19a

{Bava Kamma 37a}

ת"ר ראה שור נגח חמור לא נגח סוס נגח גמל לא נגח פרד נגח ערוד לא נגח נעשה מועד לסירוגין לכל:
The Sages learnt {in a brayta}: If an animal sees an ox and gores it, an ass and does not gore it, a horse and gores it a camel and does not gore it, a mule and gores it, a wild ass and does not gore it, the animal becomes muad to alternate beasts of all species.

לה וְכִי-יִגֹּף שׁוֹר-אִישׁ אֶת-שׁוֹר רֵעֵהוּ, וָמֵת--וּמָכְרוּ אֶת-הַשּׁוֹר הַחַי, וְחָצוּ אֶת-כַּסְפּוֹ, וְגַם אֶת-הַמֵּת, יֶחֱצוּן. 35 And if one man's ox hurt the ox of his fellow, so that it dieth; then they shall sell the live ox, and divide the price of it; and the dead also they shall divide.

What is your will? If "his fellow" is specific, then when that {ox} of a Canaanite gores that of an Israelite, he should also be exempt! And if "his fellow" is not specific, then even when that of an Israelite gores that of a Canaanite, he should be liable!
Rabbi Abahu said: The verse states {Chavakuk 3:6}:
ו עָמַד וַיְמֹדֶד אֶרֶץ, רָאָה וַיַּתֵּר גּוֹיִם, וַיִּתְפֹּצְצוּ הַרְרֵי-עַד, שַׁחוּ גִּבְעוֹת עוֹלָם; הֲלִיכוֹת עוֹלָם, לוֹ. 6 He standeth, and shaketh the earth, He beholdeth, and maketh the nations to tremble; and the everlasting mountains are dashed in pieces, the ancient hills do bow; His goings are as of old.
What did He see? He saw the 7 commandments that the descendants of Noach accepted upon themselves and did not fulfill. He stood {amad} and permitted {hittir, from vayater} their money to Israel.

IF AN OX OF AN OWNER WITH UNIMPAIRED FACULTIES GORES AN OX OF A DEAF-MUTE, AN IDIOT OR A MINOR, THE OWNER IS LIABLE.
WHERE, HOWEVER, AN OX OF A DEAF-MUTE, AN IDIOT OR A MINOR HAS GORED AN OX OF AN OWNER WHOSE FACULTIES ARE UNIMPAIRED, THERE IS NO LIABILITY.
IF AN OX OF A DEAF-MUTE AN IDIOT OR A MINOR HAS GORED, THE COURT OF LAW APPOINT A GUARDIAN, IN WHOSE PRESENCE WITNESSES WILL BE ABLE TO TESTIFY {THAT THE OX HAS GORED SO THAT IT WILL EVENTUALLY BE DECLARED MU'AD}.

נתפקח החרש ונשתפה השוטה והגדיל הקטן חזר לתמותו דברי רבי מאיר
רבי יוסי אומר הרי הוא בחזקתו:
IF THE DEAF-MUTE RECOVERS HIS HEARING [OR SPEECH], OR IF THE IDIOT BECOMES SANE, OR IF THE MINOR COMES OF AGE, THE OX PREVIOUSLY DECLARED MU'AD WILL RETURN TO THE STATE OF TAM: THESE ARE THE WORDS OF RABBI MEIR.
RABBI YOSSI SAYS THAT THE OX WILL REMAIN IN STATUS QUO.

שור האצטדין אינו חייב מיתה שנאמר כי יגח ולא שיגיחוהו:
IN THE CASE OF A STADIUM OX {used for gladiatorial hunts}, THE DEATH PENALTY IS NOT IMPOSED [UPON THE OX], AS IT IS STATED {Shemot 21:28}:
כח וְכִי-יִגַּח שׁוֹר אֶת-אִישׁ אוֹ אֶת-אִשָּׁה, וָמֵת--סָקוֹל יִסָּקֵל הַשּׁוֹר, וְלֹא יֵאָכֵל אֶת-בְּשָׂרוֹ, וּבַעַל הַשּׁוֹר, נָקִי. 28 And if an ox gore a man or a woman, that they die, the ox shall be surely stoned, and its flesh shall not be eaten; but the owner of the ox shall be quit.

And so did Rama bar Chama teach: orphans do not require a prosbul; Rabban Gamliel and his court are the fathers of orphans.

איכא מאן דפשט מהא דמאן דיהיב מידי לעניי' באמירה ובעא למהדר ביה מצי הדר ביה
ואמר הכי מדאמר רב יוסף ואע"ג דליכא עניי' הכא דליזכו ביה אנן ידי עניים אנן

There is one who resolves from this that one who gives something over to paupers with speech, and wishes to retract, is able to retract. And he says this based on the statement of Rav Yosef, "and even though the paupers are not here to acquire it, we are the hands of the paupers." We derive from here that the law of the paupers is the same law as normal individuals. For by a normal individual, if one person says to his fellow, "I have 100 zuz in your hand, give it to Ploni" in an assembly of all three of them, he {=Ploni} acquired, and if not {in such an assembly} he does not acquire. So too is the law of the paupers. And because of this, Rav Yosef said "and even though the paupers are not here to acquire it, as the law of an assembly of the three, we are the hands of the paupers."

And we say that there is not to infer this from that. For we explicitly say {Devarim 23}:
כד מוֹצָא שְׂפָתֶיךָ, תִּשְׁמֹר וְעָשִׂיתָ: כַּאֲשֶׁר נָדַרְתָּ לַיהוָה אֱלֹהֶיךָ, נְדָבָה, אֲשֶׁר דִּבַּרְתָּ, בְּפִיךָ. {ס} 24 That which is gone out of thy lips thou shalt observe and do; according as thou hast vowed freely unto the LORD thy God, even that which thou hast promised with thy mouth. {S}
this is charity. Thus, with {mere} speech he is obligated. And this that Rav Yosef said here, is to to say "and even though there are not paupers here to acquire it, we are the hands of paupers," such that is clear that if not so, he is able to retract from it. Not because the law of the paupers is like the law of the normal individuals, but rather because that half-zuz was not in his domain, for it had not yet come to his hand. And we say: Rav said: And money that you are able to take out with judges and one sanctifies, it is not sanctified.

ואקשינן הא יכול להוציאו בדיינים והקדישו קדוש
והא"ר יוחנן גזל ולא נתייאשו ממנו הבעלים שניהן אינן יכולין להקדיש זה לפי שאינו שלו וזה לפי שאינו ברשותו
ואוקימנא להא דרב במקרקעי דכי יכול להוציאו בדיינין ברשותיה קאי

And we ask: But if he was able to take it out via judges and he sanctified it, would it be sanctified? But Rabbi Yochanan said: Theft upon which the owners did not give up hope, neither of them are able to sanctify it. This one {=the thief} because it is not his, and this one {=the owner} because it is not in his domain.
And we establish this of Rav as regarding land, for when he is able to take it out via judges, it is in his domain.
And we derive from this that by moveable objects, even money, that he is able to take out via judges, and he sanctifies it, it is not sanctified. And because of this, Rav Yosef said to him: We are the hands of the paupers, that it is not any worse than the law of the normal individual, that he acquires in the assembly of the three of them.

אבל מידי דאיתיה ברשותיה ואמר הרי הוא לעניים כבר זכו ביה עניי ולא מצי למהדר ביה כדאמר בפיך זו צדקה

ות"ר האומר סלע זו לצדקה עד שלא באת ליד גבאי מותר לשנותה משבאת ליד גבאי אסור לשנותה:
But something which is indeed in his domain and he says "behold it is to paupers," the paupers have already acquired it and he is not able to retract in it, as it states {Devarim 23}:

this is charity.
And Rava said: Charity, he is obligated in it immediately, for behold, the paupers are in existence {?}.
But certainly, if he wants to switch that thing which he gives to the paupers before it reaches the hand of the collector with some other thing which is like it, he is able to switch it. As we learn in Arachin: Rav Nachman cited Rabba bar Avuah who cited Rav: This sela to charity, he is permitted to switch it, whether for himself or another, and it makes no difference if he said "this" {sela} or "upon me."

And the Sages learnt {in a brayta}: If one said "this sela to charity," while it has not yet reached the hands of the collector, he is able to switch it; once it reaches the hand of the collector, it is forbidden to switch it.

IF AN OX WAS MU'AD TO DO DAMAGE TO ITS OWN SPECIES BUT WAS NOT MU'AD TO DO DAMAGE TO ANY OTHER SPECIES [OF ANIMALS] OR IF IT WAS MU'AD TO DO DAMAGE TO THE HUMAN SPECIES BUT NOT MU'AD TO ANY SPECIES OF BEASTS, OR IF IT WAS MU'AD TO SMALL [CATTLE] BUT NOT MU'AD TO LARGE [CATTLE], IN RESPECT OF DAMAGE DONE TO THE SPECIES TO WHICH IT WAS MU'AD THE PAYMENT WILL HAVE TO BE IN FULL, BUT IN RESPECT OF DAMAGE DONE TO THAT TO WHICH IT WAS NOT MU'AD, THE COMPENSATION WILL BE FOR HALF THE DAMAGE ONLY.

אמרו לפני ר' יהודה הרי שהיה מועד לשבתות ואינו מועד לימות החול
אמר להם לשבתות משלם נ"ש ולימות החול משלם ח"נ מאימתי יהי תם משיחזור בו ג' ימי שבתות:
THEY SAID BEFORE RABBI YEHUDA: HERE IS ONE WHICH WAS MU'AD TO DO DAMAGE ON SABBATH DAYS BUT WAS NOT MU'AD TO DO DAMAGE ON WEEK DAYS.
HE SAID TO THEM: FOR DAMAGE DONE ON SABBATH DAYS THE PAYMENT WILL HAVE TO BE IN FULL, WHEREAS FOR DAMAGE DONE ON WEEK DAYS THE COMPENSATION WILL BE FOR HALF THE DAMAGE ONLY. WHEN [CAN THIS OX] RETURN TO THE STATE OF TAM? WHEN IT REFRAINS [FROM GORING] ON THREE [CONSECUTIVE] SABBATH DAYS.

It was stated {by Amoraim}:
Rav Zevid said: One should teach {in the Mishna}: "But it was not a muad..." {as we have above}.
Rav Pappa said: One should teach "it is not muad" {meaning that be default the state of muad does not spread to other species}.
Rav Zevid said one should teach "but it was not a muad" -- but in the plain {default} case, it is a muad. And Rav Pappa said one should teach "it is not a muad" -- that in the plain case, it is not a muad.
And our sugya is like Rav Pappa.
And if you say that one holds like Rav Pappa, {still} if it gored an ox, a donkey and a camel {one time each}, it is made into a muad for all of them.

We have learnt elsewhere: If a man boxes another man's ear, he has to give him a sela.

A certain man having {been summoned for} boxing another man's ear. Rav Tuvia bar Mataniah sent before Rav Asi: Did they mean a Tyrian sela or a sela of whatever country?
And he resolved it from that which we said: Rav Yehuda says: Wherever money is mentioned in the Torah, the reference is to Tyrian money, but wherever it occurs in the words of the Rabbis it means local money.
The plaintiff upon hearing that said to the judge: 'Since it will [only] amount to half a zuz, I do not want it; let him give it to the poor.' Later, however, he said to them; 'Let him give it to me, as I will go and obtain a cure for myself with it.'
Rav Yosef said to him: The poor have already acquired a title to it, for though the poor were not present here, we [in the Court, always] act as the agents of the poor. For Rav Yehuda cited Shmuel: Orphans do not require a prozbol,

IF A [TAM] OX HAS GORED FOUR OR FIVE OXEN ONE AFTER THE OTHER, COMPENSATION SHOULD IN THE FIRST INSTANCE BE MADE [OUT OF THE BODY OF THE OX] FOR THE LAST OFFENSE.
AND SHOULD THERE BE A SURPLUS, COMPENSATION IS TO BE PAID ALSO FOR THE PENULTIMATE OFFENSE; SHOULD THERE STILL BE A SURPLUS, COMPENSATION IS TO BE MADE TO THE ONE BEFORE; THE LATER THE LIABILITY THE PRIOR THE CLAIM. THESE ARE THE WORDS OF RABBI MEIR.

RABBI SHIMON SAYS: IF AN OX OF THE VALUE OF TWO HUNDRED [ZUZ] HAS GORED AN OX OF THE SAME VALUE OF TWO HUNDRED [ZUZ] AND THE CARCASS HAS NO VALUE AT ALL, THE PLAINTIFF WILL GET A HUNDRED ZUZ AND THE DEFENDANT WILL GET A HUNDRED ZUZ [OUT OF THE BODY OF THE OX THAT DID THE DAMAGE].
SHOULD THE SAME OX HAVE GORED ANOTHER OX OF THE VALUE OF TWO HUNDRED [ZUZ], THE SECOND CLAIMANT WILL GET A HUNDRED ZUZ, WHILE THE FORMER CLAIMANT WILL GET ONLY FIFTY ZUZ AND THE DEFENDANT WILL HAVE FIFTY ZUZ [IN THE BODY OF HIS OX].
SHOULD THE OX HAVE GORED YET ANOTHER OX OF THE VALUE OF TWO HUNDRED [ZUZ], THE THIRD CLAIMANT WILL GET A HUNDRED [ZUZ] WHILE THE SECOND WILL GET ONLY FIFTY [ZUZ] AND THE FIRST TWO PARTIES WILL HAVE A GOLD DENAR [EACH IN THE BODY OF THE OX THAT DID THE DAMAGE].

And the halacha is like Rabbi Shimon, for behold we establish our Mishna, the resha as Rabbi Yishmael who said that they are creditors, and the sefa as Rabbi Akiva who said that they are partners. And we establish that the halacha is like Rabbi Akiva over his colleague. And since Rabbi Shimon stands like him, the halacha is like him {=Rabbi Shimon}.

והיכא דתפסו ניזק לגבות ממנו נעשה עליו שומר שכר לנזקיו ומחייב בניזקיה
והיינו דקתני אם יש בו מותר יחזיר לשלפניו פרישנא הכי אם יש בו מותר בנזקיו יחזיר לשלפניו
ובהא אפילו רבי שמעון מודה:
And where the damaged party seized in order to collect from it, he is made upon it as if a paid watchman for his damaged goods and is liable in its damage.
And this that they state: If there is surplus, he returns it to the one before him, we explain it as follows: If there is a surplus over that of his damaged goods, he turns it over to the one before him {who was damaged}. And in this, even Rabbi Shimon admits.

Rabba bar Natan said: If he claimed wheat and he {=the defendant} admitted to him about barley, he is exempt.
Let us say that the following supports him. For they learnt {tanya -- though this appears to be a Mishna}: Where the plaintiff claimed wheat and the defendant admitted barley he is not liable.
If from there, I would have said that what is meant by exempt? Exempt from the value of the wheat, and yet he is still liable to the value of the barley. Therefore it informs us that he is entirely exempt.

And we ask on this from that which we learnt {in the Mishna}, "WHERE THERE WERE TWO INJURED OXEN, ONE BIG AND THE OTHER LITTLE, AND THERE TWO INJURING OXEN, ONE BIG AND THE OTHER LITTLE, AND THE PLAINTIFF ASSERTS THAT THE BIG ONE INJURED THE BIG ONE AND THE LITTLE ONE THE LITTLE ONE, WHILE THE DEFENDANT CONTENDS, 'NOT SO, FOR [IT WAS] THE LITTLE ONE [THAT INJURED] THE BIG ONE AND THE BIG ONE [THAT INJURED] THE LITTLE ONE'... THE BURDEN OF PROOF FALLS ON THE CLAIMANT.
Thus, if he does not bring a proof, he takes as the damaging party stated. But why? Is this not wheat and barley?

And we resolve: Where he had already seized them.
And so too, in terms of where he claimed wheat and he {=the defendant} admitted barley, if he seized barley, they do not take it away from him. And so do the {post-Talmudic} rabbis rule, as we have written.

But if 'BOTH OF THEM' are not with him he may plead, 'Go and produce evidence that it was this ox {which is still with me} that did the damage, and then I will pay you.'

Therefore, he pays him 75, plus the 50 of the carcass. Thus, it is 125. And this is what we say: This one takes 125, and this one takes 125.

How does one pay in the difference of half-damages?

The second one pays to the first one 1/2 a gold dinar, which is 12.5 zuz {or half of the 25 zuz difference}.

And we conclude: The increase in the carcass in the practical difference between them. Rabbi Meir maintains that the increase of the carcass is to the damaged party, and Rabbi Yehuda maintains it will be split.
But a loss in the value of the carcass, all agree that is belongs to the damaged party, for we assess the carcass how much it is worth at the time

כיון דברשות קא עביד פטור או דלמא איבעי ליה לעיוני
ואסיקנא אמר רבא ק"ו ומה יער שזה לרשותו נכנס וזה לרשותו נכנס נעשה כמי שנכנס לרשות חבירו וגולה זה שלרשות חבירו נכנס לא כל שכן אלמא חייב בנזקה:

"IF ONE COMES WITH HIS BARREL AND AN OTHER COMES WITH HIS BEAM...":
Rava bar Natan inquired of Rav Chisda: If one injures his wife in the course of intercourse, what is the law? Since he is acting with permission, he is exempt? Or perhaps he should have looked out {and taken greater care}?
And we conclude: Rava said: It is a kal vachomer: Just as a forest {this is a reference to the law of accidental killing while chopping wood}, that this one enters his domain and this one enters his domain, but it is made as if he entered his fellow's domain and is exiled, then this one who entered into his fellow's domain {=the wife}, should it not certainly be so?
Thus it is clear that he is liable to the damage he caused her.

They learnt {in a brayta}: Issi ben Yehuda says: the one running is liable, for he is changing {from the usual conduct}. And Issi ben Yehuda admits on erev Shabbat at twilight that he is exempt because he is running with permission.

Rabbi Yochanan said: The halacha is like Issi ben Yehuda.

And if both of them were running and damaged one another, even though on a weekday they would be exempt.

The Sages learnt {in a brayta}: If a man entered the workshop of a joiner without permission and a chip of wood flew off and struck him in the face and killed him, he {=the joiner} is exempt. But if he entered with permission {=of the joiner}, he is liable.

In what is he liable?
Rabbi Yossi bar Chanina said: He is liable in the four things {=tzaar, ripui, shevet, boshet} and is exempt from exile.
Rav Pappa in the name of Rava taught this {statement} upon the resha {modifying it rather than the sefa}: If a man entered the workshop of a joiner without permission and a chip of wood flew off and struck him in the face and killed him, he {=the joiner} is exempt. Rabbi Yossi bar Chanina said: He is liable in the four things {=tzaar, ripui, shevet, boshet} and is exempt from exile.

Rav Zevid in the name of Rava taught it upon this:
ה וַאֲשֶׁר יָבֹא אֶת-רֵעֵהוּ בַיַּעַר, לַחְטֹב עֵצִים, וְנִדְּחָה יָדוֹ בַגַּרְזֶן לִכְרֹת הָעֵץ, וְנָשַׁל הַבַּרְזֶל מִן-הָעֵץ וּמָצָא אֶת-רֵעֵהוּ וָמֵת: הוּא, יָנוּס אֶל-אַחַת הֶעָרִים-הָאֵלֶּה--וָחָי. 5 as when a man goeth into the forest with his neighbour to hew wood, and his hand fetcheth a stroke with the axe to cut down the tree, and the head slippeth from the helve, and lighteth upon his neighbour, that he die; he shall flee unto one of these cities and live;
{lit. and found} -- to the exclusion of one who brings himself {into range of the missile}.
From here Rabbi Eliezer ben Yaakov said: If from when the stone went from out of his hand, this other one stuck out his head and took it, behold this one {who threw it} is exempt.

Rabbi Yochanan established it as where he should have stopped and he did not stop. And therefore he is liable. And even according to the Sages who say that stumbling is not negligence, here, since he should have stopped and he did not stop, he is taken out of the status of accident and arises in the status of negligent. But if he was not able to stop, he is exempt, and we do not say that he should have been careful, as he was distracted.
And so is the halacha.

And if it is difficult for you that earlier {law} that if his pitcher broke and he did not remove it, that we say this is accidental action, and we do not make him liable. And this is even though he should have removed it and he did not remove it. {In answer:} There, where his pitcher broke and he did not remove it, since it was a case of accident at the the time of the falling that water and those shards are like ownerless items which come about on their own. And therefore, even if he was able to remove them and he did not remove them, he is exempt, for from the time of their falling, he made them ownerless. But here, he himself fell, and with his body he caused his fellow to stumble. Therefore, even though it is an accident at the time of the falling, if he is able to stop and did not stop, he is liable, for his own body is not ownerless. And now, since he is able to stop and he did not stop, he is not considered accidental.

Where, however, they all fell because of the first, the first is liable for the damage [sustained] by them all. If [on the other hand] they cautioned one another, there is exemption. All of them are liable for damage [done] by their person, and are exempt for damage done by their property.

Rabbi Yaakov cited Rabbi Yochanan {our gemara: Just Rabbi Yochanan}: They only learned this where they {=the thorns} were projecting {into the public ground}. But if they were confined {to the private domain}, he is exempt.
Where they are confined, what is the reason he is exempt? Rav Acha son of Rav Ikka said: Because it is not the way of people to rub themselves against walls.

Rabbi Yochanan said: They only learned this regarding an impaired wall, but in the case of a strong wall, the one who his them is exempt, and the owner of the wall is liable.
Ravina said: This informs that one who covers his pit with a neighbour's lid and the owner of the lid comes and removes his lid, the owner of the pit would be liable.

The Sages learnt {in a brayta}: The early pious ones would hide their thorns and broken glasses in the midst of their fields at a depth of three handbreadths below the surface so that {even} the plough might not be hindered by them.

Rav Sheshet would cast them into the flame. Rava would cast them into the Tigris {river}.

Rav Yehuda said: If someone wishes to be a pious one {chassid}, let him fulfill the matters {=laws} of damages {making sure not to cause damage}.
Ravina {our gemara: Rava} said: Matters of {masechet} Avot {which deals in ethical matters}. And some {variants} say: Matters in {masechet} Berachot {having to do with blessings}.

Mishna:

Let us say that our Mishna is not in accordance with Rabbi Yehuda.
For they learnt {in a brayta}: Rabbi Yehuda says: At the time {=season} of taking out foliage, a man may take out his foliage to the public domain and pile it up for a length of 40 days, in order that it be trodden upon by human feet and animal feet, for on condition of this, Yehoshua made Israel inherit the land.
And Rav Nachman bar Yitzchak resolves: Our Mishna is not at the time of taking out foliage, and it is the words of everyone {including Rabbi Yehuda}.
And even so, we do not hold like this of Rabbi Yehuda, who exempts at the time of taking out foliage, for behold we establish it at the end of Bava Metzia as the unified position. For Abaye stated: Rabban Gamliel, Rabbi Yehuda, and Rabbi Shimon all maintain that anyone to who the Sages gave authorization and then it damaged, he is exempt from paying. And in all such instances, the halacha is not like any of them.

and shared are like hefker, for they come about by themselves, for he himself did not do anything. But if he intends to merit the shards, he is liable, for behold they are not hefker. And so is the halacha.

And the general case of one declaring ownerless his damaging property, it is a dispute between Rabbi Yochanan and Rabbi Eleazar. One said he is liable and one said he is exempt.
[The one who said he is exempt is like the Sages.] And the one who said he is liable may say "It is I who says these even according to the Sages. For the Sages only say that one who declares ownerless his damaging property is exempt in the case that it was accidental {that the damaging property came about}, but in the general case of declaring damaging property ownerless, he is liable.

And the conclusion is that it is Rabbi Yochanan who says he his liable. [For Rabbi Yochanan said that the halacha is like the anonymous Mishnaic ruling, and we learn {in a Mishna}: One who dug a pit in the public domain, and an ox fell into it, or a donkey, and died, he is liable. We so conclude, and the halacha is like him.

ולענין אבנו סכינו ומשאו שהניחן ברה"ר קי"ל כשמואל דאמר כולן מבורו למדנו ובכולן אני קורא בהן שור ולא אדם חמור ולא כלים

And in terms of his stone, his knife, and his burden which he placed down in the public domain, we establish like Shmuel, who said that we learn all of them for his Pit, and in all of them I apply to them {from the verse in Shemot 21:33} "ox" and not man, "donkey" and not vessels. And these words are in terms of executing {something dangerous}, but in terms of {paying} damages, man is also liable and vessels are exempt, whether he declared them ownerless of did not declare them ownerless, for every nuisance is Pit.

In accordance with who? Like Rabbi Natan, who said there wherever there is not to be paid from this one, there is to be paid from that one.
And so is the halacha.

And Abaye said that they argue in two matters. They argue about at the time of the falling and they argue about after the falling.
They argue about at the time of the falling, in whether stumbling is considered negligence. Rabbi Meir maintains that stumbling is considered negligence, and the Sages say that stumbling is not considered negligence.
And they argue about after the time of falling, where he declared his damaging property ownerless. Rabbi Meir maintains that one who declared his damaging property ownerless is liable, and the Sages say that one who declared his damaging property ownerless is exempt.

"Tell me the details of the matter, how it was."
He said to him that there was a certain well belonging to two people, such that for each day, one of them drew {water} from it {and not the other}. One day, one of them went and drew during the days of his friend. He said to him: It is my day. He paid no heed to him. He took the blade of a hoe and hit him with it.
He said to him: Even had he struck him 100 times with the blade of a hoe. Even according to the one who maintains that a person may not take the law into his own hands, in a case of {irreparable} loss, a man may take the law into his own hands.
For it was stated {by Amoraim}: Rav Yehuda said: a man may not take the law into his own hands. Rav Nachman said: A man may take the law into his own hands.
Where there is {irreparable} loss, all agree that a man may take the law into his own hands. Where do they argue? Where there is no {irreparable} loss. Rav Yehuda said: A man may not take the law into his own hands, for since there is no loss, let him go before the judge. Rav Nachman said that a man may take the law into his own hands, for since he is acting in accordance with the law, one can say that he need not bother himself {to go to court}.

And the halacha is like Rav Nachman, for we establish that the law is like Rav Nachman in {monetary} laws.

This that it stated "for kneeing, three, etc.," the sages explained it that this is only the money for the pain {tzaar}, to the exclusion of the money for embarrassment. And other sages say that this is the full payment for everything, and they support this statement from the incident of Chanan Bisha {who was tokea to his friend}, that they only declared him liable for half a zuz, for they learnt {in a Mishna}: If one gives a blow to his friend {Rashi renders this either as a blow from his mouth, or else from his hand}, he gives him a sela, which is half a zuz. And so do we maintain.

Who is the author of our Mishna? It is Rabbi Meir, who maintains that stumbling constitutes carelessness, but the Sages say that stumbling is accident, and he is therefore exempt.
For they learnt {in a brayta}: If his pitcher broke and he did not remove the potsherds; his camel fell down and he did not raise it, Rabbi Meir makes him liable [for their damage], while the Sages say that

And the Sages admit to Rabbi Meir by his stone, his knife, or his burnden which he placed [on the top of a roof] and it fell in a common wind and damaged, that he is liable. And Rabbi Meir admits to the Sages that regarding bottles that were placed upon the top of the roof for the purpose of getting dry and fell down because of a wind of unusual occurrence and damaged, that he is exempt.

It is logical to us that the halacha is not like Rabba in these, for he holds that we do not judge dina degarmi {indirectly-caused damage}, for it is he who said in the first perek Hagozel that one who burns his friend's deeds is exempt from the laws of man and liable by the laws of heaven. And we establish that halacha is not (*like him except where*) so, for we say that Rafram compelled Rav Ashi, and he seized in the manner of a beam that is fit for decorative mouldings {=to the full extent}.

Rava Pappa said: A pitcher is the same as a barrel, and what is the practical difference? It terms of buying and selling. *)

היכי דמי אילימא דכדא לא קרו ליה חביתא וחביתא לא קרי ליה כדא הא לא קרי ליה
לא צריכא דרובא קרו ליה לכדא כדא ולחביתא חביתא ומיעוטא קרו לחביתא כדא ולכדא חביתא
מהו דתימא זיל בתר רובא קמ"ל אין הולכין בממון אחר הרוב:
How so? If you say that a pitcher is not called a barrel and a barrel is not called a pitcher, then behold it is not called that! No, it is necessary -- that most call a pitcher a pitcher and a barrel a barrel, while a few call a barrel a pitcher and a pitcher a barrel. I would have said that one goes after the majority. Therefore it informs us that we don't go in monetary matters after the majority.

"AND BREAKS IT, HE IS EXEMPT":
Why is he exempt? Let him to to him: You need to look when you are walking!
They said in the academy of Rav in the name of Rav: When he filled the entire public domain with barrels.
And Shmuel said: They learned this for the situation where it was dark.
And Rabbi Yochanan said: In the corner.

And the conclusion: Rabbi Abba said to Rav Ashi: They say in the east {=Eretz Yisrael} in the name of Rabbi Ilai: Since it is not the way of people to look around when on roads.

הדין הוא סברא דילן וחזינן למקצת רבואתא זכרם לברכה בהאי דינא מאי דלא איסתבר לן ומשום הכי לא כתיבנא ליה
There was an incident in Nehardea and Shmuel declared him liable; in Pumbedita and Rabba declared him liable.
All is well with Shmuel, for it is in accordance with his statement. But Rabba, did he hold like Shmuel?
Rav Pappa said: There, it was in the corner of an oil factory, such they acted with authorization {?} {because they customarily do this in this domain, namely keep barrels there} he should be looking as he walks.

The reason is that it was with authorization. But if they did not do this with authorization, we do not say to him "you should have looked while you were going," because it is not the way of people to look around on the roads.
This is our position. And we have seen a few {post-Talmudic} rabbis, may their memory be for blessing, in this law, that which is not logical to us, and because of this, we have have not written it.

Rav Chisda sent {a question} to Rav Nachman: Behold, they have said {that there is a fine} for kneeing, three {selas}; for kicking, five; for {a blow with} a saddle, thirteen; for the blade of a hoe or the handle of a hoe, what {is the law}?
He sent {back to him}: Chisda, Chisda, do you collect fines in Bavel?

אדם מועד לעולם מנלן אמר חזקיה וכן תנא דבי חזקיה אמר קרא פצע תחת פצע לחייבו על השוגג כמזיד ועל האונס כרצון
"MAN IS ALWAYS MU'AD":
Whence is this ruling deduced?
Chizkiya said, and so was it taught in the academy of Chizkiya: The verse states {Shemot 21:25}:
כה כְּוִיָּה תַּחַת כְּוִיָּה, פֶּצַע תַּחַת פָּצַע, חַבּוּרָה, תַּחַת חַבּוּרָה. {ס} 25 burning for burning, wound for wound, stripe for stripe.
To impose liability upon him for inadvertent action just as deliberate actions, and accidental action like willful action.

אמר רבה היתה אבן מונחת לו בחיקו ולא הכיר בה מעולם ועמד ונפלה לענין ניזקין חייב לענין ד' דברים פטור
לענין שבת פטור מלאכת מחשבת אסרה תורה
לענין גלות פטור
Rabba said: If there was a stone resting in his lab which he did not ever realize was there, and he stood up and it fell, in terms of damages, he is liable. In terms of the four items, he is exempt. In terms of Shabbat {if he carried it}, he is exempt, for the Torah forbad work that has been purposed. In terms of exile {for accidental killing with it}, he is exempt.

לענין עבד פלוגתא דרבן שמעון בן גמליאל ורבנן
דתניא הרי שהיה רבו רופא ואמר לו כחול לי עיני וסמאה חתור לי שיני והפילה שיחק באדון ויצא לחירות
רשב"ג אומר אמר קרא ושחתה עד שיתכוין לשחתה
In terms of a slave {being released}, it is a dispute between Rabban Shimon ben Gamliel and the Sages. For they learnt {in a brayta}: If the master was a physician and he {=the slave} requested him "attend to my eye" and it was accidentally blinded, or "scrape my tooth"and it was accidentally knocked out, he may now laugh at the master and go out to freedom. Rabban Shimon ben Gamliel says: The verse states {Shemot 21:26, the next pasuk}:
כו וְכִי-יַכֶּה אִישׁ אֶת-עֵין עַבְדּוֹ, אוֹ-אֶת-עֵין אֲמָתוֹ--וְשִׁחֲתָהּ: לַחָפְשִׁי יְשַׁלְּחֶנּוּ, תַּחַת עֵינוֹ. 26 And if a man smite the eye of his bondman, or the eye of his bondwoman, and destroy it, he shall let him go free for his eye's sake.
Until he intended to destroy it.

הכיר בה ושכחה ועמד ונפלה לענין ניזקין חייב לענין ארבעה דברים פטור לענין גלות [חייב דאמר קרא] בשגגה מכלל דהויא ליה ידיעה והאי הויא ליה ידיעה לענין שבת [פטור] מלאכת מחשבת אסרה תורה לענין עבד פלוגתא דרבן שמעון בן גמליאל ורבנן:
If he recognized its presence and forgot about it, and then stood up: In terms of damages, he is liable. In terms of the four items, he is exempt. In terms of exile [he is liable, for the verse stated] {Bemidbar 35:11}:
יא וְהִקְרִיתֶם לָכֶם עָרִים, עָרֵי מִקְלָט תִּהְיֶינָה לָכֶם; וְנָס שָׁמָּה רֹצֵחַ, מַכֵּה-נֶפֶשׁ בִּשְׁגָגָה. 11 then ye shall appoint you cities to be cities of refuge for you, that the manslayer that killeth any person through error may flee thither.
Thus it informs that he had {at some time} a knowledge, and in the present case, he had {as some time} a knowledge.
In terms of Shabbat [he is exempt] {despite the prior knowledge}, for work that has been purposed that is forbidden by the Law.
In terms of the {freeing of the} slave, it is a dispute between Rabban Shimon ben Gamliel and the Sages.

מתכוין לזרוק שתים וזרק ארבע לענין ניזקין חייב לענין ד' דברים פטור וכו':
If he intended to throw it two {cubits} and he threw it four, in terms of paying damages, he is liable; in terms of the four items, he is exempt; etc. {where the etc. continues for exile, Shabbat, the slave}.

ואמר רבה זרק כלי מראש גגו ובא אחר ושיברו במקל פטור מ"ט דא"ל מנא תבירא תבר:
And Rabba said: If he threw a vessel from the top of his roof and another person came and broke it with his staff {before it hit the ground}, he is exempt. What is the reason? For he may say to him: I broke an already broken vessel.

ואמר רבה זרק כלי מראש גגו והיו תחתיו כרים וכסתות וקדם וסילקן או בא אחר וסילקן פטור דבעידנא דשדייה מיפסק פסיקי גיריה
And Rabba said: If one threw a vessel from the top of his roof, and there were mattresses and cushions below it, and he came ahead {before it fully fell} and removed them, or another person came and removed them, he is exempt. For at the time he cast it, he had let his arrow off {and it could not do damage}.

ואסקא רבא אם תמצא לומר המשסה כלבו של חבירו [בחבירו] חייב בעל הכלב שיסהו בעצמו פטור מ"ט כל המשנה ובא אחר ושינה בו פטור
אמר ליה רב פפא הכי אמרינן משמיה דריש לקיש שתי פרות ברשות הרבים אחת רבוצה ואחת מהלכת בעטה מהלכת ברבוצה פטורה רבוצה במהלכת חייבת
א"ל אי משום הא לא תסייען אנן בההיא חיובא מחייבנא דאמר לה כי אית לך רשותא לסגויי עלי לבעוטי בי לית לך רשותא
וכן הלכה:
And Rava concludes: If you can say that when one sicks his friends dog [upon his {still other} friend], the owner of the dog is liable, if he sicks him {accidentally} upon himself {in the process of inciting it}, he {=the owner of the dog} is exempt. What is the reason? Anyone who acted inappropriately and as a result someone acted wrongly against him, he {=the defendant} is exempt.

Rav Pappa said to him: So do we say in the name of Resh Lakish: Two cows in the public domain, one lying down and one walking, and the walking one kicked the one lying down, it is exempt. The one lying down to the one walking, it is liable.

He said to him: If because of this, it is not a support. We, in this, would impose liability {even on the walking cow}, for he can say to her, what do have upon me? Authorization to tread upon me. To kick me, however, you do not have authorization.

And so is the halacha.

Mishna:
שור המזיק ברשות הניזק כיצד
נגח נגף נשך רבץ בעט ברה"ר משלם חצי נזק ברשות הניזק רבי טרפון אומר נזק שלם
וחכמים אומרים ח"נ:
AN OX DOING DAMAGE ON THE PLAINTIFF'S PREMISES, HOW SO?
IN CASE OF GORING, PUSHING, BITING, LYING DOWN OR KICKING, IF ON PUBLIC GROUND THE PAYMENT IS HALF, BUT IF ON THE PLAINTIFF'S PREMISES RABBI TARFON ORDERS PAYMENT IN FULL.
AND THE SAGES SAY: HALF DAMAGES.

Gemara:
איבעיא להו רגל שדרסה על גבי תינוק בחצר הניזק מהו שתשלם את הכופר
מי אמרינן מידי דהוה אקרן קרן לאו כגון דעבד תרי ותלתא זימנא אורחה הוא ומשלמת כופר הכא נמי לא שנא או דלמא קרן כוונתה להזיק האי אין כוונתה להזיק
ואסיקנא דאיכא כופר ברגל ש"מ:
It was a question to them: Foot {of an animal} which tread upon an infant {and killed it} in the courtyard of the damagee, what is the law regarding paying the kofer? Do we say that it is comparable to Horn. By Horn, is it not so that it does it two and three times, that it is its way {regular behavior} and therefore he pays kofer, and so too here, it is no different {and it is already habitual to walk, such that he would pay}? Or perhaps by Hord, it intended to damage, whereas here, its intent was not to damage?
And we conclude that there is kofer by Foot. We so deduce.

Mishna:
אדם מועד לעולם בין שוגג בין מזיד בין ער בין ישן
סימא את עין חבירו ושבר את הכלים משלם נ"ש:
MAN IS ALWAYS MU'AD WHETHER INADVERTENTLY OR WILFULLY, WHETHER AWAKE OR ASLEEP.
IF HE BLINDED HIS NEIGHBOUR'S EYE OR BROKE HIS ARTICLES, FULL COMPENSATION MUST [THEREFORE] BE MADE.

ירושלמי אמר רבי יצחק מתני' כשהיו שניהם ישנים אבל אם היה אחד מהן ישן ובא חברו וישן אצלו זה שבא לישן אצלו הוא המועד:
Yerushalmi:
Rabbi Yitzchak said: Our Mishna was where both of them {the plaintiff and defendant} were sleeping, but if one of them was asleep and his friend came and slept next to him, the one who came to sleep next to him is the muad.

Bavli:
קתני סימא את עין חבירו דומיא דשבר את הכלים מה התם נזק אין ארבעה דברים לא אף האי נמי נזק אין ד' דברים לא:
It taught {in the Mishna}: "IF HE BLINDED HIS NEIGHBOUR'S EYE" which is similar to "BROKE HIS ARTICLES." Just as there, damages yes, but the four items {of tzaar, ripui, shevet, boshet}, no, so too here as well, damages yes, but the four items no.
