אבוה הותירו זוזי חדתי פיחתו אסתירי דציניאתא
And we attempt to refute Shmuel from this that they learnt {in the Mishna}, "and so too three who cast into a purse, this one 100 and this one 200, and it increased or decreased, so do they divide."
Does this "increased" mean actually increased, and does not "decreased" mean actually decreased, and they split according to the money? And thus this is a refutation to Shmuel according to both of them, whether to Rabba or to Rav Hamnuna?

Rav Nachman cited Rabba bar Avuah: They profited due to issuance of new coins {such that the profit is on the actual coins rather than business transactions}, or they lost due to it deteriorating into an astira {coin} which is only good for applying to a bunion.
