Rif Bava Batra 7b {11b - 12a}

7b

See the Rif inside here.
{Bava Batra 11b}

and a balcony carry with them four cubits. If there are five rooms opening on to the balcony, they carry with them only four cubits between them.

We learn in Succah: A house which only has 4 cubits X 4 cubits is exempt from mezuzah and from the requirement to build a guardrail {on the roof}, and brothers and partners do not split it, for it is not fit for dwelling.

{Bava Batra 11b}
If a room is half roofed over and half unroofed, it does not have four cubits. And even if the roofing is over the outer part, and it need not be said if the roofing is over the inner part, for it is possible for him to go right through and unload.

Rav Huna inquired of Rabbi Ammi: If one of the residents of the alleyway desires to turn round his door to another alley-way, can the residents of this alley-way prevent him or can they not prevent him?
He {=Rabbi Ammi} said to him: The residents of this alley-way can prevent him.
"Is the achsania per capita or are they according to the number of doors?"
He {=Rabbi Ammi} said to him: Per capita.

A brayta also says so: The dung in the courtyard is divided according to doors; achsania per capita.

There are those who explain, the dung of the achsania {animals of the guests} which they dig up and cast out, for it is the way of the guests to leave them -- the hosts of the guests split them according to the number of people.
And some explain that achsania is the achsania of the king, or his servants, when they collect them, it is in accordance with the number of people and not according to the number of doors.

This that we said that residents of the alleyway can prevent him, these words are regarding an alley which is not open {on both sides}, since this would increase upon them the path, but an open alleyway, they cannot prevent him, for there is to him the public domain.

Rav Huna said: If one of the residents of an alley-way desires to fence in the space facing his door, the residents of the alleyway can prevent him, on the ground that he increases upon them the path.
They raised an objection {from a brayta}:
'If five [adjoining] courtyards open on an alley-way, all [the inner ones] share with the outside one the use [of the part facing it], but the outside one can use that part only. The remainder [the inner three] share with the second, but the second has the use only of the part facing itself and the outside one.
Thus the innermost one has sole use of the part facing itself and shares with all the others [the use of the part facing them].'
{So why can't he fence in that part, if the others have no right to use it?}

It is a matter of Tannaitic dispute. For they learnt {in a brayta}:
If one of the residents of an alley-way desires to open a door on to another alley-way, the residents of that alley-way can prevent him. If, however, he only desires to reopen there one which had been closed, they cannot prevent him.
And {filling in a chasurei mechsera, } if five [adjoining] courtyards open on an alley-way, all [the inner ones] share with the outside one the use [of the part facing it], but the outside one can use that part only. The remainder [the inner three] share with the second, but the second has the use only of the part facing itself and the outside one. Thus the innermost one has sole use of the part facing itself and shares with all the others [the use of the part facing them]. These are the words of Rabbi.
R' Shimon ben Eleazar says: if five courtyards open on to an alley-way, they all share the use of the alley-way.

And Rav Huna establishes like Rabbi Shimon ben Eleazar. And we do not hold like Rav Huna, for Rabbi argues upon Rabbi Shimon ben Eleazar; and we establish that the halacha is like Rabbi over his colleague.

{Earlier we said} 'If he desires to reopen a door which has been closed, the residents of the other courtyard cannot prevent him.'
Rabba {our gemara: Rava} said: They only learned this where he had not taken down the posts of the closed door {demonstrating he intended to eventually reopen it}, but if he had taken down the posts of the closed door, the residents of the courtyard can prevent him reopening it.
Abaye said to Rabba {our gemara: Rava}: There is a brayta in support of you:
{Bava Batra 12a}
A room that is shut up carries with it four cubits in the courtyard, but if the posts [of the door] have been taken down, it does not carry with it four cubits. If a room is shut up it does not render unclean all the space around it,

{Sanhedrim 26b}
We learn in perek Dinei Mamonot {=perek Zeh Borer, Sanhedrin 26b}:
Rav Nachman said: Those who eat the other thing {pork} -- and who are they? Those who accept the charity of heathens -- are invalid for testimony.
And they only said this regarding publicly doing so, but privately, no. And publicly as well, they did not say, except where he has what to be supported from privately, and he degrades himself {by accepting it} in public. But if it is not possible for him to obtain support privately, no, for it is a matter of life.

{Bava Batra 11a}
Mishna:
A COURTYARD SHOULD NOT BE DIVIDED UNLESS THERE WILL BE [AFTER THE DIVISION] AT LEAST FOUR CUBITS FOR EACH OF THE PARTIES. A FIELD SHOULD NOT BE DIVIDED UNLESS THERE WILL BE NINE KABS' [SPACE] FOR EACH.
RABBI YEHUDA SAYS, UNLESS THERE WILL BE NINE HALF-KABS [SPACE] FOR EACH.

A VEGETABLE GARDEN SHOULD NOT BE DIVIDED UNLESS THERE WILL BE HALF A KAB FOR EACH.
RABBI AKIVA, HOWEVER, SAYS, A QUARTER KAB'S SPACE.

A HALL, A DRAWING ROOM, A DOVECOT, A GARMENT, A BATHHOUSE, AN OLIVE PRESS AND AN IRRIGATED PLOT OF LAND SHOULD NOT BE DIVIDED UNLESS SUFFICIENT WILL BE LEFT FOR EACH PARTY.

WHEN IS THIS THE RULE? WHEN ONE OR OTHER OF THE OWNERS IS NOT WILLING TO DIVIDE. BUT IF BOTH AGREE, THEY CAN DIVIDE EVEN IF LESS THAN THESE QUANTITIES [WILL BE LEFT].
SACRED WRITINGS, HOWEVER, MAY NOT BE DIVIDED EVEN IF BOTH AGREE.

Gemara:

Rabbi Assi cited Rabbi Yochanan: The four cubits of which they spoke are exclusive of the space in front of the doors.
A brayta also said so: A courtyard should not be divided unless eight cubits will be left to each party.
But we learnt {in the Mishna} "four cubits"!
Rather, do we not deduce like this of Rabbi Assi citing Rabbi Yochanan? We indeed so deduce.

From what? From what we said in the beginning of the perek:
And if damage of seeing is called damage, why does it matter if they wish? When they don't wish as well, they must split. Rabbi Yochanan said: Our Mishna is where there is no law {/right} of division... And if it was where there was no right of division, when they agreed, what of it {that they can be compelled}? Either can retract! And they resolve: Where he acquired in from his hand in terms of sides. Rav Ashi said: Such that this one went by himself and took hold of {via kinyan chazaka} his share, and this one, by himself took hold of his share.
we deduce that our Mishna which taught "they wanted" was where neither of them recognizes his portion; therefore, since they acquired from their hands sides, or alternatively, each of them took possession {via chazaka} of his portion, the his dominion over the portion of his friend has gone, and they have split, such that they are not able to block one another, even though there is not in it a law of splitting, for behold, neither of them has dominion in the portion of his friend.

{Bava Batra 11a{

Rav Huna said: Each party takes a share in the courtyard proportionate to the number of his doors.
And Rav Chisda said: four cubits are allowed for each door and the remainder is divided equally.

A brayta in accordance with Rav Chisda: Doors opening on to the courtyard carry with them a space of four cubits. If one of the joint owners has one door and the other two doors, [if they divide] the one who has one door takes four cubits and the one who has two doors takes eight cubits, and the remainder is divided equally. If one has a doorway eight cubits broad, he takes eight cubits facing his door and four cubits in the courtyard.

And these 4 cubits X 8 cubits that it said are specifically 4 cubits X 8 cubits, and it is not sufficient with {equivalent area but with} less than 4 cubits; and even if there are 10 cubits in length, if there are not 4 cubits in width, there is not in this the law of division. For since there are not four cubits in it, it is not fit for use.

Amemar said: This pit holding date-stones, it has four cubits on all sides.
And they only said this where he has no designated door from which he goes to it, but if he has a designated door, {Bava Batra 11b} it carries with it only four cubits in front of his door.

Rav Huna said: An exedra {a covered way, open at the sides} does not have four cubits.
What is the reason {usually for four cubits}? To provide space for the owner to unload his animals. If there is an exedra he can go into it and unload there.

Rav Sheshet objected: 'Gates of exedras equally with gates of houses carry with them four cubits.'
Where it taught that {in a brayta}, it was regarding a Roman exedra, where it is not possible to enter and unload.

Rav Ashi said: I do not even need to stipulate, since whoever comes {to give me money for charity} relies on my judgment, and leaves it to me to give to whom I will.

There were butchers who made an agreement with one another that if either killed on the other's day, the skin of his beast should be torn up. One of them actually did kill on the other's day, and the other went and tore up the skin.
This came before Rava, and he obligated him {to make restitution}.
Rav Yemar bar Shelemya objected to Rava {from the brayta, that gives the townpeople authorization} "to inflict penalties for breach of their regulations".
He {=Rava} did not respond to him.
Rava Pappa said: He was quite right not to answer him; this regulation holds good only where there is no distinguished man in the town, but where there is a distinguished man, they certainly have not the power to make such stipulations.

The Sages learnt {in a brayta}: The collectors for charity are not required to give an account of the moneys entrusted to them for charity, nor the treasurers of the Sanctuary of the moneys given for holy purposes. There is no actual proof of this, but there is a hint to it, for it is written {II Melachim 12:16}

Rav Huna said: Applicants for food are examined but not applicants for clothes. This rule can be based, if you like on common sense, or if you prefer, on Scripture.
Common sense -- because the one {who has no clothing} is exposed to contempt, but not the other is not exposed to contempt. Scripture, for here is is written {Yeshaya 63:7}:
7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?
Paros {with a sin rather than a samech} is written {which means "examine; we have it with a samech}. There {by clothing}, it is written {same pasuk}:
7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?

And Rav Yehuda said: We investigate for clothing but do not investigate for food. If you prefer, as logic, and if you prefer, from Scripture. As logic, this one {lacking food} is suffering while this one {lacking clothing} is not suffering. As Scripture, here, it is written {same pasuk}:

7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?
Deal {paros} and give to him, immediately. While there it is written {same pasuk}:
7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?

There is a brayta in accordance with Rav Yehuda: If he says "clothe me," they investigate after him; "Feed me," they do not investigate after him.

What are the 'requirements for the night'?

Rav Assi said: A man should never neglect to give the third of a shekel {for charity} in a year, for it is stated {Nechemiah 10:33}:

And Rav Assi said: Charity is equivalent to all the mitzvot, for it is written {same pasuk}:
לג וְהֶעֱמַדְנוּ עָלֵינוּ מִצְו‍ֹת, לָתֵת עָלֵינוּ שְׁלִישִׁית הַשֶּׁקֶל בַּשָּׁנָה, לַעֲבֹדַת, בֵּית אֱלֹהֵינוּ.33 Also we made ordinances for us, to charge ourselves yearly with the third part of a shekel for the service of the house of our God;

Rav Assi {our gemara: Rabbi Eleazar} said: He who causes others to do good is greater than the doer, for it is stated {Yeshaya 32:17}:

{with tzedek as tzedaka}.
What is meant by {the end of the pasuk},
Rav Nachman son of Rabbi Yitzchak said: These are Torah scholars who banish sleep from their eyes in this world, and whom the Holy One, blessed be He, feasts with the resplendence of the Divine presence in the future world.
That is to say, from the reward of the wakening that they awake themselves from sleep, they merit to be satisfied from the likeness of Hashem.

7 Is it not to deal thy bread to the hungry, and that thou bring the poor that are cast out to thy house? when thou seest the naked, that thou cover him, and that thou hide not thyself from thine own flesh?
{and the next pesukim}
8 Then shall thy light break forth as the morning, and thy healing shall spring forth speedily; and thy righteousness shall go before thee, the glory of the LORD shall be thy rearward.
ט אָז תִּקְרָא וַה' יַעֲנֶה, תְּשַׁוַּע וְיֹאמַר הִנֵּנִי: אִם-תָּסִיר מִתּוֹכְךָ מוֹטָה, שְׁלַח אֶצְבַּע וְדַבֶּר-אָוֶן.9 Then shalt thou call, and the LORD will answer; thou shalt cry, and He will say: 'Here I am.' If thou take away from the midst of thee the yoke, the putting forth of the finger, and speaking wickedness;

And {R' Yitzchak continues} he who addresses to him words of comfort obtains eleven blessings. For it is written {the next pesukim}:
י וְתָפֵק לָרָעֵב נַפְשֶׁךָ, וְנֶפֶשׁ נַעֲנָה תַּשְׂבִּיעַ; וְזָרַח בַּחֹשֶׁךְ אוֹרֶךָ, וַאֲפֵלָתְךָ כַּצָּהֳרָיִם.10 And if thou draw out thy soul to the hungry, and satisfy the afflicted soul; then shall thy light rise in darkness, and thy gloom be as the noon-day;
11 And the LORD will guide thee continually, and satisfy thy soul in drought, and make strong thy bones; and thou shalt be like a watered garden, and like a spring of water, whose waters fail not.
12 And they that shall be of thee shall build the old waste places, thou shalt raise up the foundations of many generations; and thou shalt be called the repairer of the breach, the restorer of paths to dwell in.
Until here {the gloss in the Rif}.

Ifra Hormiz the mother of King Shapur sent four hundred dinarim (* in a chest *) to Rabbi Ammi, and he did not accept it. Before Rava, and he accepted it. Rabbi Ammi heard and was upset. He {=Rabbi Ammi} said: Does he not have {the pasuk, Yeshaya 27:11}:

And Rav Ammi maintained that if because of peace with the government, he ought to have distributed the money to the heathen poor.

Ifra Hormiz the mother of King Shapur sent a chest of gold coins to Rav Yosef. She said to him, it should be for a great mitzvah. Rav Yosef sat and considered, what is a great mitzvah? Abaye said: This from what Rav Shmuel taught: money for charity is not to be levied from orphans even for the redemption of captives, we may conclude that redemption of captives is a great mitzvah.

And the townspeople are also at liberty to fix weights and measures, prices, and wages, and to inflict penalties for the infringement of their rules.

We learn in the beginning of Arachin {6a}:
Rav Nachman cited Rabba bar Avuah who cited Rav: This sela {money} to charity, he is able to exchange it, whether for himself or for another. It does not matter whether he said "upon me" or "this one."
And the Sages learnt {in a brayta}: One who says "this sela to charity", until it reaches the hand of the collector, it is permitted to exchange it; once it reaches the hand of the collector, it is forbidden to exchange it.

And we learn there as well:
Rav said: An Israelite who pledged as a donation a candelabrum or a lamp to the synagogue, it is forbidden to exchange it.
Rabbi Chiyya bar Abba thought to say that it matters not whether for a optional purpose or a mitzvah purpose.
Rabbi Ammi said to him: So said Rabbi Yochanan: They only learned this regarding a optional purpose, but for a mitzvah purpose, it is permitted to exchange it.
And these words are so long as the name of its owner {/donor} was not established {such that the person will be upson}, but after the name of its owner was established {such that people will credit it to him}, even for an optional purpose, it is permitted to change it.

Master said {above}: Since any office conferring authority over the community must be filled by at least two persons.
From where do we know this? Rav Nachman bar Kohen said: For it says in Scriptures {Shemot 28:5}:
ה וְהֵם יִקְחוּ אֶת-הַזָּהָב, וְאֶת-הַתְּכֵלֶת וְאֶת-הָאַרְגָּמָן, וְאֶת-תּוֹלַעַת הַשָּׁנִי, וְאֶת-הַשֵּׁשׁ. {פ}5 And they shall take the gold, and the blue, and the purple, and the scarlet, and the fine linen. {P}
They were not to exercise authority over the community, but that they were to be trusted. This supports Rabbi Chanina, who said that there was an incident in which Rabbi appointed two brothers upon the charity fund.

What is the authority {involved}? Rav Nachman cited Rabba bar Avuah: Because the collectors can take a pledge for a charity contribution even on erev Shabbat.
Is this indeed so? But it is written {Yirmeyahu 30:20}:
20 Their children also shall be as aforetime, and their congregation shall be established before Me, and I will punish all that oppress them.
And Rav Yitzchak bar Shmuel bar Marta said in the name of Rav: These are charity collectors.
This is no question. Here is where he was wealthy, and here is where he was not wealthy.
Like this of Rava, who compelled Rav Natan bar Ami and took from him 400 zuz for charity.

This is a judge who judges the true law to its true conclusion.
וּמַצְדִּיקֵי, הָרַבִּים, כַּכּוֹכָבִים, לְעוֹלָם וָעֶד -- {with emphasis on matzdikei, causative of tzedaka} -- these are the charity collectors.

In a brayta they taught:
This is a judge who judges the true law to its true conclusion, as well as a charity collector.
These are teachers of young children.

Such as Rav Shmuel bar Shelat; for Rav found Rav Shmuel bar Shelat who was standing in a garden.
He {=Rav} said to him: Have you abandoned your faith {=your post}?
He {=Rav Shmuel bar Shelat} said to him: I have not seen this garden for thirteen years, and even now my thoughts are with the children.

Upon the Rabbis, what {does Scriptures say}? Ravina said: {Shofetim 5:31}:

The Sages learnt {in a brayta}: The collectors of charity {when collecting} are not permitted to separate from one another, though one may collect at the gate while the other collects at a shop {in the same courtyard}. If one of them finds money in the street, he should not put it into his purse but into the charity box, and when he comes home he should take it out. If one of them has lent a man a maneh and he pays him in the street, he should not put the money into his own purse but into the charity box, and take it out again when he comes home.

The Sages learnt {in a brayta}: If the collectors have no poor to whom to distribute it, they should change the small coins into larger ones with other persons, but not from their own money. Similarly, if the stewards of the soup kitchen have {food over and} no poor to whom to distribute it, they may sell it to others but not to themselves.

The Sages learnt {in a brayta}: In counting out money collected for charity, they should not count the coins two at a time, but only one at a time.

Abaye said: Initially, the Master {=Rabba} would not sit on the mats in the synagogue, in the study hall.

Rabba bar Rav Huna {our gemara: Rav Nachman bar Rav Chisda} imposed a poll tax upon the Sages.
Rav Nachman bar Rav Yitzchak said to him: Master has transgressed the Torah, Neviim, and Ketuvim.
Upon Torah, for it is written {Devarim 33:3}:
3 Yea, He loveth the peoples, all His holy ones--they are in Thy hand; and they sit down at Thy feet, receiving of Thy words.
Moshe said before Hashem: Master of the Universe! Even at the time you love {other} nations, all His holy ones should be in Your hand.

What is meant by {the end of the pasuk}
3 Yea, He loveth the peoples, all His holy ones--they are in Thy hand; and they sit down at Thy feet, receiving of Thy words.

?
Rav Yosef taught: these are Torah scholars who cut their feet {going} from city from city and from country to country to give and take in the speech of the Ominpresent.

Upon the Neviim, for it is written {Hoshea 8:10}:
10 Yea, though they hire among the nations, now will I gather them up; and they begin to be minished by reason of the burden of king and princes.
and Ulla said: This verse is said in Aramaic: If all of them study {יתנו} among the nations, now shall I gather them; and if not, then some of them shall begin to be free from the burden of king and princes.

Upon the Ketuvim, for it is written {Ezra 7:24}
24 Also we announce to you, that touching any of the priests and Levites, the singers, porters, Nethinim, or servants of this house of God, it shall not be lawful to impose tribute, impost, or toll, upon them.
and Rav Yehuda said: Minda -- this is the king's tax; Belo -- this is the poll tax; Vehalach -- this is arnona, such as gifts and accommodations that they give to the king when he passes by them.

We learn in Nedarim {62a}:
A person is permitted to make himself {and his worth} known in a place where they do not know him. For it is written {I Melachim 18, when Ovadiah speaks to Eliyahu}:
12 And it will come to pass, as soon as I am gone from thee, that the spirit of the LORD will carry thee whither I know not; and so when I come and tell Ahab, and he cannot find thee, he will slay me; but I thy servant fear the LORD from my youth.

But it is written {Mishlei 27}:
2 Let another man praise thee, and not thine own mouth; a stranger, and not thine own lips.

Rava said: A rabbinic scholar is permitted to make himself known and to say "I am a rabbinic scholar; begin with my case first {in court}." For it is written {II Shmuel 8}:

Just as a kohen takes his portion first, so too a Torah scholar takes his portion first. And a kohen from where? For it is written {Vayikra 21:8}:
8 Thou shalt sanctify him therefore; for he offereth the bread of thy God; he shall be holy unto thee; for I the LORD, who sanctify you, am holy.
and they taught in the academy of Rabbi Yishmael -- "thou shalt sactify him" -- for every matter of sanctity: to open {=read the Torah} first, to bless first, and to take a portion first.

"HOW LONG MUST HE BE IN THE TOWN TO BE COUNTED AS ONE OF THE TOWNSMEN":
And for all matters, do we require twelve months? And I will object:
'{A man must reside in a town} thirty days to become liable for contributing to the soup kitchen, three months for the charity box, six months for the clothing fund, nine months for the burial fund, and twelve months for contributing to the repair of the town walls'
Rabbi Assi cited Rabbi Yochanan: When they taught it in our Mishna, they also taught it in regard to the walls of the town.

And we learn from here that all these things are obligatory, and that we take {money} from them {for this} against their wills, similar to the walls of the city.

They learnt {in a brayta}: If a man vows that he will derive no benefit from the men of a certain town, he must derive no benefit from anyone who has resided there twelve months, but he may derive benefit from one who has resided there less then twelve months. If he vows to derive no benefit from the inhabitants of the town, he may derive none from anyone who has resided there thirty days, but he may from one who has resided there less than thirty days.

Rabbi Assi cited Rabbi Yochanan: All {contribute} towards the walls of the city, even from the orphans; but from the Sages, no -- Sages to not require protection.
Rav Pappa said: For the repair of the walls, for the horse-guard and for the keeper of the armory even orphans have to contribute. {Rif does not cite here, within Rav Pappa, an exemption for Sages, though our gemara has it. At any rate, this is not strictly the topic here.}
The general rule of the matter: Anything for which there is benefit for the orphans from it, we collect from them for it.

The Sages learnt {in a brayta}: The charity fund is collected by two persons {jointly} and distributed by three. It is collected by two, because any office conferring authority over the community must be filled by at least two persons. It must be distributed by three, on the analogy of money cases {tried by a bet din of three}. Food for the soup kitchen is collected by three and distributed by three, since it is distributed as soon as it is collected.

And why is the charity fund collected with two while the soup kitchen is collected with three? For the charity fund is a set amount on each individual, and the collectors do not increase of decrease {from this demanded amount}. But the soup kitchen is not a set amount, but in accordance with the needs of the time, it is collected for the paupers of the world, and one needs to set upon each individual what is fitting for him, and it thus is like money cases; therefore it needs three.

Food is distributed every day, the charity fund from one Friday to the next Friday. The soup kitchen is for the paupers of the world, while the charity fund for the poor of the town. The townspeople, are at liberty to use the soup kitchen like the charity fund,

HE [A RESIDENT OF A CITY] MAY BE COMPELLED TO CONTRIBUTE TO THE BUILDING OF A WALL, FOLDING DOORS AND A CROSS BAR.
RABBAN SHIMON BEN GAMLIEL SAYS: NOT ALL TOWNS REQUIRE A WALL.

HOW LONG MUST A MAN RESIDE IN A TOWN TO BE COUNTED AS ONE OF THE TOWNSMEN? TWELVE MONTHS. IF, HOWEVER, HE BUYS A HOUSE THERE, HE IS AT ONCE RECKONED AS ONE OF THE TOWNSMEN.

Gemara:

Rabbi Eleazar asked from Rabbi Yochanan: When they collect, do they collect based on number of people, do they collect according to their wealth, or do they collect according to the proximity of their house {to the wall}?
He said to him: They collect according to the proximity to the wall. And Eleazar, my son, fix this {ruling firmly} with rivets.

One who has an entrance in an alley, the residents of the alley cannot compel him to make a door for the alley, for he is able to say "My desire is that I should be able to enter until my entrance."

The residents of an alley can compel each other that there not settle among them {by renting to the person} a tailor, nor a tanner, nor a member of any profession {if there is already one there}. But to his neighbor {who is already there}, he cannot force him {to not take up that profession in competition}. And Rabban Shimon ben Gamliel says: Even to his neighbor, he can force him.

One who has a house in another courtyard, they can {still} compel him to make with them a door, door bolt, and lock for the courtyard, but for other things, they cannot compel him. And if he dwells with them in that courtyard, they can compel him regarding everything.

One who has a courtyard in another city, the residents of the city can compel him to dig with him pits, wells, cisterns, and aqueducts, but the rest of the things, they cannot compel him. And if he swells among them in that city, they can compel him regarding everything.

The residents of an alley can compel one another to make a post and crossbeam {for Shabbos} for the alley. The residents of a valley can compel one another to make among them a ditch and a small ditch. The residents of a city can compel one another to build among themselves a synagogue, and to purchase for themselves a sefer Torah, Neviim, and Ketuvim.

Rav Pappa imposed a levy for digging a new well upon orphans {who were minors, among others}.
Rav Sheshet son of Rav Iddi said to him: Perhaps no water will be found there? {and then the trustees for the orphans should not give this money on speculation}
He {=Rav Pappa} said to him: I will take from them, and if water is found, water is found. And if not, I will return it to them.
Rav Yehuda said: All must contribute to the building of doors in the town gates, even orphans; not, however, the Rabbis -- they do not require protection. All must contribute to the digging of a well {for a public fountain}, for it is an improvement of the plaza of the city, and even of the Sages.
And they only said this where there is no corvee {unpaid work themselves; but only a monetary contribution}, but when by corvee {to do the work themselves}, no; the Sages are not part of a corvee.

There was a certain tax that was imposed in Teveriah. They came before Rabbi.

Let us see now. There, he only sold him something by that name. Here, he {verandah owner} can say to him, "{I only took this as my share on condition} that I should be able to live in it as our father lived."

There was a certain bond of orphans {that they inherited} against which a receipt was produced.
Rav Chama said: We neither enforce payment on the strength of the bond, nor do we tear it up.
'We neither enforce payment', because a receipt is produced against it, 'nor do we tear it up', because it is possible that when the orphans grow up they will bring evidence invalidating the receipt.
Rav Acha bar Rav {our gemara: Rava} send before Ravina: The halacha is what?
He send {back} to him: The halacha is like Rav Chama {in all these cases}, except for the receipt, since we do not presume the witnesses {who have signed the receipt} to have been guilty of a falsehood.
Mar Zutra son of Rav Mari said: In this as well, the halacha is like Rav Chama, for if the receipt were genuine the defendant ought to have produced it in the lifetime of the father. We deduce from here that it was forged.
And so is the halacha.

If it is a Succah, {should no objection be raised} within seven days, this does not constitute prescriptive right, but {if objection is raised only} after seven days, it does constitute prescriptive right. And if he attaches it with clay {and still the neighbor does not object}, he acquires prescriptive right immediately.

Abaye said: If there are two houses on opposite sides of a public thoroughfare, the owner of the one should make a parapet for half his roof, and the other a parapet for half his roof, in such a way that the parapets do not face one another, though each should extend {his parapet a little beyond the middle}.
Why in connection to a public thoroughfare? Even a private grounds as well!
A public thoroughfare is needed. It was have arisen in my mind to say that he could say "When all is said and done you have to guard your privacy against the public." Therefore it informs us that he may say {and respond} "The public can only see me by day but not by night, whereas you can see me both by day and night; or again, the public can see me when I am standing but not when I am sitting, but you can see me whether I am standing or sitting; the public can see me when they look directly at me, but not otherwise, but you see me even without looking."

Rav Nachman cited Shmuel: If a man's roof adjoins another man's courtyard, he must make a parapet four cubits high, but between one roof and another this is not necessary.
And Rav Nachman stating his own words said: Even {here}, between one roof and another, four cubits is not required, but a partition of ten handbreadths is required.
For what? If to prevent damage of seeing, we require four cubits? If for the purpose of convicting his neighbor of felonious entry, a mere fence of sticks would suffice? If to prevent kids and lambs from jumping over, a partition too high for them to jump over at a headlong run would suffice?
In truth, to convict his neighbour of felonious entry. And with ten, he can find no excuse; less than ten, he can find an excuse, that he was doing this to measure it, but with ten handreadths, he cannot excuse himself.

It was stated {by Amoraim}: If two courtyards adjoin and one is higher than the other --
Rav Huna said: the lower one has to build {the party wall} up from his level, and the higher one starts building from his level going up.
And Rav Chisda said: The upper one must assist below {where his wall starts} and up.

A brayta in accordance with Rav Chidsa: If there are two adjoining courtyards of which one is higher than the other, the owner of the higher one must not say to the other, "I will start building {the party wall} from my level, but he must assist the other to build from his level. If, however, his courtyard is higher than his neighbour's roof, he has no liability.
