Rif Moed Katan 7b {Moed Katan 14b continues; 15a - 15b}

7b

{Moed Katan 14b continues}
For it is written {Devarim 16:14}
14 And thou shalt rejoice in thy feast, thou, and thy son, and thy daughter, and thy man-servant, and thy maid-servant, and the Levite, and the stranger, and the fatherless, and the widow, that are within thy gates.
If it is mourning from before {the Festival}, the positive commandment of the many comes and pushes off the positive commandment of the individual. And if it is the mourning of now {once the Festival has begun}, the positive commandment of the individual does not come and push off the positive commandment of the many.
And one placed in niddui {a type of ban - cherem} conducts himself in niddui on the Festival, and we do not permit him until he appeases his litigant opponent.
And from here we conclude this statement: We judge money matters on chol haMoed as well as judgments of lashes, and if he does not obey the court decision, we place him in Shamta {a type of cherem}.

{Moed Katan 15a}

A mourner is forbidden in haircuts from the fact that the All-Merciful said to the children of Aharon {Vayikra 10:6} {who were now in mourning over their brothers}:
6 And Moses said unto Aaron, and unto Eleazar and unto Ithamar, his sons: 'Let not the hair of your heads go loose, neither rend your clothes, that ye die not, and that He be not wroth with all the congregation; but let your brethren, the whole house of Israel, bewail the burning which the LORD hath kindled.
we may deduce that the rest of the world is forbidden.

One placed in niddui is forbidden in haircuts, for they learnt {in a brayta}: Those in niddui and lepers are forbidden to have their hair cut and to wash their clothing.

One placed in niddui who dies, Bet Din stones his casket. Rabbi Yehuda says: Not that they erect for him a pile of stones like the pile of stones of Achan, but rather Bet Din sends and places a stone on his casket, to teach you that anyone who is placed in niddui and them dies in a state of niddui, Bet Din stones his casket.

A mourner is obligated to wrap his head {in a tallit}. From the fact that the All-Merciful said to Yechezkel {Yechezkel 24:17}:
17 Sigh in silence; make no mourning for the dead, bind thy headtire upon thee, and put thy shoes upon thy feet, and cover not thine upper lip, and eat not the bread of men.'
we see that that the entire world is obligated.

One in niddui, is he required to practice wrapping of his head?
Rav Yosef said: Come and hear {a proof}. For they learnt {in a brayta} regarding a public fast -- "and they wrap themselves in a tallit and sit like mourners and people in niddui until they gain mercy from Heaven."
Abaye said to him: And perhaps one placed in niddui from Heaven {that he is not getting rain} is different in that it is more stringent?
Therefore, one placed in niddui from people is not required to wrap his head.

A mourner is forbidden to place tefillin, from the fact that the All-Merciful said to Yechezkel {same pasuk}:

17 Sigh in silence; make no mourning for the dead, bind thy headtire upon thee, and put thy shoes upon thy feet, and cover not thine upper lip, and eat not the bread of men.'
we deduce that for the rest of the {mourning} world, it is forbidden. And only for the first day {of mourning}, as we will need to say later on.

One placed in niddui, what is the law regarding tefillin?
The question stands {teku}.

A mourner is forbidden in asking greeting, from the fact that the All-Merciful said to Yechezkel {same pasuk}:
17 Sigh in silence; make no mourning for the dead, bind thy headtire upon thee, and put thy shoes upon thy feet, and cover not thine upper lip, and eat not the bread of men.'
One placed in niddui, may he ask greeting?
And they do not resolve.

A mourner is forbidden in words of Torah, for the All-Merciful said to Yechezkel {same pasuk}:

17 Sigh in silence; make no mourning for the dead, bind thy headtire upon thee, and put thy shoes upon thy feet, and cover not thine upper lip, and eat not the bread of men.'
One placed in niddui, may he learn Torah?
Rav Yosef said: Come and hear {a proof}: One placed in niddui may teach and they may teach him, may be hired and others may hire him. One placed in cherem {a more stringent class} may not teach and they may not teach him, may not be hired and they may not be hired by him. However {since the word is aval, not avel} he may learn by himself, so as not to lose {yafsid -- our gemara has yafsik, interrupt} his learning. And he makes a small shop for his livelihood.

{our gemara: and} Rav Chisda said: He sells water in the marketplace of Aravot.

We deduce from here that he is permitted in words of Torah.

A mourner is forbidden in washing clothes, for it is written {II Shmuel 14:2}
ב וַיִּשְׁלַח יוֹאָב תְּקוֹעָה, וַיִּקַּח מִשָּׁם אִשָּׁה חֲכָמָה; וַיֹּאמֶר אֵלֶיהָ הִתְאַבְּלִי-נָא וְלִבְשִׁי-נָא בִגְדֵי-אֵבֶל, וְאַל-תָּסוּכִי שֶׁמֶן, וְהָיִית, כְּאִשָּׁה זֶה יָמִים רַבִּים מִתְאַבֶּלֶת עַל-מֵת. 2 And Joab sent to Tekoa, and fetched thence a wise woman, and said unto her: 'I pray thee, feign thyself to be a mourner, and put on mourning apparel, I pray thee, and anoint not thyself with oil, but be as a woman that had a long time mourned for the dead;
One placed in niddui is forbidden in washing clothes, for they learnt {in a brayta}: Those placed in niddui and lepers are forbidden to have their hair cut and to wash their clothing.

A mourner is obligated in tearing {his clothing} for the All-Merciful said to the children of Aharon {Vayikra 10:6}:
6 And Moses said unto Aaron, and unto Eleazar and unto Ithamar, his sons: 'Let not the hair of your heads go loose, neither rend your clothes, that ye die not, and that He be not wroth with all the congregation; but let your brethren, the whole house of Israel, bewail the burning which the LORD hath kindled.
thus we deduce that for the rest of the {mourning} world, they are obligated.

Rav Tachlifa bar Avdimi cited Shmuel: A mourner who does not let his hair grow loose and his clothes rended is {figuratively} liable to death, for it is written {Vayikra 10:6}:
6 And Moses said unto Aaron, and unto Eleazar and unto Ithamar, his sons: 'Let not the hair of your heads go loose, neither rend your clothes, that ye die not, and that He be not wroth with all the congregation; but let your brethren, the whole house of Israel, bewail the burning which the LORD hath kindled.
{note that velo tamutu is also part of this derasha. we might read it thus: even though you, sons of Aharon, are not letting your hair loose and you are not rending your clothes, you still will not die -- others would in such a situation.}
Thus, someone else who did not let his hair grow loose and did not rend is liable to death.

Is one placed in niddui required to tear?
The question stands {teku}.

{Moed Katan 15b}

A mourner is obligated is turning of the bed. For bar Kapara taught {tna}: A similarity to My visage I have given in you, and for your sins you have turned it over. Therefore turn your beds over because of it.

One placed in niddui, is he required to turn over the bed?
The question stands {teku}.

And all tekus that we say in this matter are towards leniency {that we do not require it}.

Rif Moed Katan 7a {Moed Katan 13a - 14b}

7a

{Moed Katan 13a}

"And they do not bring vessels from the house of the craftsman, and if he is worried about them he may empty them out to another courtyard":
And these words are regarding vessels which are not for the purpose of the Moed, but vessels for the purpose of the Moed, they may bring.
For they learnt {in a brayta}: They may bring vessels which are for the purpose of the Moed from the house of the craftsman, such as pitchers from the house of the pitcher-maker and cups from the house of the glazier, but not wool from the dyeing house nor vessels from the craftsman, and if he has not what to eat, he gives him his wages and leaves it {the vessel} by him, and if he does not trust him, he places it in the house near him, and if he fears lest it be stolen, he may empty it out to another courtyard.

{Moed Katan 13b}
Mishna:

Dried figs may be covered with straw.
Rabbi Yehuda says: They may even be put in layers.

Dealers in fruit, garments, or utensils may sell discreetly what is required for the Moed. Huntsmen (fishers) and manufacturers of peeled barley and grits may carry on their occupations discreetly for the purpose of the Moed.
Rabbi Yossi says: They have adopted a stringency upon themselves {not to}.

Gemara:
The Sages learnt {in a brayta}: A shop which is opened to its portico, they open and close normally.
If it opens to the public domain, he opens one and closes one.
And erev the last day of Yom Tov of Succot, they bring out and adorn the market with fruits because of the honor of the last day of Yom Tov of Succot.

And when we said that he opens one and shuts one, this is for {a vendor of} fruit, but of spices, they sell in their normal fashion. For Rav Yehuda permitted those spice sellers of Pumpedita to go and sell in the market in their normal manner.

Mishna:
And these may shave {=get a haircut} on chol haMoed: One who comes from a country over the sea, and from captivity, or from prison,
{Moed Katan 14a}
and one who was placed in cherem who the Sages released, and also one who asked {regarding a vow} and was released, and the nazir and the leper, and one who arises from his ritual impurity to his state of purity.

Gemara:

And every other man is forbidden.
What is the reason? So that they shall not enter the festival in a disgraceful state.

"One who comes from an overseas country {meaning outside Eretz Yisrael}":
They learnt {in a brayta}: Rabbi Yehuda says: If one comes from an overseas country, he should not shave {get a haircut} because he left {Eretz Yisrael} without permission.

Rava said: To tour, all say it is forbidden to shave. For his livelihood, all say it is permitted. Where do they argue? For profit. Rabbi Yehuda compares it to touring and the Sages compare it to livelihood.
And we establish like the Sages.

Shmuel said: A minor {newborn} who is born on chol haMoed, it is permitted to give him a haircut on chol haMoed, since you have no greater prison than this.
On chol haMoed, yes, but from before {the Moed}, no.

{Moed Katan 14b}
Amemar and some say Rav Shisha son of Rav Iddi learned it as follows: Shmuel said: A minor, it is permitted to give him a haircut on chol haMoed, and it matters not whether he was born no the Moed or before.

Rif Moed Katan 6b {Moed Katan 12b; 13a; Pesachim 55b}

{Moed Katan 12b}
Mishna:

Gemara:
One may gather in his fruits because of thieves and remove his flax from the soak in order that it not be lost {ruined}, so long as he does not direct events such that his labor will be done on chol haMoed {but just if it happens to be so, it is allowed}, and in all cases, if they so direct their labor on chol haMoed, it should be lost.

A tanna taught: so long as he gathers them in discreetly to his house.

Rav Yosef had a certain pile of beams. He brought them in in the day.
Abaye said to him: But we learnt {in a brayta}: so long as he gathers them in discreetly within his house.
He {=Rav Yosef} said to him: The discreet conduct for these is in the day, for since in the night we need more men and need bonfires, it would have highlighted the matter.

{Moed Katan 13a}

"So long as he does not {deliberately} direct his work such that he ends up doing it on chol haMoed":
Rabbi Yirmiya inquired of Rabbi Zera: If he directs his work to be on chol haMoed and he dies, shall we fine his sons after him {and not let them perform the work}? If you find to say that if one disfigures the ear of a firstborn {animal} and then he {the one who did the disfiguring} died, they fine his sons after him, this is because it is a Biblical prohibition. And if you find to say that one who sells his servant to gentile and he {the seller} dies, they fine his sons after him, this is because every day he was taken away from performance of mitzvot. Here, what? Do the Sages fine the man himself, and he is no more, or do the Sages fine the money, and it is extant?
And we resolve: To him the Sages fined, while to his son they did not fine. And so too one who disfigures the ear of a firstborn {animal} and then dies, and one who sells his servant to a gentile and then dies, the Sages did not fine his sons after him.
And so do we resolve each of these in each place.
And so is the halacha.

Mishna:

They may not buy houses, servants, stones, nor animals, except for the purpose of the Moed, or for the needs of the seller who does not have what to eat.
One may not empty out one house into another house, but one may empty it into his courtyard.
And they do not bring back vessels from the house of the craftsman, and if he is worried about them, he may remove them to another courtyard.

Gemara:

Rava inquired from Rav Nachman: The wages of labor who does not have what to eat, what {is the law}?
That is to say: May one hire a laborer to perform some work which is not for the purpose of the Moed in order that the laborer take wish wages, so that he will have what to eat?
And we conclude that the wages of labor who does not have what to eat is permitted.

"And may not empty out one house into another house, but one may empty it into his courtyard":
{implying that he may bring from a house in another courtyard into his courtyard}
But the beginning stated that one may not empty at all {from one house to another}?
Abaye said: The end means that one may bring it to a house in the courtyard.
{and thus he may bring it from his house which is in the courtyard into his courtyard}

We learn in perek Makom sheNahagu {the fourth perek of Pesachim, on Pesachim 55b}:
The Sages learnt {in a brayta}: Fertilizer in a courtyard, they move it to the sides. In a barn and in a courtyard, they take it out to the garbage dump.
There is an internal contradiction You said that {by a courtyard} they move it to the sides, and then it returns and teaches that they move it to the dump.
And Rava answers: This is what is means to say: And if the courtyard becomes like a barn for cows, they take it out to the dump.
And so is the halacha.

Rav Yosef said: The halacha is like Rabbi Yossi.
They inquired of Rav Nachman bar Yitzchak? May one bung up a beer barrel on chol haMoed?
He said to them: Sinai {=Rav Yosef} said that the halacha is like Rabbi Yossi, who grants concern for loss, and beer also has an aspect of loss to it.

For Shmuel said: One may coat a jug with tar and may not coat a barrel with tar.

The Sages learnt {in a brayta}: They may grind flour on chol haMoed for the purpose of the Moed, but not for the purpose of the Moed is forbidden. And if he ground and there was left over, it is permitted. They may cut trees on chol haMoed for the purpose of the Moed, but not for the purpose of the Moed is forbidden. And if he cut and there was left over, it is permitted. They may brew beer on chol haMoed for the purpose of the Moed, but not for the purpose of the Moed is forbidden. And if he brewed and there was left over, it is permitted.

Rav had his field harvested on chol haMoed. Shmuel heard and was upset at him. Let us say that Shmuel holds like the individual opinion, for there is a brayta which states, "any thing which will be lost, it is permitted to do it on chol haMoed, and what will not be lost, it is forbidden; with regard to what are these words states? where it is separated from the ground, but where it is attached to the ground, even if it will all be lost, it is forbidden," and we establish that this is an individual opinion.
Another version: {or, if we remove the quote which transformed it into roshei teivot, we end up with לא as in our gemara - thus, No!} Rav harvested his wheat field {rather than barley field}, which if he did leave it, he would not have lost.
And Rav, why did he do so? He had nothing to eat. For they learnt {in a brayta - and perhaps importantly, in our gemara, this brayta is the continuation of this brayta that was just mentioned and assigned to be an individual, so even Shmuel should hold that it is allowed}: And if he does not have what to eat, he may harvest, pile up grain, thresh, winnow and grind, so long as he does not thresh with a cow on chol haMoed.
And Rav, why was he upset? The facts of the situation were not apparent to him. Alternatively, an important person {such as Rav} is different.

Rav Yehuda permits one to uproot {pick} flax on chol haMoed because it is fit for covering {food for the purpose of the Moed}, and to cut hopes, for it is useful for beer, and to uproot sesame, because they {the seeds} are fit for oil.

Rabbi Yannai had an orchard which required harvesting on chol haMoed and he did so. The next year, everyone else {took their cue from his action the previous year and} delayed their orchards until chol haMoed. Rabbi Yannai {was upset as what he had misled the masses into doing and} declared his orchard ownerless at that time.

Rabbi Yaakov bar Acha cited the Sages: Merchandise which will be lost, it is permitted to move it {say, turn it} during chol haMoed.
If there is a caravan, it is permitted to purchase from the on chol haMoed.

Rif Moed Katan 5b {Yerushalmi; Bavli Moed Katan 12a}

Yerushalmi:

Two brothers, two partners, two shopkeepers where something happened to one of them {namely, he became a mourner}, they shut up their shop.

{Why the Rif rules like this Yerushalmi which is apparently in conflict with cases in Bavli which he does not cite, especially given his statement at the end of Eruvin that we rule like Bavli over Yerushalmi, is an interesting topic, which has been discussed by Dr. Steinfeld.}

{Moed Katan 12a}

Shmuel said: Hiring {gentile} contractors within the techum is forbidden but outside the techum is permitted.
And we conclude: These words are regarding Shabbat and Yom Tov, where there is no town close to there, but on chol haMoed, even though there is no town close to there, since it is common that people go from place to place, it is forbidden.

The Sages learnt {in a brayta}: One may hire {gentile} contractors on chol haMoed to do it after the Moed, and on the Moed it is forbidden. The general principle of the matter it that anything that he may do, he may say to a gentile who will do it, and anything which he may not do, he may not say to a gentile to do it.
Another brayta: One may hire {gentile} contractors on chol haMoed to do it after the Moed, so long as he does not weigh, measure, or count in the way that he does during a weekday.

The Sages learnt {in a brayta}: One may not cause his animals to dwell in a field on chol haMoed {so as to have them fertilize it}.

To explain: They may not take sheep into a sheepfold to take their manure, and if they come of their own accord, it is permitted, and we do not assist them

Mishna:

If one has turned his olives and he suddenly becomes a mourner, or some accident, that his that his workers failed to show up, he presses the first pressing and then leaves it to after chol haMoed. These are the words of Rabbi Yehuda.
Rabbi Yossi says: He may put the olives into the oil-press and finish pressing them, and bung up the casks in the usual manner.

{Moed Katan 12a}
And so too, one whose wine was in the put, and he suddenly becomes a mourner, or some accident, or that his that his workers failed to show up, he may put the olives into the oil-press and finish pressing them, and bung up the casks in the usual manner. These are the words of Rabbi Yossi.
Rabbi Yehuda says: He constructs boards to cover it so that it does not turn sour.

It began with mourning and ended with chol haMoed?
Rav Shisha son of Rav Idi said: This says that things which are permitted on chol haMoed are forbidden for a mourner to perform during his days of mourning, but rather others should do them for him.
A brayta in accordance with Rav Shisha son of Rav Idi: Things which are permitted on chol haMoed are forbidden for a mourner to perform during his days of mourning, such as olives to turn, his cask bunged, his flax to be taken from the soaking container, his wool to be taken from the boiler. They water his field when his time of water comes. And the sharecroppers {for a portion of the yield}, contractors {for a fixed amount of crop}, and contractors {for a fixed time} they should do work. The donkey drivers, camel drivers, and sailors of his should not work {should not hire out}. And if they sharecrop by other, are pledged or hired by others initially, they may do.

One hired for the day, even in another city, should not do {work}. If the work of others was in his hand, whether contracted or not, he should not do it. If the work was in his house, in the hands of others, they should not do it. In another house, they may do it.

Ravina was owed money from the residents of Akra deSenuata. He came before Rav Ashi, and said to him: May I go the them now {and collect}?

Gemara:

"They do not dig burial caves and graves on chol haMoed":
To explain: To bury within them after chol haMoed.
What are caves and what are graves?
Rav Yehuda said: "caves" are done with digging and "graves" and done with building.
A brayta also says so: "caves" are done with digging and "graves" and done with building.

"But we may prepare {alter} the burial caves":
Prepare, how so?
Rav Yehuda said: That is it was long we shorten it.
In a brayta it taught: He elongates it and broadens it.

"And a casket, with the corpse in the courtyard":
We learnt {in a brayta} this, for the Sages learnt: All the needs of the corpse {we perform on chol haMoed} - we cut his hair, wash his garment, and construct a casket for him, and specifically from boards that were made into boards from erev Yom Tov.
Rabban Shimon ben Gamliel says: He may even bring boards and make them into boards within his house.

And the halacha is like Rabban Shimon ben Gamliel, for our plain Mishna is in accordance with him.

Yerushalmi:
They only taught this regarding a man who is not well known, but a man of renown, they make him a casket, even in the market.
When Rabbi Chanina passed away, the Sages made him a casket in the market.
And all agree that he should not cut for him cedars, and similarly, they should not quarry for him stones, and if they were already quarried, this is a dispute between Rabbi Yehuda and the Sages.

Mishna:
We do not marry {this is nisuin, the second stage after kiddushin} women on chol haMoed, not virgins nor widows, nor do we perform levirate marriage, for it is a joy to him. However, he may remarry his divorced wife; and a woman may make her adornments {do beauty care} on chol haMoed.
Rabbi Yehuda says: A woman may not apply lime because it is makes her appear unsightly {for the time}.

Gemara:

"For it is a joy to him":
And if it is a joy to him, what does that matter?
Rav Yehuda cited Shmuel: Because we do not mix one joy with another joy.

And Rav Daniel bar Katina cited Rav: Why do we not marry women on chol haMoed? Because it is written "and you shall rejoice in {/on} your Festival" -- in your festival and not in your wife.

Ulla said: This is the reason that we do not marry women on chol haMoed - because of the difficulty {/effort}.
Rabbi Yitzchak Nafcha said: Because of nullification of being fruitful and multiplying {as one will postpone his wedding to make it fall out on chol haMoed.}

They learnt {in a brayta}: All that they said that it is forbidden to marry a woman on chol haMoed, they are permitted to marry erev the Festival. (to explain) for for {a span of} one day, a man will not hold himself back.

{Moed Katan 9a}

And that we do not mix one joy with another joy, from where do we know this? For it is written {I Kings 8:65}:
65 So Solomon held the feast at that time, and all Israel with him, a great congregation, from the entrance Hamath unto the Brook of Egypt, before the LORD our God, seven days and seven days, even fourteen days.
Let us see. It is written "fourteen days." "Seven days and seven days" why do I need? Rather we derive from this that these were alone and these were alone.

It is written {next verse}
66 On the eighth day he sent the people away, and they blessed the king, and went unto their tents joyful and glad of heart for all the goodness that the LORD had shown unto David His servant, and to Israel His people.
{That was the 8th day of the second round of fesitivities, making it the 22nd day}

And it is written {II Chronicles 7:10}
10 And on the three and twentieth day of the seventh month he sent the people away unto their tents, joyful and glad of heart for the goodness that the LORD had shown unto David, and to Solomon, and to Israel His people.
{making it the 23rd day}
From here we deduce that a student who takes leave of his teacher and then sleeps overnight in that city, that he needs to take leave a second time.

{Moed Katan 9b}

"And a woman may make all her adornments {beauty care} on chol haMoed":
They Sages learnt {in a brayta}: These are the beauty cares of a woman {that she may thus do on chol haMoed} -- she applies kohl {to darken the rims of the eyelids}, arranges here hair, and puts rouge on her face.
And some some, and she shaves her pubic region.

{Moed Katan 8b}
Mishna:

An unskilled person may son normally {on chol haMoed} and a craftsman may machliv {like a kelev, a dog -- to be defined}.
And they may twine the ropes of beds.
Rabbi Yossi says: They may also {our Mishna omits af} tightened.

{Moed Katan 10a}
Gemara:

What is the definition of an unskilled person? Whoever is not able to bring out the entire needle at one time {thus performing several stitches as it goes in and out}.
Rabbi Yossi says: Whoever is not able to to make the hem even.

Rif Moed Katan 3a {Moed Katan 7a continues; 8a - 8b}

3a

{Moed Katan 7a continues}
Mishna:

Rabbi Meir says: They see the afflictions {such as leprosy} on chol haMoed initially to be lenient {to declare him clean} but not to be stringent.
And the Sages say: Not to be lenient nor to be stringent.

{Moed Katan 8a}
And Rabbi Meir further said: He may collect the bones of his father or mother {for reburial} because it is a joy for him.
Rabbi Yossi says: It is a source of mourning for him.
And he may not stir up for his dead relative, nor may he eulogize before the Festival 30 days.

Gemara:

And we establish that Rabbi Meir against Rabbi Yossi, the halacha is like Rabbi Yossi.

"And he may not stir up for his dead relative, etc.":
Why specifically 30 days?
Rav Kahana said: There was an incident with one may who gathered his money to go on a pilgrimage for the Festival, and a eulogizer for hire came and stood on his doorstep, and his wife took them {the money} and gave them to him {the eulogizer}, and this man was prevented from making the Festival pilgrimage. At that time, they said that one should not stir up for his dead relative {via a hired eulogizer} nor make a eulogy before the Festival for 30 days.
And Shmuel saud: Because the corpse is not forgotten from the heart except after 30 days.
What is the point of practical distinction between them? Where the eulogizer works for free.

{Moed Katan 8b}
Mishna:

They do not dig burial caves or graves on chol haMoed, but they can "prepare" {by altering} the burial cave, and they may make a laundering pool on chol haMoed, and a casket with the corpse present in the courtyard.
Rabbi Yehuda forbids unless there are boards with him.

Rif Moed Katan 2b {Moed Katan 6b continues; 7a}

{Moed Katan 6b continues}

And it is logical that the halacha is in accordance with Rabbi Eliezer ben Yaakov, even though he is an individual against the majority {Chachamim}, for the statement of Rav Yehuda goes in accordance with him, for he said "and if it was a moist field it is permitted."

And this that Ravina deduced from it and says "we deduce from here that it is permitted to lightly water a garden on chol haMoed -- we ask on him - a dry field {which is still a bet habaal, but water has not fallen on it for a long time}, why not? It makes the produce quick to ripen. Here too, it makes the produce quick to ripen. And he does not answer.

Mishna:
One may trap moles and nice in a field of trees and in a field of wheat in its normal way on both chol haMoed and Sheviit.
Rabbi Yehuda says: In a field of trees, in its normal way {because they can truly damage trees} and in a wheat field, not in its normal way.
And they fix the gap {in a fence) on chol haMoed, while on Sheviit, he may build in a normal way.

Gemara:

What are אישות {moles}?
Rav Yehuda said: A creature that lacks eyes.

{Moed Katan 7a}

"Rabbi Yehuda says: In a field of trees in its normal way":
The Sages learnt {in a brayta}: How so "in its normal way?" He digs a ditch and suspends in it a trap.
And how so not in its normal way? He drives a spit {into the ground} and hits it {either the spit, or the ground} with a shovel and softens the earth underneath it.

They learnt {in a brayta}: R' Shimon ben Eleazar says: When they said "in a field of wheat in its normal way," they only said this regarding a wheat field next to trees, lest they leave the wheat field and destroy the trees.

"And he repairs the breach":
How does he repair the breach?
Rav Yosef says: With palm leaves and laurel branches.
In a brayta they taught: He piles stones but does not use mortar.

Rav Chisda said: They only taught this regarding a garden wall, but the wall of a courtyard he may build in its normal way.
And this is specifically building, but not taking down.
But a leaning wall, he may take down and then build up. As they learnt {in a brayta}: a leaning wall, he may take down and then build up in its normal way because of the danger.

Rabbi Abahu said: That if it was {became} one handbreadth deep, he may restore it to six handbreadths.
Abaye permitted the residents of Bei Harmach to clear the river or tree branches.
Rabbi Yirmiya permitted the residents of Sukota to clear a blocked up river source.
Rav Ashi permitted the residents of Mata Mechasia to clear silt out of the river. He said: Since the public "drinks" {benefits} from it, it is like "the public," and we learnt {in the Mishna}: they do all needs of the public.

{Moed Katan 5a}

"And they fix the reservoirs in the public domain, and clean them":
Cleaning, yes. {Implying} Digging, no.
R' Yaakov cited Rabbi Yochanan: They only taught this regarding cases where the public did not need them, but where the public needed them, even digging is also permitted.
And the same is true for pits, ditches and cisterns of the public.
And pits, ditches and cisterns of an individual, they may cleanse them and plaster the cracks, but they may not dig, even where the individual requires them. And if he does not require them, they do not cleanse them nor plaster their cracks, and it need not be said that they may not dig. However, they may gather water in them, even though he does not need them.

The Sages learnt {in a brayta}: They go out to remove thorns from the roads and to fix the streets and plazas, and to measure the ritual immersion baths.
Any mikveh which does not have 40 seah, they cause 40 seah to flow into it.
And from where to we know that if they do not go out and do all this, that all blood which is spilt there is reckoned by Scripture to be spilt by them? For it is written {Devarim 19:10}:
י וְלֹא יִשָּׁפֵךְ, דָּם נָקִי, בְּקֶרֶב אַרְצְךָ, אֲשֶׁר ה אֱלֹקֶיךָ נֹתֵן לְךָ נַחֲלָה; וְהָיָה עָלֶיךָ, דָּמִים. {פ} 10 that innocent blood be not shed in the midst of thy land, which the LORD thy God giveth thee for an inheritance, and so blood be upon thee. {P}

And even in case of monetary loss, we do not overexert ourselves. For they teach {in the Mishna}: but not with rainwater nor with water of kilon {a deep well}.
To explain kilon, such as a gutter.
{Moed Katan 4a}
This is fine for a kilon, for there is indeed overexertion, for you need to water by drawing from it, but by rainwater, what effort is there?
Rabbi Eleazar cited Rabbi Yochanan: As a decree on rainwater because of water of a kilon.
Rav Ashi said: Rainwater will also come to water of a kilon.

The Sages learnt {in a brayta}: Different types of pools of water {perhaps bereicha is a pool of water and pesika has an additional connotation of stopping flow intermittently, as we just read והוא דלא פסקי -- but then the seifa would be difficult, though resolvable} which are filled with water from erev Yom Tov, it is forbidden to water from them on chol haMoed. And if a channel runs under them, it is permitted.
Rav Pappa said: And this is where most of this field drinks from this channel of water.

{Moed Katan 2a}
Mishna:

"We water fields that need constant irrigation {even on chol haMoed}":

{Chagiga 18a}
Gemara:
The Sages learnt {in a brayta}:
{Shemot 23:15}:
טו אֶת-חַג הַמַּצּוֹת, תִּשְׁמֹר--שִׁבְעַת יָמִים תֹּאכַל מַצּוֹת כַּאֲשֶׁר צִוִּיתִךָ לְמוֹעֵד חֹדֶשׁ הָאָבִיב, כִּי-בוֹ יָצָאתָ מִמִּצְרָיִם; וְלֹא-יֵרָאוּ פָנַי, רֵיקָם. 15 The feast of unleavened bread shalt thou keep; seven days thou shalt eat unleavened bread, as I commanded thee, at the time appointed in the month Abib--for in it thou camest out from Egypt; and none shall appear before Me empty;
This teaches regarding chol haMoed that it is forbidden in performing of labor. These are the words of Rabbi Yoshiya. Rabbi Yonatan says: As a kal vachomer. If the first and seventh day {of Pesach} which have no holiness before them or after them are forbidden in performing of labor, then chol haMoed which has holiness before them and after them, shouldn't they certainly be forbidden in performing of labor?
The six days of {the week} creation will disprove this, for they have holiness before them {Shabbat} and after them {Shabbat} and they permitted in performing of labor!
But the six days of creation do not have a mussaf sacrifice, while we say by chol haMoed which has a mussaf sacrifice {and so the previous kal vachomer is in force}.
Rosh Chodesh will disprove this, for it has a mussaf sacrifice and it is permitted in performing of labor.
But Rosh Chodesh is not called a Mikra Kodesh, while we say by chol haMoed that is is called a Mikra Kodesh {and so the previous kal vachomer is in force}. Since it is called a mikra Kodesh, it should by all means be forbidden in performing of labor.

Another brayta: {Vayikra 23:7}:
7 In the first day ye shall have a holy convocation; ye shall do no manner of servile work.
This teaches regarding chol haMoed that it is forbidden in performance of labor. These are the words of Rabbi Yossi haGelili.
Rabbi Akiva says: We do not need this {derasha}, for it states {Vayikra 23:4}:
4 These are the appointed seasons of the LORD, even holy convocations, which ye shall proclaim in their appointed season.
About what is this verse speaking? If about the first day, it was already stated Shabbaton, and if about the eighth day, it was already stated Shabbaton. Thus, the verse only speaks about chol haMoed, that it is forbidden in performance of labor.

Another brayta stated: {Devarim 16:8}
ח שֵׁשֶׁת יָמִים, תֹּאכַל מַצּוֹת; וּבַיּוֹם הַשְּׁבִיעִי, עֲצֶרֶת לַָה אֱלֹהֶיךָ--לֹא תַעֲשֶׂה, מְלָאכָה. {ס} 8 Six days thou shalt eat unleavened bread; and on the seventh day shall be a solemn assembly to the LORD thy God; thou shalt do no work therein. {S}
Just as the seventh is a stoppage {of work}, so too the six days are a stoppage.
{So why not say:} Just as the seventh is a stoppage of all work, so too the six days are a stoppage of all work?
Therefore it informs us the seventh {day}. The seventh is a stoppage of all work, and the six days are not a stoppage of all work.
Thus, the Scriptures were only given over to the Sages to tell you which day is forbidden and which day is permitted, which labor is forbidden and which labor is permitted.

{Moed Katan 2a}
As we learned {in the Mishna}: We water fields that require constant irrigation on chol haMoed and during the Sabbatical year, whether from a newly sprung spring or from a non-newly sprung spring, but we do not water with rainwater nor with water from a deep well, nor do we make irrigation ditches around vines.

What implies that these bet hashilhin connotes parched land? As is written {Devarim 25:18}:
18 how he met thee by the way, and smote the hindmost of thee, all that were enfeebled in thy rear, when thou wast faint and weary; and he feared not God.
{where עיף was shown in masechet Yoma to mean parched}
and we translate
And what implies that Bet haBaal means settled fields? As is written {Yeshaya 62:5}:
5 For as a young man espouseth a virgin, so shall thy sons espouse thee; and as the bridegroom rejoiceth over the bride, so shall thy God rejoice over thee.
and we translate כמה דמיתותב עולם עם בתולתא כן יתותבון בגויך בנייכי {with דמיתותב and יתותבון as translations}.

Parched fields yes, but settled fields no.
What is the reason?

Rif Megillah 16b {Megillah 25b continues; Tosefta; END MASECHTA}

16b

{Megillah 25b continues}

And the Chariot, they read it to the public. The incident with Reuven is read but not translated.
There was an incident with Rabbi Chanina ben Gamliel that he went to Cabul, and he read {Bereishit 35:22}
כב וַיְהִי, בִּשְׁכֹּן יִשְׂרָאֵל בָּאָרֶץ הַהִוא, וַיֵּלֶךְ רְאוּבֵן וַיִּשְׁכַּב אֶת-בִּלְהָה פִּילֶגֶשׁ אָבִיו, וַיִּשְׁמַע יִשְׂרָאֵל; {פ}

22 And it came to pass, while Israel dwelt in that land, that Reuben went and lay with Bilhah his father's concubine; and Israel heard of it. {P} Now the sons of Jacob were twelve:
and he told the translator "only translate the last part," and the Sages praised him.

The second account of the incident of the Golden Calf should be read but not translated.
To explain, because of the honor of Aharon.
And this is the second account of the incident of the Golden Calf: From {Shemot 32:21}
21 And Moses said unto Aaron: 'What did this people unto thee, that thou hast brought a great sin upon them?'
until {verse 25}:
25 And when Moses saw that the people were broken loose--for Aaron had let them loose for a derision among their enemies--
until {verse 35}:
לה וַיִּגֹּף ה, אֶת-הָעָם, עַל אֲשֶׁר עָשׂוּ אֶת-הָעֵגֶל, אֲשֶׁר עָשָׂה אַהֲרֹן. {ס} 35 And the LORD smote the people, because they made the calf, which Aaron made. {S}

"The blessing of the priests is read but not translated":
What is the reason? Because of Yisa Hashem Panav Eilecha {which might be interpreted as showing partiality}.

The incident with David and Amnon is not read and not translated. But you said {earlier} that the incident of Amnon and Tamar is read and translated. This is no question. Here is where it is written Amnon son of David {where we may not read}, while here is where is simply is written Amnon.

The Sages learnt {in a brayta}: All the verses written in the Torah negatively, we read them towards praise {/good = a sort of Bowdlerization}. {Devarim 28} ישגלנה becomes ישכבנה {both mean sleep with, but ישגלנה has a cruder aspect to it}. {Devarim 28} בעפולים becomes בטחורים {both are hemorrhoids, but the former is cruder}. {II Kings 6}:
25 And there was a great famine in Samaria; and, behold, they besieged it, until an ass's head was sold for fourscore pieces of silver, and the fourth part of a kab of dove's dung for five pieces of silver.
{II Kings 18}:
27 But Rab-shakeh said unto them: 'Hath my master sent me to thy master, and to thee, to speak these words? hath he not sent me to the men that sit on the wall, to eat their own dung, and to drink their own water with you?'
{II Kings 10}:
27 And they broke down the pillar of Baal, and broke down the house of Baal, and made it a draught-house, unto this day.
Rabbi Yehoshua ben Korcha said: למחראות should be sustained as the reading, for it is to the disgrace of idolatry.
For Rav Nachman said: All mocking is forbidden, except for mocking of idolatry, which is permitted, for it is written {Yeshaya 46}:
1 Bel boweth down, Nebo stoopeth; their idols are upon the beasts, and upon the cattle; the things that ye carried about are made a load, a burden to the weary beast.
ב קָרְסוּ כָרְעוּ יַחְדָּו, לֹא יָכְלוּ מַלֵּט מַשָּׂא; וְנַפְשָׁם, בַּשְּׁבִי הָלָכָה. {פ} 2 They stoop, they bow down together, they could not deliver the burden; and themselves are gone into captivity. {P}

Rabbi Yannai said: From here {Hoshea 10}:
5 The inhabitants of Samaria shall be in dread for the calves of Beth-aven; for the people thereof shall mourn over it, and the priests thereof shall tremble for it, for its glory, because it is departed from it.
Read not its kevodo {its glory} but rather keveido {its excrement - so Rashi}. {it seems that Rif interprets this otherwise:}
That is to say, it is as if its liver{כבד} was taken and its desire was nullified {for in Hellenic medicine, the liver is the seat of desire} and nothing at all helps it, and this is a language of mockery.

Rav Huna bar Munach cited Rav Acha son of Rav Ikka: It is permitted for an Israelite to tell an idolater "take the idol and place it in your Shin Tav {buttocks}."
And someone about whom evil reports are heard, it is permitted to disgrace him with Gimel and Shin.
To explain: son of a maidservant {Shifcha}, son of a female convert {Giyoret}.
And {similarly,} we learn in Sanhedrin, in accordance to whom do we call an evildoer son of a righteous man an evildoer son of an evildoer? Like this tanna, etc....
{Others explain Gimel Shin differently.}

Tosefta:
That which is written to the plural, one may not paraphrase it to singular; singular, one may not paraphrase it to plural.
Rabbi Yehuda says: If one translates a verse according to its form {literally}, he is a liar, and if one adds, he is a blasphemer.

{Ran gives this illustrative example: Shemot 24:10
10 and they saw the God of Israel; and there was under His feet the like of a paved work of sapphire stone, and the like of the very heaven for clearness.
Translating literally like that of the JPS translation above -- "and they saw the God of Israel" -- one is a liar, for they did not actually see Hashem.
Adding things, for example, translating it "and they saw the angels of Hashem, God of Israel, and the bottom of his throne of glory {perhaps this last is a translation of וְתַחַת רַגְלָיו} -- one is a blasphemer, for he equated the honor of the Master {Hashem} with the honor of His servant {the angels}.
Rather, translate like Onkelos -- and they saw the honor of Hashem God of Israel.
}

A translator {or repeater who restates things loudly} who stands before the Sages is not permitted to take away, add, or change, unless he {the one he is acting as turgeman for} is his father or teacher.
