25b

{Bava Kamma 61b}
Gemara:

ואקשינן למימרא דלית ליה לרבי שמעון שיעורא לפטור
והא תנן רבי שמעון אומר לא נאמרו כל השיעורים האלו אלא שאם הזיק יהא פטור מלשלם
כלומר כיון שאמר רבי שמעון הכל לפי הדליקה מראין דבריו שאין לרבי שמעון שיעור לפטור
אלא אם עברה הדליקה והזיקה חייב בין עברה הרבה בין עברה מעט ונמצא שאין לו שיעור לפטור
ושנינן אמר רב נחמן אמר רבה בר אבוה אמר רב הכל לפי גובהה של דליקה
כלומר שלא אמר רבי שמעון הכל לפי מה שתעבור הדליקה לפניה ותדליק אלא הכל לפי גובהה של דליקה קאמר שאם תעבור יתר מן הראוי לה לגבהה פטור ואם לא עברה אלא כראוי לגבהה והזיקה חייב
והא אית ליה לר' שמעון שיעורא לפטור ולא קשיא דידיה אדידיה:
And we ask on the statement that Rabbi Shimon does not maintain that there is some fixed limit in the case of Fire to exempt? For behold we learnt {tnan}: Rabbi Shimon says that these limits were only to intimate that if damage resulted there should be exemption from paying.
That is to say that since Rabbi Shimon said that all depends on the fire, his words appear to state that Rabbi Shimon does not hold that there is a limit for the purpose of exemption, but rather, if the fire traveled and damaged, he is liable, whether it traveled a lot or it traveled a litted. And thus, there is no fixed limit for the purpose of exemption.
And we learn: Rav Nachman cited Rabba bar Avuah who cited Rav: All is according to the height of the fire.
That is to say, that Rabbi Shimon did not say that all is according to what the fire traveled before it and lit, but rather he was saying that all is according to the height of the fire, that is it traveled farther that what was to be expected for its height, he is exempt, and if it only traveled as much as would be expected for its height, and it damaged, he is liable.
And thus, Rabbi Shimon does maintain a limit for the purposes of exemption, and there is no contradiction between himself and himself.

Rav Yosef cited Rav Yehuda who cited Shmuel: The halacha is like Rabbi Shimon.
And if it is a question to you, why is it different there by an over, that the Sages gave a limit, and even though, if it damaged, he pays that which it damaged, in contrast to here, where he is exempt -- this should not be problematic to you here, for according to the needs of the time he lit, and he distanced the appropriate measure, and the fire traveled more than that measure and damaged, it is accidental, for what was there for him to do? Therefore, it is a stroke from the hands of Heaven, and therefore, he is exempt, for he was not able to stop it. But there, by the over, since he is always lighting, he needed to watch out, if there was a damage to his fellow, he would remove the damage. And since he did not do so, he is negligent, and therefore he is liable.
Know this {is so}, for behold the Sages argue upon Rabbi Shimon by the oven, where he gave a measure to the exemption, whereas here, they themselves give a measure to the exemption.

Mishna:
המדליק את הגדיש והיו בו כלים ונדלקו רבי יהודה אומר ישלם כל מה שבתוכו וחכמים אומרים אינו משלם אלא גדיש של חטים או גדיש של שעורים:
IF A MAN SETS FIRE TO A STACK OF GRAIN IN WHICH THERE HAPPEN TO BE ARTICLES AND THESE ARE BURNT, RABBI YEHUDA SAYS THAT PAYMENT SHOULD BE MADE FOR ALL THAT WAS THEREIN, WHEREAS THE SAGES SAY THAT NO PAYMENT SHOULD BE MADE EXCEPT FOR A STACK OF WHEAT OR FOR A STACK OF BARLEY.

היה גדי כפות לו ועבד סמוך לו ונשרף עמו חייב

[WHERE FIRE WAS SET TO A BARN TO WHICH] A GOAT HAD BEEN FASTENED AND NEAR WHICH WAS A SLAVE [LOOSE] AND ALL WERE BURNT WITH THE BARN, THERE WOULD BE LIABILITY.
IF, HOWEVER, THE SLAVE HAD BEEN CHAINED TO IT, AND THE GOAT WAS LOOSE NEAR BY IT, AND ALL WERE BURNT WITH IT, THERE WOULD BE EXEMPTION.
THE SAGES, HOWEVER, AGREE WITH RABBI YEHUDA IN THE CASE OF ONE WHO SET FIRE TO A CASTLE THAT THE PAYMENT SHOULD BE FOR ALL THAT WAS KEPT THEREIN, AS IT IS SURELY THE CUSTOM OF MEN TO KEEP [VALUABLES] IN [THEIR] HOMES.

Gemara:
תנו רבנן המדליק את הגדיש והיו בו כלים ונדלקו ר' יהודה אומר ישלם כל מה שבתוכו וחכמים אומרים אינו משלם אלא גדיש של חטים או גדיש של שעורים ורואין מקום כלים כאילו מלא תבואה

The Sages learnt {in a brayta}: If a man set fire to a stack of grain in which there were utensils and they were burnt, Rabbi Yehuda says that payment should be made for all that was stored there, whereas the Sages say that no payment should be made except for a stack of wheat or for a stack of barley, and that the space occupied by the utensils has to be considered as if it was full of grain. {Bava Kamma 62a} Where are these words said? Where he kindled the fire on his own premises from where it traveled and consumed {the stack standing} in the premises of his neighbor; but where he kindled the fire in the premises of his neighbor, he would have to pay for all that was kept there. And Rabbi Yehuda admits to the Sages by the case where a man granted his neighbor the loan of a particular place for the purpose of piling up a stack, if he {=the borrower} piled up stacks and hid {something in them}, no payment would have to be made except for the value of the stack alone. But if he lent him the place for piling up stacks of wheat, and he piled up stacks of barley, or barley and he piled up wheat, or even where he piled up wheat but covered it with barley, or again where he piled up barley but covered it with wheat; no payment would be made except for the value of the barley alone.

אמר רבא הנותן דינר זהב לאשה ואמר לה הזהרי בו של כסף הוא הזיקתו משלמת של זהב משום דאמר לה מאי הוה לך גביה דאזיקתיה
פשעה ביה משלמת של כסף משום דאמרה ליה נטירותא דכספא קבילת עלי נטירותא דדהבא לא קבילת עלי:
Rava said: If a man gave a gold dinar to a woman and said to her 'Be careful with it, as it is a silver coin', if she damaged it she would have to pay for a gold dinar because he could plead against her: 'What business had you to damage it?'If she was {merely} negligent with it {and it was damaged}, she would have to pay only for a silver dinar, as she could plead against him: 'It was only silver that I undertook to take care of, but I never undertook to take care of gold.'

אמר רב שמעית מילתא לרבי יהודה ולא ידענא מאי היא
אמר שמואל ולא ידע אבא מאי שמיע ליה לר' יהודה דמחייב על נזקי טמון באש
עשו תקנת נגזל באשו דמשתבע ושקיל כדתנן ואלו נשבעין ונוטלין הנגזל וכו':א
Rav said: I heard a matter regarding Rabbi Yehuda, and I do not know what it is.
Shmuel said: Does Abba {=Rav} really not know what he heard regarding Rabbi Yehuda who imposes liability for damage done to Hidden items in the case of Fire? It is that the judges must make the ordinance enacted for the benefit of a robbed person for the fire, {namely} that he may swear {how much he lost} and take, and we learn {in a Mishna}, "and these are the ones who swear and take, the robbed person, etc."

There was a certain person who cut down a date-palm of his neighbor. He came before the Exilarch. He said to him: 'I myself saw the place; three date-trees stood close together in one nest and they were worth one hundred zuz. Go therefore and pay the other party thirty-three and a third {zuz}. He {=the defendant} said to the Exilarch: 'What have I to do with an Exilarch who judges in accordance with Persian Law?'
He came before Rav Nachman. He {=Rav Nachman} said: In conjunction with 60 {times as much}.

{Bava Kamma 59a}
רב פפא ורב הונא בריה דרב יהושע עבדו עובדא כוותיה דרב נחמן בששים
איכא דאמרי הכי שמין דיקלא אגב קטינא דארעא בששים
והלכתא כוותיה דרב פפא בדילקא ארמאה
והלכתא כוותיה דריש גלותא בדיקלא פרסאה:
Rav Pappa and Rav Huna son of Rav Yehoshua acted in practice like Rav Nachman, in conjunction with 60. Some say so did they assess palmtree in conjunction with the small piece of ground, in conjunction with 60 {times as much}.
And the halacha is like Rav Pappa by an Aramean palm, and the halacha is in accordance with the Exilarch by a Persian palm.

{Bava Kamma 59b}
רבי שמעון אומר אם אכלה פירות גמורין וכו'
מ"ט כי אמר רחמנא ובער בשדה אחר
מלמד ששמין על גב שדה אחרת
הני מילי דצריך לשדה אבל הני כיון דלא צריכין לשדה בעיניהו בעי שלומי:
"RABBI SHIMON SAYS: IF IT CONSUMED RIPE FRUITS...":
What is the reason? The All-Merciful said: {Shemot 22:4}:
ד כִּי יַבְעֶר-אִישׁ, שָׂדֶה אוֹ-כֶרֶם, וְשִׁלַּח אֶת-בְּעִירֹה, וּבִעֵר בִּשְׂדֵה אַחֵר--מֵיטַב שָׂדֵהוּ וּמֵיטַב כַּרְמוֹ, יְשַׁלֵּם. {ס} 4 If a man cause a field or vineyard to be eaten, and shall let his beast loose, and it feed in another man's field; of the best of his own field, and of the best of his own vineyard, shall he make restitution. {S}
This teaches that we assess based on another field. These words are where they are in need of a field, but here, since they do not need a field {since they are ripe}, they must be compensated at their actual value.

דן כרבי מאיר כי הא דתנן כתבה לראשון ולא חתמה לו לשני וחתמה לו איבדה כתובתה דברי רבי מאיר רבי יהודה אומר יכולה היא שתאמר נחת רוח עשיתי לבעלי אתם מה לכם עלי
ופסק כרבי שמעון מהא דתנן רבי שמעון אומר אכלה פירות גמורין משלם פירות גמורין אם סאה סאה ואם סאתים סאתים:
Rav Huna bar Chiya cited Rabbi Yirmeyah bar Abba: Rav judged like Rabbi Meir and ruled halacha like Rabbi Shimon.
He judged like Rabbi Meir, as in this which we learn {in a Mishna}: If the husband drew up a deed for a would-be purchaser {of a field which had been set aside for the payment of the marriage settlement of his wife} and she did not endorse it, and {when a deed on the same field was drawn up} for another purchaser she did endorse it, she has thereby lost her claim to the marriage settlement; These are the words of Rabbi Meir. Rabbi Yehuda says: She might still argue, 'I made the endorsement merely to gratify my husband; why therefore should you go against me?'
And he ruled the halacha in accordance with Rabbi Shimon, from this that we learnt {tnan}: RABBI SHIMON SAYS: IF IT CONSUMED RIPE FRUITS, THE PAYMENT SHOULD BE FOR RIPE FRUITS, IF ONE SE'AH [IT WOULD BE FOR] ONE SE'AH, IF TWO SE'AHS, [FOR] TWO SE'AHS.

Mishna:
המגדיש בתוך שדה חבירו שלא ברשות ואכלתן בהמתו של בעל השדה פטור ואם הוזקה בהן בעל הגדיש חייב ואם הגדיש ברשות בעל השדה חייב
IF A MAN PUTS HIS STACKS OF GRAIN IN THE FIELD OF ANOTHER WITHOUT PERMISSION, AND THE ANIMAL OF THE OWNER OF THE FIELD EATS THEM, THERE IS NO LIABILITY. MOREOVER, IF IT SUFFERED HARM FROM THEM, THE OWNER OF THE STACKS WOULD BE LIABLE. IF, HOWEVER, HE PUT THE STACKS THERE WITH PERMISSION, THE OWNER OF THE FIELD WOULD BE LIABLE.

Gemara:
לימא תנן סתמא דלא כרבי דאי כרבי הא אמר עד שיקבל עליו בעל הבית לשמור
אמר רב פפא הכא בנטר בי דרי עסקינן דכיון דא"ל עייל עייל ואנטר לך קאמר ליה
May we say that this Mishnah states plainly {stam} not in accordance with Rabbi? For if like Rabbi, behold he said "unless the owner of the premises explicitly took upon himself to safeguard {he would not be liable}."
Rav Pappa said: Here we are dealing with the watchman of the barns. For since he said, 'Enter and place your stacks', it surely amounted to, 'Enter and I will guard for you'.

Mishna:
השולח את הבערה ביד חרש שוטה וקטן פטור מדיני אדם וחייב בדיני שמים שלח ביד פקח הפקח חייב:

IF A MAN SENT OUT SOMETHING BURNING THROUGH A DEAF MUTE, AN IDIOT, OR A MINOR [AND DAMAGE RESULTED] HE WOULD BE EXEMPT FROM THE JUDGMENTS OF MAN, BUT LIABLE IN ACCORDANCE WITH THE JUDGMENTS OF HEAVEN. BUT IF HE SENT [IT] THROUGH A NORMAL PERSON, THE NORMAL PERSON WOULD BE LIABLE.

IF ONE PERSON [FIRST] SUPPLIES THE FIRE AND ANOTHER THE WOOD, HE WHO SUPPLIES THE WOOD WOULD BE LIABLE.
WHERE, [ON THE OTHER HAND], THE FIRST SUPPLIES THE WOOD AND THE SECOND THE FIRE, HE WHO SUPPLIES THE FIRE WOULD BE LIABLE.
BUT WHERE ANOTHER PERSON CAME ALONG AND FANNED THE FLAME, THE ONE WHO FANNED IT WOULD BE LIABLE.
IF IT WAS THE WIND THAT FANNED IT, ALL WOULD BE EXEMPT.

ואיכא מאן דאמר כיון דלא אשכחן לחזקיה דפליג בהדי רבי יוחנן הלכתא כרבי יוחנן:
Resh Lakish said in the name of Chizkiyah: They only learned this {ruling in the Mishna} where he handed over a {flickering} coal to {the deaf mute} who fanned it into flame, but if he handed over to him something already in flame he would be liable.
What is the reason? It was his acts that were the {immediate} cause.
And Rabbi Yochanan said: Even where he handed something already in flame to him, he would still be exempt. iI was the handling of the deaf mute that caused the damage; he could therefore not be liable unless where he handed over to him tinder,{Bava Kamma 60a} shavings and a light, in which case it was certainly his act that was the immediate cause.
And it is logical to us that the halacha is like Resh Lakish in the name of Chizkiyah, for Chizkiyah was the teacher of Rabbi Yochanan.
And there is one who said that since we do not find that Chizkiyah {himself} argues against Rabbi Yochanan, the halacha is like Rabbi Yochanan.

ליבתו הרוח הרי כולן פטורין:
ת"ר ליבה וליבתו הרוח אם יש בליבתו כדי ללבות חייב ואם לאו פטור

ומאי שנא מזורה ורוח מסייעתו
אמר רב אשי כי אמרי' זורה ורוח מסייעתו הני מילי לענין שבת דמלאכת מחשבת אסרה תורה אבל הכא גרמא בנזקין הוא וגרמא בנזקין פטור:
"IF IT WAS THE WIND THAT FANNED IT, ALL WOULD BE EXEMPT":
The Sages learnt {in a brayta}: Where he fanned it [along with] the wind which also fanned it, if there was enough force in his blowing to set the fire ablaze he would be liable, but if not he would be exempt.
But why is this different from winnowing {on Shabbat}, where they wind helps him?
Rav Ashi said: When we say that there is liability for winnowing where the wind is helping, this applies to Shabbat, for the Torah prohibited actions performed with intent, but here, it is merely as a secondary cause, and a mere secondary cause in the case of damage he is exempt.

Mishna:

IF HE SENT FORTH FIRE AND IT BURNT WOOD, STONES OR [EVEN] EARTH, HE WOULD BE LIABLE, AS IT SAYS {Shemot 22:5}:
ה כִּי-תֵצֵא אֵשׁ וּמָצְאָה קֹצִים, וְנֶאֱכַל גָּדִישׁ, אוֹ הַקָּמָה, אוֹ הַשָּׂדֶה--שַׁלֵּם יְשַׁלֵּם, הַמַּבְעִר אֶת-הַבְּעֵרָה. {ס} 5 If fire break out, and catch in thorns, so that the shocks of corn, or the standing corn, or the field are consumed; he that kindled the fire shall surely make restitution. {S}

עברה גדר שגבוה ארבע אמות או דרך הרבים או נהר פטור:
IF IT CROSSED A FENCE FOUR CUBITS HIGH OR A PUBLIC ROAD OR A CANAL, THERE WOULD BE NO LIABILITY.

המדליק בתוך שלו עד כמה תעבור הדליקה
רבי אלעזר בן עזריה אומר רואין אותה כאילו היא באמצע בית כור

IF A MAN KINDLES A FIRE ON HIS OWN [PREMISES], UP TO WHAT DISTANCE CAN THE FIRE PASS ON [BEFORE HE BECOMES FREE OF LIABILITY]?
RABBI ELEAZAR BEN AZARIAH SAYS: IT HAS TO BE REGARDED AS BEING IN THE CENTER OF AN AREA REQUIRING A KOR OF SEED.
RABBI ELIEZER SAYS: [A DISTANCE OF] SIXTEEN CUBITS [SUFFICES], EQUAL TO [THE WIDTH OF] A ROAD IN A PUBLIC THOROUGHFARE.
RABBI AKIVA SAYS: FIFTY CUBITS.
RABBI SHIMON SAYS: {same pasuk}

Rif Bava Kamma 24b {57b - 58b}

נפלה לגנה ונהנית משלם מה שנהנית ואפי' נחבטה על גבי ירקות או על גבי פירות והוזקו משלם מה שנהנית וכל שכן אם אכלה:
"IF A SHEEP [ACCIDENTALLY] FELL INTO A GARDEN AND DERIVED BENEFIT [FROM THE FRUITS THERE], PAYMENT WOULD HAVE TO BE MADE TO THE EXTENT OF THE BENEFIT":
And even if it struck upon vegetables or upon fruits and damaged, he would pay that which it benefited, and all the more so it it ate.

{Bava Kamma 58a}
היכי נפלה רב כהנא אמר שהוחלקה במי רגליה
ורב אמר כגון שדחפוה חברותיה
מאן דאמר כגון שדחפוה חברותיה כ"ש שהוחלקה במי רגליה ומ"ד כגון שהוחלקה במי רגליה אבל דחפוה חברותיה פשיעה היא ומשלמת מה שהזיקה דא"ל איבעי לך לאעבורי חדא חדא והכי הלכתא:
How did it fall?
Rav Kahana said: It slipped in its own urine.
And Rav said: Such that another animal pushed it down.
The one who said such that another animal pushed it down, all the more so if it slipped in its own urine. And the one who said such that it slipped in its own urine, but such that another animal pushed it down, it is negligence, and the payment should be for the amount of damage done by it, as the plaintiff would be entitled to say, 'You should have made them go past one by one.'
And so is the halacha.

אמר רב כהנא לא שנו אלא באותה ערוגה אבל מערוגה לערוגה משלמת מה שהזיקה
ור' יוחנן אמר אפי' מערוגה לערוגה ואפילו כל היום כולו עד שתצא ותחזור
אמר רב פפא לא תימא עד שתצא לדעת ותחזור לדעת אלא כיון שיצאת לדעת אף על פי שחזרה שלא לדעת משלמת מה שהזיקה
מאי טעמא כיון דאליפא להתם כל אימת דמשתמטא להתם רהטא וכן הלכתא:
Rav Kahana said: They only learned this {ruling of the Mishna} by one bed {in which it fell}, but from one bed to another bed, the payment would be for the amount of damage done by it.
And Rabbi Yochanan said: Even from one bed to another bed and did so even all day long, unless it left the garden and returned there again.
Rav Pappa said: Do not say that this is 'unless it left the garden to the knowledge of the owner and returned there again with the knowledge of the owner', for as soon as it left the garden to the knowledge of the owner, even though it returned again without his knowledge he must pay that which it damaged.
What is the reason? Since it had once become known {to it where it can find fruit, you should have realized that} whenever it broke loose it would run to that place.
And so is the halacha.

{Bava Kamma 57b}
נפלה לגינה ונהני' משלמת מה שנהנית:
אמר רב בנחבטה אבל אכלה אפילו מה שנהנית נמי אינה משלמת

"IF A SHEEP [ACCIDENTALLY] FELL INTO A GARDEN AND DERIVED BENEFIT [FROM THE FRUITS THERE], PAYMENT WOULD HAVE TO BE MADE TO THE EXTENT OF THE BENEFIT":
Rav said: Where it absorbed the blow, but if it ate, even that which it benefited as well, it would not pay.
Let us say that Rav is consistent in his opinion. For Rav said: It should not have eaten! We can say, where it was damaged {by overeating} is where he can say "It should not have eaten." But where it did damage to others, would Rav say that there would be exemption from paying?
{Bava Kamma 58a}
Rather, he is saying "it need not be said." That is, it need not be said in the case where it ate, they he pays what it benefited. But if it absorbed the impact, it should be like {fruits served for the purpose of} chasing away the lion from his fellow's assets, and that which it benefited he should not have to pay. Therefore it informs us {otherwise}.
And let us say that this is so {namely, the case of chasing away a lion}?! Chasing away a lion from a neighbor's property is voluntary, but in this case the act was not voluntary. Alternatively, in chasing away the lion from a neighbor's property, no expenses were incurred, but in this case here there was loss attached to it.

{Bava Kamma 58b}
כיצד משלם מה שהזיקה שמין בית סאה וכו':
היכי שיימינן
א"ר יוסי בר חנינא סאה בששים סאה חזקיה אמר קלח בששים קלחים
רבי ינאי אמר תרקב בששים תרקבים
וסוגיין כחזקיה דאמר קלח בששים קלחים
כלומר אפילו לא אכלה אלא קלח אחד שמין אותו בששים קלחים וכן כל דבר שהיא אוכלת שמין אותו בששים כמותו בין מעט בין הרבה:
"HOW IS PAYMENT MADE FOR THE AMOUNT OF DAMAGE DONE BY IT? BY COMPARING THE VALUE OF AN AREA IN THE FIELD REQUIRING ONE SE'AH OF SEED...":
How do we assess? Rabbi Yossi bar Chanina said: {The value of} an area requiring one se'ah of seed {is determined} in proportion to the value of an area requiring sixty se'ahs of seed.
Rabbi Yannai said: an area requiring one tarkav {=1/2 a seah} in proportion to the value of an area requiring sixty tarkav of seed.
And our sugya is in accordance with Chizkiya, who said each stalk {consumed} in proportion to the value of sixty such stalks.
That is to say, even if it only consumed a single stalk, we assess it against sixty stacks, and so too anything it consumes, we assess it against 60 like it, whether a little or a lot.

The Sages learnt {in a brayta}: We do not assess a kav by itself, because this would be an advantage to him, nor a bet kur {the area required to grow 30 seah} by itself, as this would be a disadvantage to him.
What is this saying?
Rav Huna bar Manoach said: This is what it means to say: The valuation is made neither of a kab by itself, as this would be too great an advantage to the plaintiff, nor of a kav in conjunction with an area required for a kor of seed, as this would be too great a disadvantage for the plaintiff. It must therefore be made only in conjunction with sixty {times as much}, like Chizkiyah.

הפורץ גדר בפני בהמת חבירו והכופף קמתו של חבירו בפני הדליקה והשוכר עידי שקר להעיד והיודע לחבירו עדות ואינו מעיד לו:
One who breaks down a fence in front of a neighbor's animal; one who bends over a neighbor's standing grain in front of a fire; one who hires false witnesses to give evidence; and one who knows of evidence in favor of another and does not testify on his behalf.

אמר מר הפורץ גדר לפני בהמת חבירו היכי דמי
אילימא בכותל בריא בידי אדם נמי איחיובי מיחייב אכותל אלא בכותל רעוע:
Master said {earlier} "One who breaks down a fence in front of a neighbor's animal." How so? If the wall was sound, why should the offender not be liable even according to the judgments of Man? Rather, {Bava Kamma 56a} where the wall was shaky.

הכופף קמתו של חבירו בפני הדליקה היכי דמי
אילימא דמטיא ליה ברוח מצויה בידי אדם נמי איחיובי מיחייב אלא ברוח שאינה מצויה
רב אשי אמר טומן קמתו איתמר משום דשויה טמון באש:
"one who bends over a neighbor's standing grain in front of a fire" how so? If it can now reach it in a normal wind, why is he not liable also according to the judgments of Man? Rather, with an unusual wind.
Rav Ashi said: 'covering' his grain was stated, for he makes it covered to the fire {in which case there would be exemption}.

והשוכר עדי שקר היכי דמי
אילימא לנפשיה ממונא בעי לשלומי אלא לחבריה:
"one who hires false witnesses to give evidence" how so? If for himself {=for his own benefit}, he needs to pay money. Rather, on behalf of his friend.

והיודע עדות לחבירו ואינו מעיד לו
ואפילו בחד סהדא משום דמחייבין ליה אפומיה שבועה דאורייתא:
"and one who knows of evidence in favor of another and does not testify on his behalf."
And even with one witness, for we would require based on his mouth a Biblical oath.

And one one who entrusts fire to a deaf-mute, an idiot or a minor {and damage results}, where he is exempt from the judgments of Man but liable according to the judgments of Heaven. And one who gives his fellow a fright, he is exempt from the judgments of Man but liable according to the judgments of Heaven. Where his pitcher has broken on public ground, does not remove the potsherds; he who, when his camel falls does not raise it, Rabbi Meir makes him liable for any damage, and the Sages state that he is exempt from the judgments of Man but liable according to the judgments of Heaven.

Rather, instead of the bailee. Such that the shepherd gave over to his apprentice, as it is indeed the custom of the shepherd to hand over [various things] to [the care of] his apprentice. But to a general {other} shepherd, no, for we establish that a bailee who gives over to {another} bailee is liable.

It was stated {by Amoraim}: One who is watching a lost article: Rabba said: He is like an unpaid watchman. And Rav Yosef said: He is like a paid watchman.
Rabba said: He is like an unpaid watchman -- what benefit is forthcoming to him?
And Rav Yosef said: He is like a paid watchman -- in the benefit he derives from not being required to give bread to the poor.
For Master said: Whoever is engaged in a mitzvah is exempt from a mitzvah.
Thus he is for this a paid watchman.
And we establish in this like Rav Yosef, for we say in perek HaSocher et HaUmenin, and in perek Shevuat HaDayanim that all maintain like Rav Yosef. Therefore, the halacha is like him.

Alternatively, in truth he {=Rabbi Natan} holds that one did half of the damage and the other did half of the damage, and as for your question, 'Why not let the owner of the pit pay half and the owner of the ox a quarter while the remaining quarter will be lost to the plaintiff?' because the owner of the ox can say to the owner of this pit, 'I have found my ox in your pit; you have killed it. Whatever is paid to me by the other defendant I do not mind being paid {by him}; and the rest I will be paid by you.'

Rava said: If a man puts a stone near the mouth of a pit {dug by another person} and an ox coming along stumbles over the stone and falls into the pit, we are here brought here to the dispute between Rabbi Natan and the Sages.
And it is logical that the halacha is like Rabbi Natan, for the Mishna maintains like him.

Rava said: an ox which was deaf, an ox which was abnormal, an ox which was small, for in the case of an ox which was normal there would be exemption.
What is the reason? For he may say to him, "it should have looked where it was going."
A brayta also says so: Where there fell into it an ox which was deaf, or abnormal or small, or blind or while walking at night time, there would be liability whereas if it was normal and walking during the day there would be exemption.

The Sages learnt {in a brayta}: What is considered "properly" and what is considered "improperly?" If the door was able to stand against a normal wind, it would be 'properly'. If the door could not stand against a normal wind, that would be 'improperly'.

Rabbi Eleazar said, and some said that it was stated in a brayta: There are four cases [of damage] where the Torah requires a lesser degree of precaution. They are these: Pit and Fire, Tooth and Foot.
Pit, for it is written {Shemot 21:33}:

Rav said: 'FORWARD' means literally 'on its face', and 'BACKWARD' means also literally, 'on its back'. {Bava Kamma 53a}
And this and that {case} being into the pit.
Rav is consistent in his opinion, for he said the liability for Pit imposed by the Torah is for injury caused by the unhealthy air {of the pit} but not for the blow. And Shmuel said: In a pit, whether on its face or on its back, there would always be liability.
Shmuel is consistent in his opinion, for he said that the liability for Pit imposed by the Torah is for injury caused by the unhealthy air, and all the more so for its blow.
If so, how do we have backwards from the sound of digging that he is exempt? Such that it stumbled over the pit and fell to the back of the pit, outside the pit.
Rav Chanania taught {a brayta} in support of Rav: {Shemot 21:33}:
לג וְכִי-יִפְתַּח אִישׁ בּוֹר, אוֹ כִּי-יִכְרֶה אִישׁ בֹּר--וְלֹא יְכַסֶּנּוּ; וְנָפַל-שָׁמָּה שּׁוֹר, אוֹ חֲמוֹר. 33 And if a man shall open a pit, or if a man shall dig a pit and not cover it, and an ox or an ass fall therein,
unless where it fell in the usual way of falling. From here they said: If it fell forward on account of the noise of digging there would be liability, but if it fell backward on account of the noise of digging there would be exemption, though in both cases into the pit.

Master said {earlier}: Where it fell forward on account of the noise of digging there would be liability.
But why? Let us say that it was the digger who caused it?
Rav Shimi bar Ashi said: Who is this? Rabbi Natan, who said that it was the owner of the pit who did the actual damage, and whenever no payment can be enforced from one [co-defendant] it is made up from the other.
For they learnt {in a brayta}: If an ox pushes another ox into a pit, the owner of the ox is liable, while the owner of the pit is exempt. Rabbi Natan says that the owner of the ox would have to pay a half and the owner of the pit would have to pay the other half.'
But they learnt {in another brayta}: Rabbi Natan says: The owner of the pit has to pay three-quarters, and the owner of the ox one quarter?
This is no contradiction. This is by a tam and this is by a muad.

And by tam, what was Rabbi Natan thinking? If he held that this [co-defendant] should be considered [in the eye of the law] as having done the whole of the damage, and so also the other co-defendant as having done the whole of the damage, why should not the one pay half and the other also pay half? If [on the other hand] he held that the one did half the damage and the other one also did half the damage, then let the owner of the pit pay half [of the damages] and the owner of the ox a quarter, while the remaining quarter will be lost to the plaintiff?
Rava said: Rabbi Natan was a judge, and he descended to the depth of the law. In truth, he maintains that he one was considered as having done the whole of the damage and so also the other was considered as having done the whole of the damage. And this that was a question to you 'Why should the one not pay half and the other half?' it is because the owner of the ox can say to the owner of the pit, 'What will this your joining me {in the defense} benefit me?'

Rabbi Eleazar said: If a man sells a pit to another, as soon as he hands over the cover of the pit to him, the conveyance is complete.

Say indeed, possession to have been taken [of the pit], and it was still requisite for the seller to say to the buyer, 'Go forth, take possession and become the owner', but as soon as he handed over the cover to him, this was equivalent [in the eyes of the law] to his saying to him, 'Go forth, take possession and complete the conveyance.'

Rabbi Shimon ben Lakish said in the name of Rabbi Yannai: If a man sells a herd to his neighbour, as soon as he has handed over the mashchochit, he need not say to him "go, pull and acquire," for he is as if he said to him "go, pull and acquire."
What is a mashchochit? So did they translate it: The bell.
Rabbi Yaakov said: The goat that leads the herd.
As that Gililean expounded before Rav Chisda: when the shepherd becomes angry with his flock he appoints for a leader one which is blind.

It was a question to them: If he had covered it with a cover which was strong enough for oxen but not strong enough for camels, and camels are frequent there {an emendation based on the later gemara} and they weakened it {and then oxen came and fell into the pit}, what is the law?
Do we say that since he was negligent for camels, he was negligent in terms of weakening it, of perhaps in terms of weakening it, he is considered entirely accidental?
Come and hear: 'If there fell into it an ox that was deaf, abnormal, small, blind or while it walked at night time, there would be liability. But in the case of a normal ox walking during the day there would be exemption.'
But why? Let us say that since he was negligent in terms of the deaf, abnormal, or small animal, he was also negligent in terms of the normal one. Do we not deduce that we do not say "since?"
We indeed so deduce.

The Sages learnt {in a brayta}: A man should not remove stones from his ground on to public ground. And there was an incident in which a certain man was removing stones from his ground on to public ground when a pious man found him doing so. He said to him: "Empty person, why do you remove stones from ground which is not yours to ground which is yours?"
The man laughed at him. Some days later he had to sell his field, and when he was walking on that public ground he stumbled over those stones. He then said, 'How well did that pious man say to me, "Why do you remove stones from ground which is not yours to ground which is yours?"'

"IF A MAN DIGS A PIT ON PUBLIC GROUND...":
Rav said: The liability imposed by the Torah in the case of Pit is for its air but not for its blow. Thus, he maintains that so far as the blow was concerned it was the ground of the public that caused the damage.
And Shmuel said: For its air and all the more so for its blow.
And if you say for its blow and not for its air, the Torah testified about the Pit, and even if it were filled with sponges of wool.
What is the difference between them? This is the practical difference between them: Where he made a mound on public ground. According to Rav he would not be liable, and according to Shmuel, he would be liable also on the mound.
And the halacha is like Rav, for Rav Chanania teaches {a brayta} to his support.
And there is one who states that the halacha is like Shmuel, for the halacha is like him in {monetary} law.

There was an ox which fell into the pond which supplied water to the neighboring fields. The owner slaughtered it. Rav Nachman declared it traif, for its owner did not let it last 24 hours {to see if it survived}. Thus Rav Nachman holds that there is a blow in less than 10 {handbreads}.

איתיביה רבא לרב נחמן תנן היו פחותין מי' טפחים ונפל לתוכן שור או חמור פטור
מ"ט לאו משום דלית ביה חבטא
א"ל רב נחמן לא משום דלית ביה הבלא

Rava objected to Rav Nachman: We learnt {in the Mishna}: WHERE, HOWEVER, THEY WERE LESS THAN TEN HANDBREADTHS [DEEP] AND AN OX OR AND ASS FELL INTO THEM AND DIED, THERE SHOULD BE EXEMPTION. What is the reason? Is it not because there is no {deadly} blow in it? Rav Nachman said to him:

No, rather it is because there is no {unhealthy} air in there.
If so, why where it was injured in such a pit would there be liability since there was no unhealthy air there? They said: There were no {unhealthy} air for killing, but there was unhealthy air for injuring.

[And we conclude that the reason] of Rav Nachman is that he holds that that from the abdomen of the ox to the level of the ground must be {at least} four {handbreadths}, and the pond feeding the fields must be six handbreadths; Thus, it is 10 {handbreadths}, and because of the blow he declared it traif. For perhaps the spinal chord was severed. And that which it taught {in the Mishna} WHERE, HOWEVER, THEY WERE LESS THAN TEN HANDBREADTHS [DEEP] AND AN OX OR AN ASS FELL INTO THEM AND DIED, THERE WOULD BE EXEMPTION, was where it rolled itself over into the pit, where there is no {harmful} air and no blow. And if it fell by way of falling and died from the blow, we see -- if there are 10 from it abdomen to the ground of the pit, he is liable. And we deduce from this that Rav Nachman maintains like Shmuel.

RABBI SHIMON BEN GAMLIEL SAYS: IF THIS IS SO, A WOMAN AFTER HAVING GIVEN BIRTH INCREASES IN VALUE. IT IS THEREFORE THE VALUE OF THE EMBRYOS WHICH HAS TO BE ESTIMATED, AND THIS AMOUNT WILL BE GIVEN TO THE HUSBAND. IF, HOWEVER, THE HUSBAND IS NO LONGER ALIVE, IT WOULD BE GIVEN TO HIS HEIRS. IF THE WOMAN WAS A MANUMITTED SLAVE OR A PROSELYTESS, THERE WOULD BE COMPLETE EXEMPTION.

The reason is that it {the ox} was charging at its fellow {ox}. Thus, if it was charging the woman, there would be liability to pay.
Let us say that this is an effective disproof of Rav Ada bar Ahava, who said that where cattle were charging the woman, there would be exemption from paying compensation for the embryos.
Rav Ada bar Ahava would say to you: The same ruling {of the Mishnah} would apply even in the case of Cattle making for the woman, where there would similarly be exemption from paying compensation for the embryos. And this that it taught {in the Misna} IF AN OX WHILE CHARGING ITS FELLOW {OX}-- since it needed to teach in the sefa BUT IF A MAN WHILE MEANING TO STRIKE HIS FELLOW {MAN}, for such {a case} is written in Scriptures, it taught in the resha as well IF AN OX WHILE CHARGING ITS FELLOW {OX}.

And we establish like Rav Ada bar Ahava. Firstly, because when Rav Chaga came from the South, he brought a brayta in his hands like him. And furthermore, for behold Rav Pappa is in consonance with him. For Rav Pappa said: If an ox gores a woman-slave, causing her to miscarry, there would be liability to pay for the loss of the embryos. What is the reason?It was merely a case of a pregnant she-ass being injured, for Scripture says {Bereishit 22:5}:
ה וַיֹּאמֶר אַבְרָהָם אֶל-נְעָרָיו, שְׁבוּ-לָכֶם פֹּה עִם-הַחֲמוֹר, וַאֲנִי וְהַנַּעַר, נֵלְכָה עַד-כֹּה; וְנִשְׁתַּחֲוֶה, וְנָשׁוּבָה אֲלֵיכֶם. 5 And Abraham said unto his young men: 'Abide ye here with the ass, and I and the lad will go yonder; and we will worship, and come back to you.'

The Sages learnt {in a brayta}: If a man digs a pit on private ground and opens it on to a public place, he becomes liable, and this is the Pit of which the Torah speaks. These are the words of Rabbi Yishmael. Rabbi Akiva says: When a man abandons his premises without, however, abandoning his pit, this is the Pit of which the Torah speaks.

Rabba said: In the case of a pit on public ground there is no difference of opinion that there should be liability.
What is the reason? For Scripture said {Shemot 21:33}:
לג וְכִי-יִפְתַּח אִישׁ בּוֹר, אוֹ כִּי-יִכְרֶה אִישׁ בֹּר--וְלֹא יְכַסֶּנּוּ; וְנָפַל-שָׁמָּה שּׁוֹר, אוֹ חֲמוֹר. 33 And if a man shall open a pit, or if a man shall dig a pit and not cover it, and an ox or an ass fall therein,
If for mere opening there is liability, should there not be so all the more in the case of digging? Rather, {this is to inform} that it is on account of the act of opening and on account of the act of digging that the liability is at all brought upon him. {and not because he specifically owned the ground.}
They only argue {Bava Kamma 50a} about a pit in his own domain. Rabbi Akiva holds that the All-Merciful said {in the next pasuk}:
לד בַּעַל הַבּוֹר יְשַׁלֵּם, כֶּסֶף יָשִׁיב לִבְעָלָיו; וְהַמֵּת, יִהְיֶה-לּוֹ. {ס} 34 the owner of the pit shall make it good; he shall give money unto the owner of them, and the dead beast shall be his. {S}
Thus, we are dealing with a pit which has an owner.
And Rabbi Yishmael holds that who is the "owner of the pit"? The one who caused the nuisance.

{The above was Rabba's explanation. Rav Yosef argues:}
Rav Yosef said: In the case of a pit on private ground there is no difference of opinion that there should be liability, etc.

והלכתא כרבה דקיימא לן דכל רבה ורב יוסף הלכתא כרבה בר משדה קנין ומחצה
וקיימא לן הלכתא כרבי עקיבא מחבירו

And the halacha is like Rabba, for we establish that in each case of Rabba and Rav Yosef {arguing}, the halacha is like Rabba, except for Field, Subject {emending Inyan for Kinyan}, and Half. {See Bava Batra 114a for this rule, and an elaboration of what each refers to}.
And we establish that the halacha is like Rabbi Akiva over his colleague. Therefore, it does not matter whether it is a pit in the public domain or a pit in the private domain, if he abandoned his property and did not abandon his pit, he is liable.

The Sages learnt {in a brayta}:If a man dug and left it open, but transferred it to the public, he would be exempt; if he dug it and left it open without dedicating it to the public he would be liable. And so was the custom of Nechunia the digger of ditches; he used to dig {wells} and leave them open and dedicate them to the public. And when the matter came to the Sages, they said "this one has fulfilled this halacha."

Ulla cited Rav {our gemara just has Rav}: They only learned this where the animal {was injured} by slipping on them, but if the animal ate them {and was thereby harmed}, there would be exemption. What is the reason? It should not have eaten them.

There was a certain woman who entered to bake in a certain house. A goat of the owner of the house came and ate from the dough. It became sick and died. Rava required {her} to pay the value of the goat.
Let us say this is in disagreement with Rav. For Rav said: It should not have eaten.

Rava said: If he brings his ox on another person's ground and it digs there pits, ditches, and caves, the owner of the ox would be liable for the damage done to the ground, and the owner of the ground would be liable for any damage resulting from the pit.
And even though Master said {earlier}: {Shemot 21:33}
לג וְכִי-יִפְתַּח אִישׁ בּוֹר, אוֹ כִּי-יִכְרֶה אִישׁ בֹּר--וְלֹא יְכַסֶּנּוּ; וְנָפַל-שָׁמָּה שּׁוֹר, אוֹ חֲמוֹר. 33 And if a man shall open a pit, or if a man shall dig a pit and not cover it, and an ox or an ass fall therein,

And Rava said: If he brings his ox into the premises of another person without permission, and the ox injures the owner of the premises, or the owner of the premises suffers injury through the ox {by stumbling over it}, he is liable.
If it lays down its excrements and thereby soils the utensils of the owner of the premises, he is exempt. For the excrements are considered Pit, and we do not find Pit involving liability for damage done to inanimate objects.

And Rava said: If one enters the premises of another person without permission, and injures the owner of the premises, or the owner of the premises suffers injury through him there would be liability; if the owner of the premises injured him, there would be no liability.
Rav Pappa said: They only said this where the owner had not noticed him. For if he had noticed him, even the owner of the premises by injuring him would render himself liable.

What is the reason? For he {=the trespasser} could say to him, "you have authority to send them out, but to damage them you do not have authority."
And they maintain a consistent opinion. For Rava said, or some say Rav Pappa:

Where both of them had a right {to be where they were} or where both of them had no right, if either of them injured the other, he would be liable, but if either suffered injury through the other, there would be no liability.
The reason is that both of them had a right or both of them had no right, but where one of them had a right and the other had no right, the one who had a right would be exempt, whereas the one who had no right would be liable.

נפל לבור והבאיש מימיו:
הג"ה אמר רב לא שנו אלא שהבאיש מגופו אבל הבאיש מריחו פטור מאי טעמא גרמא בעלמא הוא ע"כ:

Gloss: Rav {our gemara: Rava} said: They only learnt this where it made the water foul by its body, but where it made the water foul by the smell {of its carcass} there would be no liability.
What is the reason? It was only a {secondary} cause. End quote.

Rav said: Where the ox was Mu'ad to fall upon people in pits.

That it was looking at some grass and thus fell.

דאי פשיטא לן דהוה ולד בהדה כי נגחה משתלם חצי נזק כוליה מולד וכיון דלא ידעינן משלם רביע נזק דהוה ליה ממון המוטל בספק וחולקין
זו דברי סומכוס כדכתבינן אבל חכמים אומרים המוציא מחבירו עליו הראיה

An ox which was grazing by the river, and an ox is found killed by its side, even though this one is gored and this {other one} is a muad to gore, this one is bitten and this {other one} is muad to bite, we do not say that it is known that this one bit it, or this one gored it. Rabbi Acha says: A lustful camel which is among the camels, and a camel is found killed by its side, it is known that this one killed it.
And we establish like the Tanna Kamma.

אמר רבא פרה שהזיקה גובה מולדה מ"ט גופה היא תרנגולת שהזיקה אינה גובה מביצתה מ"ט פירשא בעלמא הוא:
ואמר רבא אין שמין לא לפרה בפני עצמה ולא לולד בפ"ע אלא שמין לולד על גב פרה
שאם אתה אומר כן אתה מכחיש את המזיק

Rava said: A cow which damaged, payment can be collected out of the body of its calf, the reason being that the latter is a part of the body of the former, whereas in the case of a chicken doing damage, no payment will be made out of its eggs.
What is the reason? It is a mere secretion.

And Rava said: We do not assess for the cow separately and for the calf separately, but the valuation will be made for the calf as at the time when it formed a part of the cow; for if you do not say this, you will be found to be making the defendant suffer unduly.
And so do you say in the case of the cutting off the hand of a neighbour's slave; and so do you say in the case of damage done to a neighbour's field.
Rav Acha the son of Rava said to Rav Ashi: And if it is the law, why should not the defendant suffer?
He said to him: Because he may say to him, "Since it was a pregnant cow that I deprived you of, it is a pregnant cow which should be taken into valuation."

פשיטא פרה דחד וולד דחד פיטמא לבעל פרה

רב פפא אמר לבעל פרה
רב אחא בריה דרב איקא אמר חולקין
והלכתא חולקין:
There is no question that where the cow belonged to one owner and the calf to another owner, the value of the fat condition of the cow will go to the owner of the cow. Its bulky appearance {which made it worth more}, what?
Rav Pappa said: To the owner of the cow.
Rav Acha son of Rav Ikka said: They split it.
And the halacha is that they split it.

RABBI YEHUDA SAYS: IN THE CASE OF TAM HE WOULD BE LIABLE, BUT IN THE CASE OF MU'AD HE WOULD BE EXEMPT, SINCE IT IS STATED {Shemot 21:36}:
לו אוֹ נוֹדַע, כִּי שׁוֹר נַגָּח הוּא מִתְּמוֹל שִׁלְשֹׁם, וְלֹא יִשְׁמְרֶנּוּ, בְּעָלָיו--שַׁלֵּם יְשַׁלֵּם שׁוֹר תַּחַת הַשּׁוֹר, וְהַמֵּת יִהְיֶה-לּוֹ. {ס} 36 Or if it be known that the ox was wont to gore in time past, and its owner hath not kept it in; he shall surely pay ox for ox, and the dead beast shall be his own.

Why was it necessary to state 'this is a fundamental principle in law'? That even if the damaged party says "I am certain" and the damager says "perhaps." And Shmuel said: When do we go after the majority? By prohibition, but by monetary matters, we do not go after the majority, and if one wishes to take money out from his friend, the burden of proof is upon him.

Rabbi Shmuel bar Nachmani cited Rabbi Yochanan: How do we know that one who wishes to take money out from his friend, the burden of proof is upon him? For it is stated {Shemot 24:14}:
יד וְאֶל-הַזְּקֵנִים אָמַר שְׁבוּ-לָנוּ בָזֶה, עַד אֲשֶׁר-נָשׁוּב אֲלֵיכֶם; וְהִנֵּה אַהֲרֹן וְחוּר עִמָּכֶם, מִי-בַעַל דְּבָרִים יִגַּשׁ אֲלֵהֶם. 14 And unto the elders he said: 'Tarry ye here for us, until we come back unto you; and, behold, Aaron and Hur are with you; whosoever hath a cause, let him come near unto them.'
he shall bring a proof to them.
Rav Ashi objected: For this, do we need a verse? It is common sense: If one has an ache, he goes to the house of the doctor. Rather, the verse is necessary for that of Rav Nachman.
For Rav Nachman cited Rabbi bar Avuah: How do we know that they {=the judges} should give prior consideration to the plaintiff? For it is stated {Shemot 24:14}:

Rif Bava Kamma 19b {41a; 44a-b}

19b

{Bava Kamma 41a, Mishna continues}

וזה וזה חייב מיתה
וכן בבן וכן בבת נגח
עבד או אמה משלם שלשים סלע בין שהוא יפה מאה מנה בין שאינו יפה אלא דינר זהב:
IN BOTH CASES, HOWEVER, THE OXEN ARE LIABLE [TO BE STONED] TO DEATH.
AND SO TOO IN THE CASE OF A [MINOR] SON AND THE SAME [JUDGMENT APPLIES] IN THE CASE OF A [MINOR] DAUGHTER {WHO WERE GORED}.
BUT WHERE THE OX HAS GORED A MANSERVANT OR A MAIDSERVANT [AND DEATH HAS RESULTED], COMPENSATION HAS TO BE GIVEN TO THE AMOUNT OF THIRTY SELA', WHETHER THE KILLED SERVANT WAS WORTH A HUNDRED MANEH OR NOT WORTH ANY MORE THAN ONE GOLD DENAR.

IF AN OX BY RUBBING ITSELF AGAINST A WALL CAUSED IT TO FALL UPON A PERSON [AND KILL HIM], OR IF AN OX WHILE TRYING TO KILL A BEAST [BY ACCIDENT] KILLED A HUMAN BEING, OR WHILE AIMING AT A CANAANITE KILLED AN ISRAELITE, OR WHILE AIMING AT NON-VIABLE INFANTS KILLED A VIABLE CHILD, THERE IS NO LIABILITY.

רבי יהודה אומר שור המדבר שור ההקדש שור גר שמת ואין לו יורשין פטורין מן המיתה לפי שאין להן בעלים:
WHERE AN OX OF A WOMAN, OR AN OX OF [MINOR] ORPHANS, OR AN OX OF A GUARDIAN, OR AN OX OF THE WILDERNESS, OR AN OX OF THE SANCTUARY, OR AN OX OF A PROSELYTE WHO DIED WITHOUT [LEGAL] HEIRS, [HAS KILLED A PERSON], IT IS LIABLE TO [BE STONED TO] DEATH.
RABBI YEHUDA SAYS: IN THE CASE OF AN OX OF THE WILDERNESS, AN OX OF THE SANCTUARY AND AN OX OF A PROSELYTE WHO DIED [WITHOUT HEIRS] THERE WOULD BE EXEMPTION FROM [STONING TO] DEATH SINCE THESE HAVE NO [PRIVATE] OWNERS.

שור היוצא ליסקל והקדישו בעליו אינו מוקדש
שחטו בשרו אסור
אם עד שלא נגמר דינו הקדישו בעליו מוקדש שחטו בשרו מותר
מסרו לשומר חנם ולשואל לנושא שכר ולשוכר נכנסו תחת הבעלים
יצא והזיק מועד משלם נזק שלם ותם משלם חצי נזק:
IF WHILE AN OX [SENTENCED TO DEATH] IS BEING TAKEN OUT TO BE STONED ITS OWNER DECLARES IT SACRED, IT DOES NOT BECOME SACRED; IF HE SLAUGHTERS IT, ITS FLESH IS FORBIDDEN [FOR ANY USE].
F, HOWEVER. BEFORE THE SENTENCE HAS BEEN PRONOUNCED THE OWNER CONSECRATES IT, IT IS CONSECRATED, AND IF HE SLAUGHTERS IT, ITS FLESH IS PERMITTED [FOR FOOD].

IF THE OWNER HANDS OVER HIS CATTLE TO AN UNPAID BAILEE OR TO A BORROWER, TO A PAID BAILEE OR TO A HIRER, THEY ENTER INTO ALL LIABILITIES IN LIEU OF THE OWNER: IN THE CASE OF MU'AD THE PAYMENT WOULD HAVE TO BE IN FULL, WHEREAS IN THE CASE OF TAM HALF DAMAGES WOULD BE PAID.
