{Bava Kamma 117a}

of Rav Pinchas and of Rav Mari, the sons of Rav Chisda. They {=the heathens} said to him "carry the wine and come with us." He carried the wine and came with them. The case came before Rav Ashi, and he exempted him.
The Sages said to him {=Rav Ashi}: But they learnt {in a brayta}: If he took and gave with his hand, he is liable!
He {=Rav Ashi} said to them: These words are where they were not {already} standing by it, but here, since they were already standing by it, it is as if already burnt.

{The Rif now finishes making his diyuk:} You can say well that this that they learnt {in a brayta} that he is liable, is even where he was forced, for then the Sages can ask from it upon Rav Ashi. But if you say that this that they learnt that he is liable is where he was not forced, but where he was forced, he is exempt, how can the Sages ask from it upon Rav Ashi? For that certain person Rav Ashi exempted was forced!

And furthermore, why did Rav Ashi say "these words were where they were standing by it?" Let him say to them "where he was not forced, while this one was forced!" Rather, we deduce from this that where they were not standing by it, even though he was forced, he is liable. And if you ask why showing is different from taking and giving by hand, that this is exempt and this is liable, for after all both of them are under duress -- this one is via indirect cause and this one is with his own hands.

And this line of thought is also supported from the fact that Rav Kahana {our gemara: Rabbi Abahu} objected to Rav Ashi: If a ruffian said to him "hand be this bunch of sheaves or this cluster of grapes," and he handed it to him, he is liable. And behold, here, even though he is standing by them, when he gives it to him with his hand, he is liable.
And we resolve: With what are we dealing? That they were standing on two banks of a riber, that he {=the ruffian} is not able to take them, and because of this, he is liable; and even though he is forcing him, he is liable.
And we derive from this that one who takes the money {or possessions} of his fellow and transfers him in his hands to a ruffian is liable, and even though he is under duress.

One of them arose and surrendered it to the parhagmona {official of public service} of the king. Abaye said: He is able to say to him, "I indeed surrendered it, and I surrendered my own." Raba said to him: Should he be believed? Rather, Rava said: He place him under the ban until he brings it {=the net}, and both of them come to court.

We learn in Gittin, in the first perek {7a}: Mar Ukva sent to Rabbi Eliezer: There are people harrassing me, and it is in my power to hand them over to the regime, what is the law?
He {=Rabbi Eliezer} made lines {required for writing pesukim} and wrote to him: {Tehillim 39}:
2 I said: 'I will take heed to my ways, that I sin not with my tongue; {N}
I will keep a curb upon my mouth, while the wicked is before me.'
That even though there is a wicked one before me, I will keep a curb upon my mouth.
He {=Mar Ukva} sent to him: They are greatly oppressing me, and I do not find that I will arise from it.
He {=Rabbi Eliezer} sent to him: {Tehillim 37}:
7 Resign thyself unto the LORD, and wait patiently for Him;{N}
fret not thyself because of him who prospereth in his way, because of the man who bringeth wicked devices to pass.
{with a derasha on hitcholel with chalal, and lo meaning for him, thus meaning}
And he will cause them to fall before you as corpses.
Get up early and leave late because of them {to study} in the study hall, and they will perish of their own accord.
We derive from this that even in a case of suffering, it is forbidden to give over an Israelite to a gentile government -- and there is no difference between his body or his possessions.

{Bava Kamma 116b}
who pointed out a heap of wheat of the house of the Exilarch. The case came before Rav Nachman. Rav Nachman obligated him to pay, based on this that they learnt {in a Mishna}: And if {the loss was} because of the thief, he is obligated to furnish him with a field.
And we establish that {indeed}, the case was where he merely pointed it out.

{Bava Kamma 117a}
Rav Huna bar Yehuda visited Bei Avyunei {either a poorhouse or the name of a place}. He came before Rava and said to him, "has there been any case which came to your hand?" He {=Rava} said to him: An Israelite whom Cutheans forced to show the money of his friend -- this came before me and I obligated him.
He {=Rav Huna bar Yehuda} said: Arise and reverse the matter to its owner {that he should get his money back}, for they learnt {in a brayta}: An Israelite whom Cutheans forced to show the money of his friend is exempt, though if he takes {the money} and places it with his own hand, he is liable.
And Rava {our gemara: Rabba} said: And if he shows it of his own accord, he is like one who got and gave with his own hand, and he is liable.

There is one {halachic decisor} who said that just as when an Israelite is forced to point out his fellow's money, he is exempt, so too, if an Israelite is forced to bring the money of his friend, and he goes and brings it, he is exempt.

And we do not maintain this, for when one delves into this sugya, it does not come out in accordance with this position whatsoever. For this that they learnt {in a brayta}, "and if he took and gave with his own hand, he is liable," with what are we dealing? If under duress, behold we have said that he is exempt. And if of his own accord, why should it matter if he took and gave? Even if he {merely} showed it, he would also be liable. Rather, is it not so that this is what it means to say: An Israelite whom Cutheans forced to show the money of his fellow, he is exempt. And specifically to show, but if he took and gave with his hand, he is liable -- and even though we was forced, there is no difference if they forced him and he want and brought, or if they forced him to bring and he brought.
And so it is also logical, for it stated: There was a certain person who showed the wine

He {=Rabbi} said to him: Is this a question? He only gets his wages {for his efforts, but not the value of his own lost donkey}.
An objection was raised: "If one hired a laborer
{Bava Kamma 116b} to bring a cabbage or damascene plums to a sick person, and {when he arrived} he found that he died, or that he became well, he is paid in full."
He said to him: There, the agent performed his agency, whereas here the agent did not perform his agency.

The Sages learnt {in a brayta}: If a caravan was traveling in the wilderness, and a band of robbers came upon it to plunder it {and they are going to bribe the band of robbers to go away}, they calculate {each person's contribution} in accordance with the money involved and do not calculate in accordance with the souls {people}. And if they hired a guide to go before them {so that they do not get lost in the desert, in paying his wages} they calculate even in accordance with the souls. But they do not deviate from the custom of donkey-drivers {in determining payment}. And the donkey-drivers are entitled to stipulate that whoever loses a donkey, that they should furnish him with another donkey. If it was lost by negligence, they do not furnish him with another one. Not by negligence, they furnish him with another one. And if he said "Give me and I will guard," they do not heed him.

To explain: If he said "give me the money for my donkey, for I do not wish to take a donkey, and I will guard with you just as at first," they need not heed him.

This is obvious! No, it is necessary, such as where he has another donkey. I would have said that he could say to them "behold I have another donkey among you." Therefore it informs us that they may say to him "upon two, you will commit yourself more, while upon one, you will not commit yourself more."

The Sages learnt {in a brayta}: If a boat was traveling on the sea, and a gale arose to sink it, and they lightened its load, they calculate {how much each must surrender} in accordance with the weight, and do not calculate according to the monetary calue. And they do not deviate from the custom of the sailors. And the sailors are entitled to stipulate among themselves that whoever loses a boat, they furnish him with another boat. If it is lost through negligence, they do not furnish him with one, but if not through neglicence, they furnish him. And if he went off to a place the sailors do not go, they do not furnish him.

The Sages learnt {in a brayta}: If a caravan was traveling in the wilderness, and a band of robbers came upon it and plundered it, and one arose and saved, he saved for all {such that they all split what he saved}. And if he said "I am saving for myself," he saves for himself.

How so? If they are able to save, even if he said as well, it is not worth anything! And if they are not able to save, even if he does not say, also {he is saving for himself}.
Rami bar Chama said: Here, we are dealing with partners, and in a case such as this, this partner can break up {the partnership} against the will of his fellow. If he said, then he is severing {the partnership}, but if he did not say, then he did not sever.

And Rava said: Here, we are dealing with a laborer, and like Rav.
For Rav said: A laborer is able to withdraw even in the middle of the day. If he {who saved from the robbers} said, then he is withdrawing, but if he did not say, then he is not withdrawing.

Rav Ashi said: Here, where they are able to save with great difficulty. If he did not say, then they would say to him, "If you would have said to us, we would have committed ourselves." If he said, then they have removed their intent from it.

These three explanations are {all} halacha.

"BUT IF IT WAS CAUSED THROUGH THE ROBBER HIMSELF, HE WOULD HAVE TO PROVIDE HIM WITH ANOTHER FIELD":
How so? If they confiscated all the land [of his and did not confiscate the entire land], and they confiscated this one {field} as well among them, then we derive from the resha: "IF THIS BLOW BEFELL THE WHOLE PROVINCE HE {=THE ROBBER} MAY SAY TO HIM {THE MAN ROBBED}, 'HERE IS THINE BEFORE THEE'." Thus, if it is not so, he is required to furnish him with a field.
With what are we dealing? Such as where they confiscated from him, and they said to him "show us your land," and he showed them this one as well among them. {but did not first steal the field}

{Bava Kamma 115a}
He maintains that they did make for him the restoration of money {he paid} at the market.
And the halacha is like Rabbi Yochanan, who maintains that they did make for him the restoration of money at the market.
Rava said: By a notorious thief, they did not establish a restoration of money of the market.

It was stated {by Amoraim}: If he stole and paid off his debt; if he stole and paid off goods received on credit, they did not establish a restoration of money of the market.
What is the reason? For we say to him: Not for the things that he gave you {now} did you {initially} give him money.

As a pledge worth 200 for 100 {which the received}, they make for him {the person who took it as a pledge} a restoration of money of the market.
Worth 100 for 100:
Amemar said: They do not make for him a restoration of the market.
Mar Zutra said: They do make for him a restoration of the market.

As a sale for an equal amount {to their value}, they make for him a restoration of the market.
Something worth 100 for 200:
Rav Sheshet said: They do not make for him a restoration of the market.
Rava said: They do make for him a restoration of the market.

And the halacha in all of them is that they do make for him a restoration of the market, with the exception of where he stole and paid off his debt, or stole and paid off goods received on credit, where they do not make for him a restoration of the market.

He {=that person} stole and brought him a garment, and gave it to him, and borrowed upon it another four zuz. This came before Ravina. He said: The first four zuz, since it is stealing and paying his debt, he {the owner} does not need to pay to him {to Abaye}. These last four zuz, certain go and give him, and take your garment.
Rav Kohen objected to this: Perhaps the garment was just for these first four zuz that he gave him, such that it will be a case of stealing and paying for his debt {such that the owner would be exempt}, while the four last ones he was trusting him with as at first.
The matter moved about the courts and arrived before Rava. He said to them: The halacha is like Rav Kohen.

A resident of Naresh stole a book and sold it to a resident of Papunia for 80 zuz. The resident of Papunia went and sold it to a resident of Mechoza for 120 {zuz}. It the end, the thief was recognized.
Abaye said: The owner of the book should go and give the resident of Mechoza 80 {zuz} and take his book, and the resident of Mechoza should go and take the {remaining} 40 {zuz} from the resident of Papunia.
Rava objected: Now that one who purchases from a thief, they enact for him a restoration of the money of the market, by one who purchases from a purchaser, would it not be all the more so? Rather, Rava said: The owner of the book should give to the resident of Mechoza 120 {zuz} and take the book, and the owner of the book {in order to recover some of that money} should go and take 40 from the resident of Papunia, and taken 80 from the thief.
And so is the halacha.

"IF ONE MAN WAS COMING ALONG WITH A BARREL OF WINE...":
{Bava Kamma 115b}
But why? Let him say to him, "I am obtaining it from hefker" {since the honey is being lost and is then ownerless}! As Rabbi Yirmeyah said: When the bale of the press-house was twined around it {it would not become ownerless, since it would only drip out}. In our Mishna as well, {say that it is} where the bale of the press-house was twined around it.

{Bava Kamma 116a}
"{If} he says to him 'I will save yours and you pay me the value of mine,' then he {=the other} is obligated to give to him" -- But let him say 'I was merely jesting with you!' For do we not learn {in a brayta}: "Behold if one was fleeing from prison and there was a ferryman before him, and he said to him {=to the ferryman} 'take a dinar and ferry me across', he {=the ferryman} only gets his wages." Thus it is clear that he can say "I was merely jesting with you." They say that it is only comparable to the sefa {of that brayta, which reads}: "If he said to him 'take this dinar as your wages and ferry me across,' he must pay the full wages {he specified, of a dinar}."
Why are the resha and the sefa different? Rami bar Chama said: In the sefa, we are dealing with a case in which he was a fisherman catching fish from the sea, such that he can say to him, 'you caused me to lose fish amounting to a zuz {=a dinar}.'

Rav Kahana inquired of Rav: If he descended to save {the other person's donkey, under the stipulation that he be paid for the value of his own donkey which would be lost}, and his own donkey came up on its own, what is the law? {Should he still be paid the stipulated amount?}
He {=Rav} said to him: This is from Heaven which had mercy upon him {and so his still receives the stipulated amount}.
Like this of Rav Safra, who was traveling with a certain caravan. A lion followed them, and every night they would cast to it one of their donkeys {so as not to be attacked themselves}. That night which reached Rav Safra's turn, they cast it his donkey, and the lion did not come. The next day, Rav Safra immediately retook possession of his donkey.
Rav Acha of Difri said to Ravina: Why did Rav Safta need to immediately take possession of it? It is obvious

Rif Bava Kamma 41b {114b - 115b; 115a}

{Bava Kamma 114b}
which was before Rabbi, an incident about a certain person {our gemara: child} who spoke in all innocence and said "I and mother was taken captives among the gentiles. I went out to draw water and my thoughts {=attention} were on mother; to collect wood, and my thoughts were on mother." And Rabbi married her off to a kohen on his word. Because in cases of a woman taken captive, the Sages were lenient.

This that they learnt {in a brayta}:
Rabbi Yishmael the son of Rabbi Yochanan ben Beroka says: It is a stipulation of Bet Din that this one may descend to his fellow's field and cut off a bough that belongs to his fellow and thus save his swarm, and pay the amount of the bough from {the value of} his swarm. And so too, it is a stipulation of Bet Din that this one may unload his wood {from his donkey} and save his fellow's flax, and take the cost of his wood from the flax of his fellow. And so too, it is a stipulation of Bet Din that this one may pour out his wine {to have a container available} and save the honey of his fellow, and take the cost of his wine from the honey of his fellow.
We have seen one who said that all of these are the halacha. But we do not maintain this to be so, for we establish like our Mishna which taught "he only has his wages." And also, we learn in the end of perek Merubah {Bava Kamma 81b}:
There were ten stipulations which Yehoshua stipulated. And are there not more? Behold, there is that that Rabbi Yehuda said: At the time of the taking out of dung, a person may take out his dung and pile it up for a period of 30 days in the public domain such that it be trodden upon by the legs of people and the legs of animals, for on this condition Yehoshua gave over the land to Israel as an inheritance. And behold, there is that of Rabbi Yishmael the son of Rabbi Yochanan ben Beroka, etc.?!
And we answer that those which are positions of individuals we do not say {in the brayta}, for something which is of an individual we don't say. And we deduce from this that this of Rabbi Yehuda and this of Rabbi Yishmael the son of Rabbi Yochanan ben Beroka, all of them are not the halacha.

Mishna:

BUT IF THIS WAS NOT SO, HE COULD NOT BE BELIEVED, FOR I MAY SAY THAT HE {THE ORIGINAL OWNER} SOLD THEM TO ANOTHER PERSON FROM WHOM THE DEFENDANT PURCHASED THEM.

Rav Yehuda cited Rav {what follows is as the statement has been modified}: Here, we are dealing with a case such that people come and lodged in his house, and he stood and called out in the night, saying "my vessels have been stolen, my vessels have been stolen!"
And perhaps that he merely found a pretext?
Rav Kahana completed the statement in the name of Rav as: Such that there was a tunnel dug and the people who lodged there had left, with bundles of articles on their shoulders, and all say that the vessels of Ploni were stolen.
And perhaps vessels were taken but books were not taken?
And we conclude: Rabbi Abahu said: Where they said 'these are the vessels of Ploni and these are the books of Ploni.'

And perhaps he needed the money and sold?
Rav Ashi said: Behold, there is the rumor of the theft in the city {supporting this other assumption that the homeowner would not sell his vessels}.

Rav in the name of Rabbi Chiya said: The lawsuit is against the first one {=the thief}.
Rabbi Yochanan in the name of Rabbi Yannai said: The lawsuit is against the second one {=the purchaser}.
Rav Pappa said: All agree that the garment itself returns to its owner. But here, the dispute is about the restoration of the extra money paid in the market. And what is the "din?" The din is regarding the law of the purchaser:
Rav in the name of Rabbi Chiya said that the law is with the first one, that the law of the purchaser to take his {extra} money from the thief. He maintains that they did not set for him the extra money paid in the market.
Rabbi Yochanan said that the law is with the second one, that the law of the purchaser is to take his extra money {that he paid} from the owner {of the stolen item}.

Rav Assi {our gemara: Rav Ashi} said: They only learned this regarding heathen bandits, who judge with haughtiness. But by an Israelite, where they will say "who says" {that it is as you have described? Bring witnesses}, even in the normal case, he will certainly have abandoned hope.

That Cuthean {who owned the vineyard} heard, came, and said to him: Of a Cuthean is permitted?!
He {=Rav Ashi} said to him: This is what I said {meant} to him: If it is of a Cuthean, bring them, for he {=the Cuthean} will accept payment, while if it is of an Israelite, do not bring them, for he will not accept payment.

He said to him: Does master not hold like that of Rav Chisda? For Rav Chisda said: We establish a time on Monday, Thursday, and Monday.
And he said to him: These words are regarding a man, who is {=might} not frequent the town, but a woman, since she is commonly in the town dwelling ther, and yet she does not come, she is rebellious from the beginning.

Rav said: We do not set a time for the days of Nissan, for the days of Sivan, for the days of Tishrei, not erev Shabbos or erev Yom Tov.
But during Nissan for after Nissan and during Tishrei for after Tishrei, we do establish. And from erev Shabbat for after Shabbat, we do not establish, because he could be busy preparing for Shabbat.

"NO MONEY MAY BE TAKEN IN CHANGE EITHER FROM THE BOX OF THE CUSTOMS-COLLECTORS OR FROM THE PURSE OF THE TAX-COLLECTORS":
Customs-collectors? {Why should the customs-collectors be considered to be acting unlawfully?} But Shmuel said: The law of the land is the law.
Rav Chinena bar Kahana cited Shmuel: By a custom-collector who has no set limit.
In the academy of Rabbi Yannai they said: By a self-appointed custom-collector.

And so too that which they taught {in the Mishna}, "To {escape} murderers or robbers or customs-collectors one may confirm by a vow {a false statement that the grain is terumah}" is for a self-appointed custom-collector or to a custom-collector who has no set limit.

They learnt {in a brayta}: It is forbidden to utilize them to escape the custom.
Rabbi Shimon says in the name of Rabbi Akiva: It is permitted to utilize them to escape the custom.

This is fine in terms of kilayim {improper mixtures of species} that they argue in that; one master maintains that something not intended is forbidden and one master maintains it is permitted. But to escape the custom-tax, who permits?! Behold, Shmuel said that the law of the land is the law!
Rav Chinena bar Kehana {earlier, citing Shmuel} said: By a custom-collector who has no set limit.
In the academy of Rabbi Yannai they said: By a self-appointed custom-collector.
Rav Ashi said: Here, we are dealing with a Kenaanite custom-collector. {Rashi has: a Kenaanite custom-collector who is an extortionist; so too, Masoret Hashas on this Rif.}
And as they learned {in a brayta}: An Israelite and a Kenaani extortionist who come before you for judgement; if you are able to rule in favor of him {the Israelite} in Israelite law, rule in favor of him, and say to him {the Kenaanite extortionist} "such is our law." If {you can rule in favor of him} in the laws of the Kenaanites, rule in favor of him {the Israelite} and say to him "such is your law." And if not, we come upon him with a ruse. These are the words of Rabbi Yishmael. Rabbi Akiva says: We do not come upon him with a ruse, because of sactification of Hashem's name.

And we establish {between these Amoraim} like Rav Ashi, for he is last.

Rav Bibi bar Gozla {our gemara: bar Gidel} cited Rabbi Shimon Chassida: The theft of a Kenaanite is forbidden; his lost article is permitted.
His theft is forbidden, like Rav Huna cited Rav. For Rav Huna cited Rav: From where do we know that theft of a Kenaanite is forbidden? For it is stated {Devarim 7:16}
טז וְאָכַלְתָּ אֶת-כָּל-הָעַמִּים, אֲשֶׁר ה' אֱלֹהֶיךָ נֹתֵן לָךְ--לֹא-תָחוֹס עֵינְךָ, עֲלֵיהֶם; וְלֹא תַעֲבֹד אֶת-אֱלֹהֵיהֶם, כִּי-מוֹקֵשׁ הוּא לָךְ. {ס}16 And thou shalt consume all the peoples that the LORD thy God shall deliver unto thee; thine eye shall not pity them; neither shalt thou serve their gods; for that will be a snare unto thee. {S}
at the time that they are given over into your hand, and not at the time that they are not given over into your hand.
His lost article is permitted, like this which Rav Chama bar Guria cited Rav: How do we know that the lost article of a Kenaanite is permitted? For it is stated {Devarim 22:3}:
ג וְכֵן תַּעֲשֶׂה לַחֲמֹרוֹ, וְכֵן תַּעֲשֶׂה לְשִׂמְלָתוֹ, וְכֵן תַּעֲשֶׂה לְכָל-אֲבֵדַת אָחִיךָ אֲשֶׁר-תֹּאבַד מִמֶּנּוּ, וּמְצָאתָהּ: לֹא תוּכַל, לְהִתְעַלֵּם. {ס}3 And so shalt thou do with his ass; and so shalt thou do with his garment; and so shalt thou do with every lost thing of thy brother's, which he hath lost, and thou hast found; thou mayest not hide thyself. {S}
the lost article of your brother, and not the lost article of a Kenaanite.

They learnt {in a brayta}: Rabbi Pinchas ben Yair said: Anywhere there is desecration of Hashem's name, even his lost article is forbidden.

Rif Bava Kamma 39b {112b - 113a}

39b

{Bava Kamma 112b}
Rava said: The law is that a document may be authenticated even not in the presence of the other party; and even if he protests aloud before us {that the document is a forgery}.
And if he says, 'Give me time till I can bring witnesses, and I will invalidate the document', we give him time. And if he does not appear we wait again over the following Monday and Thursday and Monday. If he still does not appear we write a Peticha {=a warrant} out against him and wait for him for ninety days.
For the first thirty days we do not take possession of his property as we say that he is busy trying to borrow money; during the middle thirty we similarly do not take possession of his property as we say perhaps he was unable to raise a loan and is trying to sell his property; during the last thirty days we similarly cannot take possession of his property as we still say that the purchaser himself is busy trying to raise the money. From then on, we certainly write an adrachta {=a legal order to trace the debtor's property for the purpose of having it seized and assessed to the creditor for his debt} on his property.

And these words are where he pleads 'I will come {/bring}, I will come}', but if he says 'I will not come', we immediately write an adrachta on his property.
And these words are regarding a loan, but regarding a pledge, we immediately write an adrachta on his property.
And these words are regarding land, but upon movable object we do not write {an adrachta}. What is the reason? Lest he meanwhile carry them off and consume them; and when these one brings witnesses and invalidates the document, there be nothing to pay him from.
And even where the creditor has land, we do not write an adrachta on movable objects, for we fear lest this land may depreciate in value and there not be what to repay from.
And when we write an adrachta on his property, we inform him. And this is where he is nearby, such as that an agent {of the court} leaves {to him} on Tuesday and comes on Wednesday, and he can appear on Thursday in Bet Din.

Rava {our gemara: Ravina} said: The agent of Ben Din is believed like a set of two {witnesses, that the party refused to come to court}.
And these words are in terms of placing him under the ban, but for a Peticha {=warrant}, no.
What is the reason? Because it is monetary matters which he is causing him loss, for he needs to give money for the Peticha. {our gemara: for the scribe; but Tosafot have Peticha}.

And Rava {our gemara: Ravina} said: We establish and give a fixed date {for a summons} on the word of a woman, and on the word of a neighbor.
And we only say this where he {=the party} was not in the town,
{Bava Kamma 113a}
but if he is in town, no.
What is the reason? They {=the woman or neighbor} might not tell him, thinking that the agent will find him and tell him.

Rif Bava Kamma 39a {112a-b}

{Bava Kamma 112a}
Rava said: If their father left them a cow which was borrowed by him, they may use it until the expiration of the period for which it was borrowed, though if it [meanwhile] died they would not be liable for the accident.
If they were under the impression that it was the property of their father, and so slaughtered it and consumed it, they would have to pay for the value of meat at the cheapest price, etc., as we have written it in Ketubot, in perek Elu Naarot.

The Sages learnt {in a brayta}: {Vayikra 5:23}:
23 then it shall be, if he hath sinned, and is guilty, that he shall restore the theft which he took by robbery, or the thing which he hath gotten by oppression, or the deposit which was deposited with him, or the lost thing which he found,
What does it come to inform us with אֲשֶׁר גָּזָל, "which he took by robbery"? That he should return it when it is in he same form as what he stole. And from here they said that one who stole and fed his sons, they are exempt from paying; and if he left it to them {as an inheritance}, whether they are adults or minors, they are obligated. In the name of Sumchus they said that adults are obligated and minors are exempt.

The {minor} son of the father-in-law of Rabbi Yirmeyah bolted the door in the face of Rabbi Yirmeyah {who wanted to take possession of the premises}.
He came before Rabbi Abba. He said to him: He was merely asserting his right to his own.
He {=Rabbi Yirmeyah} said to him: I can bring witnesses to testify that I took possession of the premises during the lifetime of the father.

{Bava Kamma 112b}
He {=Rabbi Abba} said to him: Can the evidence of witnesses be accepted {Bava Kamma 112b} where the other party is not present?
He {=Rabbi Yirmeyah} said to him: But they learnt {in a brayta}: "Whether adults or minors they would be liable."
He {=Rabbi Abba} said to him: Is not the divergent view at your side? "In the name of Sumchus they said that adults are obligated and minors are exempt."
He {=Rabbi Yirmeyah} said to him: Has the whole world doubled itself {=decided} like Sumchus in order to deprive me of my property?

Meanwhile the matter was referred from one to another until it arrived before Rabbi Abahu. He {=Rabbi Abahu} said to him: Have you not heard of what Rav Chama bar Yosef said in the name ofRabbi Oshaya? If a minor collected his slaves and took possession of another person's field claiming that it was his, we do not say, Let us wait till he come of age, but we wrest it from him forthwith and when he comes of age he can bring forward witnesses {to support his allegation} and then we will consider the matter.
But is it really comparable? There, he had no presumptive title to it from his father, but here, where he has such a presumptive title from his father, no.

Rabbi Assi cited Rabbi Shabtai: We accept the testimony of witnesses even not in the presence of the litigant.
Rabbi Yochanan reacted to this in surprise: Do we indeed accept witnesses not in the presence of witnesses?
Rabbi Yossi bar Chanina accepted from him {this ruling} in such a situation as where he was ill, or his witnesses were ill; that his witnesses wished to travel to an overseas country, and they sent for him and he did not come.

Rif Bava Kamma 38b {111b - 112a}

38b

{Bava Kamma 111b continues}
his children, or left it before them {as an inheritance}, they are exempt from paying, that is after abandoning hope {which the owner does}, and the theft is not extant. But if the theft is still extant, then even after abandoning hope, they are obligated to return it.
For Rabbi Oshaya taught: If one stole and fed his children, they are exempt from repaying; and if he left it before them {as an inheritance}, then if the theft is still extant they are obligated, while if the theft is not extant, they are exempt. And their father left them property constituting security, they are liable to pay.

And we said "if the theft is not extant, they are exempt." Let us say that this is a refutation to Rav Chisda! And they resolve: No. Rav Chisda will establish it as after abandoning of hope.

And now that movable objects are under lien to creditors, they are obligated to pay from the movable objects that their father left them, whether before {the owner} giving up hope or after giving up hope, whether they ate it or whether they did not eat it, for it is to him like an Oral loan. And we establish now that an oral loan collects from the heirs, whether from land or movable objects.

But certainly if their father left them money of usury, they are not liable to return it. For they learnt {in a brayta}: Money of usury, even though they knew it was of usury, they are not obligated to return.

{Bava Kamma 112a}

And if their father left them a cow, a cloak, or any distinguishable object {in Bava Metzia, the context is that received as interest}, they are obligated to return it because of their father's honor.

And we say upon it:
Rama bar Chama said: This informs that the possession of the heir is like the possession of the purchaser. {in that there is no real obligation to return it except for the father's honor}
Rava said: In truth, I will say to you that the possession of the heir is not like the possession of the purchaser. And it is different here for the Scriptures stated {Vayikra 25:36}:
36 Take thou no interest of him or increase; but fear thy God; that thy brother may live with thee.
For himself is what the All-Merciful warned; to his son, the All-Merciful did not warn.

And this that we say that they are obligated to return because of their father's honor, these words are where he repented but did not have opportunity to repent before he died, as we have established it in perek Ezehu Neshech.

Rif Bava Kamma 38a {106b - 107a; 108b; 111b; 113a; 114a; 108b-109a; 110a; 111b}

{Bava Kamma 106b}
And this is in conflict with Rabbi Chiyya bar Yosef. For Rabbi Chiya bar Yosef said: {Bava Kamma 107a} There is here an 'interweaving of sections', and when it is written {Shemot 22:8}:
ח עַל-כָּל-דְּבַר-פֶּשַׁע עַל-שׁוֹר עַל-חֲמוֹר עַל-שֶׂה עַל-שַׂלְמָה עַל-כָּל-אֲבֵדָה, אֲשֶׁר יֹאמַר כִּי-הוּא זֶה--עַד הָאֱלֹהִים, יָבֹא דְּבַר-שְׁנֵיהֶם: אֲשֶׁר יַרְשִׁיעֻן אֱלֹהִים, יְשַׁלֵּם שְׁנַיִם לְרֵעֵהוּ. {ס} 8 For every matter of trespass, whether it be for ox, for ass, for sheep, for raiment, or for any manner of lost thing, whereof one saith: 'This is it,' the cause of both parties shall come before God; he whom God shall condemn shall pay double unto his neighbour. {S}
it is written about a loan.

Why is it different by a loan? Like Rabba. For Rabba said: Why did the Torah state that partial admission requires that he swear? Because there is an assumption that a person is not so brazen before his {true} creditor, and he would really be admitting the entire claim; and this that he did not admit to him is because he is putting him off {because he cannot pay the entire amount}. But it is by the lender that he is not going to be so brazen. But by a pledge, he would be so brazen.

And we establish like Rabbi Chiyya bar Yosef.
And we derive from this that the halacha is not like Rami bar Chama who said that "four watchmen require denial in part and admission in part."

{Bava Kamma 108b}
If it was stolen by violence and the thief was identified:
Abaye said: If he {=the watchman} was an unpaid watchman, then if he wishes he may go to law with him, and if he wishes he may swear {and be exempt, such that the owner must contend with the thief}. And if he is a paid watchman, he goes to law with him and is unable to swear {to exempt himself}.
And Rava said: In both this case and that case, he brings him to law and does not swear.

And if he first swore, and only afterwards was the thief identified:
If he is an unpaid watchman, then if he wishes he may stand in his oath and if he wishes he may bring him to law. And if he is a paid watchman, he brings him to law.
And so is the halacha.

Rif Bava Kamma 37b {104b; 103a; 106a; 105b; 106b}

37b

{Bava Kamma 104b}
He said to him: let him transfer to you the ownership of the money by dint of land, and when you come back you will give us a written acknowledgment that you have received the money.
Like this of Rav Pappa, who was owed twelve thousand zuz from the house of Chaza'ei, and he transferred them to Rav Shmuel bar Acha via the threshold of him house. When he came {back} he went out to meet him until Tavach.

Where he said to his fellow, "send me my money via Ploni," and he sent to him via that particular Ploni he told him of, and a mishap occurs, he is exempt from paying, for they learnt {in a Mishna} in HaShoel et HaPara {Bava Metzia 98b}: IF THE BORROWER SAID TO HIM, 'SEND IT TO ME BY MY SON, SERVANT, OR AGENT,' OR 'BY YOUR SON, SERVANT OR AGENT, OR IF THE LENDER SAID TO HIM, 'I AM SENDING IT TO YOU BY MY SON, SERVANT OR AGENT,' OR 'BY YOUR SON, SERVANT OR AGENT, AND THE BORROWER REPLIED, 'SEND IT,' AND HE SENT IT, AND IT DIED [ON THE ROAD], HE IS RESPONSIBLE. AND THE SAME HOLDS GOOD WHEN HE RETURNS IT.

And it is so, as well, where they stipulate initially between them that when one sends to his fellow, he has permission to send it with whichever person he wishes, it is a monetary stipulation, and it stands, and he has permission to send with whichever person he sees fit; and if he encounters a mishap on the road, in the domain {or: with the permission} of the owner he had a mishap.

And where he sent to his fellow a letter, and said to him {in it}, "that thing which I have by you, send it to me via Ploni," and he sent it to him, he is not liable in its responsibility, for so are the {traveling} merchants accustomed nowadays. And we establish that where such is the custom {/common practice}, it is a substantial matter; and so was sent {as a ruling} from the Metivta. And these words were where it was willingly, but against his will, no, for he can say to him, 'You have no claim against me', as we have written above.

{?} And to a man whom is granted authorization to seize, another man does not have authorization to seize via that authorization, for he is able to say to him "I do not wish to have my pledge in the hand of another."

We learn in perek HaSholeach Get LeIshto {Gittin 48b} Abaye said: We have it on tradition that a husband {before going to law} about property belonging to his wife requires authorization from her. And we only say this where there is no produce, but where there is produce on the land, since he can put forth a lawsuit on the fruits, he can put forth a lawsuit on the main body {=the land} as well.

The Nehardeans said: We do not write an authorization of seizure on movable objects {the claim upon which} was denied {by a bailee}, etc., as we have written in perek Meruba. {See here.}

{Bava Kamma 103a}
Mishna:
IF HE REFUNDED TO HIM THE PRINCIPAL BUT DID NOT PAY HIM THE [ADDITIONAL] FIFTH, OR IF THE OTHER EXCUSED HIM THE PRINCIPAL THOUGH NOT THE FIFTH, OR EXCUSED HIM BOTH ONE AND THE OTHER, WITH THE EXCEPTION, HOWEVER, OF LESS THAN THE VALUE OF A PERUTAH ON ACCOUNT OF THE PRINCIPAL, HE WOULD NOT HAVE TO GO AFTER HIM.

IF {HOWEVER} HE PAID HIM THE FIFTH BUT DID NOT REFUND THE PRINCIPAL, OR WHERE THE OTHER EXCUSED HIM THE FIFTH BUT NOT THE PRINCIPAL, OR EVEN WHERE HE REMITTED HIM BOTH ONE AND THE OTHER, WITH THE EXCEPTION, HOWEVER, OF THE VALUE OF A PERUTAH ON ACCOUNT OF THE PRINCIPAL, HE WOULD HAVE TO CONVEY IT PERSONALLY TO HIM.

Gemara:
Rav said {Our gemara: Rav Huna cited Rav}: "I have 100 zuz of mine in your possession," and the other one says "you have nothing in my possession," and swears to that effect, and afterwards witnesses come, he is exempt. For it is stated {Shemot 22:10}:
10 the oath of the LORD shall be between them both, to see whether he have not put his hand unto his neighbour's goods; and the owner thereof shall accept it, and he shall not make restitution.
Once the owner has accepted the oath, we no longer longer pay money.
And the halacha is not like Rav.

For we say:
Rami bar Chama said to Rav Nachman: Since you do not personally accept this view of Rav, why are you pledging yourself to defend this statement of Rav?
He {=Rav Nachman} said to him: I did it merely to interpret the view of Rav.
But Rav quoted a verse!? That verse comes in reference to all those who take oaths in the Torah, that they swear and do not pay. {Perhaps as opposed to the plaintiff swearing and taking.} For it is stated {Shemot 22:10}:
10 the oath of the LORD shall be between them both, to see whether he have not put his hand unto his neighbour's goods; and the owner thereof shall accept it, and he shall not make restitution.
The one upon whom devolves the obligation to pay swears.
And the halacha is like Rav Nachman.

And even if one witness comes that he has by him 100 zuz, and he swears a Biblical oath, and afterwards another single witness comes, he combines with the first one and obligates him to pay.

{Bava Kamma 105b}
Rav Sheshet said: If one {falsely} denies a pledge, he is made upon it a robber such that he is liable in any accident that occurs to it.
Rami bar Chama objected:
'Where the other party was suspected regarding the oath. {How so?} Where he took falsely] either an oath regarding evidence or an oath regarding a deposit or an oath in vain.'
But if as you say, let them say that false denial renders him unfit!
With what are we dealing? Where it {=the animal} was placed on the meadow, such that it is not {real} denial. He is thinking 'I will get rid of him {=the plaintiff} until I will go and deliver up to him.

{Bava Kamma 106b}
Rabbi Chiyya bar Abba cited Rabbi Yochanan: One who {falsely} advances a plea of theft with reference to a deposit is not liable until he denies a part and admits a part.
What is the reason? For Scripture states {Shemot 22:8}:
ח עַל-כָּל-דְּבַר-פֶּשַׁע עַל-שׁוֹר עַל-חֲמוֹר עַל-שֶׂה עַל-שַׂלְמָה עַל-כָּל-אֲבֵדָה, אֲשֶׁר יֹאמַר כִּי-הוּא זֶה--עַד הָאֱלֹהִים, יָבֹא דְּבַר-שְׁנֵיהֶם: אֲשֶׁר יַרְשִׁיעֻן אֱלֹהִים, יְשַׁלֵּם שְׁנַיִם לְרֵעֵהוּ. {ס} 8 For every matter of trespass, whether it be for ox, for ass, for sheep, for raiment, or for any manner of lost thing, whereof one saith: 'This is it,' the cause of both parties shall come before God; he whom God shall condemn shall pay double unto his neighbour. {S}
