האי פלוגתא דרבי ורבנן בהחולץ ליבמתו וחזר וקדשה קא טרינן בגמרא לפרושי טעמייהו ואיתמרו בה כמה מימרי
וחד מינייהו מימרא דרב שרביא דאמר בחליצה פסולא קא מיפלגי דרבי סבר חליצה פסולה פוטרת ורבנן סברי אינה פוטרת
וקשיא להו לרבוואתא היכי אמרו רבנן חליצה פסולה אינה פוטרת והא כוליה פירקין חליצה פסולה פוטרת דתנן אין אחר חליצה כלום ועוד אי לא מיפטרה בחליצה פסולה במאי קא מיפטרה
וקא פרישו לה פרושי דלא מסתברי דכולהו אית להו פירכי ולהכי לא כתבינן להו
This dispute of Rabbi and the Sages by one who performed chalitza on his yevama and then went back and betrothed her, there is a give and take in the gemara to explain its reason, and many statements are said about it, and one of them is the statement of Rav Sharbia, who said that they are arguing about "deficient" {/impaired} chalitza, that Rabbi holds that deficient chalitza exempts and the Sages maintain that it does not exempt.
And it is difficult to the {post-Talmudic} Rabbis how they {the Sages} say that deficient
chalitza does not exempt -- after all, all of our perakim are that deficient chalitza exempts. For we learnt {in a Mishna} "there is nothing whatsoever after chalitza," and furthermore, if she is not made exempt by deficient chalitza, with what will she be rendered exempt?
And they explain it with an explanation which does not make sense, for all of it has cause for rejection, and therefore, we do not write them {here}.

ואנן פרישנא לה פירושא ברירא ונהירא
והכין פירושה רב שרביא סבר דרבי ורבנן בפלוגתא דרב ושמואל קא מיפלגי דאיפלגו בה בפרק ארבעה אחין דמאן דאמר הכא אינה פוטרת סבר לה כרב דאמר חליצה פסולה צריכה לחזור על כל האחין וכיון דצריכה לחזור על כל האחין אם חזר וקדשה לשום יבמות קודם חליצת אחין צריכה הימנו גט דהא עדיין אגידא באחים ולא איפטרא בההיא חליצה פסולה לגמרי
ומאן דאמר פוטרת סבר לה כשמואל דאמר חליצה פסולה אינה צריכה לחזור על כל האחין דלא בעיא חליצה מכולם אלא למיפטר צרה אבל נפשה פטרה וכיון דפטרה נפשה ואינה צריכה לחזור על כל האחין אם חזר וקדשה לשם יבמות אינה צריכה הימנו גט דהא קא פרחה מינה זיקת יבמות ואידחיא לה מההיא ביתא לגמרי
And we shall explain it with an elucidating and illuminating explanation. And here it its explanation: Rav Sharbia holds that Rabbi and the Sages are arguing in the dispute of Rav and Shmuel, which they argued about in perek Arbaa Achin. That the one who said that she is not exempt hold like Rav who said that for deficient chalitza, she needs to return to {and receive chalitza from} all the brothers. And since she needs to return to each of the brothers, if he turns around and betroths her for the sake of yibbum {via maamar} before the chalitza of {all} the brothers, she requires from him a get, for she is still connected via the levirate bond via the brothers, and she is not exempt via this {first} chalitza entirely.
And the one who said that it does exempt holds like Shmuel who said that in case of deficient chalitza, she need not return to {and receive chalitza from} all the brothers, for she does not require chalitza from all of them except to exempt her rival, but for herself, since she exempted herself and does not require to return to {and receive chalitza} from all the brothers, if he {the first person} returns and betroths her for the sake of yibbum, she does not require from him a get, for the levirate bond has flown away from her, and she is pushed away from that house entirely.

האי פירושא דהאי מימרא דרב שרביא בלא קושיא ובלא ספק
וכולהו טעמי דאיתמרו בהאי פלוגתא דרבי ורבנן לא סמכינן עלייהו דלאו אליבא דהלכתא נינהו אלא אוקימתא בעלמא נינהו וליתא לדרבי דקי"ל הלכה כרבי מחבירו ולא מחבריו
הלכך בין שקידשה לשם אישות בין שקידשה לשם יבמות צריכה ממנו גט כרבנן:
This is the explanation of this statement of Rav Sharbia without difficulty or doubt.
And all the reasons stated in this dispute of Rabbi and the Sages, we do not rely upon them, for they are not intended for setting out halacha, but rather were just discussions. And we do not hold like Rabbi, for we establish that the halacha is like Rabbi over his colleague, but not over his colleagues.
Therefore, whether he betrothed her for the sake of marriage of betrothed her for the sake of yibbum, she requires from him a get, like the Sages state.

אמר רמי בר חמא הרי אמרו אמר ללבלר כתוב גט לארוסתי לכשאכנסנה אגרשנה הרי זה גט מפני שבידו לגרשה ולאשה בעלמא אינו גט מפני שאין בידו לגרשה ליבמתו מהו כיון דאגידא ביה כארוסתו דמיא או דלמא כיון דלא עבד מאמר לא תיקו וקי"ל תיקו דאיסורא לחומרא ואם כתב גט ליבמתו לכשיכנסנה יגרשנה וכינסה וגירשה בו הויא ספק מגורשת:
Rami bar Chama said: Behold they have stated: If he said to a scribe "write a get for my betrothed so that when I marry her {nisuin} I may divorce her," this is a valid get, for it is in his hands {ability} to divorce her {at this time}; if for a general woman {to whom he is not betrothed} it is not a get, for it is not in his hand to divorce her.
For his yevama, what? Since she is bound to him {before he performs yibbum or chalitza}, she is like his betrothed? Or perhaps, since he did not perform maamar, no?

And we establish that by a teku by prohibitions, we rule stringently, and if he writes a get for his yevama, so that when he marries her {via yibbum} he will be able to divorce her, and subsequently in fact he marries her and then divorces her {with this get}, she is doubtfully divorced.

If one had intercourse with his yevama, whether accidentally or deliberately; whether against one's will or consensually; even if he is accidental and she is deliberate; or he is deliberate and she is accidental; he against his will and she consensually; she against her will and he consensually; whether the beginning stage of intercourse of the final stage, he acquires {in yibbum}, and we do not distinguish between one intercourse and another.
