Rif Ketubot 32a {70a; 71a - 72a}

32a

{Ketubot 70a continues}

But does not the steward act as an agent on his behalf? {And thus it should be forbidden under that same vow.}
Where he says "whoever maintains will not lose out."

{Ketubot 71a}
Rav said: They only taught this where he specified {the period of prohibition}, but if he said it without specification, he divorces immediately and grants the ketuba.
And Shmuel said: Even without specification as well he does not divorce, for perhaps he will find an opening to his vow.

They taught {in a Mishna}: If one forbade his wife by vow that she should not taste one of the fruits, he divorces and grants her ketuba.
This is fine according to Rav. Here is without specification and here is with specification. But according to Shmuel, it is difficult.
In what are we dealing here? Where she vowed, and he sustains it for her {without nullifying it}. And this Tanna holds that he has placed a finger between her teeth.
And the halacha is like Shmuel.

{Ketubot 71b}
Mishna:
If one forbade his wife via a vow that she should not go to her father's house, when they are in the same city as her, for one month he stays but two months, he divorces and grants the ketuba. And when they are in another city, for one Festival he stays with her but for two months, he divorces and grants the ketuba.
If one forbade his wife via a vow that she should not go to the house of a mourner or to the house of feasting, he divorces and grants her ketuba, since he shuts the door before her. And if he pleads that this was because of some other reason, he is permitted.
If he said to her: "{There is no vow} on condition that you tell this man Ploni what you told me," or "what I told you," or "that you fill and spill out to the trash heap," he divorces and grants the ketuba.

Gemara:
"To the house of feasting" is understandable {that there is an issue with his vow},
{Ketubot 72a}
for there is this aspect of shutting the door before her. But to the house of mourners, what "shutting" is there? A Tanna taught: Tomorrow she may die, and no one will eulogize her. And some {versions} say: No one will bury her.

They learnt {in a brayta}: Rabbi Meir would say: What is meant by what is written {Kohelet 7:2}:
2 It is better to go to the house of mourning, than to go to the house of feasting; for that is the end of all men, and the living will lay it to his heart.
What is meant by "and the living will lay it to his heart?" Matters of death. If one eulogizes {/mourns} for others, they will eulogize him; if he buries, they will bury him; if he escorts, they will escort him; if he carries {to the grave}, they will carry him.

"And if he pleads that it is for another matter, he is permitted":
What is "another matter?"
Rav Yehuda cited Shmuel: Because of the dissolute people {benei adam} who are found there.
Rav Ashi said: They only said this where this is established {as its reputation}, but if it is not established, it is not in his power to establish men as dissolute.

Rif Ketubot 31b {70a - 70b}

{Ketubot 70a continues}
Mishna:

If one forbade his wife by vow from having benefit from him, until 30 days he appoints a steward {to provide for the wife}. More than that, he sends her out and grants her her ketuba.
Rabbi Yehuda says: By an Israelite, a month he keeps her but 2 months he divorces her and grants her her ketuba. And by the wife of a kohen {our gemara: by a kohen}, two months he keeps and three months, he divorces and grants a ketuba.

If he forbade his wife by vow that she should not eat from one of all the fruits, he should divorce her and grant her ketuba.
Rabbi Yehuda says: By an Israelite, one day he keeps her and two days he divorces her and grants her ketuba. And by the wife of a kohen {our gemara: by a kohen}, two he keeps but three {days} he divorces and grants her ketuba.

If one forbade his wife by vow that she should not adorn herself with one of all all the adornments, he divorces and grants her ketuba.
Rabbi Yossi says: By poor women where he does not give a time limit; by rich women for thirty days.

Gemara:
And since he is obligated to {maintain} her, how can he forbid her by vow {to have benefit from him}? Does he indeed have the ability to remove her obligation upon him? But we learned {in the Mishna If a woman said to her husband}: konam {=a korban} that I do anything for your mouth, he does not need to nullify {since it is not valid in the first place}. Thus it is clear that since she is obligated to him, it is not in her power to remove her obligation to him. Here as well, he should not have the ability to remove his obligation to her from himself!?
{Ketubot 70b}
Where he says to her "deduct your handiwork for your maintenance."
If so, what need does she have for a steward? Where the large needs are met {by the handiwork} but the the handiwork is insufficient for the "small" needs which she was accustomed to in her father's house but "rolled with him" {put up with the lack}, and now she says to him, "until now, while you did not forbid me by vow, I was willing to roll with you. Now that you have forbade me by vow, I am not willing to roll with you."
And what is the difference between until thirty days? Until 30 days, people {our gemara: do not} hear and do not consider it degradation, but more, people hear and consider the matter degradation.

Rif Ketubot 31a {69a - 70a}

31a

that the conditions of the ketuba are like the ketuba itself. But marriage outfit, which is not in the conditions of the ketuba, stands as it originally stood.

{Ketubot 69a}
Rav Nechemiah son of Rav Yosed sent to Rava bar Rav Huna Zuta, to Nehardea: When this woman comes before her, let her collect 1/10th of the assets, even from the casing of the handmills. {since this is considered land}
Rav Ashi said: When we were at the academy of Rav Kahana, we allowed collection from the rent of houses.

{Ketubot 69b}
Mishna:
If one appoints {as a deposit with a third party} money for his daughter, and she says, "my husband is trusted to me," the third party {who has the deposit} must act as he was entrusted to do {and he buys a field with it}. These are the words of Rabbi Meir.
Rabbi Yossi said: And if it were only a field and she wished to sell it, she could sell it from now!
When are these words said? When she is an adult, but by a minor, the act of a minor is nothing.

Gemara:
The Sages learnt {in a brayta}: One who entrusts money for his son-in-law to purchase a field for his daughter, and she says "give it to my husband," if when married {nisuin} the authority is in her hand. If from betrothal, the trustee does what he was entrusted to do. These are the words of Ravvi Meir.
Rabbi Yossi says: An adult woman, whether from betrothal or marriage, the authority is in her hand. A minor, whether from betrothal or marriage, the trustee does what he was entrusted to do.
What is the practical distinction between the two of them? An adult woman, from betrothal. For Rabbi Meir holds that although she is an adult, it is a precept to fulfill the words of the deceased. Therefore the trustee should do as he was entrusted to do. And Rabbi Yossi holds that since she is an adult, the authority is in her hands. And this which was stated in the Mishna "when are these words said" [is Rabbi Meir], and the text is as if deficient, and this is what it means to say: "The trustee should do what he was entrusted to do. These are the words of Rabbi Meir. About what are these words said? From betrothal, but from marriage, the authority is in her hand. Where are these words said? By an {female} adult, but by a minor, the act of a minor is nothing.

It was stated {by Amoraim}:
Rav Yehuda cited Shmuel: The halacha is like Rabbi Yossi.
And Rava cited Rav Nachman: The halacha is like Rabbi Meir.
And we establish like Rav Nachman in dinim {monetary matters}.

They learnt {in a brayta}: If one said "give my children {from my estate} one shekel a week," and they are fit to recieve {that is, they require} a sela {=2 shekel}, they give ten a sela. And if he says "Do not give except for a shekel," they only give them a shekel. And if he said "if they die and the following others are to be the heirs," then whether he said "give" or whether her said "do not give {more}," they only give them a shekel.

{Ketubot 70a}
Rav Chisda cited Mar Akva: The halacha is that whether he said "give" or said "do not give {more}," we give them all their needs.
But we establish that the halacha is like Rav Meir who said that is a commandment to fulfill the instructions of the deceased?!
Those words were about other matters, but in this, it is satisfactory for him, and this that he said so {such as "only give"} is to encourage them {to be thrifty}.

We learnt {in a Mishna} there: Little children {aged 9 and 10, according to Rashi, aged 6 and 7 according to Rashba}, their purchase is a valid purchase and their sale is a valid sale, by movable objects.
Rafram said: They only taught this where they have no guardian, but if they have a guardian, their purchase is no purchase and their sale is no sale.
From where? From the fact that it taught in the Mishna, "there is nothing to the act or of {female} minor," and it did not teach "the trustee must act as he has been entrusted" as it teaches by a {female} adult, we derive from this that the act of a female minor is nothing, whether where there is a trustee or whether there is a guardian.
And so is the halacha.

Rif Ketubot 30b {68b - 69b}

{Ketubot 68b continues}

And does Rava indeed say this? But Rava objected to Rav Nachman that an orphaness whose mother married her off, etc., and we learn it that here is where she objects and here is where she does not object.
This is no contradiction: Here is where she is provided for by them and here is where she is not provided for by them.

We now learn from all these statements that when they {=the females} reach adolescence or are married, if they are provided for from them, they have this support {=the 1/10th}, even though they do not object; and if they are not provided for from them, they need to object, and if they do not object, they do not have this support.
And if they do not yet reach adolescence nor marry, even though they are not supported from them, they have this support, and do not need to object.
And if they reach adolescence and marry, even though they are provided for by them, they need to object, and if they do not object, they do not have this support.

Rav Huna cited Rabbi: The marriage outfit is not like a condition of the ketuba.
What does this mean that it is not like a condition of the ketuba? As we learnt {in a brayta}: If one says not to provide for his daughters from his estate, we do not listen to his. Not to give the marriage outfit from his estate, we listen to him. For the marriage outfit is not like a condition of the ketuba.
And there are nuschaot in which the opposite is stated, and according to the opposite nushchaot, the halacha is not like Rabbi.

{Ketubot 69a}

Rav inserted the following {query} to Rabbi between the lines: The brothers have encumbered {the assets} what is the law {that is may they be seized}? Rabbi Chiyya was sitting before him. He said to him: Did they sell them or give it as a pledge {for a loan}? He said to him: What difference is there to you in this? Whether they sold it or gave it as a pledge, we take it out for the purpose of marriage outfit but do not take it out for provisions.
And Rabbi Yochanan said: Both for this and that, we do not take out.
And we do not hold like Rabbi Yochanan, for we establish like Rabbi who said that we take it out for marriage outfit but do not take it out for provisions.

It was stated {by Amoraim}: If one died and left two daughters and a son, and the first {daughter} preempted and took 1/10th of the assets, and the second did not get a change to take before the son died:
Rabbi Yochanan said: The second one has surrendered {her rights to this particular 1/10th, and the rest they split}.
Rabbi Chanina said to him: Greater than this they said, that they seize {the estate} for marriage outfit (*and they do not seize it for provisions *), and {yet} you say the second has surrendered?

And it is logical to us that the halacha is like Rabbi Yochanan in this, because there is a house amply provided for.
For Rav Ashi, who was later {batra} so holds, for we say: Rav Yemar said to Rav Ashi: But now, if she found any find at all, such that the house is amply provided for, would we here too say that we do not give her 1/10th of the assets. He said to him: I say, a house amply provided for from the same assets.

However, in the Yerushalmi they rule the halacha like Rabbi Chanina. For we learn there: One who died and left two daughters and one son, and the first one took 1/10th of the assets, and the son died -- Rabbi Chanina says: Even the second takes 1/10th of the assets, and the rest they split evenly.
Rav Tavu cited Rabbi Yoshia: The reason of Rabbi Chanina is that if from the assets under lien she collects, then all the more so from that which is before her!
Rabbi Zeira asked before Rabbi Assi: How do we act in practice?
He said to him: Like Rabbi Chanina.
And so too went out an incident like Rabbi Chanina.

Amemar said: A daughter is an heir, in that if they wish to send her away with coin, they cannot send her away.
Rav Ashi said: She is a creditor, and that they are able to send her away with coin.
And the halacha is like Rav Ashi.
And even Amemar retracted.
And now that you have said that she is a creditor, is she one of the father or of the brother?
To what practical distinction? To collecting from the medium level land without an oath, and from the lowest level land with an oath. What {type of creditor}?
Come and hear. For Ravina allowed the daughter of Rav Ashi to collect from Mar bar Rav Ashi medium level land with an oath, and from Mar son of Rav Chama {our gemara: Sama} son of Rav Ashi from the lowest level land, with an oath.
We thus deduce that she is a creditor of the brother. We so deduce.

{Ketubot 69b}

Rava said: The halacha is that {she may collect} from land but not movable objects, whether for provisions, marriage outfit, or ketuba.

And nowadays, the Sages in the Metivta enacted to collect the ketuba even from movable objects. [Therefore, provisions also even from movable objects.] For we establish

We have seen a Gaon who writes that we go after our estimation of the father's attitude to reduce from 1/10th of the assets, but to add to the 1/10th, no, for we do not find explicitly one who said that we add to the 1/10th.
And in perek Naarah sheNitpateta, we say:
Rabbi Yochanan cited Rabbi Shimon ben Yochai: Why did they enact the ketuba of male children? So that a man will leap to give his daughter like his son.
And until how much? Abaye and Rava both say "until 1/10th of the assets."
Therefore, me cannot take out of the assets of the orphans more than 1/10th of the assets.

And another Gaon said that Rabbi Yehuda, who said "if he married off his first daughter, to his second daughter is given in the same he gave to his first daughter," making it clear that we go after an assessment of the father's attitude, this was said plainly without stipulation, such that it does not matter whether to reduce from the 1/10th or to add to the 1/10th.
And since the halacha is ruled explicitly like Rabbi Yehuda, we act in accordance with him -- that where we know an estimation of the father's attitude, we give her how much we estimate, whether to reduce from the 1/10th or to add to the 1/10th, and if we do not know his attitude, we give her 1/10th of the assets.

To return to the actual text:
Rabbi says: A daughter supported by the brothers takes 1/10th of the assets.
They said to him: According to your words, one who has 10 daughters and 1 son, the son gets nothing when there are these daughters here.
He said to them: So do I say: The first takes 1/10th of the assets, the second {1/10th} of the remaining {rather than the initial sum}, the third of what remains, and they return and divide equally.
Divide equally?
{Ketubot 68b}
But each one has taken her own! This is what it means to say: If all of them come to marry at once, they divide equally. And so is the halacha.

The Sages learnt {in a brayta}: The daughters, whether they matured before marriage of married before maturity, they lose their provision but do not lose their marriage outfit. These are the words of Rabbi.
Rabbi Shimon ben Eleazar says: They even lose their marriage outfit {this 1/10th of the estate}.
How should they act? They hire for themselves husbands {who will say they are willing to marry them} and thus extract for themselves the marriage outfit.

Rav Nachman said: Huna said to me that the halacha is like Rabbi.
Rava objected to Rav Nachman: "A orphaness whose mother and brother married her off {even} with her consent and they write for her {of the estate} 100 or 50 zuz, she is able, when she matures, to extract from their hands what is due to be given her." The reason is that she is a female minor. But, if she were an adult, this would have been forgiving {the amount due her}.
This is no contradiction. Here is where she protested and here is where she did not protest.

And so is also logical, for if so {that is, otherwise}, there would be a contradiction between Rabbi and Rabbi. For they learnt {in a brayta}: Rabbi says that a daughter who is provided for by the brothers takes 1/10th of the assets. Implying that if supported, yes, but in not supported, no. Do we not deduce from this that here is where she objects and here is where she does not object? We so deduce.

Ravina said to Rava: Rav Ada bar Ahava said to us in your name: If she became an adolescent and did not marry, she does not need to object. If she married and did not achieve adolescence, she does not need to object. If she achieved adolescence and married, she needs to object.

Rif Ketubot 29b {Ketubot 67b continues; 68a}

29b

{Ketubot 67b continues}

The Sages learnt {in a brayta}:
דֵּי מַחְסֹרוֹ -- you are commanded to support him, but you are not commanded to make him wealthy.
אֲשֶׁר יֶחְסַר לוֹ -- even a horse to ride upon and a servant to run before him.
They said about Hillel the elder that he hired, on behalf of a poor man of a good family, a horse to ride upon and a servant to run before him. One time he did not find a servant to run before him, and he {=Hillel the elder} ran before him for 3 mil.
If he did not have and did not wish to be supported, they give it to him as a gift and if he does not accept, they give it to him as a loan, and then turn around and give it to him as a gift.

The Sages learnt {in a brayta}: {In that same pasuk in Devarim 15}
תַּעֲבִיטֶנּוּ -- "shall surely lend him" -- this is he who does not have and does not wish to be supported except from charity, they give to him in the name of a gift, and then turn around and are repaid from him after death. These are the words of Rabbi Yehuda. And the Sages say: If he has and he does not wish to maintain himself, we need not concern ourselves with him. Rather, about what shall I apply תַּעֲבִיטֶנּוּ {which is a duplicate word, coming after וְהַעֲבֵט} -- the Torah speaks in the language of people.

{Ketubot 68a}
Rabbi Chiyya bar Rav of Difti taught: Rabbi Yehoshua says: Anyone who lifts his eye from charity is as if he worshiped idols. It is written here {Devarim 15:9}
9 Beware that there be not a base thought in thy heart, saying: 'The seventh year, the year of release, is at hand'; and thine eye be evil against thy needy brother, and thou give him nought; and he cry unto the LORD against thee, and it be sin in thee.
and it is written there {Devarim 13:14}:
יד יָצְאוּ אֲנָשִׁים בְּנֵי-בְלִיַּעַל, מִקִּרְבֶּךָ, וַיַּדִּיחוּ אֶת-יֹשְׁבֵי עִירָם, לֵאמֹר: נֵלְכָה, וְנַעַבְדָה אֱלֹהִים אֲחֵרִים--אֲשֶׁר לֹא-יְדַעְתֶּם 14 'Certain base fellows are gone out from the midst of thee, and have drawn away the inhabitants of their city, saying: Let us go and serve other gods, which ye have not known';
Just as over there is idolatry, so too over here is idolatry.

The Sages learnt {in a brayta}: Whoever pretends to be blind, have a shrunken leg {or according to Jastrow, a hump}, or a swollen belly in order to take charity which he does not need, he will not leave the world until he comes to this state.

They learnt {in a Mishna} there: We do not require the pauper to sell his house and his household items.
But they learnt {in a brayta}: If he made use of a gold vessel, he should instead make use of a silver vessel. Of a silver vessel, he should make use of a copper vessel.

Rabba son of Rav Huna said: This refers to a silver strigel {used to scrape skin after a bath such that it is no big deal switching metals}.
Rav Pappa said: This is no question. Here is before he came to collection and her is after he comes to collection.
To explain: So long as he only takes privately, we do not require him to sell his household items. But if he needs to take from the collection basket, we do not give to him until after he sells.

Mishna:
An orphaness who was married off by her mother and brother, {even} with her consent, and they wrote for her {as her share in the estate of her father} 100 zuz or 50 zuz, when she matures she is able to take it from their hands what is fit to give to her {a tenth of the estate}.

Rabbi Yehuda says: If he {=the father} married off the first daughter, the second daughter {who married after his death} should be given in the same way as the first.
And the Sages say: There are times that a man was poor and became rich, or was rich and became poor. Rather, we assess the assets and give to her.

Gemara:
Shmuel said: For marriage outfit, we assess based on the father.
That is to say, we assess and estimate the mind of the father, and say, "If the father was alive, how much would he have given to his daughter for marriage outfit to the husband" and give it to her.
And we object to Shmuel from out Mishna which stated that there are times that he was a poor man and became rich, but rather we assess the assets and give to her.

What is meant by "he was a pauper and became wealthy?" If you say that a pauper is a pauper in assets and a wealthy man is wealthy in assets, we deduce that the Tanna Kamma holds that even if he was a wealthy man and became poor, we give as initially, and behold he does not have! Rather is it not that a pauper is a pauper in mind {=attitude} and that a rich man is a rich man in attitude? And it states that we assess the assets and give her. Thus, we do not go after estimation. {Thus, this is a question on Shmuel.}
And we resolve it that he says like Rabbi Yehuda, for we learnt {in the Mishna} that Rabbi Yehuda says that if he married off a first daughter, it is given to the second daughter {married off after his death} in the way that he gave to the first. And let us say that the halacha is like Rabbi Yehuda. If you say that the halacha is like Rabbi Yehuda, I would believe that specifically where he married off {while he was alive}, such that he revealed his mindset, but if he did not marry off. Therefore it informs us that the reason of Rabbi Yehuda is that we go after estimation, and it does not matter whether he married off or did not marry off, and this that it said he married off is to show the power of the Sages {'s position}, that even though he married off {a daughter} and revealed his mindset, we do not go after estimation.

Rava said to Rav Chisda: We are expounding in your name that the halacha is like Rabbi Yehuda.
He {=Rav Chisda} said to him: Let it be the Will {of Hashem} that all these sublime matters are expounded in my name.
And does Rava actually say this? But we learnt {in a brayta}: Rabbi says that a daughter who is provided for from the brothers takes 1/10th of the assets.
And Rava said that the halacha is like Rabbi!
This is no question. Here is where they estimated him, and here is where they did not estimate him.
That is to say, if we know the estimation of his attitude, we give to her how much we estimate, and if we do not know the estimation of his attitude, we give her 1/10th of his assets.
This is also logical, for Rav Adda bar Ahava said: There was an incident in which Rabbi gave her 1/12th of the assets. We deduce from this that here is where we estimated and here is where we did not estimate. We so deduce.

Rif Ketubot 29a {Ketubot 66a continues; 66b - 67b}

29a

{Ketubot 66a continues}
Mishna:

If one allocated money to his son-in-law and then his son-in-law died, the Sages said that he is able to say, "to your brother I wished to give, but to you I do not wish to give."
If she allocated to bring in {to marriage} to him 1000 dinarim, he allocates corresponding to them 15 maneh {=1500 dinarim}.
And corresponding to assessed goods, he allocates {as her ketuba} 1/5th less.
{If he was asked to put in the ketuba} "Goods assessed at a maneh" and it is really worth a maneh, he only has a claim for a maneh.
{Otherwise, if asked to put in the ketuba} "Goods assessed at a maneh {=100 dinarim}" she gives him 31 sela and a dinar. {Since a sela = 4 dinar, 31 X 4 = 124 + 1 dinar = 125. Thus, the 100 dinar is 1/5 less.}
"For 400," she gives 500.
{Ketubot 66b}
Whatever a bridegroom assigns {his wife in a ketuba}, he assigns at 1/5th less {the value}.

Gemara:
The Sages learnt {in a brayta}: It need not be said in the case in which the first one is a Torah scholar and the second one an ignoramus, but even if the first one is an ignoramus and the second one a Torah scholar, he is able to say "To your brother I wished to give but to you, I do not desire to give."

Yerushalmi: And these things which are acquired with speech, Bar Kappara taught {in a brayta} that he allocated on condition to take in {in marriage}.
To explain: Anything he allocates to his son-in-law, his mind is on the condition that he {the son-in-law} will take in, and since his son-in-law died and did not take in {the man's daughter in marriage}, he is not obligated to give to his brothers.
And we have seen one who offers a different explanation, but we only hold like this which we have written.

Yerushalmi: What did they see to say by money, 1 and a half, but by assessment {of goods}, reduction by 1/5th?
Rabbi Yossi beRabbi Chanina said: They assess the mind of the woman, that she wishes to wear down her vessels and to thus reduce them by 1/5th, and they assess the mind of the man, that he deals in money and makes them into 1 and 1/2 {their value}.
Rabbi Yossi said: This tells us that a man is not allowed to sell his wife's vessels.

Mishna:
If she allocates to bring in to him money, each sela {=4 dinarim} become 6 dinarim {thus, 1 and 1/2}, and the bridegroom accepts upon himself 10 dinarim to her {perfume} basket for each and every maneh {100 dinarim}.
Rabban Shimon ben Gamliel says: All is according to the custom of the country.

Gemara:
And the halacha is like him.

"Ten dinarim to the basket":
What is the basket?
Rav Assi {our gemara: Ashi} said: A basket of perfume.
And Rav Assi {our gemara: Ashi} said: These words were only said in Yerushalayim.

{Ketubot 67a}
Mishna:
If one marries off his daughter plainly {without specifying conditions}, he should not give her less than 50 zuz.
If he {the groom} agreed to allocate to take her in naked {that is, without bringing in clothing}, the husband shall not say "when she comes into my house I will clothe her," {read אכנסנה instead of אכסנה} but rather he clothes her while she is still in her father's house.
And so too one who marries off a {female} orphan, they should not reduce from 50 zuz. And if there is in the {charity} purse, she is fitted out according to her honor.

Gemara:

Abaye said: These 50 zuz are small coins {of zuz}.

The Sages learnt {in a brayta}: An orphan and an orphaness who come to be supported {from charity}, they support the orphaness and afterwards support the orphan, for it is the way of a man to return {our gemara: lachazor al hapetachim -- to go begging at the doors} and it is not the way of a woman to return {our gemara: to go begging at the doors}.
{Ketubot 67b}
An orphan and an orphaness who came to be married off, they marry off the orphaness and afterwards marry off the orphan, for the shame of a woman is greater than that of a man.

The Sages learnt {in a brayta}: An orphan who comes {for assistance} to marry a woman, we rent him a house and prepare for him a bed, and all his necessary household objects, and afterwards he is given to marry a woman, for it is stated {Devarim 15:8}:
8 but thou shalt surely open thy hand unto him, and shalt surely lend him sufficient for his need in that which he wanteth.

מחסורו -- this is a house.
אשר יחסר -- this is movable objects
לו -- this is a wife.

Rif Ketubot 28b {Ketubot 64b; 65b - 66a}

{Ketubot 64b}
Mishna
:

He gives her a ma'ah of silver for her needs, and she eats with him from one night of Shabbat to the next night of Shabbat.
And if he does not give her a ma'ah of silver for her needs, her handiwork is hers.
And what does she do for him? The weight of 5 sela of warp in Judea, which are 10 in Galilee {based on different standards of measurement}, or the weight of 10 sela woof in Judea, which are 20 in Galilee.
And if she is nursing, they reduce from her {required} handiwork and add to her food.
Where are these words said? By the poorest man in Israel. But by the honored, all according to his honor.

{Ketubot 65b}
Gemara:
What is meant by the statement that "she eats?"
Rav Nachman said: She actually eats.
And Shmuel said: Intercourse, as is written {Mishlei 30:20}
20 So is the way of an adulterous woman; {N}
she eateth, and wipeth her mouth, and saith: 'I have done no wickedness.' {P}
And we establish like Rav Nachman in dinim.

Rav Huna said: How do we know that a guest is forbidden in intercourse? For it is written {I Shmuel 1:19}:
19 And they rose up in the morning early, and worshipped before the LORD, and returned, and came to their house to Ramah; and Elkanah knew Hannah his wife; and the LORD remembered her.
Now, yes, but initially, no.

"And if she is nursing, they reduce from her her {required} handiwork and increase her food":
R' Ulla Rabba expounded at the entrance of the house of the Prince: Even though they said that a man does not {need to} support {/feed} his minor sons and daughters, he must still feed the really young minors.
And how much? Until 6 years old, as Rav Ashi said: A 6 year old is exempt via the eruv of his mother.
Our Mishna supports him, for they learn {in a Mishna}: And if she is nursing, they reduce from her {required} handiwork and add to her food.

It was stated {by Amoraim}:

The find of a woman and her handiwork are to her husband, as well as her inheritance, and he eats the fruits in her lifetime. Her embarrassment and blemish {payments} are hers.
Rabbi Yehuda ben Beteira says: When in private, she gets 2/3 and he gets 1/3/ When revealed, he gets 2/3 and she gets 1/3. His they give to him immediately and hers, land is acquired and he eats the fruits.

They learned {in a Mishna} there: {If a woman says} Konam that I do anything for your mouth, he does not need to nullify it. Rabbi Akiva says: He should nullify it, lest she increase for him more than it fit for him.
When Rabin came he cited Rabbi Yochanan: With surplus which is not due to much exertion, all agree that it is the husband's. With surplus which is due to much exertion, the Tanna Kamma holds that it is the husband's and Rabbi Akiva holds it is hers.
And the halacha is like the Tanna Kamma, and so ruled Rabbenu Hai Gaon, z"l.

Rabbenu Hai Gaon, z"l, wrote that so they brought up in the Yeshiva, that even though in dispute between an individual and the many, the halacha is like the many, here, the halacha is like Rabbi Yehuda ben Beteira. Since the Sages ask and resolve according to Rabbi Yehuda ben Beteira, we derive from this that the halacha is like him.

{Ketubot 64b}
Mishna:

If one maintains his wife via a trustee, he should not give her less than two kav of wheat or than four kav of barley.
Rabbi Yossi said: The only who allocated out barley was Rabbi Yishmael, who was close to Edom.
And he also gives her half a kav of pulse, half a log of oil, and either a kav of dates or a maneh of pressed figs. And if he does not half them, he allocates in their stead fruits from another place. And he gives her a bed and a mattress, and if he does not have a mattress, he gives her a rush mat. And he gives her a cap for her head, a girdle for her loins, and sandals from one festival to the next festival, and clothing worth 50 zuz once a year. And he does not give her new clothing in the sunny season nor worn-out clothing in the rainy season, but rather he gives her clothing worth 50 zuz, and she clothes herself with the worn out clothes in the sunny season, and the worn out clothing is hers.

And it does not mention wine! This supports Rabbi Eleazar. For Rabbi Eleazar said:
{Ketubot 65a}
We do not allocate wine for a woman.
And these words are where she is not accustomed to it, but if she is accustomed to it, we allocate. For we say: The wife of Rav Yosef son of Rava came before Rav Yosef {our gemara: before Rav Nechemiah the son of Rav Yosef}. She said to him: Allocate for me provisions. He allocated for her. "Allocate for me wine." He allocated for her. He said, "I know about the residents of Mechoza that they drink wine."
The wife of Rav Yosef son of Rav Menashia of Devil came before Rav Yosef. She said to him: Allocate for me provisions. He allocated for her. "Allocate for me wine." He allocated for her. "Allocate for me silks." He said to her, "why do you need silks?" She said to him: For your friends and associates {=to maintain social standing}.

The Sages learnt {in a brayta}: A surplus of provisions {food} is to the husband; a surplus of worn-out clothing is to the woman?

What use does she have of them? Rav Pappa said: That she wears them during her days of menstruation so that she does not become repulsive to her husband.
Abaye said: We have a tradition that the surplus of worn-out clothes of a widow are to the heirs {of the husband}.
There, it is so that she should not become repulsive to her husband. Here, let her be repulsive.

{Ketubot 64a continues}

Rav Tobi bar Kisna cited Shmuel: We write a letter {=certificate} of rebellion on a betrothed woman but we do not write a letter of rebellion on a woman waiting on her levir.
This statement of Shmuel applies to the "latter" Mishna. For we learnt {in the Mishna}: Initially, when they {people} intended for the precept, they {=Sages} would say that the {fulfilling of the} commandment of yibbum is preferable to the commandment of chalitza. Now that people do not intend for the precept, they retracted to say that the commandment of chalitza is preferable to the commandment of yibbum.

And we do not hold like the "latter" Mishna. For we learn in perek haCholetz: Rav Assi bar Adda cited Rabbi Yochanan: They retracted to {now} say that the commandment of yibbum is preferable to the commandment of chalitza.
Rav Nachman said: The fit of the generation initially thought like Abba Shaul and in the end thought like the Sages.
For they learnt {in a brayta}: Abba Shaul says: If one takes in {via yibbum} his siter-in-law for the purpose of beauty, for the purpose of marriage, for the sake of some other matter, it is as if he violated incest, and it is near in my eyes to declare the child a bastard. And the Sages say {Devarim 25:5}:
5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
in any case.

And since in the end they hold like the Sages, the latter Mishna is removed from halacha and so the statement of Shmuel is nullified, where he said that we do not write a letter of rebellion for a woman waiting on her levir.

And this matter which we have written above, the two Metivtas argue about it. One Metivta holds that she is not a rebellious woman, and they rely on this of Shmuel, that he said that we do not write a letter of rebellion for a woman waiting on her levir. And the other Metivta holds that she is a rebellious woman, for this reason that we have written, and they are in a superior position, and it is more logical like them, and like them we conduct.c

Here it says seven {for her reduction} and here it says three {for the husband's addition if he rebels}.
Rabbi Yossi beRabbi Chanina said: She is obligated to him seven, so she is reduced by seven; he is obligated to her three, so therefore he is increased by three.
Rabbi Yossi beRabbi Chanina is consistent, for he said in the gemara that even from work she is a rebel.
However, our gemara, which maintains that {only} from intercourse, she is a rebel, it gives a reason as corresponding to the seven days of the week, since she being reduced, it does not have the appearance of wages for Shabbat, so we give him wages of Shabbat {the seventh day}. And where it is adding {to her ketuba} and looks like payment for Shabbat, we do not give her wages for Shabbat, but rather we add for her three dinarim per week, which is 1/2 a zuz for each day for the six days of the week, and for Shabbat itself she does not have.

How so a rebellious woman?
Amemar said: Where she says "I like him but I am tormenting him." But if she says "he is repulsive to me," {she is not a rebellious woman and} we do not compel her.
Mar Zutra said: We compel her.
There was such an incident and Mar Zutra compelled her, and from this union came Rav Chinena from Sura.
And this is not so {and it is not a good thing to compel}. Over there, there was the help of Heaven.

The daughter-in-law of Rav Zevid rebelled, and grabbed a silk cloak.
Amemar, Mar Zutra, and Rav Ashi sat, and Rav Gamda sat by them. And they sat and said: A rebellious woman loses her worn-out clothing which are extant.
Rav Gamda said to them: Because Rav Zevid is a great man, do you flatter him? But Rav Kahana said that Rava asked this question but it was unresolved.
To explain: "her worn out things" are the worn-out items of her dowry.

There are some {girsaot} that say: They sat and said: A rebellious woman does not lose her worn-out clothing which are extant.
Rav Gamda said to them:
{Ketubot 64a}
Because Rav Zevid is a great man, do you turn the law against him? But Rav Kahana said that Rava asked this question but it was unresolved?!

And {continues the gemara}, now that it is not stated, neither like Master nor like Master, if she seized it, we do not take it from her, but if she did not seize if, he do not give it to her. And we wait for her 12 months, a year, for the bill of divorce, and in these 12 months, a year, she does not have provisions from the husband.

Such is the law laid down in the gemara, but nowadays, in the courts of the Metivta, they rule as follows by a rebellious woman:
When she comes and says "I do not want this man, let him give me a get," he gives her a get immediately {rather than waiting the 12 months}, and if she seizes anything from her ketuba, we take it away from her and return it to the husband.
And these words are in what the husband wrote to her of his own {assets}, but that which she brought from her father's house, whether she seized it or did not seize it, all that exists extant we give to him, and if there is nothing brought that is extant and there is something which came from it, we give it to him. And if there is nothing extant nor anything which came from it, but rather it is entirely lost to them, we do not take away from the husband {their value} at all. And these words are about assets which are melog, but assets which are iron sheep, anything which is extant he takes, and even though they are extremely worn out, and this is where they are fir for what they were initially fit for, such as that they are fit for use for some of his work. But that which is entirely worn out and is not fit for any purpose as it was initially, he pays their initial value from his own assets. And certainly that which stolen or accidentally destroyed, the husband pays her from his own, because they stood in his domain as we learn {in a Mishna}: If they die, they die to him, and if they increase, they increase to him.

And we have seen a Gaon that says that he gives her the main ketuba of 100 or 200 only, so that the daughters of Israel are not treated as ownerless property, but that which he wrote to her of his own, whether as an addition {to the ketuba} or as a gift, we do not give her at all.
Meanwhile, the law in the gemara is that even the main ketuba we do not give her, as we said at the beginning of the perek, that the conditions of the ketuba are like the ketuba, with a practical application to a woman who sells {or} forgives {her ketuba} and to a rebellious woman. Thus it is clear that {according to the law in the gemara} the rebellious woman does not get either the main ketuba nor the addition.
This is the law of the rebellious woman which the Sages practiced in the Metivta for many years until now.

But certainly this fix is only present when the woman rebels against her husband and wishes to leave him because she does not want him. However, where she became deathly ill or where there is worry of death, and she wishes to leave her husband so that he does not inherit her, there is not this fix and we do not practice this in action.
And in such a matter, there is to say that since initially there was inheritance, the Sages did not enact.
And although we see in this matter a dispute among the {post-Talmudic} Rabbis, it is logical like the one who said that we do not perform the enactment in this matter.

And according to everyone, anyone who we force him to divorce, whether because of the actual law, as we learn {in a Mishna} "these that we force them to divorce," as well as those similar to them, or whether sourced in enactment, then if his wife dies before the husband divorces her with a get, her husband inherits her, for we do not uproot the inheritance of the husband except with full divorce.
And so is the halacha.

And our Rabbis returned and counted {and ordained} that they announce upon her for 4 weeks, one after the other, and send to her from Bet Din {the warning}, "Know that even if your ketuba is of 100 maneh {note: to compare, a widow's ketuba is a single maneh} you are losing it. Whether to a betrothed woman, a married woman, even to a menstruant, even to an ill woman, and even to a woman waiting for her levir.

Rabbi Chiyya bar Yosef said to Shmuel: And is a menstruant one to whom intercourse is applicable?
He said to him: One who has bread in his basket is not comparable to he who does not have.
Rami bar Abba {our gemara, Rama bar Chama} said: We do not announce upon her except in the synagogues and study halls.
And Rami bar Abba {again the variant} said: Two times they send her, once before the announcement and once after the announcement.
Rav Nachman bar Rav Chisda expounded: The halacha is like our Rabbis {in the brayta above}.
And Rav Huna bar Yehuda cited Rav Sheshet: The halacha is that we consult with her.

In what do they argue? One Master holds that we learn a common thing from a common thing, while the other Master holds that we learn something which he causes her {abstention as a result of his vow} from something that he caused her.

Rav said: The dispute is where he specified {the period of abstention}, but plain {without specification}, all say that he divorces her and grants her her ketuba.

For there is no one who is obligated in conjugal duty once a week except the man of leisure and the day laborer.
He {=Abaye} said to him: No. On all of them it teaches that he must divorce and grant her ketuba.
{Ketubot 62b}
"But six months it states! So how should he divorce and grant a ketuba for one week?!"
He {=Abaye} said to him: It is not comparable on who has bread in his basket to one who does not have bread in his basket. That this one, his heart hungers and this one, his heart does not hunger. In wool, yes. In flax {/linen}, no.
Who is our Mishna{'s author}? It is Rabbi Yehuda. For they learnt {in a brayta}: We do not force her to stand {in waiting}, not before his father nor before his son, not to put straw before his cattle, but he may compel her to put straw before his beast. {our gemara reverses the last.} Rabbi Yehuda says: He even may not compel her to work in flax, because flax swells the mouth and stiffens the lips.
And specifically Roman flax.

"Rabbi Eliezer said: Even is she brought in {100 maidservants}":
Rav Malkio cited Rav Ada bar Ahava: The halacha is like Rabbi Eliezer.

{Ketubot 59b}
Mishna:
Rabban Shimon ben Gamliel says: Even one who forbids his wife via vow from doing labor, he must divorce her and grant her her ketuba, for idleness leads to idiocy.

Gemara:
Rabban Shimon ben Gamliel is the same as Rabbi Eliezer?! This is the difference between them. Where she is addicted to wooden cubs {a game} or chess {/checkers}.
According to the one who said that idleness brings to sexual impropriety, this also brings to sexual impropriety. And according to the one who said that it brings her to idiocy, this does not bring her to idiocy.
And we have already ruled the halacha like Rabbi Eliezer that we worry about sexual impropriety.

Mishna:
If someone forbade himself via vow to intercourse with his wife:
Bet Shammai say two weeks {after which he must get his vow annulled or divorce her}.
And Bet Hillel say: One week.
And the students who go to learn Torah without permission, 30 days.
And the laborers, 1 week.

The conjugal obligation mentioned in the Torah: Men who walk about {at leisure} every day; laborers twice a week; donkey drivers once a week; camel drivers once every 30 days; sailors once every six months. These are the words of Rabbi Eliezer.

Rif Ketubot 25a {Ketubot 60a continues; 60b - 61a}

25a

{Ketubot 60a continues}

The Sages learnt {in a brayta}: A nursing mother whose husband died within the 24 months, she may not remarry or become betrothed
{Ketubot 60b}
until 24 months. These are the words of Rabbi Meir. Rabbi Yehuda permits at 18 months.

And we establish in this like Rabbi Meir. For Rav and Shmuel both say that she needs to wait 24 months excluding the day in which he was born and excluding the day she is betrothed thereon.

And even if she gives her son to a nurse or weans him, she is forbidden to remarry until 24 months. But if he {=the child} dies, she is permitted.
Mar bar Rav Ashi said: Even if he dies also she is forbidden, lest she kill him and go and remarry.
There was an incident in which a woman strangled her infant. And it is not so, for she was an imbecile, for women do not strangle their infants.

The Sages learnt {in a brayta}: Behold if they gave her a child to nurse, she should not nurse with her her own son nor her friend's son. If she had made arrangements for little food, she must nonetheless eat a lot. And she should not eat with him bad things.

"If she had made arrangements for little food, she must nonetheless eat a lot" -- from where?
Rav Sheshet said: From her own.

"Nor should she eat with him bad things" -- such as what?
Rav Kahana said: Gourds, lichen, and earth.
Abaye said: Even pumpkin and quinces.
Rav Papa said: Even heart-of-palm and unripe dates.
Rav Ashi said: Even shimchei, and beer and and fish-hash.
Some of them cause the milk to stop and some of them cause the milk to become turbid.
To explain shimchei -- large onions.
{See gemara for alternate girsa of this list.}

{Ketubot 61a}

Rav Huna said: Rav Huna bar Chinena tested us: She says she wants to nurse and he says not to nurse, to her we listen for the suffering is hers. If he says to nurse and she says she does not wish to nurse, what?
And we resolve it that wherever it is not her custom, we listen to her. If is it her custom and not his custom, what? And we resolve it that she rises with him but does not descend with him.

"If she brought in with her a single maidservant" --
Rabbi Chana, and some say Rabbi Shmuel bar Nachmani, said: Not that she necessarily actually brought with her anyone, but rather, since she was fit {=in a position} to bring, even if she did not bring.
A tanna taught: Whether she brought in to him or whether she found for him of his own {by saving up}.

"Four, she sits in her easy chair":
R' Yitzchak bar Chanina cited Rav Huna: Even though they said that "four, she sits in her easy chair," she nevertheless mixes for him the cup, makes his bed, and washes his face, hands and feet.
And R' Yitzchak beRabbi Chanina cited Rav Huna: All labor that a woman does for her husband, a menstruant does for her husband except for mixing the cup, making the bed, and washing his face, [hands] and feet.

"And making the bed":
Rava said: They only said this in front of him, but not in front of him, we have no problem in it.

"And mixing the cup":
The wife of Shmuel switched from the left hand to the right hand. The wife of Abaye placed it on the edge of the wine cask. In the house of Rava {/the wife of Rava} on the side of the couch. In the house of Rav Papa on his foot-stool.

At what age does he recognize her?
Rabbi Yirmeya said: 3 months.
And Rabbi Yitzchak cited Rabbi Yochanan: 50 days old.
And Rabbi Shimi bar Ashi said: The halacha is like Rabbi Yitzchak who cited Rabbi Yochanan.

There was one {divorced woman refusing to nurse her infant} who came before Shmuel. Rav Dimi bar Yosef was sitting before him. Shmuel said to Rav Dimi bar Yosef: Go investigate her {whether the child knew the mother}. He sat her in a row of woman and took her son and carried him in front of them. When he reached her, he gazed longingly at her, but she turned away from him. He said to her "lift you your eyes, come and take your son."

The Sages learnt {in as brayta}: We continue to nurse an infant until 24 months. From then on, it is like nursing an abominable thing. These are the words of Rabbi Eliezer. Rabbi Yehoshua says: Even 4 or 5 years. If it stopped suckling after 24 months and returned, it is like nursing an abominable thing.
Rav Yosef said: The halacha is like Rabbi Yehoshua.

And how much is a stoppage {in nursing}?
R' Yehuda ben Chaviva said: Three days.

Yerushalmi:
Where are these words said? Where he stopped while entirely healthy, but if he stopped because of ailment, we return him.

They learned {in a brayta}: {Human} blood found on a loaf of bread, he scrapes it off and then eats it {the bread}, and between the teeth, he sucks and swallows it without concern.
