Rif Yevamot 3b {Yevamot 13b; 17a}

Gemara:

מקשינן הא דתנן ב"ש מתירין את הצרות לאחים ותו אהא דתנן מגילה נקראת באחד עשר בשנים עשר בשלשה עשר בארבעה עשר בחמשה עשר קרי כאן לא תתגודדו לא תעשו אגודות אגודות
ואסקה רבא כי אמרינן לא תתגודדו כגון בית דין אחד בעיר אחת פלג מורין כדברי בית שמאי ופלג מורין כדברי בית הלל אבל שני בתי דינין בעיר אחת לית לן בה וכ"ש ב' בתי דינין בשתי עיירות:
We ask: This that we learn in the Mishna: Bet Shammai permit the rivals to the brothers, and furthermore, on this that we learn in the Mishna, "the megillah is read on the 11th, on the 12th, on the 13th, on the 14th, on the 15th" -- but we read regarding this לא תתגודדו which we interpret as do not make separate sects.
And Rava concludes that when do we say לא תתגודדו? Such as a single Bet Din in a single city -- part rules like words of Bet Shammai and part rules like the words of Bet Hillel. But two courts in a single city, we have no issue with it. And certainly two courts in two different cities.

The Sages learnt {in a brayta}: There are some who either undergo yibbum or chalitza; who undergo chalitza but not yibbum; yibbum but not chalitza; not chalitza nor yibbum. The forbidden relations about whom they said that they do not undergo either chalitza or yibbum, add to them the wife of a eunuch of the sun {a natural eunuch}, the wife of a hermaphrodite, the wife of a brother from the mother's side, the wife of a convert, the wife of a freed slave, and an aylonit {infertile, who never develops the signs of maturity} do not undergo either chalitza or yibbum.
The female deaf-mute and the {female} idiot undergo yibbum and not chalitza.
Those prohibited by precept {=secondary, Rabbinic prohibited relatives = shniyot} and those prohibited because of holiness {such as e.g. a widow to a Kohen gadol or as divorcee to a regular kohen} undergo chalitza but not yibbum.
A barren woman or an elderly woman and the rest of {regular} women may either undergo chalitza or yibbum.

There are those {men} who may perform either chalitza or yibbum; may perform chalitza but not yibbum; yibbum but not chalitza; not chalitza nor yibbum.
To the forbidden about whom they said that they may not perform chalitza or yibbum, add to them a eunuch of the sun, a hermaphrodite, the brother from the mother's side, the convert, the freed slave.
For where there are two twin brothers, and their conception was not in holiness {their mother was not Jewish at the time} and their birth was in holiness, they do not perform chalitza nor yibbum, but they are liable for violating marrying one's brother's {ex-}wife.
The deaf-mute and the idiot may perform yibbum but not chalitza.
The doubtful ones, such as e.g. if he betrothed one of two sisters and does not know which of the two he betrothed, or if her child was mixed up with her daughter-in-law's child, or if she did not wait after her {ex-}husband 3 months, they perform chalitza and not yibbum.
One with crushed stones, maimed in his private parts, one castrated at the hands of man, and elderly man perform chalitza but not yibbum. And if they had intercourse they acquire {via yibbum} but it is forbidden to maintain them because of {Devarim 23:2}:
ב לֹא-יָבֹא פְצוּעַ-דַּכָּא וּכְרוּת שָׁפְכָה, בִּקְהַל ה. {ס} 2 He that is crushed or maimed in his privy parts shall not enter into the assembly of the LORD. {S}

And every other man may either perform chalitza or yibbum.

כיצד אשת אחיו שלא היה בעולמו ב' אחין ומת אחד מהן ונולד להן אח ואח"כ יבם השני את אשת אחיו ומת הראשונה יוצאה משום אשת אחיו שלא היה בעולמו והשניה משום צרתה עשה בה מאמר ומת שניה חולצת ולא מתייבמת שני אחים ומת אחד מהן ויבם השני את אשת אחיו ואח"כ נולד להן אח ומת הראשונה יוצאה משום אשת אחיו שלא היה בעולמו והשניה משום צרתה עשה בה מאמר ומת שניה חולצת ולא מתייבמת רבי שמעון אומר מייבם לאיזו שירצה או חולץ לאיזו שירצה:
How so the wife of his brother who was not in his world?
If there were two brothers, and one of them died, and a brother was born to them, and afterwards the second {of the two original} brother performs levirate marriage on his brother's wife, and then he {too} dies, the first one goes out {and is exempt from yibbum and chalitza} for being the wife of his brother {the first brother to die} who was not in his world, and the second one for being her rival.
If he does maamar {the Rabbinic equivalent of betrothal for yibbum} and then dies, the second one undergoes chalitza and not yibbum.
Two brothers, and one of them dies, and the second one performs levirate marriage on his {dead} brother's wife, and afterwards a brother is born to them, and then he {the brother who performed levirate marriage} died, then the first one {=the original brother's wife who was a yavama and is now a widow} goes out {without yibbum or chalitza} because of being the wife of the brother who was not in his world, and the second one because of being her rival.
If he did maamar {Rabbinic betrothal of a yevama before yibbum} and then he dies {and there is another brother}, the second one {=the rival} undergoes chalitza and not yibbum.
Rabbi Shimon says: He may perform yibbum on whichever one he chooses, or perform chalitza on whichever one he chooses.

The wife of the brother who was not in his world, where is it written?
Rav Yehuda cited Rav: The verse stated {Devarim 25:5}
ה כִּי-יֵשְׁבוּ אַחִים יַחְדָּו, וּמֵת אַחַד מֵהֶם וּבֵן אֵין-לוֹ--לֹא-תִהְיֶה אֵשֶׁת-הַמֵּת הַחוּצָה, לְאִישׁ זָר: יְבָמָהּ יָבֹא עָלֶיהָ, וּלְקָחָהּ לוֹ לְאִשָּׁה וְיִבְּמָהּ. 5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
Brothers who have a single {shared} dwelling in the world, to the exclusion of the wife of the brother who was not in his world. {The next word:} יַחְדָּו - together - who are distinct in inheritance, to the exclusion of brothers from the mother.

ואזדא שמואל לטעמיה דאמר שמואל הלכה כר' יהודה בן בתירא דתנן שומרת יבם שקידש אחיו את אחותה משום ר' יהודה בן בתירא אמרו אומרין לו המתן עד שיעשה אחיך הגדול מעשה וצריכא
Rav Yehuda cited Shmuel: A woman waiting for her yavam {to perform levirate marriage} who died, he is forbidden to marry her mother.
It is apparent that he maintains that there is zika {some form of attachment before the marriage}. And Shmuel is consistent in his opinion, for Shmuel said: The halacha is like Rabbi Yehuda ben Beteira that we learnt {tnan}: A woman waiting for her yavam, where his brother in the meantime married her sister -- in the name of Rabbi Yehuda ben Beteira they said that they say to him, "wait until your older brother consummates."
And it is necessary...
