Rif Nedarim 10a {27b - 28b}

10a

{Nedarim 27b continues}
Mishna:

נודרין להרגין ולחרמין ולמוכסין שהיא של תרומה אע"פ שאינה של תרומה שהן של בית המלך אע"פ שאינן של בית המלך

בית שמאי אומרים בכל נודרין חוץ מבשבועה
ובית הלל אומרים בשבועה בית

שמאי אומרים לא יפתח לו בנדר
ובית הלל אומרים אף יפתח לו בנדר

בית שמאי אומרים במה שהוא מדירו
ובית הלל אומרים אף במה שאינו מדירו
כיצד אמר לו אמור קונם אשתי נהנית לי ואמר אשתי ובני נהנין לי

בית שמאי אומרים אשתו מותרת ובניו אסורין
וב"ה אומרים אלו ואלו מותרין
One may vow to murderers, robbers, and publicans that it is of teruma even though it is not in fact of teruma; that they are of the king's house even though they are not of the king's house.

Bet Shammai say: One may vow any vow {e.g. may this be forbidden to me if...}
{Nedarim 28a}
except for by an oath {may this be forbidden to me by an oath if...}.
And Bet Hillel say: With an oath.

Bet Shammai say: He may not volunteer a vow {in these situations}.
And Bet Hillel say: He may even volunteer a vow.

Bet Shammai say: As far as he {=the murderer, etc.} makes him vow.
And Bet Hillel say: Even what he does not make him vow.
How so? If he {=the murderer} said to him: Say "Konam benefit my wife has of me," and he says "konam benefit my wife and children have of me."

Bet Shammai say {that in such a situation, where he volunteered this extra}: His wife is permitted and his sons are forbidden.
And Bet Hillel say: Both these and those are permitted.

Gemara:
נודרין להרגין כו' [ולמוכסין].
והאמר שמואל דינא דמלכותא דינא
אמר רב חיננא אמר רב כהנא אמר שמואל במוכס שאין לו קצבה
דבי רבי ינאי אמרי במוכס העומד מאליו:
"They may vow to murderers, etc., [and publicans]":
But Shmuel said: The law of the land is the law!
Rav Chinena cited Rav Kahana who cited Shmuel: This is by a publican who has no fixed limit.
{Soncino: Under the Roman Procurators there was a tremendous amount of illegal extortion, particularly of octroi tolls, v. Sanh. (Sonc. ed.) p. 148}
In the academy of Rabbi Yannai they said: By a collector who was unauthorized.

אף על פי שאינן של בית המלך וכו'.
היכי נדר
אמר רב עמרם אמר רב באומר יאסרו כל פירות שבעולם עלי אם אינן של בית המלך
וכיון דאסרינהו אסיר עליה כל פירות דעלמא
באומר היום
אי דאמר היום לא מקבל מיניה המוכס
דאמר בלבו היום ומוציא בשפתיו סתם ואף על גב דקיימא לן דברים שבלב אינן דברים גבי אונסין שאני:
"Even though they are not in fact of the king's house...":
How does he vow?
Rav Amram cited Rav: Where he said "all the fruits of the world should be forbidden to me if these are not of the king's house."
But once he makes them forbidden, all fruits in the world are forbidden upon him?!
Where he said "today."
If he said "today," the collector would not accept it from him.
Where he said it in his heart but uttered it with his lips plainly {without "today"}. And even though we establish that matters of the heart are not substantive, by duress it is different.

בית שמאי אומרים במה שמדירו:
אמר רב הונא תנא בית שמאי אומרים לא יפתח לו בשבועה ובית הלל אומרים אף יפתח לו בשבועה

ולבית שמאי בשבועה הוא דלא יפתח הא בנדר יפתח
והא אנן תנן בית שמאי אומרים לא יפתח לו בנדר

ותו מפתח הוא דלא פתח בשבועה הא מינדר נדר ליה אף בשבועה והא אנן תנן בית שמאי אומרים בכל נודרין חוץ מבשבועה

תנא מתניתין בנדר להודיעך כחן דבית שמאי ותנא ברייתא שבועה להודיעך כחן דבית הלל
רב אשי אמר הכי קאמר בית שמאי אומרים אין שאלה בשבועה ובית הלל אומרים יש שאלה בשבועה
"Bet Shammai say {only} in what he wants him to vow":
Rav Huna said: A tanna taught: Bet Shammai say: He should not suggest {that he that swear} with an oath. And Bet Hillel say: He may even suggest an oath.

And to Bet Shammai, {the implication is} it is specifically by an oath that he should not suggest, but a vow he may suggest.
But we taught {in the Mishna}: Bet Shammai say: He may not suggest a vow.

And furthermore, {the implication is} that specifically it is suggesting that he may not do with an oath, but he may vow to him with an oath. But we taught {in the Mishna}: Bet Shammai say: He may vow in any way, except with an oath.

{The answer the gemara gives:} The Mishna taught it with a vow to inform you of the strength of bet Shammai's position, and the brayta taught an oath to teach you the strength of Bet Hillel's position.

Rav Ashi said: This is what it means to say: Bet Shammai say: There is no absolution for an oath, while Bet Hillel say: There is absolution for an oath.

Mishna:
הרי נטיעות אלו קרבן אם אינן נקצצות טלית זו קרבן אם אינה נשרפת יש להם פדיון
הרי נטיעות אלו קרבן עד שיקצצו טלית זו קרבן עד שתשרף אין להם פדיון
{If he says} "Behold these saplings shall be as a korban if they are not cut down; this garment shall be as a korban if it is not burnt;" then they can be redeemed.
"Behold these saplings shall be as a korban until they are cut down; this garment shall be as a korban until it is burned,"
{Nedarim 28b}
then they do not have redemption.
