Rif Yevamot 40a {Niddah 47a continues; 47b - 48a}

40a

{Niddah 47a continues}

Rabbi Yossi says: When a ring forms around the nipple.
Rabbi Shimon says: When the kaf {mons veneris} grows lower.
{Niddah 47b}
And so did Rabbi Shimon ben Yochai say: The Sages gave three signs in a woman below and corresponding to them above. An unripe fig above, it is known that she did not bring forth two {pubic} hairs. A ripening fig above, it is known that she brought froth two hairs. A ripe fig above, it is known that the mons veneris has grown lower.

What is the kaf {mons veneris}?
Rav Huna said: There is a rounded eminence in the woman above that place. As she matures, it continuously becomes lower.

They asked Rabbi: The halacha is like whom?
He said to them: The halacha is like the words of all of them, stringently.
Rabbi Yochanan and Savia both said: The halacha is like the words of all of them, stringently -- that if she brought forth one of these signs, we assume that she is an adult, stringently.
That is to say that if she had in her one of these signs and betrothed herself {to a man} in her father's lifetime, her betrothal is a betrothal and she needs a get, and her father may not nullify her vows, and if her father betroths her without her consent, she requires a get.

Mishna:
A woman 20 years old who did not bring forth two {pubic} hairs -- they bring proof that she is 20 years old and she is an aylonit -- she does not perform chalitza or yibbum.
A man 20 years old who did not bring forth two {pubic} hairs -- he brings proof that he is 20 years old and he is the eunuch -- he does not perform chalitza nor yibbum.
These are the words of Bet Hillel.
Bet Shammai say: Both this and that at 18 years of age.
Rabbi Eliezer says: The male like the words of Bet Hillel and the female like the words of Bet Shammai, for the female is quicker to develop than the male.

Gemara:
And they objected: "Both a boy nine years and a day and a man 20 years who did not bring forth two hairs {both are considered a minor}."
R' Shmuel bar Yitzchak cited Rabbi {our gemara: Rav}: And this {in our Mishna} is where the signs of being a eunuch developed in him.
Rava said: One may indeed derive this {from careful analysis of the wording of the Mishna}, for it taught "and he is the eunuch."
We so derive.
And when he did not develop the signs of being a eunuch, until how long?
Rabbi Chiyya taught {in a brayta}: Until most of his years {middle age}.
When they came {with a possible eunuch} before Rabbi Chiyya, if he was skinny he told them "go and fatten him up," and if he was fat, he told them "go slim him down." For these signs, sometimes they come as a result being too skinny and sometimes they come as a result of being too fat.
Rav said: The halacha in all of our perek is from day to day {to calculate age}.
And Ulla said: Where this was taught, it was taught, and where it was not taught, it was not taught.
That is to say -- twenty years, where we did not learn "and one day," we do not require from time to time {thus a full amount of years, but rather parts of years count, based on the calendar year}.
And the halacha is like Ulla, for there is a brayta like him:

Rabbi Yossi ben Kipper said in the name of Rabbi Eleazar: The 20th year, which thirty days went out of it, it is still like the 20th year in all its respects.

{Niddah 48a}
And Rav Yitzchak bar Nachmani cited Rabbi Eleazar: It is logical like Rabbi Yossi ben Kipper, for throughout our perek it taught "{and} 1 day" and here it did not teach it, we deduce that the halacha is like him.

NIDDAH PEREK SIX
Mishna:
If the lower sign came before the upper sign came, she either undergoes chalitza or yibbum.
If the upper {sign} came before the lower, even though it is not possible, Rabbi Meir says that she does not undergo either chalitza or yivvum. And the Sages say that she either undergoes chalitza or yibbum, for they said that it is possible for the lower {sign} to come before the upper, but it is not possible for the upper {sign} to come before the lower one comes.

Gemara:
"Even though it is not possible":
But did it not in fact come?
"It came" -- according to Rabbi Meir, "even though it is not possible" -- for the Sages.
And let us teach "if the upper {signs} develop before the lower ones" and I will know that it is because it is not possible! If it did not teach "even though it is not possible," I would have believed that the case is where the majority of the lower {signs} developed first and a minority of the upper, and Rabbi Meir is consistent in his opinion that we worry for the minority, and these words are in the general case, but where we examined and did not find, they would admit to Rabbi Meir that the upper one developed first. Therefore it informs us that it is not possible, but rather for certain the lower {signs} came and then dropped off.
And the halacha is like the Sages, for {in a case of dispute between} an individual and the many, the halacha is like the many.

According to everyone, however, we rely on the lower {signs}.
From where do we know this? Rav Yehuda cited Rav, and so was it taught in the academy of Rabbi Yishmael: The Scripture states {Bemidbar 5:6}:
ו דַּבֵּר, אֶל-בְּנֵי יִשְׂרָאֵל, אִישׁ אוֹ-אִשָּׁה כִּי יַעֲשׂוּ מִכָּל-חַטֹּאת הָאָדָם, לִמְעֹל מַעַל בַּיהוָה; וְאָשְׁמָה, הַנֶּפֶשׁ הַהִוא. 6 Speak unto the children of Israel: When a man or woman shall commit any sin that men commit, to commit a trespass against the LORD, and that soul be guilty;
The Scripture equates a woman to a man for all punishments in the Torah -- just as a man with just a single sign {of maturity}, so too a woman with just a single sign. And perhaps you should say "either this or this," {such that either an upper or lower sign would suffice}? Like a man. Just like a man, it is the lower sign and not the upper, so too a woman, it is the lower sign and not the upper.
A brayta also says so: Rabbi Eliezer beRabbi Tzadok said: So did they explain at Yavneh: Once the lower sign comes, they no longer pay any heed to the upper.

Rif Yevamot 39b {Niddah 45b - 46a; 47a}

39b

We learn in Masechet Niddah:

{Niddah 45b}
Mishna:

A girl who is 11 years and a day, her vows are examined {to see if she is aware of their significance}.
A girl who is 12 years and a day, her vows stand.
And they examine for all the 12 years {until that point}.

A boy who is 12 years and a day, his vows are examined.
A boy who is 13 years and a day, his vows stand.
And they examine all thirteen years.

Before this time, even though they say "we know towards Whom we vowed and we know towards Whom we consecrated," their vow is no vow and their consecration is no consecration.
After this time, even though they say "we do not know towards Whom we vowed and we do not know towards Whom we consecrated," their vow is a vow and their consecration is a consecration.

Gemara:
It was a question to them: Within the time, which is the 12th year for girls and the 13th year for boys, is this like before the time or like after the time?
And Rava concludes that the halacha is that within the time is like before the time.

{Niddah 46a}
They learnt {in a brayta}: A boy 9 years and a day who brings forth two hairs, it is a mole. From 9 years until 12 years and day who brings forth two hairs and it is still on him, it is {still} a mole.
Rabbi Yossi beRabbi Yehuda says: It is a sign {of maturity}.
A boy 13 years and a day, all say it is a sign.

Rava said: A female minor, all 12 years she may continue to refuse. From then on, she may not refuse and may not undergo chalitza.
"She may not refuse?" This indicates that she is an adult, and if she is an adult, she may have chalitza! And if you say this instance is a doubt to him, {this cannot be so,} behold that Rava said that a female minor who reaches the her age {of maturity} does not to be examined {for presence of pubic hairs}, for there is an assumption that she brought forth signs. These wprds are in the standard case, but if they examined and did not find two hairs, no. If so, let her refuse!
We worry lest {they came and} fell out.
This is fine according to the one who says that we so worry, but according to the one who says that we do not so worry, what is there to so?
Even according to the one who said that we do not worry, those words are in terms of chalitza, but in terms of refusal, we do worry.
Thus we derive that we worry {that the hairs fell off}, she may undergo chaliza. But we merely worry {and should this doubt be enough to allow chalitza}? Rather, in truth, the case is where they did not examine, and in terms of chalitza, we worry {and do not allow chalitza}.
And when Rava said there is a presumption, it was for refusal, but for chalitza, she requires an examination.

Rav Dimi from Nahardea said: The halacha is that we worry lest they fell out. And these words are where he betrothed within the time and had intercourse after the time, which is Biblical doubt. But for the initial one {betrothal}, no.

{Niddah 47a}
Mishna:

The Sages described a parable as regards a woman: An unripe fig, a ripening fig, a ripe fig.
An unripe fig, when she is still a child.
A ripening fig, these are the days of being a maiden {neurim}.
In these and these, her father merits her find and the work of her hand, and in nullifying her vows.
A ripe fig, this is when she matures {becomes a bogeret}, her father has no domain in her.

What are her {=the bogeret's} signs?
Rabbi Yossi haGelili says: When the wrinkle arises {appears} under the breast.
Rabbi Akiva says: When the breasts hang down.
Ben Azzai says: When the ring around the nipple darkens.
Rabbi Yossi says: When one places one's hand on the nipple and it sinks and waits a bit before rising again.

Gemara:
Shmuel said: Not that the wrinkle actually arises {=appears}, but rather, when she puts her hand behind her, it appears as if the wrinkle below the breast appears.
Shmuel examined his slave and gave her four zuz as payment for her embarrassment.
Shmuel is consistent with his his ruling, for Shmuel said {Vayikra 25:46}:
מו וְהִתְנַחַלְתֶּם אֹתָם לִבְנֵיכֶם אַחֲרֵיכֶם, לָרֶשֶׁת אֲחֻזָּה--לְעֹלָם, בָּהֶם תַּעֲבֹדוּ; וּבְאַחֵיכֶם בְּנֵי-יִשְׂרָאֵל אִישׁ בְּאָחִיו, לֹא-תִרְדֶּה בוֹ בְּפָרֶךְ. {ס} 46 And ye may make them an inheritance for your children after you, to hold for a possession: of them may ye take your bondmen for ever; but over your brethren the children of Israel ye shall not rule, one over another, with rigour. {S}
{literally: forever, of them you may perform work.}
For work I have given them and not for embarrassment.
Shmuel would appoint a manservant to a maidservant.
Rav {our gemara: Nachman} would switch them when they cast their eyes on one.
Rav Sheshet would give them over to Arabs, and tell them be careful {not to have intercourse} from an Israelite {but otherwise they were free to do as they pleased}.

"Rabbi Yossi says: Such that one places his hand on the ukatz {nipple}...":
Shmuel said: The nipple of the breast.

The Sages learnt {in a brayta}: These are the signs of maturity {bagrut}:
Rabbi Eleazar beRabbi Tzadok says: When the breasts begin to shake {when walking} {alternatively, become stiff}.
Rabbi Yochanan ben Beroka says: When the top of the nose {Jastrow: the central circle of the oblate part of the breast} becomes white.

But when it grows white, is she not already old?
Rather Rav Ashi said: When the top of the nose splits. {alternatively -- Jastrow: When the skin of the central circle of the oblate part of the breast appears wrinkled}

Rif Yevamot 39a {Yevamot 112a}

39a

{Yevamot 112a}

There were two {= a couple, a levir and his yevama} who admitted {that they did not perform yibbum} who came before Rava. Rava said to them: Perform chalitza on her and dismiss her case.
Immediately, Rav Sherevia said to {them} Rava: But they learnt {in a brayta}: She requires both a get and chalitza.
He said to him: If it was so taught, it was taught.

Hon [the son of Rav Nachman] inquired of Rav Nachman: Her rival, what?
He said to her: And would it be that because we force or request we have done an action? {such that she would be forbidden? The yevama's declaration causes problems for herself but not for her rival.}

We learnt {in a Mishna} over there: Initially they said that three women go out and take their ketuba -- one who says "I am impure to you" {for she is married to a kohen and says she has been raped}; "the Heavens are between me and you" {such that intercourse is not happening}; and "may I be taken away from the Jews {and not have intercourse with any of them". They withdrew this, so that she should not cast her eyes on another and disgrace her husband. Rather, if she says "I am impure to you," she should bring a proof to her words; "The heavens are between me and you," they make a way of request {with her husband}; and "may I be taken away from the Jews," he nullifies his portion {of the vow, such that she is still forbidden to others} and she has intercourse with him, and she is thus taken away from the Jews.

It was a question to them: "may I be taken away from the Jews" with regard to the levir, what {is the law}? Would it have arisen in her mind that her husband may die and she would fall before the levir, and therefore we do not force him to perform chalitza with her, or not?
Rav said: The levir is not like the husband, and we force him to perform chalitza with her.
And so is the halacha.

And the practical import of this is that she is not considered a rebellious women. And the reason is that she vowed during her husband's lifetime; thus, after her husband's death she is a rebellious woman.
And we deduce from this that we do not hold like Shmuel who said that we do not write a letter of a rebellious woman on a woman waiting for her levir.

Rif Yevamot 38b {111a - 112a}

HIDE/SHOW IMAGE38b

{Yevamot 111a}
Mishna:

A man who married two {female} orphan minors and he dies, and the levir has intercourse with the first one, and then returns and has intercourse with the second one, or if his brother has intercourse with the second one,
{Yevamot 111b}
he does not invalidate the first one.
And so too two {female} deaf-mutes.

{The levir of rivals who were} a {female} minor and a {female} deaf-mute, and he had intercourse with the minor and then returned and had intercourse with the deaf-mute, or his brother had intercourse with the deaf mute, he thereby invalidates the minor.
If the levir had intercourse with the {female} deaf-mute and then returned and had intercourse with the {female} minor or his brother had intercourse with the minor, he invalidates the deaf-mute.

A normal adult woman and a {female} deaf-mute, and the levir had intercourse with the normal woman and then returned and had intercourse with the deaf-mute or his brother had intercourse with the deaf-mute, he does not invalidate the normal woman.
If the levir had intercourse with the deaf-mute and then returns and had intercourse with the normal woman or his brother had intercourse with the normal woman, he invalidates the deaf-mute.

An adult woman and a female minor, and the levir had intercourse with the adult and then returned and had intercourse with the minor or his brother had intercourse with the minor, he does not invalidate the adult.
If the levir had intercourse with the minor and then he returns and had intercourse with the adult, or his brother than had intercourse with the adult, he invalidates the minor.
Rabbi Eliezer says: In all of them, we instruct the {female} minor to refuse him. {and then he is free to perform yibbum on the other}

Gemara:
Rav Yehuda cited Shmuel: The halacha is like Rabbi Eliezer.
And so said Rabbi Eleazar: The halacha is like Rabbi Eliezer.

Mishna:

A minor levir who had intercourse with his minor yevama, they should grow up together.
If he had intercourse with his adult yevama, she should bring him up.

The yevama who said within 30 days {after levirate marriage} "I have not had intercourse," they force him to perform chalitza.
After 30 days, they request of him that he perform chalitza.
And when he admits {that it is so}, even after 12 months they force him to perform chalitza.

If she vows off benefit from her brother-in-law during the lifetime of her husband, they force him to perform chalitza.
{If she so vowed} After the death of her husband, they request of him that he perform chalitza.
And if she intended this {so as to spark chalitza}, even {if she vowed} within her husband's lifetime, they {merely} request of him that he perform chalitza with her.

{Yevamot 112a}
Gemara:
And before we force him to perform chalitza, let us force him to perform yibbum!
Rav said: This is where her get comes out from under her hand {given to her by her levir -- and until now it was under the presumption that he had intercourse with her and then gave her a get, such that she is free without chalitza, but now that she never had intercourse with him, this get is not enough}, for since he gave her the get before any intercourse, he invalidates her in terms of himself.

They learnt {in a brayta}: A yevama who says within 30 days "I did not have intercourse," whether he {the levir} says "I did have intercourse" or whether he says "I did not have intercourse," they force him to perform chalitza with her. After 30 days, they request of him that he perform chalitza with her. She says "I did have intercourse" and he says "I did not have intercourse," she goes out with a get. He says "I did have intercourse" and she says
"I did not have intercourse," even though her retracts and says "I did not have intercourse," she requires a get and chalitza.

Rif Yevamot 38a {Yevamot 110a - b}

38a

{Yevamot 110a}

And Shmuel held that even though he had intercourse with her after she grew up, she requires a get from the second husband, for whoever has intercourse does so on the basis of the initial betrothal.

And we object to Rav from this that they learnt {in a brayta}: If one betroths a {female} minor, her betrothal is suspended.
What is meant by "her betrothal is suspended?" Does this not mean that when she matures, it {meaning the betrothal} matures with her, even though he did not have intercourse with her.
And we resolve the matter of a {female} minor is a suspended suspended, and we establish that is he had intercourse, yes, and if he did not have intercourse, no.

And we do not explicitly establish the halacha here.
And we have seen one who wrote that this matter is one of doubt, and so we act stringently, for they learnt {in a brayta}: If one betroths a {female} minor, her betrothal is suspended. And even though we interpreted it {otherwise, as above}, we do not rely on interpretations, and if he did not have intercourse with her [when she matures] and she is betrothed to another {man}, she requires a get from this one and from that one.

And this reasoning is an excellent reasoning. For we learn explicitly in perek Yotzei Dofen, in the matter of the two {pubic} hairs of a daughter:
Rav Dimi of Nehardea said: The halacha is that we worry lest they fell out. And these words are where he betrothed her within the time and had intercourse with her outside of the time, such that it is a Biblical doubt, but initially, no, since he betrothed and had intercourse within the time (. But if he betrothed within the time) and he did not have intercourse after the time, we [do not] worry lest they fell out, but rather we inspect her -- if she brings forth two hairs, we say she is an adult and she may not refuse, and if we do not find two hairs, we say that she is still a minor and she goes out with refusal, for the marriage of a {female} minor is Rabbinic, and it is a Rabbinic doubt in which case we act leniently.
And we deduce from this that a {female} minor who did not refuse and who grew up, even if she did not have intercourse agter she grew up, she does not go out with refuse, but rather she requires a get Rabbinically. And since it is {only} Rabbinically that she needs a get, the betrothal of the second one takes hold and she requires a get from him.

And it is logical to us that if the second one wishes to marry her {and stay married to her}, the first one should divorce her and the second one should marry. But for the second one to divorce and the first one to marry, no.
Just like this that we learnt in Gittin {89b}, in perek haMegaresh et Ishto: If they did not substantiate the rumor {about a prior betrothal} what? Rav Huna said: The first one divorces and the second one marries, but for the second one to divorce her and the first one to marry, no, lest they come to say that he is taking back his divorcee {that he divorced} from {a state of} betrothal.
And this {present case} too is like that.

And this is specifically where he did not have intercourse with her before the divorce of the first one, but if he had intercourse with her before the divorce of the first one, she is forbidden to both of them and requires a get from both of them, for it is like {the case of} the women whose husband went to an overseas country {and there was a false rumor that he died, such that she married another man}, so she is forbidden to this one and to that one and requires a get from this one and that one. But in terms of bastardy, there is none attached, for this is Rabbinic nuptials and not Biblical nuptials.
And where he had intercourse after she grew up, he "acquires" her in a full, Biblical, acquisition, and she does not require a get from the second one, like Rav. And we do not hold like Shmuel who said that whoever has intercourse does so with the original betrothal in mind.
And this that they learnt {in a brayta} that one who betroths a {female} minor, her betrothal is suspected entirely, this is a rejection to Shmuel.

Mishna:

One who was married to two {female} orphan minor and he dies, the intercourse or chalitza of one of them exempts her rival.
And so too two deaf women. {such that they are both on the same level}

A {female} minor and a {female} deaf mute -- the intercourse of one of them will not exempt her rival.
A normal woman {=non-deaf adult} and a {female} deaf-mute, the intercourse of the normal woman will exempt the deaf-mute, but the intercourse of the deaf-mute will not exempt the normal woman.
A mature woman and a {female} minor -- the intercourse of the adult will exempt the minor, but the intercourse of the minor will not exempt the adult.

Gemara:
"And so too two deaf women":
And is a deaf-mute woman subject to chalitza? But they learnt {in a Mishna}: A male deaf-mute who underwent chalitza and a female deaf who performed chalitza, and a woman who performed chalitza with a {male} minor, her chalitza is invalid.
Rav Gidel cited Rav: In regards to what does it teach "And so too two deaf women?" In regard to intercourse, but a female deaf-mute certainly is not subject to chaliza.

{Yevamot 110b}
"A {female} minor and a female deaf-mute, the intercourse of one of them will not exempt her rival":
So how are they released?
Rav Chisda cited Rav: He takes in {via intercourse} the female deaf-mute and send her out via a get, and the female minor, he waits until she matures and then she undergoes chalitza.
And according to Rabbi Eliezer {who we ruled like earlier}, we instruct the {female} minor to refuse him and he then performs yibbum on the deaf-mute.
And so is the halacha.

Rif Yevamot 37b {Yevamot 109a continues; 110a}

37b

{Yevamot 109a continues}
Gemara:

What is the reason of Rabbi Eleazar? That he decrees on these because of the case of the {female} orphan in her father's lifetime.
And we establish like the Sages.
They learnt {in a brayta}: The Sages admit to Rabbi Eleazar by a minor whom her father married off, and then was divorced, such that she is an "orphan in her father's lifetime," and he {the husband} takes her back, that she is forbidden to the levir, for her divorce was a complete divorce while her taking back was not a {real} taking back. When are these words said? When he divorced her when she was a minor and took her back when she was a minor. But, if he divorced her when she was a minor and took her back when she was an adult, or {even} if he divorced her when she was a minor and took her back when she was a minor and she became an adult while with him, and he dies, she either undergoes chalitza or yibbum. In the name of Rabbi Eleazar they said that she undergoes chalitza but not yibbum.

Rava inquired of Rav Nachman: Her rival, what of her?
And the conclusion is that her rival either undergoes chalitza or yibbum, and so is the law for the rival of the orphan in her father's lifetime, according to the Sages.

Mishna:
Two brothers who married two minor orphan sisters, and the husband of one of them died, she goes out {without yibbum or chalitza} because of being the sister of the wife.
And so too two {female} deaf-mutes, an adult and a minor -- if the husband of the minor died, she goes out because of being the sister of the wife.
If the husband of the adult died, Rabbi Eliezer says: we instruct the minor to refuse him {her husband -- and then, that living husband is able to perform yibbum or chalitza}.
Rabban Gamliel says: If she refuses {her husband}, she refuses, and if not, she {the widow} should wait until she {the minor} matures, and then she {the widow} will go out for being the sister of the wife.
Rabbi Yehoshua says: Woe to him for on account of his wife and woe to him on account of his brother's wife -- he must send out his wife with a get and his brother's wife with chalitza.

{Yevamot 110a}
Gemara:
Rav Yehuda cited Shmuel: The halacha is like Rabbi Eliezer.
And so did Rabbi Eleazar say: The halacha is like Rabbi Eliezer.

It was stated {by Amoraim}: A {female} minor who did not refuse and then she grew up and married {someone else} --
Rav said: She does not require a get from the second husband.
And Shmuel said: She requires a get from the second husband.
And we establish this that Rav said that she does not require a get from the second, where the first one had intercourse with her after she grew up by him, but if he did not have intercourse with her after she grew up by him, it is betrothal of a minor and it is nothing at all, and so she requires a get from the second husband.

Rif Yevamot 37a {Yevamot 108b continues; 109a} Refusal Together With Get;

37a

{Yevamot 108b continues}
Mishna:

If she {a minor} refused a man, he is permitted to her relatives and she is permitted to his relatives, and she is not invalidated from marrying a kohen.
If he gave her a get, he is forbidden to her relatives and she is forbidden to his relatives, and she is invalidated from marrying a kohen.
If he gave her a get and took her back, and then she refused him, and then married another man and was either widowed or divorced {from that man}, she is permitted to return to him.
If she refused him and he took her back and he then gave her a get, and then she was married to another man and was either widowed or divorced {from that man}, she is forbidden to return to him.
{Yevamot 108b}
This is the general rule: A get after refusal -- she is forbidden to return to him; refusal after a get, she is permitted to return to him.

If she refused a man and then married another man and he divorced her, and then married another {third man} and then refused him, and then married another {fourth} man and he divorced her, and then married another {fifth} man and she refused him -- every one whom she left via a get she is forbidden to return to him, but via refusal she is permitted to return to him.

Gemara:
Within the Mishna, the former clause contradicts the latter clause.
For the former clause teaches that "If she refused him and he took her back and he then gave her a get, and then she was married to another man and was either widowed or divorced {from that man}, she is forbidden to return to him" -- the reason is that she was widowed or divorced, implying that if she refused {that other man}, she would be permitted to return to him {the first husband}. Thus it is clear that the refusal of his fellow can nullify his get.
And the latter clause teaches that "If she refused a man and then married another man he divorced her, and then married another {third man} and then refused him, and then married another {fourth} man and he divorced her, and then married another {fifth} man and she refused him -- every one whom she left via a get she is forbidden to return to him, but via refusal she is permitted to return to him." Thus it is clear that the refusal of his fellow cannot nullify his get.
And Rabbi Eleazar resolves -- there is a break, and the one that taught this one did not teach that one.
And Ulla said: {The latter clause is} Such as where she was thrice divorced, such that she appears like an adult, and because of this, the refusal of his fellow cannot come and nullify his get.

And who is the Tanna {of our Mishna}? It is Rabbi Eleazar bar Iddi, Rav, and Rabbi Yishmael beRabbi Yossi . {Following the emendation of Hagahot Chavot Yair:} Rav Yehuda cited Rav: It is Rabbi Yishmael beRabbi Yossi.
For Rav Yehuda cited Rav: What is meant by {Eicha 5:4}:
4 We have drunk our water for money; our wood cometh to us for price
At the time of danger, they sought this halacha -- if she went from the first one with a get and from the second with refusal, may she return to the first one. They hired a man for 400 zuz, and he came and asked Rabbi Akiva in prison and he forbade, and {asked} Rabbi Yehuda ben Beteira in Netzivin and he forbade. Rabbi Yishmel beRabbi Yossi said: Not for this {simple question} did we need -- for a prohibition carrying a penalty of karet you have permitted {a married minor who refused}, for a regular prohibition {of machzir gerushato}, would you not certainly. Rather, this was the question: If she was the wife of his mother's brother, such that she is a secondarily {Rabbinically} prohibited relation to him, and she married his paternal brother, and he dies, may she refuse now to uproot the initial marriage and then let her rival undergo yibbum. Is there refusal after death in case of precept {namely, yibbum of the rival} or not? They hired a man for 400 zuz, and he came and asked Rabbi Akiva in prison and he forbade, and {asked} Rabbi Yehuda ben Beteira in Netzivin and he forbade.

To explain: And even though we establish that there is refusal after death, here by secondarily {Rabbinically} prohibited relations, no. For his daughter may not refuse after death and allow her rival to undergo yibbum {to him} because of Rami bar Yechezkel, so too here, if we permit this secondary relative to refuse after death, they will come to permit his daughter's rival.
And our sugya that states the his refusal nullifies his get but his friend's refusal does not nullify his get, since she recognizes his winks and hints, he will get to her and get her to refuse his friend and return to him. Therefore, the refusal of his friend will not come and nullify his get.

"If she refused a man and then married another man and he divorced her...This is the general rule - whomever she left via a get, she is forbidden to return to him":
Rav Yitzchak bar Ashian cited Rav: Just as she is forbidden to him, so is she forbidden to his brothers. And even though it is regarding him that she recognizes his hints and winks, but his brothers, she does not recognize their hints and winks, even so, it is a decree on his brothers because of him.
And so is the halacha.

{Yevamot 109a}
Mishna:
If someone divorces his wife and takes her back, she is permitted to the levir. And Rabbi Eleazar forbids.
And so too one who divorces an {female} orphan and then takes her back, she is permitted to the levir. And Rabbi Eleazar forbids.
A {female} minor whom her father married off, and she was divorced -- such that she is considered an orphan in the lifetime of her father -- and then he takes her back, she is forbidden to the levir.

Rif Yevamot 36b {Yevamot 108a}

36b

Gemara:

Rav Yehuda said, and some say in a brayta it was taught: Initially they wrote a document {get} certifying refusal, "I don't like him and I do not want him, and I do not wish to be married to him." Once they say that it had a lot of words, they said that it may come to be confused
{Yevamot 108a}
with a bill of divorce {get}, and so they established it as follows:
On day X, Plonit daughter of A refused Ploni son of B before us.

The Sages learnt {in a brayta}: What is "refusal?" Any {woman} who says "I do not want Ploni my husband; I do not want the betrothal which my mother and brother betrothed me."
More than this Rabbi Yehuda said: Even if while sitting in the bridal litter and they are taking her from her father's house to the house of her husband and she says "I do not want Ploni my husband," this is {valid} refusal.
More than this Rabbi Yehuda said: Even if {wedding} guests are reclining in her husband's house and she stands and gives drink to them, and she says "I do not want Ploni my husband," this is refusal.
More than this Rabbi Yehuda {our gemara: Rabbi Yossi ben Yehuda} said: Even if her husband sent her to the shopkeeper to bring him one of his objects, and she went and brought his object, and she says "I do not want Ploni my husband," there is no greater refusal than this.

"Rabbi Chanina ben Antigonos says: Any {female} child who is unable to guard her token of betrothal does not need to refuse":
That is to say, she is as if she never was betrothed.
Rav Yehuda cited Shmuel: The halacha is like Rabbi Chanina ben Antigonos.

A tanna taught: A {female} minor who did not refuse and went and married {another man}, in the name of Rabbi Yehuda ben Beteira they said: Her marriage is her refusal.
It was a question to them: If she arose and betrothed {rather than married}, what?
Come and here. For they learnt {in a brayta}: A {female} child who did not refuse and arose and was betrothed {to another} -- in the name of Rabbi Yehuda ben Beteira they said: Her betrothal is her refusal.
And the halacha is like Rabbi Yehuda ben Beteira, and even where the {full} marriage to the first had taken place.

"Rabbi Eliezer says: The act of a {female} minor is only considered like a seduced woman...":
They learnt {in a brayta}: Rabbi Eliezer says: The act of a {female} minor is nothing at all, and her husband is not entitled to her find or the work of her hands, not in nullifying her vows, and he does not inherit her nor does he defile himself for her {should she die and if he is a kohen}. The general rule of the matter is that she is not like his wife in any matter, except that she requires refusal.
Rabbi Yehoshua says: The act of a {female} minor is considered something, so her husband is entitles to her find and to the work of her hands, and in nullifying her vows, and he inherits her and defiles himself for her. The general rule of the matter is that she is like his wife in every matter, except that she goes out with refusal.

And the halacha is like Rabbi Yehoshua, firstly because {in case of dispute between} Rabbi Eliezer and Rabbi Yehoshua, the halacha is like Rabbi Yehoshua.
And further, Rav and Shmuel both push off this of Rabbi Eliezer and hold like this of Rabbi Yehoshua.

For we learn in Ketubot, in perek Almana Nizonet {Ketubot 100b-101a}:
Rav taught: A {female} minor who went out {of marriage} with a get does not receive a ketuba, and all the more so one who refuses. And Shmuel taught that one who refuses does not receive a ketuba, but one who goes out with a get does receive a ketuba.
And Shmuel is consistent in his opinion, for Shmuel said: one who refuses does not receive a ketuba,but one who goes out with a get does receive a ketuba; one who refuses is not invalidated from the brothers nor is she invalidated from {marrying} a kohen, but one who receives a get is invalidated from the brothers and is invalidated from {marrying} a kohen; one who refuses does not need to wait three months, but one who goes out with a get needs to wait three months.
What does this inform us? We have learnt it {in a Tannaitic source}! "One {woman} who refuses a man, he is permitted to her relatives and she is permitted to his relatives..." It is needed for the fact that she needs to wait three months, which is not taught {tnan}.
And we say: Let us say that this {Amoraic dispute} goes along the lines of a Tannaitic dispute -- Rabbi Eliezer says that the act of a {female} minor is nothing at all, and her husband is not entitled to her find, etc., and Rabbi Yehoshua says that the act of a {female} minor is considered something, etc.
Let us say that Rav said like Rabbi Eliezer and Shmuel said like Rabbi Yehoshua.
And we say that according to the opinion of Rabbi Eliezer, everybody agrees. That is to say that the halacha is not like him. Rather, when do they argue? According to Rabbi Yehoshua. Shmuel holds like Rabbi Yehoshua. And Rav -- Rabbi Yehoshua only said that there from her hand to his hand {the benefits transferred, such as the rights to her find and the work of her hand} but from his hand to her hand, no.
And we deduce from it that whether according to Rav or according to Shmuel, they do not hold of Rabbi Eliezer's opinion.

And we learn also: From what time does a man inherit his minor wife? Bet Shammai say: Once she stands in her height {=reaches puberty}. And Bet Hillel say: Once she enters the chuppa. And Rabbi Eliezer says: Once she has intercourse.
And we answer up for Rabbi Eliezer -- when she becomes an adult and has intercourse. And Bet Shammai and Bet Hillel stand in one position, that the act of a {female} child has some substance, and so her husband inherits her, and so Rabbi Eliezer is an individual against the many.

And we learn also in Gittin, in perek haNizakin:
Rabbi Yochanan ben Godgada testified regarding a {female} deaf-mute whom her father married off that she goes free with a get, and regarding a {female} minor daughter of an Israelite who was married off to a kohen that she eats terma, and if she dies, her husband inherits her.
And we deduce from all of these that a {female} minor who did not refuse, her husband inherits from her.
And so is the halacha.

Rava objected to Ulla {from a brayta}: All {women} who are able to refuse and did not refuse, her rival undergoes chalitza and not yibbum.
But why? Let her refuse now and uproot her original marriage, and thus let her rival undergo yibbum!

And he resolves: The rival of an incestuous relation is different.
For Rami bar Yechezkel taught: If she refused with her husband, she is permitted to his father; if she refused with her levir, she is forbidden to his father.
Thus it is clear that at the time of falling {before the levir} she was like his daughter-in-law. So too here, at the time of her falling, she appeared like the rival of his daughter.
And the halacha is like Ulla.

Rav said: If she "refused" this one {of the levirs}, she is forbidden to his brothers, just as is true by the woman who received a get {from a levir}. A woman who received a get, once she is forbidden to {this} one she is forbidden to all of them, so too here, it makes no difference.

And Shmuel said: If she "refused" this one {of the levirs}, she is permitted to his brothers, and it is not comparable to a woman who received a get {from a levir}. A woman who received a get, it is the get that pushes her away, while here it is he who she pushes away, for she tells him, "I do not want you, and do not wish to be with you." It is he that she does not want, but his brothers, she does want.
And the halacha is like Shmuel, for Rabbi Yochanan establishes like him, for when Rabin came, he cited Rabbi Yochanan that "if she refuses this one, she is permitted to his brothers."
And so is the halacha.

"Bet Shammai say: Before him...":
Until this point Bet Hillel did not say, except that we do not require experts, but three {judges} we require, for they learnt in a Mishna: Chalitza and refusal is with three.
And a brayta also says so: Refusal -- Bet Shammai say in Bet Din and Bet Hillel say in bet Din or not in Bet Din. Both of them admit that they require three {judges}. Rabbi Yossi son of Rabbi Yehuda and Rabbi Eleazar son of Rabbi Shimon validate with two.
Rav Yosef bar Minyumi cited Rav Nachman: The halacha is like that pair.

Mishna:

Who is the {female} minor who is required to "refuse?" Anyone who her mother or brother married her off with her consent. If they married her off against her will, she does not need to refuse.
Rabbi Chanina ben Antigonos says: Any {female} child who is not able to guard her token of betrothal does not need to refuse.
Rabbi Eliezer says: The act of a {female} minor is not considered anything, but she is rather like a seduced woman. Thus, if a daughter of an Israelite and married to a kohen, she may not eat of teruma. If the daughter of a kohen to an Israelite, she may eat of teruma.

The order of chalitza: In the beginning, Bet Din requires to establish a place in the daytime and make {/get} a sandal which has a heel and straps, and which is not sewn with flax and place it on his right leg, and read out for the yevama מֵאֵן יְבָמִי לְהָקִים לְאָחִיו שֵׁם בְּיִשְׂרָאֵל--לֹא אָבָה, יַבְּמִי -- "My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me" in those words in the Holy Tongue {=Hebrew}. And they read out for the levir לֹא חָפַצְתִּי לְקַחְתָּהּ -- "I like not to take her." And the levir must press his foot on the ground, and the yevama comes and loosens the straps of the sandal and removes it from his foot, and casts spittle on the ground from her mouth in front of the levir. And the judges must see the spittle as it leaves her mouth. And after this they read out for her כָּכָה יֵעָשֶׂה לָאִישׁ אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו -- "So shall it be done unto the man that doth not build up his brother's house" {and} וְנִקְרָא שְׁמוֹ, בְּיִשְׂרָאֵל: בֵּית, חֲלוּץ הַנָּעַל -- "And his name shall be called in Israel The house of him that had his shoe loosed."
And all sitting there exclaim after her "him that had his shoe loosed, him that had his shoe loosed, him that had his shoe loosed," three times. And when he writes a document certifying the chalitza, he needs to draw lines on it with a tracer {a reed used to trace these lines} and not with ink, and he needs to write "in a sitting of three as one {=together} we were," and the three of them sign on it, so long as they know how to read.

And this is {the text of} the document certifying chalitza:
{Note: I use Plonit and Ploni for the yevama and yavam, and letters otherwise.}
On {weekday} day X which is day Y to month Z, which is such-and-such {year} to the count that we are used to counting in city A, we the judges some of whom are signed below {presumably because three sign and the chalitza is best done with five judges} in a sitting of three as one were sitting in the court, and there came out before us Plonit daughter of C {her father} the widow of D {her deceased husband}. And she brought before us a certain man whose name is Ploni son of F {his father}, and so did this Plonit say to us:
D {the deceased} son of G {his father}, the brother of this Ploni {the yavam} from his father {thus, a paternal brother} -- I was married to him and he died, and he left life to the Sages and all of Israel, and a son or daughter as heir to inherit and establish a name in Israel he did not leave, and this Ploni {the yavam} his brother is fit to perform yibbum upon me.
Now, Sages, judges, say to him that if he wishes to perform yibbum upon me, he should perform yibbum, and if not, let me loosen for myself before you his right foot and free his shoe from upon his foot, and I will spit before him.
And we knew this Plonit that she was the wife of the deceased D, and we knew that this Ploni was the paternal brother of D. And we said to him {Ploni}, "If you wish to perform yibbum upon her, perform yibbum, and if not, she shall loosen before us your right foot and release your shoe from upon your foot, and she shall spit before you." And he spoke up and he said "I do not wish to perform yibbum upon her."
Immediately, we read out for this Plonit מֵאֵן יְבָמִי לְהָקִים לְאָחִיו שֵׁם בְּיִשְׂרָאֵל--לֹא אָבָה, יַבְּמִי -- "My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me."
And even to this Ploni, we read out for him לֹא חָפַצְתִּי לְקַחְתָּהּ -- "I like not to take her." And she loosened his right foot and released his shoe from upon his foot, and spat before him spittle which was seen by us, from her mouth, upon the ground. And we further read out for this Ploni[t] {based on the word da rather than dein, and based on the verse which says that she says it, it must be Plonit, rather than Ploni here} : כָּכָה יֵעָשֶׂה לָאִישׁ, אֲשֶׁר לֹא-יִבְנֶה אֶת-בֵּית אָחִיו -- "So shall it be done unto the man that doth not build up his brother's house" and we further read out for her וְנִקְרָא שְׁמוֹ, בְּיִשְׂרָאֵל: בֵּית, חֲלוּץ הַנָּעַל -- "And his name shall be called in Israel The house of him that had his shoe loosed." And we the judges, and all who were sitting before us, spoke up after her "him that had his shoe loosed, him that had his shoe loosed, him that had his shoe loosed," three times.
And once this ceremony was done before us, we permitted this Plonit to go to marry anyone she desires, and no man may protest her from doing this, from this day and forever.
And this Plonit requested this document certifying chalitza from us, and we have written it and signed it, and given it to her for benefit, like the law of Moshe and Israel.

And three sign upon it.

And she does not need to wait three months, but rather is permitted immediately to marry anyone she wishes to. And he only says his words while standing.

5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
then he {=the levir} is required to perform yibbum on his {deceased brother's} wife. And when he wishes to perform yibbum, he first betrothes and then performs yibbum {via intercourse}, for Rav said that the precept of yibbum is to first betroth and then have intercourse, for it is written
5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
And before this, the ketuba of the yevama was on the assets of her first husband, and now the Sages established for her from the second one, so that she will not be easy in his eyes to send out.

5 If brethren dwell together, and one of them die, and have no child, the wife of the dead shall not be married abroad unto one not of his kin; her husband's brother shall go in unto her, and take her to him to wife, and perform the duty of a husband's brother unto her.
And this Plonit desires to undergo yibbum to Ploni son of A her brother-in-law, in order to establish the name {of the deceased} in Israel, as is written
6 And it shall be, that the first-born that she beareth shall succeed in the name of his brother that is dead, that his name be not blotted out of Israel.
And this is the nedunia {dowry} that this Plonit brings from her father's house, such-and-such {value}. And Ploni writes to Plonit his sister-in-law 25 zuz which are fit to her, which were written in her ketuba which her first husband wrote to her. And he adds of his own such-and-such {value}. And this Ploni accepts upon himself responsibility and the additional amounts of this ketuba and upon his heirs after him, from his land and movable property, and even from the shirt off his back, etc...
as we write in the general case of ketuba.

Rabbi Hoshaya said: She may refuse to his {the levir's} maamar {that is, after his Rabbinic betrothal} but may not refuse to his levirate bond.
This is saying that even though she may refuse his maamar {and in a non-levirate case this would sever it entirely} and does not require a get, she {still} needs chalitza for his levirate bond.
What is the reason? Maamar and intercourse that he performs with her, it can thus uproot, but levirate bond which the All-Merciful casts upon her, it is not able to uproot.

{Yevamot 107b}
Ulla said: She may even refuse to his levirate bond.
What is the reason? She is uprooting her initial marriage {to the deceased}.
And the halacha is like him. {like Ulla.}

The commandment of chalitza -- he and his sister-in-law come to Bet Din, and they give advice which is appropriate for him, for it is stated {Devarim 25:8}

7 And if the man like not to take his brother's wife, then his brother's wife shall go up to the gate unto the elders, and say: 'My husband's brother refuseth to raise up unto his brother a name in Israel; he will not perform the duty of a husband's brother unto me.'
And he says
ח וְקָרְאוּ-לוֹ זִקְנֵי-עִירוֹ, וְדִבְּרוּ אֵלָיו; וְעָמַד וְאָמַר, לֹא חָפַצְתִּי לְקַחְתָּהּ. 8 Then the elders of his city shall call him, and speak unto him; and if he stand, and say: 'I like not to take her';
And they speak this in Hebrew.
9 then shall his brother's wife draw nigh unto him in the presence of the elders, and loose his shoe from off his foot, and spit in his face; and she shall answer and say: 'So shall it be done unto the man that doth not build up his brother's house.'
-- spittle which is visible to the judges.

Until this point they used to read.

And once Rabbi Horkenos, under the terebinth in Kefar Akko caused the entire parsha {section} to be read, they established it to read the entire parsha. {to the end of pasuk 10, which has a setuma present.}
{ס} 10 And his name shall be called in Israel The house of him that had his shoe loosed.
This is a commandment on the judges and not a commandment upon the students.
Rabbi Yehuda says: It is a commandment upon all standing there, to say "him that had his shoe loosed, him that had his shoe loosed, him that had his shoe loosed."

Gemara:

"they give advice which is appropriate for him":
What is "advice which is appropriate for him?" That if he is young and she is old, or if he is old and she is young, they tell him "What have you to do with a child?" "What have you to do with an older woman?" "Go to one such as yourself and to not bring strife into your house."

We learn in Sanhedrin, in the third perek:
And the yevama goes after the levir to free her.
Rabbi Ami said: Even from Teveriah to Tzippori, for it is written
ח וְקָרְאוּ-לוֹ זִקְנֵי-עִירוֹ, וְדִבְּרוּ אֵלָיו; וְעָמַד וְאָמַר, לֹא חָפַצְתִּי לְקַחְתָּהּ. 8 Then the elders of his city shall call him, and speak unto him; and if he stand, and say: 'I like not to take her';
And not the elders of her city.

Rav Yehuda said: The {order of the} commandment of chalitza is that she reads, he reads, she loosens and spits, and then she reads.
What does this inform us? This is, after all, our Mishna! This informs us that it is a precept {mitzvah = lechatchila} to do so, and if it is reversed, it matters not to us.

Abaye said: If someone reads a document of chalitza {dictating the chalitza formula}, he should not read for her לֹא by itself and אָבָה יַבְּמִי by itself. For that would imply that אָבָה יַבְּמִי {he desires to perform yibbum unto me}. Rather, {he should read} לֹא אָבָה יַבְּמִי at one time. And he should not read to him לֹא by itself and חָפַצְתִּי לְקַחְתָּהּ by itself, which would imply that he does want to take her. Rather, {he should read} לֹא חָפַצְתִּי לְקַחְתָּהּ at one time.
Rava said: This is just the closing {our gemara: איפסוקי מילתא = pausing; and so Tosafot} of the sentence, and we do not care about that.

Rav Ashi found Rav Kahana was taking pains to read it לא אבה יבמי {at once}. He said to him: Does Master not hold like that of Rava who said that in closing of sentences, we do not worry about it? He said to him: Rava admits by לא אבה יבמי since it is the closing of the sentence {and so לא might join to the previous segment}.
Like Rabbi Zera who said that whatever is fit for mixing, mixing does not prevent {its validity and is not required} and whatever is not fit for mixing, mixing prevents it. So too here, if it is possible to read it at once, its reading does not stand in the way, and if not, it does stand in the way.

And the halacha is like Mar Zutra.
