Rif Yevamot 5a {Yevamot 22a continues; 22b; 23b} Matrilineal descent; Yibbum with uncertainly which sister he married

5a

ואם לאו יבא עשה וידחה לא תעשה
אלא מ"ט אמור רבנן חייבי לאוין חולצין ולא מיבמין גזרה ביאה ראשונה אטו ביאה שנייה והיינו דקתני גבי פצוע דכא וכרות שפכה ואם בעלו קנו ואסור לקיימן בביאה שנייה משום שנאמר לא יבא פצוע דכא וכרות שפכה בקהל ה':
and if not, the positive commandment comes and pushes off the negative commandment.
If so, why do the Sages say that those prohibited by negative commandment {chayvei lavin, such as a divorcee to a kohen} should undergo chalitza rather than yibbum? As a decree of the first intercourse because of the second {prohibited} intercourse, and this is what we teach regarding one of crushed stones or a maimed member, that if they had intercourse they effected the acquisition {in marriage of yibbum} but it is forbidden to sustain them {in marriage} for a second intercourse, for it is stated {Devarim 23:2}
ב לֹא-יָבֹא פְצוּעַ-דַּכָּא וּכְרוּת שָׁפְכָה, בִּקְהַל ה. {ס} 2 He that is crushed or maimed in his privy parts shall not enter into the assembly of the LORD. {S}

{Yevamot 22b}
ואחיו הוא לכל דבר
למאי הלכתא ליורשו וליטמא לו:
"And he is his brother for every matter":
To what halachic end? To inherit from him and to become ritually impure for him.

חוץ ממי שיש לו מן השפחה ומן העובדת כוכבים
מ"ט אמר קרא האשה וילדיה תהיה לאדוניה אשכחן שפחה
עובדת כוכבים מנא לן
אמר ר' יוחנן משום ר"ש בן יוחאי אמר קרא כי יסיר את בנך מאחרי בנך הבא מבתך קרוי בנך ואין בנך הבא מן העובדת כוכבים קרוי בנך אלא בנה:
"Except for one he has from the {non-Hebrew} maidservant and from the gentile mother":
What is the reason? The verse stated {Shemot 21:4}:
ד אִם-אֲדֹנָיו יִתֶּן-לוֹ אִשָּׁה, וְיָלְדָה-לוֹ בָנִים אוֹ בָנוֹת--הָאִשָּׁה וִילָדֶיהָ, תִּהְיֶה לַאדֹנֶיהָ, וְהוּא, יֵצֵא בְגַפּוֹ. 4 If his master give him a wife, and she bear him sons or daughters; the wife and her children shall be her master's, and he shall go out by himself.
Thus we have found the {non-Hebrew} maidservant. The gentile woman, from where?
Rabbi Yochanan cited Rabbi Shimon ben Yochai: The verse stated {Devarim 7:4}:
ד כִּי-יָסִיר אֶת-בִּנְךָ מֵאַחֲרַי, וְעָבְדוּ אֱלֹהִים אֲחֵרִים; וְחָרָה אַף-יְהוָה בָּכֶם, וְהִשְׁמִידְךָ מַהֵר. 4 For he will turn away thy son from following Me, that they may serve other gods; so will the anger of the LORD be kindled against you, and He will destroy thee quickly.
The {grand}son who comes from your daughter {even though she marries a gentile} is called your son {=offspring} and your {grand}son who comes from a gentile woman {who marries your son} is not called your son but rather her son.

וחייב על מכתו ועל קללתו וכו':
קרי כאן ונשיא בעמך לא תאור בעושה מעשה עמך בשעשה תשובה
ה"מ לענין חיובא אבל לענין איסורא אפילו לא עשה תשובה אסור לו לבן להכותו לאביו ולקללו
דגרסינן בסנהדרין בפרק אלו הן הנחנקין אמר רבה בר רב הונא וכן תנא דבי רבי ישמעאל לכל אין הבן נעשה שליח לאביו לא להכותו ולא לקללו חוץ ממסית ומדיח שהרי אמרה תורה לא תחמול ולא תכסה עליו:
"and he is liable for striking him and cursing him...":
But apply the verse here {Shemot 22:27}
כז אֱלֹהִים, לֹא תְקַלֵּל; וְנָשִׂיא בְעַמְּךָ, לֹא תָאֹר. 27 Thou shalt not revile God, nor curse a ruler of thy people.
that is, when he acts in accordance with the actions of your people {yet here, he fathered a bastard child!}
{The answer:} Where he repented.
These words are in terms of liability {to the penalty for striking/cursing}, but in terms of the prohibition, even if he does not repent, it is forbidden for a son to hit his father or to curse him.
For we learn in Sanhedrin perek elu hen hanachnakin: Rabba bar Rav Huna said, and so too they taught in the academy of Rabbi Yishmael: to anyone, the son may not be appointed an agent towards his father, not to strike him or to curse him, except for where he {the father} is seducing people to idolatry, for the Torah said {Devarim 13:9}:
ז כִּי יְסִיתְךָ אָחִיךָ בֶן-אִמֶּךָ אוֹ-בִנְךָ אוֹ-בִתְּךָ אוֹ אֵשֶׁת חֵיקֶךָ, אוֹ רֵעֲךָ אֲשֶׁר כְּנַפְשְׁךָ--בַּסֵּתֶר לֵאמֹר: נֵלְכָה, וְנַעַבְדָה אֱלֹהִים אֲחֵרִים, אֲשֶׁר לֹא יָדַעְתָּ, אַתָּה וַאֲבֹתֶיךָ. 7 If thy brother, the son of thy mother, or thy son, or thy daughter, or the wife of thy bosom, or thy friend, that is as thine own soul, entice thee secretly, saying: 'Let us go and serve other gods,' which thou hast not known, thou, nor thy fathers;
ח מֵאֱלֹהֵי הָעַמִּים, אֲשֶׁר סְבִיבֹתֵיכֶם, הַקְּרֹבִים אֵלֶיךָ, אוֹ הָרְחֹקִים מִמֶּךָּ--מִקְצֵה הָאָרֶץ, וְעַד-קְצֵה הָאָרֶץ. 8 of the gods of the peoples that are round about you, nigh unto thee, or far off from thee, from the one end of the earth even unto the other end of the earth;
ט לֹא-תֹאבֶה לוֹ, וְלֹא תִשְׁמַע אֵלָיו; וְלֹא-תָחוֹס עֵינְךָ עָלָיו, וְלֹא-תַחְמֹל וְלֹא-תְכַסֶּה עָלָיו. 9 thou shalt not consent unto him, nor hearken unto him; neither shall thine eye pity him, neither shalt thou spare, neither shalt thou conceal him;


הא דתנן ובנו הוא לכל דבר חוץ ממי שיש לו מן השפחה ומן העובדת כוכבים
אמרי רבואתא ה"מ שפחה דאחרים דומיא דעובדת כוכבים דלית ליה קנין בגוה אבל שפחה דידיה לא דאין אדם עושה בעילתו בעילת זנות
ואיתמר משמיה דרב נטרונאי גאון הכי הא דתנן וכל מי שאין לה עליו ולא על אחרים קדושין הולד כמוה ואי זו זו ולד שפחה ועובדת כוכבים ה"מ שפחה דאחרים דומיא דעובדת כוכבים דלית ליה קנין בגוה אבל בא על שפחה דידיה וילדה ממנו בת אע"ג דלא נקיטא גט חירות בתו היא דאמור רבנן אין אדם עושה בעילתו בעילת זנות ואם בא עליה חייב משום בתו ואם בא עליה בנו חייב משום אחותו
וחזינן לגאון אחר דמספקא ליה מילתא ומתוך דבריו נקיטינן בהא מילתא לחומרא לגבי איסורא דהיכא דאית ליה איתתא ומית ולית ליה זרעא אלא האי דאוליד מן השפחה נקיטינן לחומרא וחולצת ההיא איתתא ולא מתיבמת ולענין ממונא נקיטינן לקולא ולא ירית ליה אבל איהו גופיה לא מזבני ליה יורשין ואי בעא למיסב בת ישראל מצריכין גט שחרור ואי קדיש מקמי גט שחרור מצריכינן לה גיטא מיניה ואי בעי למנסב שפחה לא שבקינן ליה

This that they learnt in the Mishna "and he is his son for every matter except for the son he has from the {non-Hebrew} maidservant and from the gentile woman," the {post-Talmudic} Sages say that these words are regarding the maidservant of others, similar to the gentile woman, such that he does not have an acquisition {valid} with her, but his own {non-Hebrew} maidservant, no, for a man does not make his intercourse one of illicit relations.

And it was stated in the name of Rav Natronai Gaon as follows -- this that they learnt {tnan -- a Mishna in Kiddushin 66b} "and anyone whom neither he nor anyone else has {the ability to effect} kiddushin, the child is like her. and who is that? the child of a {non-Hebrew} maidservant, and a gentile woman," these words are about the maidservant of others, similar to the gentile woman where there is no legal "acquisition" for her, but if he had relations with his own {non-Hebrew} maidservant and she has a daughter, even though she {the maidservant} did not receive from him a document of manumission, she {the child} is his daughter, for the Sages have said that a man does not make his intercourse one of illicit relations -- and if he had relations with her {the daughter}, he would be liable for sleeping with his daughter, and if his son had relations with her {the daughter}, he would be liable for sleeping with his sister.
And we have seen another Gaon for whom the matter is in doubt, and from his words we take in this matter stringently regarding prohibition -- that where he has a wife and he dies, and he only has descendants which were born to him from the maidservant, we take a stringent position and that wife must undergo chalitza but not yibbum; and regarding monetary matters, we take a lenient position, and they do not inherit from him, but he himself cannot them, and if one of the descendants wishes to marry an Israelite woman, he would need a document of manumission {to free him}, and if he betroths before receiving a document of manumission, she {the woman he marries} still requires a bill of divorce from him, and if he wishes to marry a maidservant, we do not permit him.

Mishna:
מי שקידש אחת משתי אחיות ואינו יודע אי זו מהן קידש נותן גט לזו וגט לזו מת ולו אח אחד חולץ לשתיהן היו לו שנים אחד חולץ ואחד מיבם קדמו וכנסו אין מוציאין מידן
If one betroths one of two sisters, and he does not know which of the two he betrothed, he gives a bill of divorce to this one and a bill of divorce to that one; if he dies and he has a brother, one of them {the two sisters} may undergo chalitza for both of them; if he has two brothers, one of them performs chalitza and {then} the other may perform yibbum {with the other sister}. If they preempted {bet din} and married them, we do not take them out of their hands {meaning that they may remain married}.

Gemara:
שמעת מינה קדושין שאין מסורין לביאה הוו קדושין הכא במאי עסקינן שהוכרו ולבסוף נתערבו האי קושיא והאי פירוקא אליבא דרבא הוא דסבר קידושין שאין מסורין לביאה לא הוו קידושין ולית הלכתא כותיה דקיימא לן כאביי ביע"ל קג"ם והא חדא מינייהו הלכך בין הוכרו בשעת קידושין ולבסוף נתערבו בין לא הוכרו כלל נותן גט לזו וגט לזו כפשטא דמתני':
We deduce from this that betrothal which cannot be consummated {since at the time of betrothal he did not know which one} is a valid betrothal. {No, for} With what are we dealing? With where they were first recognized {at the time of betrothal} and in the end became mixed up. This is thus the question and this is the answer, according to Rava who holds that betrothal which is not given over to be consummated is not betrothal. And the halacha is not like him, for we establish like Abaye in ya'l kegam, and this is one of them. Therefore, whether they were recognized at the time of betrothal and subsequently were mixed up, or whether they were never recognized at all, he gives a divorce document to this one and a divorce document to this one, like the simple reading of the Mishna.

היו לו שנים אחד חולץ ואחד מייבם.
דוקא מיחלץ והדר יבומי אבל יבומי ברישא לא דקא פגע באחות זקוקתו
"if he had two {brothers}, one performs chalitza and {subsequently, on the other sister} one may perform yibbum":
Specifically that one performs chalitza and subsequent to this is the yibbum, but yibbum at the start, no, for he bumps into the problem of the sister of the one bonded to him {to undergo yibbum}.
