Rif Nedarim 26b {87a - 89b}

26b

{Nedarim 87a continues, Mishna}

IF SHE SAYS, 'KONAM IF I TASTE FIGS' AND 'IF I TASTE GRAPES', THEY ARE TWO DISTINCT VOWS.

Gemara:
Who is the author of our Mishna? It is Rabbi Yishmael. For they learnt {in a brayta}: {Bemidbar 30}:
14 Every vow, and every binding oath to afflict the soul, her husband may let it stand, or her husband may make it void.
If she says "konam these figs and grapes that I taste," if he confirmed the figs, he confirmed it all; {Nedarim 87b} if he annulled the figs, it is not annulled until he annuls even the grapes. These are the words of Rabbi Yishmael.
Rabbi Akiva says: Behold, it states yekimenu and yefeirenu. Just as yekimenu {confirm} means part of it {yakim mimenu}, so yefeirenu {void} means part of it.
And Rabbi Yishmael: Does it say yafer mimenu?
And Rabbi Akiva: We connect annulling to confirming. Just as confirming is mimenu {and thus even on part of it}, so too annulling is mimenu {part of it}.

Rabbi Chiyya bar Abba cited Rabbi Yochanan: These are the words of Rabbi Yishmael and Rabbi Akiva. But the Sages say: We connect confirming to annulling. Just as annulling, that which he annulled was annulled, and that which he did not annul was not annulled, so too by confirming, that which he did not confirm is not confirmed.

Mishna:
[IF THE HUSBAND DECLARES,] 'I KNOW THAT THERE WERE VOWS, BUT DID NOT KNOW THAT THEY COULD BE ANNULLED', HE MAY ANNUL THEM [NOW].
[BUT IF HE SAYS:] 'I KNOW THAT ONE CAN ANNUL, BUT DID NOT KNOW THAT THIS WAS A VOW,' RABBI MEIR SAYS: HE CANNOT ANNUL IT, WHILE THE SAGES SAY: HE CAN ANNUL.

{Nedarim 88a}
IF A MAN IS UNDER A VOW THAT HIS SON-IN-LAW SHALL NOT BENEFIT FROM HIM, AND HE DESIRES TO GIVE MONEY TO HIS DAUGHTER, HE MUST SAY TO HER, 'THIS MONEY IS GIVEN TO YOU AS A GIFT, PROVIDING THAT YOUR HUSBAND HAS NO RIGHTS THEREIN, [FOR ONLY THAT IS YOURS] WHICH YOU MAY PUT TO YOUR PERSONAL USE.

Gemara:
Rav said: We learnt this only if he says to her, 'WHICH YOU MAY PUT TO YOUR PERSONAL USE.' But if he says, 'Do what you please,' the husband acquires it.
And Shmuel said: Even if he declares, 'Do what you please,' the husband has no rights therein.

Mishna:

{Bemidbar 30:10}
10 But the vow of a widow, or of her that is divorced, even every thing wherewith she hath bound her soul, shall stand against her.
How so? If she said, "behold I am a female nazir after thirty days," even if she is married within thirty days, he is not able to annul.
{Nedarim 89a}
If she vows while in the domain of her husband, he may annul.
How so? If she says "Behold I am a female nazir after 30 days," and her husband annulled for her, even though she becomes widowed or divorced within the 30 days, it is annulled.
If she vowed on a certain day, and that same day he divorced her and then took her back, he is not able to annul.
This is the general rule: Whenever she leaves for even a single hour into her own domain, he is not able to annul.

Gemara:
They learnt {in a brayta}: A widow or divorcee who says "behold I am a female nazir when I marry," and she then marries --
Rabbi Yishmael says: He may annul.
Rabbi Akiva says: He may not annul.
A married woman who says "behold I am a female nazir when I am divorced" and then she is divorced --
Rabbi Yishmael says: He may not annul {while she is still married}.
Rabbi Akiva says: He may annul.

"This is the general rule...":
"This is the general rule" {comes to include, and so that phrase} which was stated by a betrothed maiden is to include where the father went with the agents of the husband, or where the agents of the father went with the agents of the husband, that her father and her last husband may annul her vows.
{With that setup:}
"This is the general rule which is taught in regard to Elu Nedarim {=this perek} is to include what? To include where the father gave her over to the agents of the husbands, or the agents of the father gave her over to the agents of the husband, that the husband is not able to annul the previous{ly made} vows.

THERE ARE NINE MAIDENS WHOSE VOWS STAND:
  1. A BOGERET WHO [VOWED] AND IS AN ORPHAN;
  2. A MAIDEN [WHO VOWED] AND [THEN] BECAME A BOGERET AND IS AN ORPHAN;
    {Nedarim 89b}
  3. A NA'ARAH WHO IS NOT YET A BOGERET, AND IS AN ORPHAN;
  4. A BOGERET [WHO VOWED] AND WHOSE FATHER DIED;
  5. NA'ARAH [WHO VOWED] AND IS NOW A BOGERET AND WHOSE FATHER DIED;
  6. A NA'ARAH WHO IS NOT YET A BOGERET AND WHOSE FATHER DIED;
  7. A MAIDEN WHOSE FATHER DIED, AND AFTER HER FATHER DIED SHE BECAME A BOGERET;
  8. A BOGERET WHOSE FATHER IS ALIVE;
  9. A MAIDEN TURNED BOGERET, WHOSE FATHER IS ALIVE.
Rabbi Yehuda says: ALSO ONE WHO MARRIED HIS DAUGHTER OFF WHILE A MINOR, AND SHE WAS WIDOWED OR DIVORCED AND RETURNED TO HIM [HER FATHER] AND IS STILL A NA'ARAH.

Gemara:
Rabbi Yehuda cited Rav: These are the words of Rabbi Yehuda. But the Sages say: The vows of three maidens stand:
  1. a bogeret;
  2. an orphan;
  3. an orphan during her father's lifetime.

Mishna:
[IF SHE VOWS,] 'KONAM THAT I BENEFIT NOT FROM MY FATHER OR YOUR FATHER IF I PREPARE AUGHT FOR YOU,' OR, 'KONAM THAT I BENEFIT NOT FROM YOU, IF I PREPARE AUGHT FOR MY FATHER OR YOUR FATHER,' HE IS NOT ABLE TO ANNUL {our gemara, Ritva, Ramban, the Mishna in the Yerushalmi: he can annul}.

Gemara
:
The Sages learnt {in a brayta}: [If she vows,] 'Konam that I benefit not from my father or your father, if I prepare aught for you' -- Rabbi Natan says: he does not annul. And the Sages say: He can annul.

Rif Nedarim 26a {83b - 87a}

26a

{Nedarim 83b}
Gemara:

Thus it is clear that she is able to be sustained from his {possessions}. We thus derive that her husband is not included in "mankind." But then the sefa says "and she is able to benefit from gleanings, forgotten sheaves, and peah." Thus it is clear that the husband is included in "mankind."

Ulla said: In truth, the husband is not included within "mankind," and the pattern of the Mishna is "one and more." One -- that the husband is not included within "mankind," and further -- he is not able to annul because she is able to benefit from gleanings, forgotten sheaves, and peah.

Rava said: In truth, the husband is included within "mankind," and the pattern of the Mishna is "what is the cause?" What is the cause of his not being able to annul? she is able to benefit from gleanings, forgotten sheaves, and peah.

Rav Nachman said: In truth, the husband is not included within "mankind," and this is what it means to say: If she is divorced, she is able to benefit from gleanings, forgotten sheaves, and peah.

{Nedarim 85a}
Mishna:
{IF SHE VOWS,} 'KONAM THAT I DO NOT ANYTHING FOR MY FATHER,' 'YOUR FATHER,' 'MY BROTHER,' OR, 'YOUR BROTHER,' {THE HUSBAND} CANNOT ANNUL IT.

'THAT I DO NOT ANYTHING FOR YOU,' HE NEED NOT ANNUL. {because the vow not not take hold.}
RABBI AKIVA SAYS: HE MUST ANNUL IT, LEST SHE EXCEED HER OBLIGATIONS TOWARDS HIM. {in which case that excess should be covered by the vow}
RABBI YOCHANAN BEN NURI SAYS: HE MUST ANNUL IT, LEST HE DIVORCE HER AND SHE THEREBY BE FORBIDDEN TO RETURN TO HIM.

Gemara:
Shmuel said: The halacha is like Rabbi Yochanan ben Nuri.
But a man is not able to consecrate something which has not yet come to the world? {And here, she is not yet divorced nor has she produced anything.}
{Nedarim 85b}
Rav Huna son of Rav Yehoshua said: Where she said "my hands are consecrated in respect to what they may produce." For hands do exist in the world.
But they {=the hands} are pledged to the husband!
{Nedarim 86b}
Rav Ashi said: Konams are different, for they are like intrinsic sanctity. And like Rava. For Rava said: Hekdesh {=consecration to the temple}, leaven, and manumission {of a slave} take out of
pledge.
If so, let them be consecrated from now {and not after divorce}?
The Sages strengthened the lien of the husband.

Mishna:
IF HIS WIFE VOWED, AND HE THOUGHT THAT HIS DAUGHTER HAD VOWED, OR IF HIS DAUGHTER VOWED AND HE THOUGHT THAT HIS WIFE HAD VOWED; IF SHE TOOK THE VOW OF A NAZIRITE, AND HE THOUGHT THAT SHE HAD VOWED A SACRIFICE, OR IF SHE VOWED A SACRIFICE, AND HE THOUGHT THAT SHE VOWED A NAZIRITE VOW; IF SHE VOWED FROM FIGS, AND HE THOUGHT THAT SHE VOWED FROM GRAPES, OR IF SHE VOWED FROM GRAPES AND HE THOUGHT THAT SHE VOWED FROM FIGS, HE MUST ANNUL AGAIN.

Gemara:
Is this to say that {Bemidbar 30:9}
9 But if her husband disallow her in the day that he heareth it, then he shall make void her vow which is upon her, and the clear utterance of her lips, wherewith she hath bound her soul; and the LORD will forgive her.
means "her" specifically?
{Nedarim 87a}
But by tearings {for the dead}, where it is written al, al -- for it is written {II Shmuel 1:12}:
11 Then David took hold on his clothes, and rent them; and likewise all the men that were with him.
יב וַיִּסְפְּדוּ, וַיִּבְכּוּ, וַיָּצֻמוּ, עַד-הָעָרֶב: עַל-שָׁאוּל וְעַל-יְהוֹנָתָן בְּנוֹ, וְעַל-עַם ה וְעַל-בֵּית יִשְׂרָאֵל--כִּי נָפְלוּ, בֶּחָרֶב. {פ} 12 And they wailed, and wept, and fasted until even, for Saul, and for Jonathan his son, and for the people of the LORD, and for the house of Israel; because they were fallen by the sword. {P}

And they learnt {in a brayta}: If they said to him that his father died, and he tore, and afterwards it is found to be his son, he has fulfilled tearing.
This is no question. Here is plain, where here it is spelled out.

But they learnt {in a brayta}: If they said to him that his father died, and he tore, and they it is found to have been his son, he did not fulfill tearing. If they said to him that someone to him {a relative} had died, and he thought it was his father but it turned out to be his son, he has fulfilled tearing.

Rav Ashi said: Here is when it was within time of an utterance {toch kdei dibbur}, and here is after the time of an utterance.
If it was discovered within the time of an utterance, he fulfilled. If after the time of an utterance, he did not fulfill.

But they learnt {in a brayta}: One who has a sick person in his house, and the person fainted, and he thought the person died, and tore, and afterwards the person actually died, he has not fulfilled tearing.
And Rabbi Shimon ben Pazi cited Rabbi Yehoshua ben Levi in the name of bar Kappara: They only learned this where it was after the time of an utterance, but within the time of an utterance, he does not return and tear again.

And the halacha is that anything within the time of an utterance is like that {first utterance}, with the exception of blasphemy, idolatry, betrothal and divorce.

Mishna:
IF SHE VOWS, 'KONAM, IF I TASTE THESE FIGS AND GRAPES, AND HE {THE HUSBAND} CONFIRMS {THE VOW} IN RESPECT OF FIGS, THE WHOLE {VOW} IS CONFIRMED; IF HE ANNULS IT IN RESPECT OF FIGS, IT IS NOT ANNULLED, UNLESS HE ANNULS IN RESPECT OF GRAPES TOO.

Rif Nedarim 25b {81b-83b}

25b

{Nedarim 81b}

Another explanation: {Bemidbar 30:3}
3 When a man voweth a vow unto the LORD, or sweareth an oath to bind his soul with a bond, he shall not break his word; he shall do according to all that proceedeth out of his mouth.
from here that a Sage may not release his own vows.

From whom have we heard say that "that I will not apply kohl" and "that I will not apply rouge" are matters between him and her? Rabbi Yossi. For if it is the Sages, they say that they are vows of self-denial. And we deduce from here that he can annul.

Master said: "that I will not have sexual intercourse, etc."
Where she said "the pleasure of your intercourse {is forbidden} upon me," and like Rav Kahana. For Rav Kahana said: {If she vows} "the pleasure of my intercourse {is forbidden} upon you," we compel her and she has intercourse with him. "The pleasure of your intercourse upon me," he must annul it, for we do not feed a person {in this case, her} something which is forbidden to that person.

Rava inquired of Rav Nachman: {A vow against} Sexual intercourse, to the Sages -- is it classified as self-denial or a matter between him and her?
He said to him: We have learnt this: {If she vows} "May I be taken from the Jews {in terms of intercourse},"
{Nedarim 82a}
he annuls his part and she may have intercourse with him, but she is taken away from the {other} Jews.

Shmuel said in the name of Levi: All vows, a husband annuls for his wife, except for "my benefit upon Ploni," which he cannot annul. But "the benefit of Ploni {should be forbidden} upon me," he can annul.

Rav Yehuda cited Shmuel {our gemara: Rav}: If she vowed off two loaves, one of which involves self-denial and one which does not involve self-denial {e.g. if one was of fine flour and one was of course flour}, since he can annul in respect of that which causes self-denial, he can also annul in respect of the one which does not cause self-denial.
And Rav Assi cited Rabbi Yochanan: He may annul the one causing self-denial, but may not annul the one which does not cause self-denial.

{Nedarim 83b}
Mishna:
[IF SHE VOWS], 'KONAM, IF I MIGHT BENEFIT FROM MANKIND,' HE CANNOT ANNUL, AND SHE CAN BENEFIT FROM THE GLEANINGS, FORGOTTEN SHEAVES, AND PE'AH.
[IF A MAN SAYS] 'KONAM BE THE BENEFIT WHICH PRIESTS AND LEVITES HAVE FROM ME,' THEY CAN SEIZE [THEIR DUES] AGAINST HIS WILL.
[BUT IF HE VOWS,] 'KONAM BE THE BENEFIT THESE {particular} PRIESTS AND LEVITES HAVE FROM ME,' OTHERS TAKE [THE DUES].

Rav Chanina said: One who is silent in order to provoke {her} may annul even from now until ten days.
Rav Chisda objected: "There is a stringency by confirming {a vow} over annulling, and there is a stringency by annulling over confirming. {Nedarim 79a} There is a stringency by confirming, that silence confirms and silence does not nullify. If he confirmed in his heart, it is confirmed; If he nullified in his heart, it is not nullified. If he confirmed, he cannot annul, etc."
It taught, however, that silence confirms. Is this not silence in order to provoke?
No. It is by silence in order to confirm.
But this is confirmation in his heart! {And the Tanna would not say the same thing twice.}
Rather, it is plain silence {without specific intent}.

We have found a stringency by confirmation. A stringency by annulment, from where do we know?
Rabbi Yochanan say: (* For we learn in a Mishna *) We ask absolution on confirmation, but we do not ask absolution on annulment.

Rav Ashi objected: {If the husband says} "I know that there were vows, but I did not know that they could be annulled," he may {now} annul. "I know that they could be annulled, but I did not know that this was a {binding} vow" -- Rabbi Meir says: He may not annul. And the Sages say: He may annul.

But why? Let him be like one who was silent with intent to provoke!
This is a valid refutation to Rav Chanina.
Therefore the halacha is not like him.

{פ} 17 These are the statutes, which the LORD commanded Moses, between a man and his wife, between a father and his daughter, being in her youth, in her father's house.
This teaches that the husband may annul things which are between him and her.

We can say: Both these and these he may annul. However, vows of afflicting the soul are permanently annulled, while those not afflicting the soul, while she is married to him it is a valid annulment, but once he divorces her, her, the vow applies to her. Specifically for matters which are between him and her, but do not have affliction of the soul {=self-denial}. But if there is affliction of the soul, the vow does not apply to her {at that point}

And matters which do not involve self-denial, when he divorces her, the vow takes effect?
But they learnt {tnan}: Rabbi Yochanan ben Nuri says: He must annul it, lest he divorce her and she be forbidden to return to him.
Therefore it is clear that when he divorces her, and annuls for her beforehand, it is a valid annulment.
They can say: Both this and that is a valid annulment. However, vows which involve self-denial he may annul for both himself and for others {=subsequent husbands aside for himself}, but which do not involve self-denial, he may annul for himself but for others, he may not annul.
And this is what it means to say: These are the vows which he may annul, both for himself and for others -- vows which involve self-denial.

'IF I BATHE.':
How did she say? If she said 'Konam be the fruit of the world to me, if I bathe'? then why annul it? Let her not bathe, and so the fruit of the world will not be prohibited to her!
{Nedarim 80b}
Rava said {our gemara: Rav Yehuda, in brackets}: Where she said, "the pleasure of bathing upon me forever, if I bathe {our gemara: today}, and an oath that I will not bathe {today}; the pleasure of adornment {is forbidden} upon me forever, if I adorn myself {our gemara: today}, and an oath that I will not adorn myself {today}.

{Nedarim 81b}
And they learnt {in a brayta}: Matters which involve self-denial, whether between him and her , or between her and others, he may annul; matters which do not involve self-denial, between him and her he may annul, but between her and others he may not annul.
How so?
If she said "konam fruits upon me," he may annul. "Konam that I do {prepare} anything for my father," "for your father," "for my brother," or "for your brother," or "that I will not place straw in front of your animal," or "before your cattle," he is not able to annul.
"That I will not apply kohl," "that I will not apply rouge," "that I not attend to my bed" {=have intercourse}, he may annul, because it is a matter between him and her.
"That I will not make your bed," "that I will not mix for you the cup {of wine}," "that I will not wash your face, hands and feet," he need not annul {because the vow does not take effect}.
Rabban Gamliel says: He annuls {so that she does not treat vows lightly}, for it is stated {Bemidbar 30:3}
3 When a man voweth a vow unto the LORD, or sweareth an oath to bind his soul with a bond, he shall not break his word; he shall do according to all that proceedeth out of his mouth.

Rif Nedarim 24b {77a - b}

24b

{Nedarim 77a}

It was a question to them: Do we annul vows which are for the needs of Shabbat {to annul them}, or perhaps even not for the needs of Shabbat?
It is a matter of Tannaitic dispute. For they learnt {in a brayta}: Annulment of vows are all the day; Rabbi Yossi beRabbi Yehuda and Rabbi Eliezer beRabbi Shimon say: A 24 hour period.
According to the one who said that it is all day, more than that no, then even not for the sake of Shabbat he can annul {for if he waits until after Shabbat, the husband can no longer annul, and this would in effect remove his right to annul, which we will not do}. According to the one who said a 24 hour period, for the needs of the Shabbat yes, but not for the needs of the Shabbat, no.

"And we ask absolution for vows which are for the sake of Shabbat":
It was a question to them: {Is this} When it is not possible for them while it was yet day {on erev Shabbat}, or perhaps where it was possible for them while it was yet day?
Come and hear {a proof}: The Rabbis gave a hearing to the son of Rav Zutra son of Rabbi Zera, even for vows which it was possible for them while it was yet day.
Rav Yosef thought to say that we ask absolution on vows on Shabbat -- with a single expert, yes, but with three laymen, no, because it would look like a lawsuit.
Abaye said to him: Since we hold that even while standing, even with relatives, even at night, it no longer looks like a lawsuit.
{Nedarim 77b}
Rava cited Rav Nachman: The halacha is that we ask absolution on vows while standing, by an individual, at night, on Shabbat, and with relatives, and even where it was possible for them while it was yet day.

"Standing":
But they learnt {in a brayta}: Rabban Gamliel descended from the donkey, wrapped himself up, sat, and absolved the vow for him?
Rabban Gamliel held that we do not {our gemara, and Bach: we do} suggest an opening based on regret, and thus need to uproot the vow, and thus we need to focus. And because of this he sat.
And Rav Nachman held that we {our gemara, Bach: do not} suggest based on regret, and even while standing.

Rava said to Rav Nachman: Behold, Master, a scholar, who came from the west {=Eretz Yisrael}, and said that the Rabbis gave a hearing to Rav Huna bar Avin and released for him his vow, and said to him: Go, seek mercy on your soul, for you have sinned. For Rav Dimi, the brother of Rav Yosef learnt: Anyone who vows, even though he fulfills it, is called a sinner, for it is stated {Devarim 23:23}:
23 But if thou shalt forbear to vow, it shall be no sin in thee.

They learnt {in a brayta}: One who said to him wife, "all vows which you vow, I do not wish that you vow them"; or "I do not want you to vow"; or "there is no vow here," he has not said anything.
"You have done well"; and "there is none like you"; and "if you had not vowed, I would have imposed the vow upon you," his words stand.
A man should not say on Shabbat to his wife, "It is annulled for you," as he says during the week, but rather he says to her, "Take and drink," and the vow is annulled by itself.
Rabbi {our gemara: Rabbi Yochanan} said: and he needs to annul it in his heart.

They learnt {in a brayta}: Bet Shammai say: On Shabbat he annuls it in his heart. On a weekday, be puts it out with his lips. And Bet Hillel say: Both here and there, he annuls it in his heart, and need not put it out with his lips.

Rabbi Yochanan said: A Sage who said it {=the absolution} in the language of the husband {=annulment}, and the husband who said it in the language of the Sage, has not said anything.
For they learnt {in a brayta}: {Bemidbar 30:2}
2 And Moses spoke unto the heads of the tribes of the children of Israel, saying: This is the thing which the LORD hath commanded.

That a Sage absolves and a husband does not absolve {but rather annuls}.
For we might have said, if a Sage who is unable to annul is able to absolve, then a husband who is able to annul, certainly he should be able to absolve!
{Nedarim 78a}
Therefore it informs us זֶה הַדָּבָר -- that the Sage absolves and the husband does not absolve.
Another brayta: זֶה הַדָּבָר -- that a husband can annul and the Sage cannot annul. For we might have said, if the husband, etc. {as the reverse of the above}. Therefore it informs us זֶה הַדָּבָר, that the husband is able to annul and the Sage does not annul. It is stated over here זֶה הַדָּבָר, and it is stated by sacrifices slaughtered outside {the Temple court} {Vayikra 17:2}:
2 Speak unto Aaron, and unto his sons, and unto all the children of Israel, and say unto them: This is the thing which the LORD hath commanded, saying:
Just as over there, Aharon, his sons, and all of Israel, so too by the topic of vows, Aharon, his sons, and all of Israel.

To what practical halachic effect?
Rav Acha bar Yaakov said: To inform that absolution of vows is with three laymen.
But "heads of the tribes" is written?
Rav Chisda said, and some said it was Rabbi Yochanan: With a single expert.

It was a question to them: Can a husband annul {the vows of} his two wives simultaneously: is the word 'her' particularly stated, or not?
Come and hear: We do not give two suspected adulteresses to drink at once, because each is emboldened by the other. Rabbi Yehuda says: This is not the reason, but rather because it is stated "and he makes her drink," implying alone.

Rabbi Yehoshua says: {If she waits} for one but not for two.
Rabbi Akiva says: Not for one nor for two.
Rabbi Eliezer said: If for a woman he acquired himself, he can annul her vows, a woman given over to him from heaven, is it not the case the he can annul her vows?
Rabbi Akiva said to him: No. You can say by a woman that he acquired her himself, that others do not have any rights in her. But can you say this by a woman given over to him from Heaven, where others have right in her?
Rabbi Yehoshua said to him: Your words are so by two levirs {such that the other levir has rights in her}. What will you answer where there is only a single levir?
He said to him: A yevama is not as completely united with her levir as a woman is completely united with her husband. {And proof of this is that if there were another levir, he would also have rights in her.}

RABBI ELIEZER SAID: IF HE CAN ANNUL VOWS WHICH HAVE ALREADY HAD THE FORCE OF A PROHIBITION, SURELY HE CAN ANNUL THOSE WHICH HAVE NOT HAD THE FORCE OF PROHIBITION!
THEY SAID TO HIM: {Bemidbar 30:14}:

These are the words of Rabbi Yoshiya.
Rabbi Yonatan said: We find throughout the entire Torah that a man's agent is as himself.
Rabbi Yoshiya said to him: This is the decree of the Scriptures, {Bemidbar 30:14}:
14 Every vow, and every binding oath to afflict the soul, her husband may let it stand, or her husband may make it void.

HOW SO?
IF SHE VOWED ON THE NIGHT OF THE SHABBAT, HE CAN ANNUL ON THE NIGHT OF THE SHABBAT AND ON THE SHABBAT DAY UNTIL NIGHTFALL.
IF SHE VOWED JUST BEFORE NIGHTFALL, HE CAN ANNUL ONLY UNTIL NIGHTFALL. FOR IF NIGHT FELL AND HE HAD NOT ANNULLED IT, HE CAN NO LONGER ANNUL IT.

Rav said to him: So said my uncle {chaviv is parallel to dod. thus, his uncle, Chiyya bar Rav}: The halacha is not like that pair.
Chiyya bar Rav shot arrows and inspected vows. {thus, he treated absolution lightly.}

Rif Nedarim 23b {69a - 73a}

23b

{Nedarim 69a}

Rabbi Yochanan said: One can seek absolution from confirmation but not from annulment.

Rava {our gemara: Rabba} inquired: 'It is confirmed to thee, it is confirmed to thee,' and then sought absolution of his first confirmation, what {is the law}?
Come and hear: For Rava said: If he obtained absolution from the first, the second becomes binding upon him.

Rava inquired: {If he said,} 'It be confirmed unto thee and annulled unto thee, but the confirmation be not valid unless the annulment had operated,' then what {is the law}?
{Nedarim 69b}
Come and hear: It is a dispute between Rabbi Meir and Rabbi Yossi. For we learnt {in a Mishna}: "This [animal] be a substitute for a burnt-offering, a substitute for a peace-offering," it is a substitute for a burnt-offering {only}. These are the words of Rabbi Meir. Rabbi Yossi said: If that was his original intention, since it is impossible to pronounce both designations simultaneously, his declarations are valid.
And even Rabbi Meir said not say this except where he did not say 'Let the first not be valid unless the second take effect'; but here that he declared, 'but the confirmation be not valid unless the annulment has operated,' even Rabbi Meir would also admit that the annulment takes effect.

Rava inquired: 'It be confirmed unto thee and annulled to thee simultaneously,' what {is the law}?
Come and hear: For Rava said: Anything which is not valid consecutively is not even valid sequentially.

Rava inquired: 'It is confirmed to you today,' what {is the law}?
Do we say that it is as though he had said to her, 'but it is annulled to you tomorrow?' Or perhaps he did not in fact say this?
{Nedarim 70a}
And if you find to say that he did not in fact say this, then if he said "it is annulled to you tomorrow," what {is the law}?
Do we say that tomorrow he is not able to annul for her, for he confirmed the vow today? Or, since he did not say "It is confirmed for you today," is it like he said to her "It is annulled for you tomorrow from today?"
And if you find to say that since he confirms today {implicitly}, then tomorrow it is as if extant, then if he says "It is confirmed for you for an hour," what {is the law}? Do we say that he is as if he said "it is annulled to you after an hour?" Or perhaps, he did not {explicitly} say this to her?
And if you find to say, behold, he did not say to her, then do we say that once he confirmed it, he has confirmed it {permanently}, or perhaps since the entire day is the span in which confirmation and annulment can take place, when he said to her "it is annulled to you after an hour," it work.
And these inquiries are not resolved, and we act stringently.

"IF THE FATHER DIES, HIS AUTHORITY DOES NOT PASS OVER TO THE HUSBAND":
What is the reason? For the verse stated {Bemidbar 30:17}:
{פ} 17 These are the statutes, which the LORD commanded Moses, between a man and his wife, between a father and his daughter, being in her youth, in her father's house.

From where do we know this?
Rava {our gemara: Rabba} said: Because the verse stated {Bemidbar 30:7}:
ז וְאִם-הָיוֹ תִהְיֶה לְאִישׁ, וּנְדָרֶיהָ עָלֶיהָ, אוֹ מִבְטָא שְׂפָתֶיהָ, אֲשֶׁר אָסְרָה עַל-נַפְשָׁהּ. 7 And if she be married to a husband, while her vows are upon her, or the clear utterance of her lips, wherewith she hath bound her soul;
{Nedarim 70b}
Thus the vows before her second marriage are connected to the vows before her first marriage. Just as the vows before the first marriage, only the father annuls, so too the vows before the second marriage, only the father annuls.
But say that these words are about vows which were not seen {=known} to the betrother? To those apply {Bemidbar 30:17}:
{פ} 17 These are the statutes, which the LORD commanded Moses, between a man and his wife, between a father and his daughter, being in her youth, in her father's house.

Mishna:
BUT IN ANOTHER MATTER, THE HUSBAND'S POWER IS GREATER THAN THAT OF THE FATHER, FOR THE HUSBAND CAN ANNUL {HER VOWS} AS A MATURE WOMAN, BUT THE FATHER CANNOT ANNUL HER VOWS AS MATURE WOMAN.

{Nedarim 71a}
IF SHE VOWED WHEN SHE WAS A BETROTHED WOMAN, WAS DIVORCED ON THAT DAY AND BETROTHED [AGAIN] ON THE SAME DAY, EVEN A HUNDRED TIMES, HER FATHER AND LAST BETROTHED HUSBAND CAN ANNUL HER VOWS.

{Rif omits this from his Mishna: THIS IS THE GENERAL RULE: AS LONG AS SHE HAS NOT PASSED OUT INTO HER OWN CONTROL FOR [BUT] ONE HOUR, HER FATHER AND LAST HUSBAND CAN ANNUL HER VOWS.}

Gemara:

"IF SHE VOWED WHEN SHE WAS A BETROTHED WOMAN...": From where do we know these words, that the last betrothed husband annuls vows which were seen by the first betrothed husband?
Shmuel said: {Bemidbar 30:7}:
ז וְאִם-הָיוֹ תִהְיֶה לְאִישׁ, וּנְדָרֶיהָ עָלֶיהָ, אוֹ מִבְטָא שְׂפָתֶיהָ, אֲשֶׁר אָסְרָה עַל-נַפְשָׁהּ. 7 And if she be married to a husband, while her vows are upon her, or the clear utterance of her lips, wherewith she hath bound her soul;
Vows which were already upon her.

But perhaps these words were about vows which were not seen by the betrothed husband, but vows which were seen by the first betrothed husband, the last betrothed husband is unable to annul? "Upon her" is a superfluous word {from which we learn this, that he can.}

{Nedarim 71b}
It was a question to them: Is divorce like silence of like confirmation?
To what practical end?
Such as where her husband heard and divorced her, and then took her back the same day. If we say that this is like silence, he can now annul for her. And if you say it is like confirmation, then he can no longer annul for her. And our question is not resolved, and we go stringently.

{Nedarim 72b}
Mishna:
IT IS THE PRACTICE OF TORAH SCHOLARS THAT BEFORE HIS DAUGHTER DEPARTS FROM HIS HOUSE {in marriage = nisiun}, HE SAYS TO HER, "ALL THE VOWS WHICH YOU VOWED IN MY HOUSE ARE ANNULLED."
LIKEWISE THE HUSBAND, BEFORE SHE ENTERS INTO HIS CONTROL WOULD SAY TO HER, "ALL VOWS WHICH YOU VOWED BEFORE YOU ENTERED INTO MY DOMAIN ARE ANNULLED," BECAUSE ONCE SHE ENTERS INTO HIS CONTROL HE CANNOT ANNUL THEM.
Gemara:
Rami bar Chama inquired: Her husband, may he annul without hearing? Is "and her husband heard it" exact {and thus required} or not?
And our question is not resolved.
{Therefore we would act stringently.}

{Nedarim 73a}
Rami bar Chama inquired: Can a deaf man annul for his wife? If you wish to say that a man can annul for his wife without actually hearing it, this is because he is one who is generally capable of hearing. But a deaf man, who is not capable of hearing, no. And this would fall within Rabbi Zera's statement, for he said "anything capable of being mixed, lack of mixing does not hinder its validity, but anything which is not capable of being mixed, lack of mixing does hinder its validity."
Or perhaps "And her husband heard" does not hinder.

Come and hear: {A brayta makes a derasha: The pasuk states} "And her husband heard" -- To the exclusion of the wife of a deaf man.
We so deduce.

Rif Nedarim 23a {66b - 69a}

23a

BEGIN PEREK TEN:
{Nedarim 66b}
Mishna
:

A BETROTHED MAIDEN, HER FATHER AND HER BETROTHED HUSBAND ANNUL HER VOWS.
{Nedarim 67a}
IF HER FATHER ANNULLED [HER VOW] BUT NOT THE HUSBAND, OR IF THE HUSBAND ANNULLED [IT] BUT NOT THE FATHER, IT IS NOT ANNULLED; AND IT GOES WITHOUT SAYING IF ONE OF THEM CONFIRMED [IT].

{Nedarim 70a}
IF THE FATHER DIES, HIS AUTHORITY DOES NOT PASS OVER TO THE HUSBAND; BUT IF THE HUSBAND DIES, HIS AUTHORITY PASSES OVER TO THE FATHER.

{Nedarim 67a}
Gemara:
"AND IT GOES WITHOUT SAYING IF ONE OF THEM CONFIRMED [IT]":
Why bother to teach this? Now, given that if this one annuls without the other, it is nothing, then if one of them confirmed it, it is necessary to state it?
It is necessary, such as where one of them confirms it and the other one annuls it, and the one who confirms it retracts and asks absolution for his confirmation.
I would have thought that what he confirmed, he uprooted. Therefore it informs us that until they annul at the same time.

And the fact that a betrothed maiden, her father and husband annul her vows, where do we know this from?
Rabba said: The verse stated {Bemidbar 30:7}:
ז וְאִם-הָיוֹ תִהְיֶה לְאִישׁ, וּנְדָרֶיהָ עָלֶיהָ, אוֹ מִבְטָא שְׂפָתֶיהָ, אֲשֶׁר אָסְרָה עַל-נַפְשָׁהּ. 7 And if she be married to a husband, while her vows are upon her, or the clear utterance of her lips, wherewith she hath bound her soul;
From here that a betrothed maiden, her father and husband may annul her vows.

{Nedarim 68a}
It was a question to them: Does the husband cut {the vow in half, since there is the father's half} or weaken it?
Where is this a question to us? Such that she vowed off two olives {of anything}, and her arus {man who betrothed her} heard and annulled for her, and she ate. If you say he cut it, she receives lashes {since 1/2 of the vow, that is, one olive measure, remains}. And if you say he weakened it, there she did a prohibited act {but he weakened that prohibition on both olive measures, such that she does not receive lashes}. What {is the law}?

Come and hear: When did they say that if the husband died, his authority passes over to the father? In the case where the husband did not hear [the vow] before he died, or heard and annulled it, or heard it and was silent, and died on the same day: this is what we learnt: If the husband died, his authority passes over to the father. {Nedarim 68b} But if he heard and confirmed it, or heard it and was silent, and died on the following day, he {=the father} cannot annul it.
If the father heard and annulled it, and died before the husband managed to hear of it, this is what we learnt: If the father died, his authority does not pass over to the husband.
If the husband heard and annulled it, and died before the father managed to hear of it, this is what we learnt: If the husband died, his authority passes over to the father.
If the husband heard and annulled it, and the father died before he managed to hear of it, this is what we learnt: If the father died, the authority does not pass to the husband, and the husband cannot annul it, for because the husband can annul only in partnership with the father.
{Nedarim 69a}
If the father heard and annulled it, and the husband died before he managed to hear of it, he father can again annul the husband's portion.
Rabbi Natan said: These are the words of Bet Shammai. But Bet Hillel say: He cannot annul it {a second time}.

We deduce from here that according to Bet Shammai, he cuts it, and according to Bet Hillel, he weakens it.
We so deduce.

RABBI YISHMAEL SAID TO HIM: MY SON, DID YOU VOW OFF THIS ONE?
HE SAID TO HIM: NO.
AND RABBI YISHMAEL PERMITTED HIM.

AT THAT HOUR, RABBI YISHMAEL CRIED, AND SAID, 'THE DAUGHTERS OF ISRAEL ARE BEAUTIFUL, BUT POVERTY DISFIGURES THEM.'

AND WHEN RABBI YISHMAEL DIED, THEY {=THE DAUGHTERS OF ISRAEL} RAISED A LAMENT, AND THEY SAID, "YE DAUGHTERS OF ISRAEL, WEEP FOR RABBI YISHMAEL."

An incident to contradict? {For the Mishna spoke of a case where he was mistaken, and she really was beautiful, while in the incident with Rabbi Yishmael, she changed from ugly to pretty.}
The text is deficient, and this is what it means to say: Rabbi Yishmael says: Even if she is ugly and becomes pretty. And there was an incident, etc.

She boiled him a גריוא {which he did not want, but he was exaggerating in speech, or else compensating for yesterday's performance}. Rav Nachman bar Yitzchak said: {No.} {Nedarim 66a} It means that we do not tear up the ketuba deed {such that when he has money later, he must pay}.

Mishna:

WE OFFER AS AN OPENING SHABBAT AND YOM TOV.
INITIALLY, THEY WOULD SAY THAT FOR THESE DAYS THE VOW IS CANCELED, BUT FOR OTHERS IT IS BINDING;
UNTIL RABBI AKIVA CAME AND TAUGHT: A VOW WHICH IS PARTIALLY ANNULLED IS ENTIRELY ANNULLED.

HOW SO?
IF ONE SAID, "KONAM THAT I {DO NOT} BENEFIT FROM ANY OF YOU," IF ONE WAS {SUBSEQUENTLY} PERMITTED {TO BENEFIT HIM}, THEY ARE ALL PERMITTED.

{BUT IF HE SAID, 'KONAM}THAT I {DO NOT} BENEFIT FROM THIS ONE AND THAT ONE,' IF THE FIRST IS PERMITTED, ALL OF THEM ARE PERMITTED. IF THE LAST IS PERMITTED, THE LAST IS PERMITTED BUT ALL {THE REST} OF THEM ARE FORBIDDEN.

{IF ONE VOWS,} 'KORBAN BE WHAT I BENEFIT FROM THIS ONE, KORBAN BE WHAT I BENEFIT FROM THAT ONE,' AN OPENING [FOR ABSOLUTION] IS NEEDED FOR EACH ONE INDIVIDUALLY

Gemara:

Rava said: It is Rabbi Shimon, who said: Until he says "an oath" to each and every one.

that we suggest an opening {for a vow} for a person with a new fact.
And the Rabbanan -- Did these indeed die? But Rabbi Yochanan said in the name of Rabbi Shimon ben Yochai: Anyplace where it is stated "quarreling" and "standing," it is only a reference to Datan and Aviram. {And we see these two later, explicitly, by Korach's rebellion.} Rabbi Shimon ben Lakish said: That they descended from their assets, and a pauper is considered as dead. {And, we might add to explain this gemara, this is not considered a new fact since it is a common event which might be foreseen. See inside.}

We learn in perek haSholeach {=the 4th perek of Gittin, daf 35b}:
Does one need to spell out the vow {when asking absolution} or not?
Rav Pappa said: He needs to.
Rav Nachman bar Yitzchak said: He does not need to.
For if you say that he needs, there are times that he will cut off his words, and the sage will only annul that which he hears.
And Rav Pappa said: He needs to, for perhaps he swore about something which was forbidden.
And the halacha is like Rav Pappa.

{Nedarim 65a}
They learnt {in a brayta}: One who vowed off benefit from his fellow, they only release him in his {=the fellow's} presence.
From where do we know these words? Rav Nachman said: Because it is written {Shemot 4:19}
19 And the LORD said unto Moses in Midian: 'Go, return into Egypt; for all the men are dead that sought thy life.'
The Holy One, Blessed Be He, said to Moshe: In Midian you vowed, therefore annul your vow in Midian.
For it is written {Shemot 2:21}
21 And Moses was content to dwell with the man; and he gave Moses Zipporah his daughter.

And ala only means an oath, for it is written {Yechezkel 17:13}: {talking about Tzidkiyahu and Nevuchadnezzar}
יג וַיִּקַּח מִזֶּרַע הַמְּלוּכָה, וַיִּכְרֹת אִתּוֹ בְּרִית; וַיָּבֵא אֹתוֹ בְּאָלָה, וְאֶת-אֵילֵי הָאָרֶץ לָקָח. 13 and he took of the seed royal, and made a covenant with him, and brought him under an oath, and the mighty of the land he took away;

And it is written {II Divrei HaYamim 36:13}:
13 And he also rebelled against king Nebuchadnezzar, who had made him swear by God; but he stiffened his neck, and hardened his heart from turning unto the LORD, the God of Israel.
What was his {=Tzidkiyahu's} rebellion? Tzidkiyahu found Nevuchadnezzar eating a live rabbit. Nevuchadnezzar said to Tzidkiyahu, "swear to me that you will not reveal me, such that you will not disgrace the kingship." He swore to him. In the end, Tzidkiyahu was pained {at not being able to reveal this}, and he had his oath absolved, and he said it. Nevuchadnezzar heard that they were deriding him. He sent and brought the Sanhedrin and Tzidkiyahu. He said to them: Do you see what Tzidkiyahu does? And did he not swear by the Name of Heaven that he would not reveal? They said to him: He had his vow annulled. He said to them: Can one be absolved of an oath? They said to him: Yes. He said to them: In his presence {of the one it impacts} or not in his presence. They said to him: {Only} In his presence.
"Any why have you does this, and not said this to Tzidkiyahu?"
Immediately, {Eicha 2:10}:
י יֵשְׁבוּ לָאָרֶץ יִדְּמוּ, זִקְנֵי בַת-צִיּוֹן--הֶעֱלוּ עָפָר עַל-רֹאשָׁם, חָגְרוּ שַׂקִּים; הוֹרִידוּ לָאָרֶץ רֹאשָׁן, בְּתוּלֹת יְרוּשָׁלִָם. {ס} 10 They sit upon the ground, and keep silence, the elders of the daughter of Zion; they have cast up dust upon their heads, they have girded themselves with sackcloth; the virgins of Jerusalem hang down their heads to the ground. {S}
Rabbi Yitzchak said: That they removed the cushions from under them {as a sign of their unworthiness}.

RABBI ELIEZER SAYS: ONE MAY SUGGEST TO A MAN AS AN OPENING {FOR ABSOLUTION} THE HONOR OF HIS FATHER AND MOTHER, BUT THE SAGES FORBID.
RABBI TZADOK SAID: BEFORE SUGGESTING AN OPENING TO HIM OF THE HONOR OF HIS FATHER AND MOTHER, LET US SUGGEST THE HONOR OF THE OMNIPRESENT AS AN OPENING. IF SO, THERE ARE NO VOWS!
AND THE SAGES ADMIT TO RABBI ELIEZER BY A MATTER BETWEEN HIMSELF AND HIS FATHER AND HIS MOTHER THAT THEY SUGGEST FOR HIM AN OPENING BASED ON THE HONOR OF HIS FATHER AND HIS MOTHER.

We learn above, in the beginning of perek Arba'a Nedarim {=3rd perek of Nedarim, daf 22a}:
We do not suggest an opening based on that which Rabba bar bar Channa cited Rabbi Yochanan, "Rabban Gamliel suggested an opening to a certain old man:
{Mishlei 12:18}:
18 There is that speaketh like the piercings of a sword; but the tongue of the wise is health.
Anyone who speaks {a vow} is worthy of being pierced by the sword, but that the tongue of the wise {=absolution} health.
Nor to we suggest an opening in this other one. For they learnt {in a brayta}: Rabbi Natan says: Anyone who vows is as if he built a private altar, and one who fulfills it is as if he sacrificed an offering upon it.
In the first part {of the brayta} we do not suggest.
In the latter part:
Abaye said: We do suggest; Rava said: We do not suggest.
And the halacha is that we do not suggest, neither based on the former part nor based on the latter part.
And we do not suggest an opening as well from this that Shmuel said: Whoever vows is called an evildoer, even though he fulfills it.
