{Bava Batra 22b}

בהדי דמנח ליה קפצה ויתבא ארישא

והא גרמא הוא

אמר רב טובי בר קיסנא אמר רב מתנה אמר רב זאת אומרת גרמא בנזקין אסור

that as he is setting it {the ladder}, it {the weasel} jumps on and sits at its head.

But this is an indirect cause?!

Rav Tovi bar Kisna cited Rav Matna who cited Rav: This effectively says that indirect cause by damages is prohibited.

רב יוסף הוו ליה הנהו תאלי דהוו אתו אומני יתבי תותייהו ואתו עורבי ואכלי דמי וסלקי יתבו בתאלי ומפסדי להו

אמר להו רב יוסף אפיקו לי קור קור מהכא

א"ל אביי והא גרמא הוא

הא אמר רב טובי בר קיסנא א"ר מתנה אמר רב זאת אומרת גרמא בנזקין אסור

והא אחזוקי להו

והאמר רב נחמן אמר רבה בר אבהו אין חזקה לנזקין

לאו מי אתמר עלה רב מרי אמר בקוטרא ורב זביד אמר בבית הכסא

אמר ליה הני לדילי כיון דאנינא דעתאי כקוטרא וכריחא דבית הכסא דאמו לי:

Rav Yosef has certain small date trees {Bava Batra 23a} under which cuppers used to sit {and let blood}, and ravens used to collect to suck up the blood, and they used to fly on to the date trees and damage them.

Rav Yosef said to them {the cuppers}: Take away your croakers from here.

Abaye said to him: But it is an indirect cause?

"But Rav Tovi bar Kisna cited Rav Matna who cited Rav: This effectively states that indirect cause by damages is prohibited."

"But he granted them the right {to let blood under the trees; or: they have established the right}?"

"But Rav Nachman cited Rabba bar Abahu: There is no title to cause damages."

"But do we not state upon it: Rav Mari said: regarding smoke; and Rav Zevid said: in the privy?"

He {=Rav Yosef} said to him: 'I am very sensitive, and these ravens are {as offensive} to me as smoke or a privy.'

ואם לקחו אפילו בית רובע הרי הוא בחזקתו:

אמר רב פפא ואיתימא רב זביד זאת אומרת טוענין ליורש וטוענין ללוקח

טוענין ליורש תנינא הבא
