From where that we do not swear to transgress a commandment {that is, that the oath will not take hold}? For it is stated {Bemidbar 30:3}:
ג אִישׁ כִּי-יִדֹּר נֶדֶר לַה, אוֹ-הִשָּׁבַע שְׁבֻעָה לֶאְסֹר אִסָּר עַל-נַפְשׁוֹ--לֹא יַחֵל, דְּבָרוֹ: כְּכָל-הַיֹּצֵא מִפִּיו, יַעֲשֶׂה. 3 When a man voweth a vow unto the LORD, or sweareth an oath to bind his soul with a bond, he shall not break his word; he shall do according to all that proceedeth out of his mouth.
He may not break his word, but he must break a word in matters of Heaven.
Why are vows different, in that it states אִישׁ כִּי-יִדֹּר נֶדֶר לַה... לֹא יַחֵל, דְּבָרוֹ {stressing LaHashem, thus even for Divine matters}. By oaths as well, it is written או השבע שבועה לה' {--actually, it does not say this, but the word laHashem precedes it, as we see above}.

Abaye said: Here {by vows} is where he said "the benefit of a Succah upon me," whereas here {by an oath} is where he said "that I will not benefit from a Succah."
Rava said to him: But precepts were not given for benefit {/enjoyment, and so one cannot technically be said to be benefiting from a precept}!
Rather, Rava said: Here {by vows} is where he said "dwelling in a Succah upon me," whereas here is where he said "an oath that I will not dwell in a Succah."

Mishna:

האומר לאשתו קונם שאיני משמשך הרי זה בלא יחל דברו כו':
IF ONE SAYS TO HIS WIFE, KONAM IF I COHABIT WITH YOU.' HE IS LIABLE TO [THE INJUNCTION,] HE SHALL NOT BREAK HIS WORD, etc.

Gemara:
והא משועבד לה מן התורה דכתיב שארה כסותה ועונתה לא יגרע
באומר הנאת תשמישך עלי
והא לא ניחא ליה בתשמיש
דאמר רב כהנא הנאת תשמישי עליך כופין אותה ומשמשתו דשעבודי משעבדא ליה
הנאת תשמישך עלי אסור דאין מאכילין לאדם דבר האסור לו
But he is obligated in this Biblically? for it is written {Shemot 21:10}:
י אִם-אַחֶרֶת, יִקַּח-לוֹ--שְׁאֵרָהּ כְּסוּתָהּ וְעֹנָתָהּ, לֹא יִגְרָע. 10 If he take him another wife, her food, her raiment, and her conjugal rights, shall he not diminish.
{Answer:} Where he said, "the pleasure of your intercourse {is forbidden} upon me." And thus he denies himself the pleasure of intercourse.
For Rav Kahana said: {If a woman vows:} "The pleasure of my intercourse {in forbidden} upon you," they compel her and she has intercourse with him, for she is under obligation to him. "The pleasure of your intercourse upon me," she is forbidden, for we do not feed a person something forbidden to him.


Mishna:
קרבן לא אוכל לך הקרבן שאוכל לך לא קרבן לא אוכל לך מותר
שבועה לא אוכל לך השבועה שאוכל לך לא שבועה לא אוכל לך אסור

This implies that "haShevuah that I eat" implies "that I will not eat."
But I will raise an objection: Oaths are two which are four: "that I eat," "that I do not eat," "that I ate," and "that I did not eat."
From the fact that it {=the brayta} states the case of "that I do not eat," we may deduce that "that I eat" implies "that I will eat."
Abaye said: "That I eat," two separate meanings can be implied. If they were urging him to eat, and he said "I will not eat, and furthermore an oath that I eat," the implication is "that I will not eat."
Rav Ashi said: "That I eat" of vows {our gemara: of oaths} is really saying "that I will not eat" {and it is shorthand used by the Mishna, but he really said the negative}.
If so, {our gemara: it is obvios!} why state it?
I would have said that it is a mispronunciation which caused him to stumble {namely, that he said she `i ochel rather than sheOchel}. Therefore it informs us.

"If one said to his wife, 'behold you are unto me like my mother, etc.":
And they objected: "If one says to his wife, 'Behold! you are to me as the flesh of my mother, as the flesh of my sister, as 'orlah,' as kil'ayim of the vineyard, he has not said anything."

Abaye said: He has not said anything -- on a Biblical level, but he requires asking {for release} Rabbinically.
Rava said: This is by a Torah scholar, and this is by an ignoramus.

For they learnt {in a brayta}: One who vows by the Torah has not said anything.
And Rabbi Yochanan said: And {yet} it requires asking {for release} to a Sage, Rabbinically.
And Rav Nachman said: He is a Torah scholar, and does not need.

{Nedarim 14b}
תניא הנודר בתורה לא אמר כלום
במה שכתוב בתורה דבריו קיימין
בה ובמה שכתוב בה דבריו קיימין

השתא במה שכתוב בתורה דבריו קיימין בה ובמה שכתוב בה מבעיא

They learnt {in a brayta}: If one vows by the Torah, he has not said anything. By what is written in the Torah, his words stand. By is and by what is written in it, his words stand.

Now that {where he says} "in what is written in Torah," his words stand, "it and what is written in it," do we need?
Rav Nachman said: This is no question. Here is where the Torah is lying on the ground, while here is where he took it in hand.

If it is lying on the ground, his mind is upon it, but if he took it in his, his mind is on the Divine Names therein.
And if you want I will say that it is in fact lying on the ground, and this informs us that, even though it is lying on the ground, if he said "with what is written therein," it works. (* And it is {his words were in the style of} "this and it need not be said this. *)
And if you want I will say the intermediate case as well, that he is holding it in his hand, and it informs us that since he holds it in his hand, even though he only said "it" {and not what is in it}, he is just like one who said "in what is written therein."

אתמר קונם עיני בשינה היום אם אישן למחר

It was stated {by Amoraim}: "Konam my eyes from sleeping today, if I sleep tomorrow."
Rav Yehuda cited Rav: He may not sleep that day, for we fear lest he sleep the next day.
And Rav Nachman said: He may sleep today, and we do not fear that he will sleep tomorrow.
And Rav Yehuda admits by one who says "konam that I will not sleep tomorrow, if I sleep today," that he may sleep today {and allow the vow for tomorrow to take hold},
{Nedarim 15a}
for he will not lax in his condition {which causes the vow to take hold}, but he will not be lax in his prohibition.

תנן קונם שאני ישן שאני מדבר שאני מהלך

They learnt {in a Mishna}: Konam that I sleep, that I speak, that I walk.

How so? If as is stated in the Mishna, how is "that I sleep" a vow? But they learnt {in a Mishna}: A stringency by oaths, in that an oath applies to something that has substance and something that lacks substance, which is not the case by vows. And sleep is something which lacks substance! Rather, that he stated "konam my eyes in regard to sleep."

And if he did not give a measure, would we indeed leave him until he committed a prohibition? But Rabbi Yochanan said: An oath that I will not sleep for three days, we lash him and he sleeps immediately!
{and they attempt to reinterpret the Tannaitic statement to stand in contradiction to Rav Yehuda. So which we reply}
Ravina said: In truth, it is as we taught, and what is "he shall not break {his word}?" Rabbinically.
And is there a Rabbinic "he shall not break?" Yes. As it was taught: If there were permitted things and others practiced in them prohibition, you are not permitted to treat them as permitted in order to nullify them {our gemara: rather than "in order to nullify them," "in their presence"}. For it is stated {Bemidbar 33}: "He shall not break his word."

From where do we know these words? Scriptures states {Bemidbar 30:3}:

"{hakorban [as one word] ...} Rabbi Meir forbids":
But they learnt {in a brayta}: The Sages admit to Rabbi Yehuda by where he says "ha korban, ha olah, ha chatat, ha mincha, ha todah, ha shelamim" "what I eat of yours," that he is permitted, for he did not vow except by the life of the korban. {thus, by the life of the korban, I will eat of yours."
{Nedarim 13b}
This is no contradiction. This is where he said ha korban [and this is where he said hay korban. {our gemara: "hakorban," as one word, but then the examples of permitted and forbidden would be reversed.} If he said ha korban, it is forbidden. If he said hay korban, he is permitted. What is the reason? By the life of the korban, he means.
And so is the halacha.

"My mouth speaking with you":
They raise an objection: There is a stringency by oaths more than by vows, and by vows more than by oaths. There is a stringency by vows, in that vows take effect upon something required by commandment, just as by optional matters, which is not true by oaths.
And there is a stringency by oaths, in that oaths take effect whether on something that has substance or something that lacks substance, which is not true by vows.
{and the implication is that in the Mishna he vowed not to undertake the action of his mouth speaking with him, which is an action. The resolution:}

Where he says "my mouth is forbidden, in respect to my speech"; "my hand, in respect to their actions"; and "my legs in respect to their walking."
Indeed, we can arrive at this conclusion through careful analysis of the language of the Mishna, which stated "my mouth from speaking with you," and did not state "that I will not speak with you." We indeed so deduce.

We learn later on in the fourth perek {of Nedarim, 22a}:
Shmuel said: Anyone who vows, even though he fulfills it, is called an evildoer.
{in our gemara, Rabbi Abba says the following:} What is the Scriptural basis? {Devarim 23:23}:
כג וְכִי תֶחְדַּל, לִנְדֹּר--לֹא-יִהְיֶה בְךָ, חֵטְא. 23 But if thou shalt forbear to vow, it shall be no sin in thee.
{which, I might note, can be cast as a michlav lav ata shomea hen. If you forbear, it shall be no sin. But if you do not forbear, then it shall be a sin. But that is the derasha put forth in Nedarim 77b. Here, the gemara instead continues:}
It is via a link of forbear - forbear. It is written here {Devarim 23:23}:
כג וְכִי תֶחְדַּל, לִנְדֹּר--לֹא-יִהְיֶה בְךָ, חֵטְא. 23 But if thou shalt forbear to vow, it shall be no sin in thee.
and it is written there {Iyyov 3:17}:
יז שָׁם רְשָׁעִים, חָדְלוּ רֹגֶז; וְשָׁם יָנוּחוּ, יְגִיעֵי כֹחַ. 17 There the wicked cease from troubling; and there the weary are at rest.
Rav Yosef said: Even we also learn it, in the Mishna: "like the vows of the wicked," it is a vow for a Nazirite, for a sacrifice and for an oath.

And we learn in perek Naarah {Nedarim 77b}:
Rava said to Rav Nachman: Master should see this rabbi who came from the west {=Eretz Yisrael} and said that the Sages gave a hearing to Rav Huna bar Avin, and released his vow, and said to him, "go and seek mercy, for you have sinned."
He said to him, "this is true, for Rav Dimi, the brother of Rav Safra taught {tnei}: Anyone who vows, even if he fulfills it, is called a sinned. What is the Scriptural source? {Devarim 23:23}:
כג וְכִי תֶחְדַּל, לִנְדֹּר--לֹא-יִהְיֶה בְךָ, חֵטְא. 23 But if thou shalt forbear to vow, it shall be no sin in thee.
Thus if you do not forbear, then there will be in you sin.

The Sages learnt {in a brayta}: You should not generally be accustomed to make vows, for your end will be to trespass oaths. You should not frequent amei haAretz {as opposed to a chaver -- thus, someone who is not careful about teruma and maaser, rather than any connotations of ignorance}, for his end will be to feed you tevel {untithed produce}. You should not increase talk with a woman, for your end will be to come to unchastity.

Yerushalmi:
{Mishlei 20:25}
כה מוֹקֵשׁ אָדָם, יָלַע קֹדֶשׁ; וְאַחַר נְדָרִים לְבַקֵּר. 25 It is a snare to a man rashly to say: 'Holy', and after vows to make inquiry.
When a person begins to vow, his ledger is opened.
Another explanation: מוֹקֵשׁ אָדָם etc.: when a person delays his vow, his ledger is opened.

There was a incident with a certain person who said "behold upon me a burnt-offering," and he delayed in bringing it, and his ship sunk at sea.

Mishna:

It was stated {by Amoraim}:
Substitutes {=nicknames} --
Rabbi Yochanan said: They are the language of the nations.
Resh Lakish said: They are the language which the Sages devised for people to vow thereby.
And so too it says {in I Kings 12:33}:
לג וַיַּעַל עַל-הַמִּזְבֵּחַ אֲשֶׁר-עָשָׂה בְּבֵית-אֵל, בַּחֲמִשָּׁה עָשָׂר יוֹם בַּחֹדֶשׁ הַשְּׁמִינִי--בַּחֹדֶשׁ, אֲשֶׁר-בָּדָא מלבד (מִלִּבּוֹ); וַיַּעַשׂ חָג לִבְנֵי יִשְׂרָאֵל, וַיַּעַל עַל-הַמִּזְבֵּחַ לְהַקְטִיר. {פ} 33 And he went up unto the altar which he had made in Beth-el on the fifteenth day in the eighth month, even in the month which he had devised of his own heart; and he ordained a feast for the children of Israel, and went up unto the altar, to offer.
{Soncino on gemara notes that this citation of the pasuk appears in no manuscript, and is a copyist's gloss which crept into the main text. Presumably, I would add, to explain the meaning of the word bada.}

And why did the Sages enact substitutes? So that he should not say "korban."
And let him say "korban?!"
So that he will not say "korban to Hashem."
And let him say "korban to Hashem?!"
Perhaps he will say "to Hashem" and not say "korban."
In which case he would be expressing the Name of Heaven in vain.

And they learnt {in a brayta}: Rabbi Shimon says:
{Nedarim 10b}
From where that a person should not say "to Hashem, a burnt-offering"; "to Hashem, a meal-offering"; "to Hashem, a thanksgiving offering"; "to Hashem, a peace offering?"
Therefore it informs us {Vayikra 1:2}:

ב דַּבֵּר אֶל-בְּנֵי יִשְׂרָאֵל, וְאָמַרְתָּ אֲלֵהֶם, אָדָם כִּי-יַקְרִיב מִכֶּם קָרְבָּן, לַה--מִן-הַבְּהֵמָה, מִן-הַבָּקָר וּמִן-הַצֹּאן, תַּקְרִיבוּ, אֶת-קָרְבַּנְכֶם 2 Speak unto the children of Israel, and say unto them: When any man of you bringeth an offering unto the LORD, ye shall bring your offering of the cattle, even of the herd or of the flock.
And we can draw a kal vachomer: Just as this, in which he did not intend to mention the Name of Heaven except on the sacrifice, the Torah says "an offering unto the LORD," {deliberately} in vain, all the more so!

Let us say that this is in accordance with a Tannaitic dispute: Bet Shammai says: Nicknames of nicknames are forbidden, and Bet Hillel say that nicknames of nicknames are permitted.
Let us say that the one who said they are forbidden holds that they are the language of the nations. And the one who holds that they are permitted holds that they are the language devised by the Sages.

No. All agree that they are the language of nations. Bet Shammai hold that it is the language of nations. Bet Shammai hold that so do gentiles speak. And Bet Hillel says that gentiles do not speak this way.
And if you want I will tell you that Bet Shammai hold that we decree a nickname for a nickname, because of the nicknames themselves. And Bet Hillel hold that we do not decree.

How so nicknames for nicknames for vows?

The nicknames for nicknames for cherem?
Rav Yosef learnt: mepashaah, charkaya, charchaya, charfaya. {Thus, the Aramaic plurals.}

The nickname for nicknames for Nazir?
Rav Yosef learnt: menazikna, menazachma, mefazachna. {First person singular, present tense.}

כנויי כנויין דשבועות ה"ד שבואל שבותאל שקוקאל. שבואל בן גרשום משמע אלא שבובאל שבותאל שקוקאל
אמר שמואל שובתא לא אמר כלום אשקוקא לא אמר כלום קורסנא לא אמר כלום:
The nickname for nicknames for oaths, how so? Shevuel, Shevutel, Shekukel. But Shevuel may imply Shevuel son of Gershom {see Divrei HaYamim I, 23:16}. Rather, Shevuvel, Shevutel, Shekukel.
Shmuel said: If he said Shuvta, he has said nothing. Ashkuka, he has not said anything. Kursana, he has not said anything.

נדר במוהי ה"ז כנוי לשבועה:
תניא רשב"ג אומר במוחי לא אמר כלום במומתא לא אמר כלום אמר מוהי הרי זה כנוי לשבועה:
"If he vowed by Mohi, this is a nickname for oath":
They learnt {in a brayta}: If he said "By Mochi," {=by Moshe} he has not said anything. "By Mometa," he has not said anything. If he said "Mohi," this is a nickname for an oath.

{Nedarim 11a}

They thought that what is lechulin {in the Mishna, in a certain girsa}? la chullin is it, but rather an offering.
Who is the author of our Mishna? If it is Rabbi Meir, behold he does not have the principle of from the negative you can infer the positive! For they learnt {in a Mishna}: Rabbi Meir says: Any stipulation which is not like the stipulation of the sons of Gad and the sons of Reuven is not a valid stipulation.
But can we say it is Rabbi Yehuda? The sefa {latter part of the Mishna} states: Rabbi Yehuda says, "One who says Yerushalayim does not say anything." And from the fact that the sefa is Rabbi Yehuda, the resha is not Rabbi Yehuda.
This is no question. It is all Rabbi Yehuda, and this is what it means to say: For Rabbi Yehuda says, "One who says 'Yerushalayim' has not said anything."

But if he said "Like Yerushalayim, would Rabbi Yehuda forbid?" But they learnt {in a brayta}, "One who said 'like Yerushalayim' has not said anything, until he vows with what is sacrificed in Yerushalayim.

{The answer:} It is all Rabbi Yehuda, and it is two Tannaim within the opinion of Rabbi Yehuda.

{Nedarim 11b}
תנא חולין החולין כחולין בין שאוכל לך בין שלא אוכל לך מותר.
לא חולין שאוכל לך אסור
לא חולין לא אוכל לך מותר
It was taught: Chullin, haChullin, keChullin, whether "that I eat of yours," or "that I do not eat of yours," is permitted.
It is not chullin, that I eat of yours, it is forbidden.
It is not chullin that I do not eat of yours, it is permitted.

רישא מני ר"מ היא דלית ליה מכלל לאו אתה שומע הן
אימא סיפא לחולין לא אוכל לך מותר
The resha is who? Rabbi Meir, who does not have the principle of deriving the positive statement from the negative statement. But then the sefa says "lachullin {=not chullin} I will not eat from you, it is permitted!
{And this cannot be Rabbi Meir, because:}
והתנן לקרבן לא אוכל לך רבי מאיר אוסר וקשיא לן
הא לית ליה לרבי מאיר מכלל לאו אתה שומע הן
וא"ר אבא נעשה כאומר לקרבן יהא לפיכך לא אוכל לך
ה"נ לא חולין ליהוי לפיכך לא אוכל לך

האי תנא סבר לה כותיה בחדא ופליג עליה בחדא ס"ל בחדא דלית ליה מכלל לאו וכו' ופליג עליה בחדא בקרבן
רב אשי אמר הא דאמר לחולין הא דאמר לא חולין דמשמע לא ליהוי חולין אלא קרבן
But we learnt {in a Mishna}: lakorban {=not a korban} that which I do not eat of yours, Rabbi Meir forbids. {With the simple understanding that: since that which I do not eat is not a korban, that which I would eat of your would be forbidden like a korban.} But Rabbi Meir does not hold of the principle of deriving the positive statement from the negative statement?!
And Rabbi Abba {there} says: He is made as if he said "for a korban {=lekorban} it should be, and therefore I will not eat of yours."
So too {here, by the sefa of the brayta, we should interpret it as} "it is not to be chullin, and therefore I will not eat of yours."

The answer: This tanna holds like him {Rabbi Meir} in one and argues upon him in one. He holds in one {=the resha} that there is no principle of deriving the positive statement from the negative statement. And he argues with him in one of them -- by the korban. {and the meaning of lakorban.}

Rav Ashi said: This {=resha} is where he said leChullin, and this is where he said la chullin, which implies that it should not be chullin but rather korban.

א"ר גידל א"ר האומר אשנה פרק זה או מסכת זו נדר גדול נדר לאלהי ישראל.
והלא מושבע ועומד מהר סיני הוא ואין שבועה חלה על שבועה
מאי קמ"ל דאפילו לזרוזי בעלמא היינו דר"ג קמייתא
הא קמ"ל כיון דאי בעי פטר נפשיה בק"ש שחרית וערבית:
Rav Gidel cited Rav: One who says "I will learn this perek," or "this masechet," this is a great vow to the God of Israel.
But is he not already sworn on this from Har Sinai, and an oath cannot apply on top of an existing oath? What is this coming to inform us? If it is that it is to encourage himself, then this is the same as the first statement of Rav Gidel. Rather, it informs us that {the oath is binding}, since if he wished he could exempt himself {of the Biblical obligation} with the reading of Shema in the morning and evening.

א"ר גידל א"ר האומר נשכים ונשנה פרק זה עליו להשכים שנאמר ויאמר (ה') אלי קום צא אל הבקעה ושם אדבר (עמך) [אותך] ואצא אל הבקעה והנה שם כבוד ה' עומד:
Rav Gidel cited Rav: If one said {to his fellow}, let us arise early and learn this perek, it is upon him {=the one who said this} to arise early, for it is stated {Yechezkel 3:22-23}:
כב וַתְּהִי עָלַי שָׁם, יַד-ה; וַיֹּאמֶר אֵלַי, קוּם צֵא אֶל-הַבִּקְעָה, וְשָׁם, אֲדַבֵּר אוֹתָךְ. 22 And the hand of the LORD came there upon me; and He said unto me: 'Arise, go forth into the plain, and I will there speak with thee.'
כג וָאָקוּם, וָאֵצֵא אֶל-הַבִּקְעָה, וְהִנֵּה-שָׁם כְּבוֹד-ה עֹמֵד, כַּכָּבוֹד אֲשֶׁר רָאִיתִי עַל-נְהַר-כְּבָר; וָאֶפֹּל, עַל-פָּנָי. 23 Then I arose, and went forth into the plain; and, behold, the glory of the LORD stood there, as the glory which I saw by the river Chebar; and I fell on my face.

א"ר יוסף נדוהו בחלום צריך י' בני אדם להתירו והוא דתני הלכתא אבל מתנו ולא תנו לא
ואי ליכא אפי' מתנו ולא תנו
ואי ליכא אזיל ויתיב אפרשת דרכים ויהיב שלמא לבי עשרה עד דמקלעין עשרה דתנו הלכתא.
Rav Yosef said: If he was placed under a ban in a dream, he needs 10 men to release him. And this is where they learnt halacha, but if they learnt Mishna and did not learn {halacha}, no.
{See here in Rif on Megillah 9b, where the distinction is between Mishna and Talmud, but with the relative importance reversed and identities reversed. See Nimukei Yosef where he gives the distinction of learned vs. taught, or Mishna vs. Talmud. Learned vs. taught is based on a slightly different girsa.}
And if there are none, then even those who learned Mishna but did not not learn {halacha}.
And if there are none, he should go and sit at the crossroads, and give greeting to ten men, until he reaches ten men who have learned halacha.

א"ל רבינא לרב אשי ידע מאן שמתיה מהו דנשרי ליה
אמר ליה לשמותי שוויה שליח למשרי לא שוויה שליח
Ravina said to Rav Ashi: If he known who placed him under the ban {in his dream}, may he have him release him {while awake}?
He said to him: He {=this man} was appointed an agent to ban him, but was not appointed an agent to release him.

אמר ליה רב אחא בריה דרבא לרב אשי שמתוהו ושריוהו בחלמא מהו.
א"ל כשם שא"א לבר בלא תבן כך א"א לחלום בלא דבר בטל.
Rav Acha son of Rava said to Rav Ashi: If he both banned him and released him it the dream, what is the law?
He said to him: Just as it is impossible to have wheat without chaff, so is it impossible to have a dream without some measure of meaningless matter. {And the release is the meaningless matter.}

{Nedarim 8b}
רבינא הו"ל נדרא לדביתהו אתא לקמי' דרב אשי א"ל בעל מהו שיעשה שליח לחרטת אשתו
א"ל אי מכנפין אין אי לא לא.
ש"מ תלת ש"מ לא שרי למשרי נדרא באתרא דרביה.
וש"מ כי מיכנפי שפיר דמי.
וש"מ לכנופי לא

ויחיד מומחה שרי שמתא ואפי' באתרא דרביה
Ravini's wife had a vow, and he came before Rav Ashi.
He {=Ravina} said to him: May a husband be an agent for the regret of his wife?
He said to him: If they {=the three scholars} are already assembled, yes, but if not {and he will have to go to the trouble of assembling them}, no.
We derive from this three things. We derive from this that one may not release a vow in the location of his teacher. And we derive from this that if they are assembled, it is fine. And we derive from this that to assemble, no.

And an single ordained scholar may release a ban even in the location of his teacher.

{Nedarim 9a}
Mishna:
כנדרי רשעים נדר בנזיד בקרבן ובשבועה
כנדרי כשרים לא אמר כלום כנדבותם נדר בנזיר ובקרבן
{IF ONE SAYS} 'AS THE VOWS OF THE WICKED,' HE HAS VOWED IN RESPECT OF NEZIROTH, A SACRIFICE, AND AN OATH.
{IF HE SAYS:} 'AS THE VOWS OF THE RIGHTEOUS,' HIS WORDS ARE OF NO EFFECT.

{BUT IF HE SAID,} 'AS THEIR FREEWILL-OFFERINGS,' HE HAS VOWED IN RESPECT OF A NAZIRITE VOW AND A SACRIFICE.

Gemara:
מאן תנא דשני [ליה] בין נדר לנדבה
לימא לא ר"מ ולא ר"י ולא ר"י
דתניא את אשר תדור שלם טוב אשר לא תדור משתדור ולא תשלם
טוב מזה ומזה שאינו נודר כל עיקר דברי ר"מ

Who is the Tanna who teaches this distinction between a vow and a freewill offering? Let us say it is neither Rabbi Meir nor Rabbi Yehuda.
For they learnt {in a brayta} {Kohelet 5:4}:
ד טוֹב, אֲשֶׁר לֹא-תִדֹּר-- מִשֶּׁתִּדּוֹר, וְלֹא תְשַׁלֵּם. 4 Better is it that thou shouldest not vow, than that thou shouldest vow and not pay.
Better than this or that is not to vow in the first place. These are the words of Rabbi Meir.
Rabbi Yehuda said: Better than this or that is to vow and fulfill.

{Nedarim 10a}
ואסקי' מתני' ר"י היא.
וכי קאמר ר"י בנדבה בנדר לא קאמר.
והקתני טוב מזה ומזה נודר
תני נודב.
ומ"ש נדר דלא דילמא אתי לידי תקלה נדבה נמי אתי לידי תקלה.
ר"י לטעמיה דאמר מביא אדם כבשתו לעזרה ומקדישה וסומך ידו עליה ושוחטה
And we conclude that the Mishna is Rabbi Yehuda. And where Rabbi Yehuda spoke {in the brayta}, he was speaking of a free-will offering.
But it taught in the braya "better than this or that is one who vowed." Teach instead "made a free-will offering."
And what it the difference that by a vow, no? Perhaps he will come to a stumbling block. But by a free-will offering, perhaps he will also come to a stumbling block!
Rabbi Yehuda is consistent in his opinion, for he said: A man can bring his sheep to the Temple court, and then consecrate it, lean his hand upon it, and slaughter it.

כר' יהודה דאמר ידים שאין מוכיחות לא הויין ידים דתנן גופו של גט הרי את מותרת לכל אדם ר' יהודה אומר ודין דיהוי ליכי מנאי ספר תרוכין ואגרת שבוקין:
like Rabbi Yehuda, who said that handles which are not explicit are not handles. For we learnt: The essential part of a get is "Behold you are permitted to any man." Rabbi Yehuda says: And this {document} should be from me to you as a book of dismissal and a letter of release."

אתמר ידים שאין מוכיחות אביי אמר הויין ידים ורבא אמר לא הויין ידים:
It was stated {by Amoraim}: Handles which are not explicit, Abaye said that they are handles and Rava said that they are not handles.

{Nedarim 7a}

איבעיא להו יש יד לצדקה או אין יד לצדקה
היכי דמי אילימא דאמר זוזא הדין לצדקה והדין נמי. צדקה עצמה היא.
אלא כגון דאמר ודין ולא אמר נמי מאי והדין נמי לצדקה קאמר או דילמא והדין לנפקותא בעלמא קאמר ודיבורא הוא דלא אסקיה ואסיק תלמודא בתיקו והלכך אזלינן לחומרא:

אמר רבי יוסי בר' חנינא מודר אני לך שניהם אסורין מודר אני ממך הוא אסור וחבירו מותר.
ומיירי דאמר מודר אני לך מאכילה או מהנאה אבל בסתם הוי ידים שאינן מוכיחות:
It was a question to them:
Is there a handle to charity or is there not a handle to charity?
How so? If you say that he said, "these zuzim to charity, and these also," then it is {designation} of charity itself.
Rather, such as he said "and this" and he did not say "also." What? Did he thus say "and these also are for charity," or perhaps did he thus say "and these for some general expenditure." And it is an unclear statement. And the Talmud concludes with a teku {leaving it unresolved}. Therefore, we go stringently.

Rabbi Yossi beRabbi Chanina said: "I am avowed to you," both of them are forbidden. "I am avowed from you," he is forbidden and his friend is permitted.
And this is talking about where he said "I am avowed to you from eating," or "from benefit," but plainly, without elaboration, these are inexplicit handles.

ר' עקיבא היה חוכך בזה להחמיר
אמר אביי מודה ר"ע לענין מלקות שאינו לוקה דא"כ נתני ר"ע מחמיר:
"Rabbi Akiva was inclined in this to be stringent":
Abaye said: Rabbi Akiva admits in terms of lashes that he is not lashed, for if so, it should have taught "Rabbi Akiva is stringent."

אמר רבינא נדינא ממך דכ"ע לא פליני דאסור משמתינא ממך דכ"ע לא פליגי דשרי.

Ravina {our gemara: Rav Pappa} said: "I am isolated {nedina} from you," all agree that he is forbidden. "I am in shamta {mishmatina} from you," all agree that he is permitted. In what do they argue? By "I am banned {meduna} to you."
{Nedarim 7b}
That Rabbi Akiva holds that it is a language of nidui {isolation}. And the Sages hold that it is a language of shamuta {accursed}.

ופליגא דר' חסדא
דההוא גברא דאמר משמתנא בנכסי דבריה דר' ירמיה בר אבא
אתא לקמיה דר"ח
אמר לית דחש להא דר"ע
דקסבר במשמתנא פליגי.
And this {understanding by Rav Pappa/Ravina of the dispute between Rabbi Akiva and the Sages} is in disgreement with Rav Chisda. For there was a certain person, who said "I am accursed {mishmatna} in the assets of Rabbi Yirmeya bar Abba," who came before Rav Chisda. He {=Rav Chisda} said: There is none who worry about this of Rabbi Akiva.
Thus he held that they argue in {the language} of mishmatna.

אמר רבי אילא אמר רב נדוהו בפניו אין מתירין לו אלא בפניו.

Rabbi Ila cited Rav: If he {=a Rabbi} banned him in his presence, we only release him in his presence. If he banned him not in his presence, we release him whether in his presence or not in his presence.

Rabbi Avin {our gemara: Rabbi Chanin} cited Rav: If one hears mention of the Name {in vain} from his fellow's mouth, he must ban him. And if he did not ban him, then he himself is under the ban. For whenever mention of the Name {in vain} is found, there poverty is found.
And poverty is like death. For it is stated {Shemot 4:19}:
יט וַיֹּאמֶר ה אֶל-מֹשֶׁה בְּמִדְיָן, לֵךְ שֻׁב מִצְרָיִם: כִּי-מֵתוּ, כָּל-הָאֲנָשִׁים, הַמְבַקְשִׁים, אֶת-נַפְשֶׁךָ. 19 And the LORD said unto Moses in Midian: 'Go, return into Egypt; for all the men are dead that sought thy life.'
and they learnt in a brayta: Rabban Shimon ben Gamliel says {our gemara omits the attribution}: Wherever the Sages cast their eyes is either death or poverty.

Rabbi Avin {our gemara: Rabbi Abba} said: I was standing before Rav Huna, when he heard a certain woman utter a mention of the Name in vain, and he placed her under the ban and then released her immediately, and permitted her in her presence.
We deduce from this three things. We deduce from this that one who hears mention of the Name {in vain} from his fellow's mouth is required to place him under the ban.
And we deduce from this that is he placed him under the ban in his presence, we do not release him except in his presence.
And we deduce from this that there need not be between the ban {nidui} and the annulling any time at all.

א"ר גידל ת"ח היה מנדה לעצמו ומיפר לעצמו.
פשיטא מ"ד אין חבוש מתיר עצמו מבית האסורין קמ"ל.

Rav Gidel said {our gemara: citing Rav}: A Torah scholar may ban himself and annul for himself {his ban}.
This is obvious!
I would have said that one locked up cannot release himself from prison. Therefore it informs us.
How so? Like this of Mar Zutra Chasida, when a disciple incurred a ban {shamta, a less restrictive ban}, he would ban himself and then turn around and ban the disciple. And when he entered his house, he released himself and subsequently released him.

But he is already under an oath from Har Sinai?!

And "handles," where are they written? For it is written {Bemidbar 6:2}:

to make the handles of nezirut like nezirut, and the nicknames for nezirut like nezirut. This only tells me for a Nazirite. By vows, from where? Therefore it informs us נֶדֶר נָזִיר--לְהַזִּיר: it connects vows to nezirut and nezirut to vows. Just as by nezirut it made handles to nezirut like nezirut, so too by vows it make handles to vows like vows.
And just as for vows, one might violate "not breaking his word" and "not delaying," so too upon nezirut one might violate "not breaking his word" and "not delaying."

And just as by vows, the father can annul the vows of his daughter and the husband can annul the vows of his wife, so too by nezirut, the father can annul the nezirut of his daughter and the husband can annul the nezirut of his wife.

But if he said "I am barred from you," it does not imply a prohibition on eating.

What is the reason?
"I am barred from you" implies that I will not speak to you. "I am separated from you" imples that I will not conduct business with you. "I am distanced from you" implies that I will not stand in your four cubits.

He may compel her to move with him from a town which is a majority gentile to a town which is majority Israelite, but not from a town which is majority Israelite to a town which is majority gentile.

There is an internal contradiction! You have said "if he married a woman in the land of Israel and he divorced her in Cappadocia, he gives of the currency of the land of Israel." Thus, we go after the place the obligation was undertaken.
But then he teaches "If he married a woman in Cappadocia and divorced her in the land of Israel, he gives her from the currency of the land of Israel." Thus, we go after the place of collection!
Rabbi Abba {our gemara: Rabba} said: They are teaching here of the leniencies of the ketuba {since they hold it is Rabbinic}.
"Rabban Shimon ben Gamliel said: He gives her of the currency of Cappadocia" -- he holds that ketuba is Biblical.

The Sages learnt {in a brayta}: If a man produces a bond of indebtedness against another which was written in Bavel {and the place of issue of Bavel was recorded there}, he must allow him to collect it in Babylonian currency.
If it was written in the land of Israel {and the place of issue of Israel was recorded there}, he must allow him to collect it in the currency of Israel.
If it was written without specification, if he produced it in Bavel he must allow him to collect it from Babylonian currency, and if he produced it in the land of Israel, he must allow him to collect it in the currency of the land of Israel.
If it was written in it "silver" without specification {presumably of an amount}, whatever {amount} the borrower wishes to pay he may collect.
Which is not true by ketuba.

"Which is not true by ketuba" is going on what?
R' Mesharshiya said: On the former part {resha}, and to exclude from Rabban Shimon ben Gamliel, who said that ketuba was Biblical. Thus it informs us that it is Rabbinic.

And so is the halacha.

All agree that if both have the best quality land, both have medium quality land, or both have lowest quality land, it is a matter of merely switching bags. {and what is the point?!}
Where do they argue? Where one of them has best and medium, and the other has lowest quality.
Rav Nachman holds that they estimate {this "best" and "worst"} with his own {holdings}. And Rav Sheshet holds that the estimate with what all people have.
And we establish the halacha like Rav Nachman in monetary matters.

He {=Abaye} said to him: You have said well, for Rabbi Yochanan said, if he pleads and says "I turned around and purchased it back from him," he is believed.
To explain: And this is where the land is in his possession, but if the land is not in his possession, he is not believed.
This can only be arrived at by careful analysis, for he said to him, "go and give him." We so derive.
Abaye said: One who appoints a guardian should appoint like this one, who knows how to turn the scales in favor of the orphans.

Admon said well! {What, then is the reason of the Sages?}
Rav Yehuda cited Rav: Such that 4 different men {own field which} surround his 4 sides.
If so, what is the reason of Admon?
Rather, Rava said: Four who come by virtue of the rights of four {by purchase or gift}, or four who came by virtue of the rights of one {by purchase or gift}, all agree that they can find to push him off.
Where do they argue? By one person who comes by virtue of the rights of four {=he purchased it from four separate individuals}.
Admon held that "In all events, my path is in your territory."
And the Sages hold {that he may retort}, "If you will keep quiet, well and good, but if not I will return the deeds to their respective original owners whom you will have no chance of calling to law."

There was one {who was dying} who said to them that a palm tree should be given to his daughter. The brothers came and divided, and they did not give the palm tree to the daughter.
Rav Yosef thought to say that this is our Mishna {in that each brother can shift responsibility to his fellow}.
Abaye said to him: Is it truly comparable? There, each of them can find to push her off. Here, the palm tree is by all of them.
What is their fix? They should give her the palm tree, then turn around and divide again from the start {without the palm tree}.

המוציא שטר חוב על חבירו והלה הוציא שמכר לו את השדה
אדמון אומר אילו הייתי חייב לך היה לך ליפרע את שלך כשמכרת לי את השדה
וחכמים אומרים זה היה פקח שמכר לו את הקרקע שיכול למשכנו עליו
IF A MAN PRODUCED A BOND OF INDEBTEDNESS AGAINST ANOTHER, AND THE LATTER PRODUCED {A DEED OF SALE, SHOWING} THAT THE FORMER HAD SOLD HIM A FIELD --
ADMON RULED; [THE OTHER] CAN SAY, HAD I OWED YOU [ANYTHING] YOU WOULD HAVE RECOVERED IT WHEN YOU SOLD ME THE FIELD'.
THE SAGES, HOWEVER, SAY; THIS [SELLER] MAY HAVE BEEN A PRUDENT MAN, SINCE HE MAY HAVE SOLD HIM THE LAND IN ORDER TO BE ABLE TO TAKE IT FROM HIM AS A PLEDGE.

In a place where they give the money and afterwards write the deed, all agree that he is able to say to him, "you should have been repaid {when you sold me the field}." Where do they argue? In a place where they write the deed and afterwards give the money. Admon holds that he that he should have made a declaration of his motive. And the Sages hold that {the claimant can retort}, "Your friend has a friend, and your friend's friend has a friend."

THE SAGES, HOWEVER, RULED: THE ONE RECOVERS HIS DEBT AND THE OTHER RECOVERS HIS DEBT.

ADMON RULED: SHE MAY SAY, 'HAD I MYSELF PROMISED THE SUM ON MY BEHALF I WOULD REMAIN {SINGLE} UNTIL MY HAIR GREW GREY, BUT NOW THAT MY FATHER HAS PROMISED IT, WHAT CAN I DO? EITHER MARRY ME OR SET ME FREE'.

RABBAN GAMLIEL SAID: ADMON'S WORDS HAVE MY APPROVAL.

Or Mishna is not in accordance with the Tanna of the following brayta:
Rabbi Yossi beRabbi Yehuda said: Admon and the Sages do not disagree regarding one who promised money to his son-in-law and then defaults, that she does not sit until her hair turns gray. And upon what do they argue? Where she herself promised. For the Sages say that she sits until her hair turns gray. Admon says: She is able to say, "I thought that Father would give me. Now that Father will not give me, what am I able to do? Either marry me or set me free."
Rabban Gamliel said: I see the words of Admon.

וקי"ל כתנא דידן והשתא דתקינו רבנן למורדת למיתב לה (לאלתר) [גיטא] ל"ש פסק עליה אביה ול"ש פסקה איהי כד אמרה ליה או כנוס או פטור כייפינן ליה ויהיב לה גיטא בעל כרחיה
And we establish like our own Tanna. And now that the Sages enacted for a rebellious woman to give her (* immediately *) [the get], it does not matter whether her father promised on her behalf or if she herself promised, but rather, when she says to him "Either marry me or set me free," we force him, and he gives her the get against his will.

IF A MAN CONTESTS {THE OWNERSHIP OF} A FIELD ON {THE DEED OF SALE OF} WHICH HE IS SIGNED AS A WITNESS {and his claim is that the seller took the field from him by violence} --
ADMON RULED; {HIS CLAIM IS ADMISSIBLE BECAUSE} HE CAN SAY, '{LITIGATION WITH} THE SECOND {=the purchaser} IS EASIER FOR ME, SINCE THE FIRST IS A MORE DIFFICULT PERSON THAN ME {our Mishna: THAN HE}'.
THE SAGES, HOWEVER, RULED THAT HE HAS LOST HIS RIGHT.

IF HE {=THE SELLER - so Soncino; but from below, perhaps the contestant} MADE IT {=the contested field} A {BOUNDARY} MARK FOR ANOTHER PERSON {who bought an adjacent field}, then he {=THE CONTESTANT} HAS LOST HIS RIGHT.

Gemara:
אמר רבי אמי לא שנו אלא עד אבל דיין לא איבד זכותו דתני ר' חייא אין העדים חותמין על השטר אא"כ קראוהו והדיינין חותמין אע"פ שלא קראוהו:
Rabbi Ammi {our gemara: Abaye, as below} said: They only learned this where he was a witness, but as a judge, he did not lose his right. For Rabbi Chiyya taught: The witnesses do not sign on the deed unless they have read it, while the judges sign it even though they have not read it.

עשאה סימן לאחר איבד זכותו
אמר אביי לא שנו אלא לאחר אבל לעצמו לא איבד זכותו דאי לאו דעבד הכי לא הוה מזבין ליה
"If he made it as a {boundary} sign for another, he {the contestant} has lost his right":
Abaye said: They only learned this where it was for another person, but for {the contestant} himself, he {=the contestant} has not lost his right. For if he did not do that, he would not have sold to him.

ירושלמי לא סוף דבר שעשאה העורר סימן לאחר אלא אפילו עשאה אחר לאחר והעורר חתום עליה בעד איבד זכותו
Yerushalmi:
It is not the end of the matter that the contestant makes it a sign for another, but even if another makes {it a sign} for still another, and the contestant signs upon it as a witness, he lost his right.

שוקל לו שקלו ופורע לו חובו ומחזיר לו אבידתו ובמקום שנותנין עליה שכר תפול הנאה להקדש

דתנן תורמין על האבוד ועל הגבוי ועל העתיד לגבות

אלא פורע לו חובו הא קא משתרשי ליה

We learnt {in a Mishna} there: If one vows off benefit from his friend,

he may still pay his shekel {contribution to the Temple for korbanot}, pay off his debt {owed to a third party}, return his lost article, but where a reward is offered {for the return of the lost article}, that benefit is to hekdesh.
It is well and good in terms of paying his shekel, for he is performing a precept. For we learned {in a Mishna}: It is lawful to withdraw {from the Temple funds} on the account of that which was lost, collected, or about to be collected.
And {the ruling that he may} restore to him any object he may have lost' {is also intelligible since thereby} also he is performing a precept.
But paying his debt, he certainly causes him to root {=benefit him}!
Rav Hoshaya said: Who is this? It is Chanan, who said that he is placing his money on the horn of a stag.

Yerushalmi:
Rabba bar Mamal {said}: If one pays a bond of indebtedness to {=of} his friend without his {friend's} knowledge, it is a dispute between Chanan and the sons of the Kohanim Gedolim.
Rabbi Yossi said: The reason of the sons of the Kohanim Gedolim over there, is that it did not enter his mind that his wife will starve to death. But here, he can find to say that "I would have placated him, and he would have forgiven me the debt," and even though there was a pledge.

Rabbi Yehoshua ben Levi said: You do not find someone who is placated on his friend who owes him money except for the produce tax and the head tax.
Rav said: Whatever is seized because of his fellow, he is obligated to repay him.
The strength of Rav is from here: If one stole a field and sold it to his friend, and the authorities took it away from him, they force him {=the thief} to return the money. And he did not hear the statement of Rabbi Yochanan, for Rabbi Yochanan said: They imposed a fine on the thief.

Mishna:
אדמון אומר שבעה מי שמת והניח בנים ובנות בזמן שהנכסים מרובין הבנות יזונו והבנים יורשין ובזמן שהנכסים מועטים הבנות יזונו והבנים ישאלו על הפתחים

אמר רבן גמליאל רואה אני את דברי אדמון
ADMON LAID DOWN SEVEN RULINGS:
IF A MAN DIES AND LEAVES SONS AND DAUGHTERS, IF THE ESTATE IS LARGE THE SONS INHERIT IT AND THE DAUGHTERS ARE MAINTAINED {FROM IT}.
AND IF THE ESTATE IS SMALL THE DAUGHTERS ARE MAINTAINED FROM IT, AND THE SONS CAN GO BEGGING.
ADMON SAID, 'AM I TO BE THE LOSER BECAUSE I AM A MALE!?
RABBAN GAMLIEL SAID; ADMON'S VIEW HAS MY APPROVAL.

{Rif:} And the halacha is not like Admon.

Mishna:
הטוען את חבירו כדי יין וכדי שמן והודה לו בקנקנים
אדמון אומר הואיל והודה ממין הטענה ישבע
וחכמים אומרים אין ההודאה ממין הטענה
אמר רבן גמליאל רואה אני את דברי אדמון
IF A MAN CLAIMED FROM ANOTHER JARS OF OIL AND [THE LATTER] ADMITTED HIS CLAIM TO [EMPTY] JARS, ADMON RULED: SINCE HE ADMITTED A PORTION OF THE CLAIM HE MUST TAKE AN OATH.
BUT THE SAGES SAID: THE ADMISSION OF THE PORTION [OF THE CLAIM] IS NOT OF THE SAME KIND AS THE CLAIM.
RABBAN GAMLIEL SAID; ADMON'S VIEW HAS MY APPROVAL.

Gemara:
היכא דאמר ליה מלא עשרה כדי שמן יש לי בידך שמן טעין ליה קנקנים לא טעין ליה
עשרה כדים מלאים שמן יש לי אצלך שמן וקנקנים קא טעין ליה
Where he said to him, "the fullness of ten jugs of oil I have in your hand," then he is claiming the oil but not claiming the jugs.
"Ten jugs full of oil I have by you," he is claiming both oil and jugs.

כי פליגי היכא דא"ל עשרה כדי שמן יש לי אצלך
אדמון סבר יש בלשון הזה לשון קנקנים והוה ליה מודה מקצת הטענה וישבע
ורבנן סברי אין בלשון הזה לשון קנקנים ואין כאן הודאה ממין הטענה אלא מה שטענו לא הודה לו ומה שהודה לו לא טענו
דהוה ליה כמו שטענו חטים והודה לו בשעורים דפטור
וקי"ל כאדמון דאמר יש בלשון הזה לשון קנקנים והוה ליה מודה מקצת הטענה
Where do they argue? Where he said to him, "ten jugs of oil I have by you."
Admon holds that there is in this language the language of jugs, such that he {who admits the jugs} admits to part of the claim, and thus swears.
And the Sages hold that there is not in this language the language of jugs, and so this is not admission to part of the claim, but rather that which he claimed, he did not admit to him, and that which he admitted to him, he did not claim.
For it is like where he claimed wheat and he admitted to him barley, that he is exempt.

And we establish like Admon who said there there is in this terminology the language of jugs, and so he is admitting to him part of the claim.

For we say: Rabbi Zera cited Rabba Bar Yirmeya: Two things which Chanan said, the halacha is like him and like those like him. The seven things said by Admon, there are some of them in which the halacha is like him, and those like him; there are some of them in which the halacha is not like him and those like him.
Wherever Rabban Gamliel said I see the words of Admon, the halacha is like him, and if not, no.
And those of which Rabban Gamliel said "I see the words of Admon," they are three -- (a) one who died and left sons and daughters; (b) and one who claimed from his fellow jugs of oil; (c) and one who allocates money for his son-in-law.
Now, one who died and left sons and daughters, we take it out of this halachic conclusion, and we establish like the Sages, who say that for a small estate, the daughters are supported and the sons beg at doorways.
We are thus left with two, in which the halacha is like Admon, and those like him.

Those like Chanan, is that which we said earlier: Rav Hoshaya said: Who is this? This is Chana , who said that he placed his money on the horns of a stag.

ואמר רבי חייא בר אבא תלמוד ערוך הוא בפי' ר' יוחנן הא מני אדמון היא וכבר ברירנא בשבועות שהלכה היא טענו שור שה

Those like Admon is that which we said in Shevuot: If he claimed an ox, a sheep and a donkey, and he {=the other} admitted to him in one of them, he is obligated.
And Rabbi Chiyya bar Abba said: It was a laid out teaching, in the explanation of Rabbi Yochanan - Who is this? It is Admon.
And we have already explained it in Shevuot, that the halacha is that if he claimed an ox, a sheep and a donkey, and he admitted to him in one of them, he is obligated.
