Rif Ketubot 8a {Ketubot 20b continues; 21a - b} Validating Handwriting

8a

{Ketubot 20b, Mishna, continues}

This one says "this is my handwriting" and this one says "this is my handwriting," they require that another combine with them. These are the words of Rabbi.
And the Sages say: They do not require another to combine with them, but rather a man is believed to say "this is my handwriting."

Gemara:
If you find to say according to the words of Rabbi, they are testifying about their own handwriting and therefore they require another to combine with them {such that there are two witnesses testifying about each signature},
{Ketubot 21a}
and according to the words of the Sages, they are testifying regarding the 100 zuz in the contract, and thus with the two of them it is sufficient.
And we establish like the Sages.

Rav Yehuda cited Rav: Two are signed on the document and one of them dies, they require two {rather than one} from the marketplace to testify as regard to him.
So that 3/4 of the money would not go out based on the word of a single witness.
And so is the halacha.

And if there is one one {other witness}, what?
Abaye said: Let him write his signature on a piece of clay and cast it forth in the court, and they will establish it, and he will not be required to testify about his own handwriting, and then he and this other one will go and testify on the other {signature}.
And specifically on a piece of clay, but on a scroll, no, lest an untoward man find it and write upon it what he wishes, and they have learnt: If he takes out against him his handwriting that he is obligated {money} to him, he may collect from the assets with no lien on them.

Rav Yehuda cited Shmuel: A witness and judge can combine.
Rami bar Chama said: How sublime is this statement.
Rava said to him: What is the excellence? This that the witness testifies, the judge does not testify to, and that which the judge testifies to the judge does not testify to. Therefore, they do not combine.
And so is the halacha.

{Ketubot 21b}

Rav Huna cited Rav: Three who sat to confirm a contract, where two of them recognize the signatures of the witnesses and one does not recognize, before they sign, they testify before him, and he may then sign. Once they have signed, they may not testify before him such that he may sign.

Rif Ketubot 7b {Ketubot 20a} Testifying From Memoirs

7b

{Ketubot 20a}

The Sages learnt {in a brayta}: A man may write his testimony on a document and testify about it after many years.

Rav Hai, z"l, explained: Such as where he has in hand testimony about an acquisition and it was delayed for a long time, and afterwards the lender requested that he write for him this testimony on a document, or he requested that he testify for him about it in court, he can write his testimony on a document or testify for him about it in court even after many years, and not worry lest that debt was paid or lest it was forgiven.
Rab Huna said: And this was where he remembered it of his own accord.
And Rabbi Yochanan said: Even if he does not remember it of his own accord, but others remind him and them he remembers, he may testify.
Rava said: We deduce from this of Rabbi Yochanan that if a set of two know testimony and one of them has forgotten it, he fellow may remind him and then he will recall.

And some say that this that a man may write his testimony on a document, it is not a document in the hand of the lender, but rather such as a book or ledger that a man has in his house to write in it his memiors, and this claimant comes and requests that he testify for him, and he finds in his memoirs written that on day X, responsibility for testimony was given over to him in such and such for man Y, he goes and testifies for him upon it, even after many years.

Rav Huna said: And this is where he remembered it of his own accord.
And Rabbi Yochanan said: Even though he does not remember it of his own accord, but rather from his text he remembers, he testifies.
And Rava carefully deduces from the words of Rabbi Yochanan who says that even though he does not remember of his own accord but rather from his text that he may go and testify, that so too, two who know testimony and one of them forgets, his fellow may remind him, such that he will recall and then testify with his friend, and it is fine.
And this deduction which Rava deduces only comes out according to this latter explanation, but according to the first explanation, it does not come out, for it is the simple meaning of Rabbi Yochanan, and Rava does not need to go and deduce from him anything.
Therefore, this latter explanation is better, and more logical.

It was a question to them: For himself, what?
To explain: If the witness forgets, may the litigant {himself} remind him?
Rav Chaviva says: Even he himself may remind.
Rav Ashi said: For himself, no.
And the halacha is that for himself, no.
{Ketubot 20b}
And if he is a Torah scholar, even for himself. Like this of Rav Ashi in which he knew evidence for Rav Kahana and he {=Rav Kahana} said to him, "does Master remember the testimony?" He said to him "no." He said to him, "and was it not such-and-such?" "I don't know." In the end, Rav Ashi remembered and went to testify for him. He saw Rav Kahana that he was surprised. He said to him, "do you think that I am relying upon you? I was the one who wracked my brains and remembered."

Mishna:
This one {witness} says "this is my handwriting and this is the handwriting of my fellow," and this one says "this is my handwriting and this is the handwriting of my fellow," they are believed.

Rif Ketubot 7a {Ketubot 19b continues}

7a

{Ketubot 19b continues}

And do we indeed collect with it? Why? They are two and two?
{Ketubot 20a}
Rav Nachman said: We establish two against two and we leave the assets in its owner's possession. Just as was true by the assets of a certain madman.
For a certain madman sold assets, and two came and said that he sold it while he was a madman, and two others came and said that when he was of right mind he sold his assets. Rav Ashi said: We set up the two against the two and we leave the money in its assumed state with the madman. And we do not say it except where he has a presumption because it was his fathers', but if he does not have a presumption since it was his fathers, we say that when he was a madman he sold and when he was a madman he bought.

Rabbi Abahu said: We only rebut {by saying "you were with us in another place at that time"} the witnesses in their presence, but we can contradict {the substance of the testimony of} the witnesses even not in their presence.
And while rebuttal not in their presence, granted it is not rebuttal, but it is however a valid contradiction.
Rav Asi said: We do not establish {=confirm} a contract {in terms of handwriting} from another contract that was contested, unless it {that other contract} was confirmed in court.
The Nehardaeans say: We do not establish a contract unless from contracts of two fields or two ketubot, and this is only where their owners enjoyed them {the fields} for three years, in in comfort {without protest from others}.
And this is where it {the contract} came out of the hand of another person, but from his own hand, he worry lest it is a forgery.

Rif Ketubot 6b {Ketubot 19a - 19b}

6b

{Ketubot 19a}

Rav Ashi said: In truth, it is where witnesses stated {that it was a deed of trust}, and it was where their handwriting did not come from another place. And when you say "why are they not believed?" it is like Rav Kahana. For Rav Kahana said: It is forbidden for a man to retain a deed of trust within his house, for it is stated {Iyyov 11:14}:
14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--
{Ketubot 19b}

Rav Shisha son of Rav Idi said: We deduce from Rav Kahana that witnesses who said "our words were a deed of trust" are not believed. What is the reason? Since it is avla {unrighteousness}, upon avla they do not sign.

Rabbi Yehoshua ben Levi said: It is forbidden for a man to retain within his house a paid-off bill of indebtedness, for it is stated {Iyyov 11:14}:
14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--

It was stated {by Amoraim}: A {Biblical} book which is not corrected:
Rabbi Ami said: Until 30 days it is permitted to retain it; after thirty days it is forbidden to retain it, for it is stated {Iyyov 11:14}:
14 If iniquity be in thy hand, put it far away, and let not unrighteousness dwell in thy tents--

Rav Nachman said: Witnesses who said "our words were on a deed of trust" are not believed. "Our words were on a matter of protest" {that the seller protested he was being forced to sell} they are not believed.

Mar son of Rav Ashi said: "Our words were on a deed of trust," they are not believed. "Our words were on a matter of protest," they are believed.
What is the reason? This is not given over to be written, while that is given over to be written.
And so is the halacha {like Mar bar Ravina}.

Witnesses who said "our words were on a condition," they are believed. And when they {the people involved} come before us, we say to them "fulfill your condition and then come to court."
If one witness says it was subject to a condition and one witness says there was no condition --
Rav Pappa said: They each are testifying that it is a fine contract, and this one who said there was a condition is a single witnesses, and the words of one do not stand in place of two {witnesses}.
Rav Huna son of Rav Yehoshua objected to this: If so, even if both of them {say it was on condition} also {since they first testified the contract was valid}! Rather we say, these are coming to uproot their testimony {and thus they are believed}. Here too {with only one witness}, he is coming to uproot his testimony.
And the halacha is like Rav Huna son of Rav Yehoshua.

The Sages learnt {in a brayta}: Witnesses who were signed on a contract and died, and two come and say that "it was their {=the deceased} handwriting, but they were forced; they were minors; they were invalid as witnesses" they are believed. And if there are other witnesses that it is their handwriting, or if their handwriting {sample} comes from some other place, that is from a contract which was complained about and subsequently established in bet din, they are not believed.

Rif Ketubot 6a {Ketubot 15b; 18b - 19a}

6a

{Ketubot 15b}
Mishna:

And Rabbi Yehoshua admits, where he said to his friend "This field was your father's and I acquired it from him" that he is believed {Ketubot 16a} for the mouth which bound was the mouth that loosened.
And if there are witnesses that it was his father's, and he says "I acquired it from him," he is not believed.

{Ketubot 18b}
Witnesses who said "this is our handwriting, but we were forced; we were minors; we were invalid witnesses," they are believed. But if there are witnesses that it is their handwriting, or there other handwriting {sample} comes from another place, they are not believed.

Gemara:
Rami bar Chama said: The only learned this where they said "we were forced by mortal danger," but "we were forced via threat of money," they are not believed.
What is the reason? Because a man cannot declare himself an evildoer.

{Ketubot 19a}

Rav Yehuda cited Rav: If one says "this is a {loan} deed of trust" {where he writes this document trusting that the loan will be given to him later}, he is not believed.
In this case, who is speaking? If it is the borrower speaking, it is obvious that he is not believed! But rather, if it is the lender, may blessings come upon him {for being so honest, such that he will now not collect}. But rather witnesses? If their handwriting comes from another place {such that we need not rely upon them for that fact}, it is obvious! And if their handwriting does not come from another place, why should they not be believed?

Abaye said: In reality, it is where the lender said this, and such that he is obligated to others, like this of R' Natan. For R' Natan said: From where {do we know} that if one {A} has a claim of 100 against his friend {B}, and his friend {B, has such a claim} against his friend {C}, that we can take from this one {C} and give to that one {A}? For it is written {Bemidbar 5:7}:
7 then they shall confess their sin which they have done; and he shall make restitution for his guilt in full, and add unto it the fifth part thereof, and give it unto him in respect of whom he hath been guilty.

Rif Ketubot 5b {Ketubot 15b- 16b}

5b

BEGIN PEREK
{Ketubot 15b}
Mishna:

The woman who was widowed or divorced -- she says "I was married as a virgin" and he says "no but rather as a widow I married you" -- if there are witnesses that she went out in a hunuma with her head uncovered, her ketuba is 200.
Rabbi Yochanan ben Beroka says: Even the distribution of roasted ears of grain.

{Ketubot 16a}
Gemara:

The reason is that there are witnesses. Thus, if there are no witnesses, the husband is believed.

{Ketubot 16b}

{Note: If she had her ketuba, there would be no dispute as to the 100 or 200. Thus, she is obviously claiming her ketuba money in court based on these witnesses without producing the ketuba.}
(And let us be concerned lest she produce witnesses go in this court and collect, and then produce her ketuba in that court and collect!
Rabbi Abahu said: This tells us that we write a receipt {for collection of ketuba}.
Rav Pappa says: We are dealing with a location in which they do not write a ketuba.
And let us worry lest she produce witnesses to the hinuma {in which she went out} in this court and collect and then turn around and produce witnesses in that court and collect? Since it is not possible, since they will surely write a receipt.)

The Sages learnt {in a brayta}: How do we dance before the bride?
Bet Shammai say: {Ketubot 17a} The bride as she is.
And Bet Hillel say: Beautiful and graceful bride.
Bet Shammai say to Bet Hillel: According to your words, if she was lame or blind, would you say "Beautiful and graceful bride?" But the Torah says "Keep distance from falsehood!"
Bet Hillel said: If one acquired bad merchandise from the market, should one praise it in his eyes or depreciate it in his eyes? Certainly he should praise in in his eyes.
From here, the Sages said that a person's disposition should always be pleasant with others.

R' Shmuel bar Nachmeinu cited Rabbi Yonatan: It is permitted to look at the bride's face all seven days in order to make her beloved to her husband.
And the halacha is not like him.

The Sages learnt {in a brayta}: They move away the dead {=a funeral procession} before the bride {a bridal procession}, and both this and that before the king of Israel. They said about King Agrippas they he made way for a bride, and the Sages praised him.
"They praised him" -- this implies that he did well!
But Rav Ashi said that even according to the opinion that a prince who forgoes his honor, his honor is forgone, a king who forgoes his honor, his honor is not forgone, for it is stated {Devarim 17:15}

15 thou shalt in any wise set him king over thee, whom the LORD thy God shall choose; one from among thy brethren shalt thou set king over thee; thou mayest not put a foreigner over thee, who is not thy brother.
It was at a cross-roads.

The Sages learnt {in a brayta}: We interrupt study of Torah for the funeral procession and for the bridal procession. They said about Rabbi Yehuda beRabbi Illai that he interrupted Torah study for the funeral procession and for the bridal procession.
Where are these words said: Where he does not have all that is necessary for him, but if he has all he requires, we do not interrupt.
And how much is "all he needs?" Rav Shmuel bar Ivia cited Rav: 12,000 men and 6000 trumpeters. And some say 12,000 men and among them 6000 trumpeters.
Rav Sheshet, and some say Rabbi Ammi, and some say Rabbi Yochanan, said: Like its {=the Torah's} giving, so too its taking away. Just as its giving was with 600,000, so too its taking away is with 600,000.
And these words refer to one who read {Torah} and learned {Mishna}. But one who learns {gemara -- this follows Rif's earlier definition of the term}, there is no measure.

Rif Ketubot 5a {Ketubot 14b - 15a} The Incident of Rape by the Spring

5a

{Ketubot 14b}
Mishna:

Rabbi Yossi said: There was an incident with a girl who descended to fill from the spring and she was raped.
Rabbi Yochanan ben Nuri said: If the majority of the city could marry a kohen, she may marry a kohen.

{Ketubot 15a}

Rav Yehuda cited Rav: In the springs of Tzippori was the incident.
Like Rabbi Yannai who said that if she had intercourse at the time of {people going to} the springs, she is valid for a kohen.
And this was where there was a caravan of valid people passing there, such that there are two majorities - the majority of the city and the majority of the caravan.
And so is the halacha.

Rif Ketubot 4b {Ketubot 12b - 14a} Rape Date, Wood Injury, Paternity, Chazaka and Credibility

4b

{Ketubot 12b}
Mishna:

If one married a woman and did not find to her virginity, and she says "after the time you betrothed me I was raped, and it is your field which has been inundated," and he says, "no but rather before I betrothed you, and so my acquisition was an acquisition in error."
Rabban Gamliel and Rabbi Eliezer say: She is believed.
Rabbi Yehoshua says: We do not live by her word, but rather she is under the assumption of being a non-virgin before she was betrothed and that she deceived him, unless she brings a proof to her words.

Gemara:
(Rav Yehuda cited Shmuel: The halacha is like Rabban Gamliel.)

It was stated {by Amoraim}: "I have 100 in your possession," and the other one says "I don't know" --
Rav Huna and Rav Yehuda say he is obligated {to pay} and Rav Nachman and Rabbi Yochanan say he is exempt.
Rav Huna and Rav Yehuda say he is obligated, for in conflict between someone who is positive and someone who is unsure, the positive person is on stronger footing.
And Rav Nachman and Rabbi Yochanan says that he is exempt -- for the money stays in the presumption of being in the present owner's possession.

Let us say that Rav Huna and Rav Yehuda are saying like Rabban Gamliel, while Rav Nachman and Rabbi Yochanan say like Rabbi Yehoshua.
Rav Nachman could say to you: We say even according to Rabban Gamliel. Rabban Gamliel only speaks there where we say that we place the woman in accordance with her presumed state {and she was born a virgin}, but here, what assumption does he have here?
This is indeed logical, as we have learned. For if you do not say this, you have a contradiction from one halachic conclusion to another halachic conclusion. For we establish that the halacha is like Rav Nachman in monetary matters, and in this, Rav Yehuda cited Shmuel that the halacha is like Rabban Gamliel. Rather, do we not deduce as we have learned? We indeed so deduce.

{Ketubot 13a}
Mishna:

She says "I was injured by a piece of wood" and he says "No but rather you were trodden by a man."
Rabban Gamliel and Rabbi Eliezer says she is believed.
Rabbi Yehoshua says: Not from her mouth do we live, but rather, behold she is under the assumption of being trodden by a man until she brings proof to her words.

If they saw her speaking with a man in the marketplace, and they said to her, "what is the status of this man?" and "he is a kohen."
Rabban Gamliel and Rabbi Eliezer say that she is believed.
Rabbi Yehoshua says: Not from her mouth do we live, but rather, behold she is under the presumption of having had intercourse to a Netin {a Gibeonite} or to a bastard, until she brings proof to her words.

If she was pregnant, and they said to her, "what is the status of this fetus?" "From so-and-so, and he is a kohen."
Rabban Gamliel and Rabbi Eliezer say that she is believed.
And Rabbi Yehoshua says: Not from her mouth do we live, but rather, behold she is under the presumption of being pregnant from a Netin or from a bastard until she brings a proof to her words.

And Rabbi Eleazar said: Even the one who declares her fit declares her daughter unfit.
And we establish like Rabbi Yochanan, for he is the teacher of Rabbi Eleazar.
And furthermore, for Abba Shaul rules the halacha like him in perek Asara Yuchsin. For we learn {in a Mishna}: Abba Shaul would call a Shtuki {silent one} a beduki. And Rav said: What is a beduki? That we investigate {bodkin} his mother, and if she says "to a valid person I had intercourse," she is believed, and even though there are a majority of people who are invalid by her. And Rava said: The halacha is like Abba Shaul.

There was a betrothed man and his betrothed {woman} who came before Rav Yosef. She said, "It {=the fetus} is from him," and he said
{Ketubot 14a}
"Yes, it is from me."
Rav Yosef said: What are we concerned about? Firstly, he admits. And furthermore, Rav Yehuda cited Shmuel that the halacha is like Rabban Gamliel.
Abaye said to him: And in this, if he did not admit, would Rabban Gamliel declare fit? But Shmuel said to Rav Yehuda, "Sharp one! The halacha is like Rabban Gamliel, but you should not act on it until there are a majority of fit ones {that if she slept with them, the fetus would be valid} by her." Yet here, there are a majority of invalid ones by her {that is, everyone but her betrothed}!
{Rav Yosef's reply:} "And according to your reasoning, there is an internal difficulty. It is halacha, yet you should not conduct yourself like it?? Rather, this is ab initio, and this is after the fact. And here as well, it is like after the fact" -- for they are a betrothed man and his betrothed {woman}.

There was one who came before Rabbi. He said to him, "I had intercourse and did not find blood." She said to him, "I was a complete virgin when I had intercourse, but it is a year of famine." Rabbi saw their faces were black {from hunger}, and commanded regarding them, and they brought them to a bath, and fed them and gave them to drink, and brought them to a chuppa {bridal chamber}, and he had intercourse and he found blood.
He {=Rabbi} said to him: Go, you have done well in your acquisition.
He called upon them {Eicha 4:8}:
ח חָשַׁךְ מִשְּׁחוֹר תָּאֳרָם, לֹא נִכְּרוּ בַּחוּצוֹת; צָפַד עוֹרָם עַל-עַצְמָם, יָבֵשׁ הָיָה כָעֵץ. {ס} 8 Their visage is blacker than coal; they are not known in the streets; their skin is shrivelled upon their bones; it is withered, it is become like a stick. {S}

We learn in perek Elu Naarot {Ketubot 35b-36a}:
The female deaf-mute, the female imbecile, the mature woman, and the one wounded by wood {such that she tore her hymen} -- they do not have to them a claim of virginity {able to be lodged against them}. The blind woman and the aylonit {who never developed signs of maturity} do have to them a claim of virginity.
And we ask: And does a mature woman not have a claim of virginity? But Rav said, "A mature woman, we give her the first night {to continue to have intercourse}." Thus it is clear that she does have a claim of virginity, for if she does not, why do we give her the first night -- it is surely menstrual blood?!
And we answer: If he lodges the complaint the "I found the opening open," indeed she does have a claim of virginity {able to be lodged against her}, for all virgin mature women, her opening is closed. Rather, with what are we dealing when we say that she has no claim of virginity {against her}? Where he claimed a claim of {absence of} blood. That we say that she was a virgin, but her blood {which would come from breaking the hymen} was finished {used up}.
And this of Rav, we establish it in perek tinoket {Niddah 64b} as referring to a mature woman who had not yet seen {menstrual} blood, but a mature woman who had seen {menstrual} blood when she was still in her father's household, she only has the intercourse of precept and then he separates.
And so is the halacha.
We now find that mature virgins, some of them have blood {since it was not "finished"} and this is what Rav said that we give them the first night, and some of them do not have blood {since it has "finished"}, and this is what they teach that the mature woman does not have {against her} a claim of virginity {based on absence of blood}, but a claim of "an open opening" she does have.
And so is the halacha.

Mishna:

The convertess, the woman who was captured, and the maidservant who were redeemed, converted, or were freed while less than 3 years and a day, their ketuba is 200 and they have against them a claim of virginity.

The adult {a boy over 13} who had intercourse with a minor {a girl under 12}, and a male minor who had intercourse with a female adult, and a woman {whose hymen was} injured by wood, their ketuba is 200. These are the words of Rabbi Meir.
And the Sages say: A woman injured by wood, her ketuba is 100.

A virgin who was a widow, a divorcee, or a chalutza from full marriage, their ketuba is 100, and they do not have {against them} a claim of virginity.
The convertess, the captive woman and the maidservant who were redeemed, freed, or who converted when older than 3 years and a day, their ketuba is 100, and they do not have {against them} a claim of virginity.

{Ketubot 11b}
Gemara:
Rava said: A woman {whose hymen was} injured by wood, according to the Sages, has a ketuba of 100, whether he knew this about her {when he married her} or did not know this about her.

And so is the halacha, for he {=Rava} retracted from the first statement, in which he said that if he knew this about her, 100, and if he did not know this about her, {she gets} nothing at all.

However if he took her in {to marriage} under the assumption that she was a virgin and she is found to have had {actual} intercourse, she gets nothing at all. For they learned {in a Mishna}: If someone marries a woman and does not find in her virginity, and she says "I was raped while betrothed, such that it is his field that was inundated," while he says, "no, but rather before I betrothed you you were raped, such that my acquisition was an acquisition in error." And Rava says: It is entirely an acquisition in error. This implies that she gets nothing. And so is the halacha.

{Ketubot 12a}
Mishna:
If one eats by his father-in-law in Judea without presence of witnesses, he is unable to lodge a complaint of virginity, because he secluded himself with her.

Both the widow who was an Israelite and the widow who was a kohenet {=daughter of a kohen}, her ketuba is 100.
The court of the kohanim would collect for a virgin {who was daughter of a kohen} 400 zuz, and the Sages did not protest.

Rif Ketubot 3b {Ketubot 9b; 10b} Belief About An Open Opening Claim; Excuses for Absence of Blood

3b

{Ketubot 9b}

Rav Yehuda cited Shmuel: If someone says "I found an open opening," he is believed to deprive her of her ketuba.
{Ketubot 10a}
Rav Nachman cited Shmuel in the name of Rabbi Shimon ben Eleazar: The Sages established for the daughters of Israel, for a virgin 200 and for a widow 100, and they lent him credence that if he said "I found an open opening," he is believed.
And if so, what did the Sages accomplish with their edict?
Rava said: It is an assumption that a man with not trouble himself to prepare the feast and then spoil it.

And we have seen that a Gaon {said} that this is in terms of the 100 or 200, but in terms of the addition, he is not believed. And there is an understable reason here, for the Sages only enacted the 100 vs. 200, but the addition, he wrote by himself. Therefore he is not believed.

There was one who came before Rav Nachman. He said to him, "I found an open opening."
Rav Nachman said to them: The harlots of Mabrachta lie prostrate before him. Lash him with palm-switches! {Since to have such experience to be able to determine this, he must have slept around.}
But it is Rav Nachman who said that he is believed?! He is believed, and is lashed with palm-switches.
Rav Achai learned: Here by a bachur {who should have no such experience} and here with one already married. A bachur is not experienced, while a married one is experienced,

There was one who came before Rabban Gamliel. He said to him, "I found an open opening."
He said to him: Perhaps you moved aside {and thus had intercourse without tearing the hymen}. I will relate to you a parable to what the matter is comparable -- to a man who went in the deep darkness of night {and came to a door}. If he moves aside {the bolt} he finds it open, if he does not move aside he finds is locked.

There was one who came before Rabban Gamliel. He said to him, "I had intercourse and did not find blood."
She said to him: Rabbi, I am still a virgin.
He {=Rabban Gamliel} said to them: Bring forward two maidservants, one who is a non-virgin and one who is a virgin. They brought them before him, and he placed them upon a cask of wine. The virgin, the smell went through {and they could smell it on her breath}. The non-virgin, the smell went through. They {then} placed her {=the wife} on it and the smell did not go through.
He said to him: Go, you have done well with your acquisition.

And let him have initially inspected her {and not first relied upon the maidservants}. He had heard this as a tradition but had not seen it in practice, and he thought that the matter might not be certain, and it is not the proper way to deal lightly with the daughters of Israel to this extent {without first confirming the validity of the process}.

There was one who came before Rabban Gamliel the Edler. He said to him: I had intercourse and I did not find blood. She said to him: Rabbi, I was a complete virgin when I had intercourse, but I am from a family of Dorkati, who do not have neither virginal blood nor menstrual blood.
Rabban Gamliel investigated her relatives and found that it was as she spoke.
He {=Rabban Gamliel} said to him: Go, you have done well with your acquisition.
What is "Dorkati?" They taught: A cut off generation.

Rif Ketubot 3a {8b-9a} Blessings of Grooms; An Open Opening and Doubt

3a

{Ketubot 8b}

Rabbi Yitchak cited Rabbi Yochanan: They bless the blessing of grooms with ten {men} all seven {days}, and the groom is among the count. The blessing of mourners is with ten [all seven] and the mourners are not among the count. And this is where new faces came.
What is the blessing of mourners? The blessing in the street.

{Ketubot 9a}
Rabbi Eleazar said: If he says "I found an open opening" {=she was not a virgin as I had expected}, he is believed to forbid her upon him, for he he may impose upon himself a forbidden piece of meat. And these words are by the wife of a kohen.
To explain: Where there is only a single doubt -- it is a doubt whether it was when she was with him {=betrothed to him} of not with him {=before that}. And you cannot say {the argument} that if you say it was while with him, it is a doubt whether it was the result of wood puncturing or whether of being trodden by a man, for one for whom it was the result of injury from wood, her opening is closed.
And if you want, say it is by the wife of an Israelite, and this is where her father accepted the betrothal when she was less than three years and a day {since the hymen will grow back if broken when less than that age}, such that it is a single doubt -- a doubt whether it was rape or whether it was willingly, and in a case of Biblical doubt, we rule stringently.
However, the wife of an Israelite who was betrothed when older than three years and a day, she is permitted, for we have in her two doubts -- a doubt whether while with him she had unlawful intercourse or whether while she was not with him she had the unlawful intercourse, and in you say that it was while with him, it is a doubt whether it was willingly or unwillingly. Therefore, she has to her two doubts, and in case of two Biblical doubts, we rule leniently.

Rav Yehuda said:
{Ketubot 8a}
  1. That He created all for His Glory.
  2. Blessed is the Creator of man.
  3. Blessed who created man in His Image, in the image of the likeness of his form, and prepared from him {=from man} a perpetual building {=woman}. Blessed are you, Hashem, who created man.
  4. May the barren woman greatly rejoice and exult in the gathering of her children within her midst in joy. Blessed who causes Zion to rejoice in her children.
  5. May you cause the loving companions {man and his wife} to rejoice, as you caused your creations to rejoice in Gan Eden. Blessed who causes the groom and bride to rejoice.
  6. Blessed are You, Hashem, who creates joy and gladness, the groom and bride, rejoicing, singing, mirth and delight, love and brotherhood, peace and friendship. Speedily, Hashem our God, may it be heard in the cities of Judea and in the streets of Jerusalem the voice of joy and the voice of gladness, the voice of the groom and the voice of the bride, the sound of shouts of joy of grooms from their wedding canopies, and of youths from their feasts of song. Blessed are you, Hashem, who causes the groom to rejoice with the bride.

Rav Ashi visited the house of Rav Kahana. The first day, he blessed all of them. From then on, if there were new faces, he blessed all of them, and if not, (no) it is merely a continuation of joy and so he blessed "that the happiness is in his dwelling," and "Asher Bara." From the seventh until the thirtieth, whether he {=the host} said to them {=the guests} 'because of the wedding' or whether he did not say 'because of the wedding,' he blesses "that this happiness is in his dwelling." From then on, if he says to them 'because of the wedding,' he blesses "that this happiness is in his dwelling," and if not, no.
And when he says 'because of the wedding,' until when?
And at first {from before the wedding}, until when? From when they put barley into the mortar. {Thus, from when they begin preparing for the wedding.}
Rav Pappi cited Rava: Until twelve months, thus a year.

Rif Ketubot 2a {Ketubot 5a-b; 7a-b} Why the When the Widow and Virgin are Married; First Intercourse on Shabbat; The Blessing of Grooms

2a

{Ketubot 5a}

Bar Kappara taught {in a brayta}: A virgin is married {nisuin} on Wednesday and intercourse takes place on Thursday, since on it {the fifth day of creation} the blessing for fish was pronounced. A widow is married on Thursday and has intercourse on Friday, since on it was said the blessing for man.

And they learnt {in a brayta}: Why did they say that a widow is married on Thursday and has intercourse on Friday? Since if they tell him to have intercourse on Thursday, the next day he will arise to do his job and leave. The Sages looked out for the interests of the daughters of Israel, that he should rejoice with her for three days -- Thursday, Friday, and Shabbat.

{Ketubot 5b}
It was a question to them: May one have first intercourse on Shabbat?
And the conclusion: And the halacha is that it is permitted to have the first intercourse on Shabbat.

{Ketubot 7a}

Rabbi Ami permitted to have first intercourse on Shabbat.
The Sages said to him: But no ketuba was written.
He said to them: Let he seize movable objects.

Rav Huna cited Rav Abba bar Zavda who cited Rav: Both a virgin and a widow require a blessing all seven {days}.
And specifically a widow who married a bachur {man for whom this is his first marriage} but a widow who married widower only requires a blessing for one day.
But this that they learnt {in a brayta}, that the Sages looked out for the interests of the daughters of Israel, such that he should rejoice with her for three days, in what instance? If by a bachur, you have said "all seven." And if by a widower, you have said "one day."

If you wish you may say by a bachur, and if you wish you may say by a widower.
If you wish you may say by a bachur -- seven for blessing and three for rejoicing.
And if you wish you may say by a widower -- one day for blessing and three for rejoicing.
For there is no virgin with less than seven, and no widow with less than one day.

{Ketubot 7b}
Rav Nachman said: Huna said to me: From where that the blessing of grooms is with ten? For it is stated {Rut 4:2}
2 And he took ten men of the elders of the city, and said: 'Sit ye down here.' And they sat down.
Rabbi Abba said: From here {Tehillim 68:27}:
27 'Bless ye God in full assemblies, even the Lord, ye that are from the fountain of Israel.'

The Sages learned {in a brayta}: The blessing of grooms is in the house of the groom. Rabbi Yehuda said: Also in the house of betrothal they bless it.

Abaye said: In Judea they learned this, because he had yichud with her.

Another brayta: They bless the blessing of grooms in the house of the groom and the blessing of betrothal in the house of betrothal.
What do they bless? Blessed Who sanctified us regarding forbidden relations, and forbade for us the betrothed, and permitted us the married via chuppa {=the bridal canopy} and betrothal. Blessed are You, Hashem, who sanctifies Israel.

The Sages learnt {in a brayta}: The bless the blessing of grooms all seven {days}.
Rav Yehuda said: And this is where new faces came.

Rif Ketubot 1b {Ketubot 3b - 4a} Marriage Upon Death of a Parent

1b

{Ketubot 3b}

They learnt {in a brayta}: If his bread was baked and his meat slaughtered and his wine mixed, and the father of the groom or the mother of the bride died, they bring in the corpse to another room, and the groom and the bride to the chuppa,
{Ketubot 4a}
and he {subsequently} performs the intercourse of the precept, and separates. And he keeps the seven days of the {wedding} feast, and afterwards keeps seven days of mourning. And all those days he sleeps among the men and his wife sleeps among the women.
And so too one whose wife became a menstruant, he sleeps among the men and she sleeps among the women.
And we do not keep back adornments from the bride all 30 days {of mourning}.

And specifically the father of the groom and the mother of the bride, for there is no {other} person to trouble themselves on their behalf, but the opposite scenario, with the mother of the groom and the father of the bride, no.
Rafram bar Pappa cited Rav Chisda: They only learned this where they placed water on the meat, but if they did not place water upon the meat, they should sell it.
Rava said: And in a city, even if they placed water upon the meat, they should sell it.
Rav Pappa said: And in a village, even if they did not place water upon the meat, they should not sell it.
And this of Rav Chisda is found when it is out of the realm of being a city and out of the realm of being a village.
And we deduce from this that where it is possible to sell it and there is no loss, that they do not practice the days of feast in the beginning.

Master had said: "he sleeps between the men and she sleeps between the women."
This supports Rabbi Yochanan, for Rabbi Yochanan said: Even though they said that there is no mourning on the Festival {moed}, matters in private he keeps.
Rav Yosef son of Rava expounded in the name of Rava: They only taught that he sleeps between the men and she sleeps between the women when he did not have intercourse {with her yet}, but if he had intercourse with her, his wife sleeps with him in the same house.
And specifically a groom whose wife became a menstruant. But a groom whose father-in-law or mother-in-law died, whether he had intercourse with her or he did not have intercourse, he sleeps among the men and his wife sleeps among the women, and they teach in a brayta.

Rif Ketubot 1a {Ketubot 2a; 3a} When a Virgin and Widow Marry

1a

{Ketubot 2a}
Mishna:

A virgin {woman} marries on Wednesday and a widow on Thursday, for two days in the week Jewish courts sit in judgment in the cities, on Monday and on Thursday, such that if he has a complaint that she is not a virgin, he may arise {the next morning} to Bet Din.

Gemara:
Rav Yosef cited Rav Yehuda who cited Shmuel: Why did they say that a virgin is married on Wednesday? Since if he had a complaint about virginity he may arise to Bet Din {on Thursday}.
And let her marry on Sunday, and if he had a complaint about virginity he may arise to Bet Din {on Monday}?
The Sages watched over the ordinance {=benefit} of the daughters of Israel -- so that a man will endeavor in the feast for three days, Sunday, Monday and Tuesday, and on Wednesday he will take her in.
And now that we have learned that they watched over, this that we learned that if the time came and they did not marry, they eat of his; if the time came on Sunday, since he is not able to take in, he does not give over to her provisions. Therefore, if he became ill or she became ill, of she became a menstruant, he does not give over to her provisions.
And this which we said that "they eat of his," this is specifically unconsecrated food, but teruma, no. For we establish like the latter Mishna, than the woman does not eat of teruma until she enters the chuppa.

(Rava said: And in the matter of get, it is not so.
Thus Rava maintains that there is no "unpreventable accident" by get.)

{Ketubot 3a}
R' Shmuel bar Yitzchak cited Rabbi: They only learned this from the edict of Ezra and on, since courts were not established [except on Monday and Thursday]. But in a place where courts are established every day, a woman may be married every day. And this is where he took the trouble {of preparing for the wedding}.

Yerushalmi:
If they found written and signed on a document, "the man Ploni died," or "the man Ploni was killed" --
Rabbi Yirmeyah says: The marry off his wife.
Rabbi Bon bar Kahana said: The do not marry off his wife.
A brayta supports this one and that one.
One supports Rabbi Yirmeyah, for they learnt {in a brayta}: "based on the word of witnesses" and not based on their writing, and not based on a translator, and not based on a single witness. And now, do they not marry off based on a single witness, and based on a second-hand testimony. -- And just like this, based on their writing and based on a translator, they marry off.
A brayta supports Rabbi Bon. For they learnt {in a brayta}: The power of witnesses is better than the power of a document -- for if witnesses said "Ploni died; Ploni was killed," they marry off his wife. If they found written in a document "Ploni died; Ploni was killed," they do not marry off his wife. And the power of a document is better than the power of witnesses, for if one lends to his fellow with a document, he may collect from the assets to which a lien may apply, but via witnesses, he may {only} collect from free assets.

They learnt {tnan} there in perek Keitzad eshet Achiv shelo haya beOlamo:
If one brought a get from an overseas country and said, "before me it was written and before me it was signed," he {the agent} may not marry his {=the ex-husband's} wife. "I killed him; they killed him," he may not marry his wife.
Rabbi Yehuda says: "I killed him," his wife may not remarry; "we killed him," his wife may remarry; "he died -- I killed him," he {who is stating this} may not marry his wife. --

It is he who may not marry his wife, but to another man, his wife may marry. And we do not say that he is an evildoer, and the Torah says {Shemot 23:1}
1 Thou shalt not utter a false report; put not thy hand with the wicked to be an unrighteous witness.
{Thus, "put not the wicked to be a witness."}
For we establish like Rava, for Rava said that a man is his own relative, and a man may not transform himself {via testimony} into an evildoer.
And we deduce from this that an evildoer is invalid for the testimony of a woman {to marry}.

And we learn in the first perek of Rosh HaShana:
Rav Menashe said: This effectively states that a robber according to their words {=Rabbinically} is valid for the testimony of a woman {to marry}.

And in perek Keitzad Eishet Achim, we also ask from it {saying}:
But Rav Menashe said that a robber according to their words {=Rabbinically} is valid for the testimony of a woman {to marry} -- thus a robber according to Biblical standards is invalid for the testimony of a woman.
And we deduce from it that someone who is invalid Biblically is specifically the one who is invalid for the testimony for a woman, but someone invalid Rabbinically, such as one who plays with dice and his fellows are valid for testimony for a woman.
And it is logical to us that someone who is Biblically invalid who speaks in all innocence, they may remarry the woman on his say so, since it is no worse than a Cuthean.

We learn in a Mishna in Gittin, in perek Kol haGet {Gittin 28b}:
Three things Rabbi Eliezer ben Prata said before the Sages and they upheld his words:
  1. On a city which a siegework surrounded
  2. and on a ship floundering {/sinking} at sea
  3. and on one who is going to {capital} judgment
that they are in the presumption of alive.
However,
  1. A city which the siege captured
  2. And a ship lost at sea
  3. And one who went to be executed
they place upon his the stringencies of the living and the stringencies of the dead.

{Yevamot 122a}
Mishna:
Rabbi Akiva said: When I descended to Nehardea to add a month to the year, Nechemiah of Bet Deli found me. He said to me: I have heard that they do not marry off a woman in Eretz Yisrael based on the word of a single witness, {they do not do it} except for Yehuda ben Bava.
I said to him: So indeed is the matter.
He said to him: Say to them in my name, "you know that this country is in confusion because of raiders. I have accepted from Rabban Gamliel the Elder that they may marry off a woman on the say-so of a single witness."
And when I came and recounted these words before Rabban Gamliel, he rejoiced at my words, and said, "we have found a colleague for Yehuda ben Bava."
From these matters, Rabban Gamliel recalled that people were killed at Tel Arza, and Rabban Gamliel (the Elder) married off their wives on the say-so of a single witness.

And they established to marry off on the say so of a second-hand witness {one witness who heard from another witness}, on the say so of a woman, on the say-so of a slave, on the say-so of a maidservant.
Rabbi Eliezer and Rabbi Yehoshua say: They may not marry off a woman based on the say-so of a single witness.
Rabbi Akiva said: Nor on the say-so of a woman, nor on the say-so of relatives.
They said to him: There was an incident with certain Levites who went to Tzoar, city of palms, and one of them became ill and they placed him in an inn. When they returned, they said to the female innkeeper, "where is our colleague?" She said to them, "he died, and I buried him." And they remarried his wife.
Should not a kohen's wife be like a female innkeeper?
He said to them: When she is like the female inkeeper [she will be believed. The female innkeeper brought out to them his staff, his bag, and the sefer Torah which was in his hand].

Gemara:
And the halacha is that they may marry off the wife based on the word of a witness from the mouth of a witness, from the mouth of a woman, from the mouth of a slave, from the mouth of a maidservant, from the mouth of relatives.

{Yevamot 122b}

"They said to him: There was an incident with certain Levites...":
What is the inferiority of the female innkeeper?
Rav Kahana said: The female innkeeper was a Cuthean, and was speaking in all innocence -- "This is his staff and this is his bag, and this is the grave in which I buried him."
But they had said to her, "where is our colleague!?"
Once they saw her crying, they said to her, "where is our colleague?" She said to them, "he died and I buried him."

We deduce from this that where the Cuthean begins speaking in all innocence, ever though the then replies and reveals the matter from it, it is fine and has not gone out of the status of speaking in all innocence, but rather he is believed, and the marry {her off} on his say-so. And we do not need by testimony for a woman investigation and cross-examination.
