Rif Nedarim 10b {30a - 31a}

10b

{Nedarim 30a}
Mishna:

הנודר מיורדי הים מותר ביושבי יבשה
מיושבי יבשה אסור ביורדי הים שיורדי הים בכלל יושבי יבשה
לא כאלו ההולכים מעכו ליפו אלא ממי שדרכו לפרש

One who vowed from those who go down to the sea {=seafarers} is permitted in those who dwell on the dry land {=land dwellers}.
From those who dwell on dry land, he is forbidden even on seafarers, for seafarers are within the class of those who dwell on dry land.
Not like those who travel from Akko to Yaffo, but rather from those who take long voyages.

הנודר מרואי חמה אסור אף בסומים שלא נתכוון זה אלא למי שהחמה רואה אותו.
הנודר משחורי הראש אסור בקרחים ובעלי שיבות ומותר בנשים ובקטנים שאין נקראים שחורי הראש אלא אנשים.
הנודר מן הילודים מותר בנולדים
מן הנולדים ר"מ מתיר אף בילודים
וחכ"א לא נתכוון זה אלא במי שדרכו להוליד
One who vows from those who see the sun is forbidden even by blind people, for his intent is only he whom the sun sees.
One who vows from the black-haired is forbidden even by the bald and the gray-haired, and is permitted {benefit} from woman and minors, for only men are called "black-haired."

One who vows from "those born" is permitted from those who are yet to be born {noladim}.
From those to be born {noladim} -- {our Mishna: is forbidden even by those already born} Rabbi Meir permits even those born {already; =yillodim}; And the Sages say: This one only intended one whose way is to be born.

{Nedarim 31a}
הנודר משובתי שבת אסור בישראל ובכותים.
מאוכלי שום אסור בישראל ובכותים.
מעולי ירושלים אסור בישראל ומותר בכותים

One who vowed from those who rest on Shabbat is forbidden to both Israelites and Cutheans.
"From those who eat garlic" is forbidden to both Israelites and Cutheans.
"From those who go up to Yerushalayim" is forbidden to an Israelite and permitted to a Cuthean.

קונם שאני נהנה לבני נח מותר בישראל ואסור באומות העולם.
קונם שאני נהנה לזרע אברהם אסור בישראל ומותר באומות העולם
שאיני נהנה לישראל לוקח ביותר ומוכר בפחות
שישראל נהנין לי לוקח בפחות ומוכר ביותר אם שומעין לו.

שאיני נהנה להם והם נהנין לי יהנה לאומות
קונם שאיני נהנה לערלים מותר בערלי ישראל ואסור במולי אומות העולם
שאין הערלה קרויה אלא על שם העובדי כוכבים
שנאמר כי כל הגוים ערלים
Konam that I benefit from a ben Noach {descendant of Noach}, he is permitted to an Israelite and forbidden to the gentiles.
Konam that I benefit from the seed of Avraham, he is forbidden to an Israelite and permitted to gentiles.
That I do not benefit from an Israelite, he buys for more than its usual price and sells for less.
That an Israelite benefit from me, he buys for less and sells for more, if they listen to him.

That I will not benefit from them nor they benefit from me, he may benefit only from gentiles.

{Nedarim 31b}
Konam that I will not benefit from the uncircumcised, he is permitted {benefit} from the uncircumcised Israelites and is forbidden even to the circumcised gentiles. For uncircumcies is called upon the idolaters, as is stated {Yirmeyahu 9:25}:
כה עַל-מִצְרַיִם וְעַל-יְהוּדָה, וְעַל-אֱדוֹם וְעַל-בְּנֵי עַמּוֹן וְעַל-מוֹאָב, וְעַל כָּל-קְצוּצֵי פֵאָה, הַיֹּשְׁבִים בַּמִּדְבָּר--כִּי כָל-הַגּוֹיִם עֲרֵלִים, וְכָל-בֵּית יִשְׂרָאֵל עַרְלֵי-לֵב. {פ} 25 Egypt, and Judah, and Edom, and the children of Ammon, and Moab, and all that have the corners of their hair polled, that dwell in the wilderness; for all the nations are uncircumcised, but all the house of Israel are uncircumcised in the heart. {P}

הנודר מישראל אסור בגרים
הנודר מגרים מותר בישראל
הנודר מישראל אסור בכהנים ולוים
הנודר מכהנים ולוים מותר בישראל
הנודר מכהנים מותר בלוים בלוים מותר בכהנים
Tosefta:
One who vows {benefit} from Israelites is forbidden {also} to converts. One who vows from converts is permitted {standard} Israelites. One who vows from Israelites {means Jews, and thus} is forbidden in Kohanim and Leviim {as well}. One who vows from Kohanim and Leviim is permitted to {general, non-Levite/Kohen} Israelites.
One who vows from Kohanim is permitted to Levites; to Levites is permitted to Kohanaim.

ת"ר הנודר הנאה מבני העיר כל ששהה בעיר י"ב חדש אסור ליהנות ממנו הנודר הנאה מבנים מותר בבני בנים
The Sages learnt {in a brayta}: One who vows off benefit of the residents of the city, anyone who remained in the city for 12 months, he is forbidden to benefit from him. One who vows off benefit of sons is permitted to sons of sons.

נדר מיורדי הים אחר שלשים יום ונעשו מיושבי הישוב פליגי ר' ישמעאל ור"ע ר' ישמעאל אומר אחר הנדר ור"ע אומר אחר האיסור
Yerushalmi {Nedarim 11b}:
If he vowed of those {to be forbidden benefit} of who descend to the sea {=seafarers} after thirty days, and they became dwellers of the settlement {we should probably emend to as our Yerushalmi has, מיושבי היבשה, dwellers of dry land}, Rabbi Yishmael and Rabbi Akiva argue. Rabbi Yishmael says it goes after the vow {and at the time the vow was stated, these people were seafarers}. And Rabbi Akiva says: It goes after the prohibition {and at the time the prohibition set it, they were not seafarers}.

רב פפא ורב אחא בריה דרב איקא חד מתני ארישא וחד מתני אסיפא
מאן דמתני ארישא מתני הכי
הנודר מיורדי הים מותר ביושבי יבשה הא ביורדי הים אסור לא כאלו ההולכים מעכו ליפו דהלין יושבי יבשה מקרי אלא מי שדרכו לפרש
ומאן דמתני אסיפא מתני הכי הנודר מיושבי יבשה אסור ביורדי הים שיורדי הים בכלל יושבי יבשה לא כאלו שהולכין מעכו ליפו לבד אלא אף מי שדרכו לפרש דסופו ליבשה סליק:
"One who vows from those who descend to the sea {=seafarers} ...":
Rav Pappa and Rav Acha son of Rav Ikka:
One taught {the clarification at the end of the Mishna that "Not like those who travel from Akko to Yaffo, but rather from those who take long voyages"} as going on the resha, and one taught it as going on the sefa.
The one who taught it as going on the resha taught it as follows: One who vows off {benefit} from seafarers is permitted to those who dwell on dry land. Thus of those who are seafarers, he is prohibited.
{Nedarim 30b}
{Now, to clarify:} Not like those who travel from Akko to Yaffo, for those are called land dwellers. Rather one who travels on long journeys.
And the one who taught it upon the sefa taught it as follows: One who vowed from those who dwell on land is prohibited {even} upon those who are seafarers. For seafarers are within the realms of land dwellers. Not only like those who travel from Akko to Yaffo, but even one who travels long distances, for in the end he will come out onto dry land.

אלא ממי שהחמה רואה אותו:
לאפוקי מאי לאפוקי עוברים ודגים:
"But rather he whom the sun sees":
To the exclusion of what?
To the exclusion of fish and embryos.

מן הנולדים ר"מ אומר וכו':
נולדי' משמע הכי ומשמע הכי ובנדרים הלך אחר לשון בני אדם:
"From those who are noladim {those to be born}, Rabbi Meir says":
Noladim implies like this and implies like that, and by vows we go after people's usage of language.

וחכמים אומרים לא נתכוון זה כו'.
לאפוקי מאי לאפוקי דגים ועופות:
"And the Sages say: This one only intended {he whose nature is to be born}":
To the exclusion of what?
To the exclusion of fish and fowl.

{Nedarim 31a}

קונם שאני נהנה לבני נח כו'.
וישראל נפקי מכלל בני נח אין כיון דאיקדש אברהם איקדשי בנים על שמיה:
"Konam that I receive benefit from the sons of Noach...":
And are Israelites excluded from the category of sons of Noach?!
Indeed, for since Avraham was sanctified, his sons are sanctified on his name.

שאני נהנה לזרע אברהם כו'.
אע"ג דאיכא ישמעאל ועשו דאתי מיצחק
דכתיב כי ביצחק יקרא לך זרע ביצחק ולא כל יצחק.
"That I do not benefit from the seed of Avraham":
{only Israelites are intended}
Even though there is Yishmael, as well as and Esav who came from Yitzchak. For it is written {Bereishit 21:12}:
יב וַיֹּאמֶר אֱלֹהִים אֶל-אַבְרָהָם, אַל-יֵרַע בְּעֵינֶיךָ עַל-הַנַּעַר וְעַל-אֲמָתֶךָ--כֹּל אֲשֶׁר תֹּאמַר אֵלֶיךָ שָׂרָה, שְׁמַע בְּקֹלָהּ: כִּי בְיִצְחָק, יִקָּרֵא לְךָ זָרַע. 12 And God said unto Abraham: 'Let it not be grievous in thy sight because of the lad, and because of thy bondwoman; in all that Sarah saith unto thee, hearken unto her voice; for in Isaac shall seed be called to thee.
{veYitzchak} -- within Yitzchak and not all of Yitzchak.
