Rif Ketubot 16a {44a - 45a}

16a

by both of them, each of them according to its shibud, and we do not say that they are the same contract, even though both of them are for the same sum.
For we learned in get pashut {Bava Batra 172a}: Rava said: One who takes two documents for a sum of 50 each, and says make them for me into a single one with a sum of 100, we do not make him one. The Sages made a matter which is good for the borrower and good for the lender. It is good for the lender such that he does not blemish his contract, and it is good for the lender such that he will not force him to pay it off.
Therefore it is clear that he collects both.

{Ketubot 44a}
Mishna:

The convertess whose daughter converted with her and then played the harlot is punished with strangulation, but does not have {stoning} at the door to her father's house, nor does she have 100 sela {paid by the husband for a false accusation}.
If her conception was not in holiness but her birth was in holiness, she is punished by stoning but she does not have {stoning} at the door to her father's house nor 100 sela.
If both her conception and birth were in holiness, she is like an female Israelite in all her matters.
If she has a father but not a door to her father's house; if she has a door to her father's house but no father, she is stoned {but without the it being at the door to her father's house}. The only said the door to her father's house for precept {but not requirement}.

{Ketubot 44b}
Gemara:

Shila taught: There are three measures by a betrothed maiden. If witnesses come about her in her father-in-law's house {=after her marriage} that she had illicit intercourse while in her father's house {=while betrothed}, they stone her by the entrance to her father's house, so as to say "see that plant you have raised."
{Ketubot 45a}
If witnesses came about her in her father's house {=while betrothed} that she had illicit relations while in her father's house {=while betrothed}, they stone her by the entrance of the gate [of the city].
If she first spoiled and later matured {=attained adolescence}, she is judged with strangulation.

This implies that wherever there is a to say that wherever her body changes, her death changes. But we may object: A betrothed maiden who had illicit relations, and when she matured he cast upon her a bad name {by accusing her of such}, he is not lashed and does not pay 100 sela, and she and her false witnesses are hurried to the house of stoning.
She and the false witnesses against her, do you think? Rather, either she or her false witnesses are hurried to the house of stoning.
Rava said: You are speaking of a case of casting upon her a bad name. Casting upon her a bad name is different, for it is a novelty which the Torah innovated. For the typical betrothed maiden who had illicit relations is with stoning; if she entered the bridal canopy but did not yet have intercourse {with her husband} and then had illicit relations, with strangulation, whereas by casting upon her a bad name, with stoning.
Rav Huna son of Rav Yehoshua said to Rava: And perhaps, the All-Merciful only innovates where her body did not change, but where her body changed, the All-Merciful does not innovate.

This section, the post-Talmudic Sages discuss, and they give in it many explanations, and there is not one explanation among them that takes it out appropriately. And therefore, we have seen to explain and elucidate it appropriately, and from here we want to explain it:

Rif Ketubot 15b {Ketubot 43b - 44a}

15b

[Shimon ben] Gamliel.
Marriage, this that we have said. Lashes, that we learn {in a Mishna} One who is lashed and repeats {the sin}, Bet Din take him in to the chamber {for execution} and feed him barley until his stomach bursts.
Expected periods, for we learn {in a Mishna}: A woman does not establish an expected period until it is established three times, and is not [rendered pure for her] from the expected period until it is uprooted from her three times.
The warned ox, for they learn {in a Mishna}: What is warned? Anything that they warn about it three times.

{Ketubot 43b}

"Her ketuba is hers":
And from when does she collect?
Rav Huna said: One hundred, two hundred, from the betrothal, and the additional amount from the time of the marriage.
And Rav Ashi said: Both this and that from the time of the marriage.

{Ketubot 44a}
What of it?
Come and hear, for Rav Yehuda cited Shmuel in the name of Rabbi Eleazar beRabbi Shimon that one hundred, two hundred, from the betrothal, and the additional amount from the time of the marriage. And the Sages says that both this and that from the time of the marriage.
(*and the halacha is, both this and that from the time of the marriage.)

Rav Nachman said: Two contracts which went out one after the other, the second nullifies the first.
Rav Pappa said: And Rav Nachman admits that if he added one palm tree, he wrote it for the purpose of an addition.
It is obvious {that they are valid} if the first one was as a sale and second one as a present, he wrote it to improve his {=the other person's} rights, because of the law of preemption {in which an adjoining neighbor can claim that he wishes to purchase it}, and certainly if the first one is as a present and the second one as a sale, for we say that because of the law of the creditor he wrote it to him. Certainly if both of them were of sale or both of them were of a present, the second nullifies the first.

What is the reason? Rafram said: Because he has admitted to him {that the first contract was invalid}.
Rav Acha said: Because we may say that he has forgiven {and thus surrendered} the first shibud {security of tenure, of the intervening period between the first and second contract}.
What is the practical difference between them? This is the practical difference: Disqualification of witnesses, compensation for "fruits," and land tax.

To explain: This which Rav Nachman said, that the second one nullifies the first one, these words are by a document of land and that which is similar to it, such as a woman's ketuba, but by admissions and lendings,

Rif Ketubot 15a {Ketubot 41b; 43a - b}

15a

BEGIN PEREK FOUR
{Ketubot 41b}
Mishna:

If a naarah was seduced, her embarrassment, her blemish and her fine go to her father, as well as the fine if she was grabbed {=raped}.
If she stood in court before the father died, they belong to the father, such that when the father died, they belong to the heirs.
If she did not yet stand in court when her father died, they belong to her.
If she stood in court before she matured {to be a bogeret}, they are of the father, such that if the father died, they belong to the brothers {of the girl}.
If she did not stand in court until she matured, they belong to her.
Rabbi Shimon says: If she did not manage to collect until after the father died, they belong to her. {Ketubot 42a} The work of her hands and her find, even though she did not yet collect yet, if the father died, they belong to the brothers.

{Ketubot 43a}
Gemara:

Rabbi Avina inquired of Rav Sheshet: A daughter who is maintained by the brothers, to whom belongs the work of her hands? Do they stand in place of the father, such that just as for the father, the work of her hands is to the father, so too here, the work of her hands is to the brothers? Or perhaps it is not comparable to a father. Over there, he {the father} supports her from his own, whereas here, they do not support her from their own {estate but rather from their father's}.
And Rav Yosef resolved that the work of her hands belongs to her, and he deduces this from careful analysis of out Mishna, which teaches that "the work of her hands and her find, even though she did not collect it." From whom would she collect her find?? Rather, does it not mean as follows? That the work of her hands is like her find. Just as her find, in the life of the father is to the father, while after the death of the father belongs to her, so too the work of her hands, in the life of her father it is to the father but after the death of the father it is to her.
It was also stated {by Amoraim}: Rav Yehuda cited Rav: A daughter supported by the brothers, the work of her hands is to her. Rav Kahana said: What is the reason of Rav? For it is written {Vayikra 25:46}:
מו וְהִתְנַחַלְתֶּם אֹתָם לִבְנֵיכֶם אַחֲרֵיכֶם, לָרֶשֶׁת אֲחֻזָּה--לְעֹלָם, בָּהֶם תַּעֲבֹדוּ; וּבְאַחֵיכֶם בְּנֵי-יִשְׂרָאֵל אִישׁ בְּאָחִיו, לֹא-תִרְדֶּה בוֹ בְּפָרֶךְ. {ס} 46 And ye may make them an inheritance for your children after you, to hold for a possession: of them may ye take your bondmen for ever; but over your brethren the children of Israel ye shall not rule, one over another, with rigour. {S}
Them {the slaves} to your sons, and not your daughters to your sons. This teaches that a man does not give over the rights of his daughter to his son.
And so is the halacha.

{Ketubot 43b}
Mishna:
If one betroths off his daughter and she was divorced {and then} he betroths her off and she was widowed, her ketuba is his.
If he married her off {nisuin} and she was divorced, {and then} he married her off and she was widowed, her ketuba is hers.
Rabbi Yehuda says: The {ketuba of the} first one {marriage} is the father's.
They said to him: One she married, the father has no domain in her.

Gemara:

The reason is that he married her off and then she was divorced, {and then} he married her off and she was widowed, but if she was widowed two times, she would no longer be fit to be married off. And thus it is simply stated {stam, in the Mishna} like Rabbi who said that with two times, it is a presumption.
And so is the halacha.

For we learn in perek haBa al yevimto: Marriage and lashes like Rabbi, periods and the warned ox, like Rabban

Rif Ketubot 14b {Ketubot 40b continues; 38b; 41a} A Fine Where There Is A Sale; Paying Principal Vs. Fine Based On Admission

14b

{Ketubot 40b continues}

"Wherever there is sale there is no fine":
Rav Yehuda cited Rav: These are the words of Rabbi Meir, but the Sages say there is a fine where there is a sale, as we have written before.

There is one who says that the halacha is like Rabbi Meir, for the stam Mishna is like him. But we do not think so.
First of all, because Rav Yehuda said "these are the words of Rabbi Meir, but the Sages...," which makes it clear that he does not hold like him, for he {=Rabbi Meir} is a lone opinion (and the halacha is not like him {that is, like Rabbi Meir}).
And furthermore, behold we find Rava, who is later, who holds like the Sages. For Rava inquired {Ketubot 38b} "Is there maturity {=becoming an adolescent, where the naarah would have become a bogeret by the time the case came to court} in the grave or is there no maturity in the grave? Is there maturing in the grave such such that it {=the fine} belongs to her son, or perhaps there is no maturing in the grave such that it belongs to her father. (Say that there is no maturing in the grave and it belongs to her father.) We deduce from this that he holds like the Sages who say that a female minor has a fine, for we do not find to her that she has a son prior to maturing except where he had intercourse with her (*via rape) when she was a minor.
And even though the problem was resolved, it was not resolved because of this reason.

And furthermore, we learnt in perek Naarah sheNitpateta: Resh Lakish said: If one causes an evil name to go out on a female minor {rather than a naarah, alleging that she cheated on him} he is exempt, for it is stated {Devarim 22:}
יט וְעָנְשׁוּ אֹתוֹ מֵאָה כֶסֶף, וְנָתְנוּ לַאֲבִי הַנַּעֲרָה--כִּי הוֹצִיא שֵׁם רָע, עַל בְּתוּלַת יִשְׂרָאֵל; וְלוֹ-תִהְיֶה לְאִשָּׁה, לֹא-יוּכַל לְשַׁלְּחָהּ כָּל-יָמָיו. {ס} 19 And they shall fine him a hundred shekels of silver, and give them unto the father of the damsel, because he hath brought up an evil name upon a virgin of Israel; and she shall be his wife; he may not put her away all his days. {S}
naarah {written with a heh} in full states Scriptures ... rather, here specifically a naarah. But all places where it says "naarah" {written without the heh} -- even a female minor is implied. Thus it is clear that he holds like the Sages.
And so is the halacha.

"A mature woman {bogeret} does not have a sale and she has no fine":
Via careful analysis of this, we deduce that {payment for} embarrassment and blemish however {as opposed to fine} she does have. And specifically if she was a mature rape victim, but a mature seduced woman, she has nothing.

{Ketubot 41a}
Mishna:

If one says "I seduced Ploni's daughter," he pays for embarrassment and blemish based on his own admission but does not pay the fine based on this own admission.
If one says "I stole Ploni's ox," he pays the principal based on his own admission, but he does not pay the double payment, or four or five times payment.
"My ox killed Ploni" or "{my ox killed} Ploni's ox," he pays based on his own admission.
"My ox killed Ploni's slave," {for which the penalty payment is 30 shekel} he does not pay based on his own admission.
This is the general rule: Anyone paying more than he damaged does not pay based on his own admission.

{Ketubot 38a continues}
Gemara:

And the halacha is like Rabbi Akiva, for we establish that the halacha is like Rabbi Akiva over his colleague.

{Ketubot 38b}
Abaye said: If he had intercourse and she died, he is exempt, for it is stated {Devarim 22:29}:
כט וְנָתַן הָאִישׁ הַשֹּׁכֵב עִמָּהּ, לַאֲבִי הַנַּעֲרָ--חֲמִשִּׁים כָּסֶף; וְלוֹ-תִהְיֶה לְאִשָּׁה, תַּחַת אֲשֶׁר עִנָּהּ--לֹא-יוּכַל שַׁלְּחָהּ, כָּל-יָמָיו. {ס} 29 then the man that lay with her shall give unto the damsel's father fifty shekels of silver, and she shall be his wife, because he hath humbled her; he may not put her away all his days. {S}
and not to the father of the deceased.

{Ketubot 39a}
If he had intercourse before she was betrothed and then she was betrothed, her fine goes to her father, for she still has not left the domain of her father, for they learn {in a Mishna}: A betrothed maiden {naarah}, her father and her husband nullify her vows.
However, if he had intercourse with her and then she was married, or matured, her fine belongs to her, for maturity and marriage take her out of the father's domain entirely.
And this was where she did not stand in judgment before she matured or was married, but if she stood in judgment, her fine is to her father.

Mishna:

The seducer gives three things and the rapist four.
The seducer gives {=pays} for embarrassment, blemish, and fine.
The rapists adds upon this, in that he gives for pain.

What is the difference between the seducer and the rapist? The rapist gives for pain and the seducer foes not give for pain. The rapist gives immediately and the seducer when {=if} he sends out. The rapist drinks from his pot and the seducer, if he wishes to send out, he may send out.

Gemara:
"And the seducer when he sends her out":
Is she his wife {such that "sends out" is appropriate}?
Abaye said: Say instead, "when he does not take in."
A brayta also says so: Even though they said that the seducer gives when he does not take in {in marriage}, for embarrassment and blemish he gives immediately. Both the rapist and seducer, either she or her father are able to prevent {the marriage}.
Another brayta: Although they said that a rapist gives immediately, when she goes out, she has nothing.

Mishna:
What is meant by "he drinks from his pot?" Even if she is lame, even if she is blind.
If {however} he finds in her some immoral act, or if she is unfit to marry an Israelite, he is not allowed to maintain her, for it is stated {Devarim 22}:
כט וְנָתַן הָאִישׁ הַשֹּׁכֵב עִמָּהּ, לַאֲבִי הַנַּעֲרָ--חֲמִשִּׁים כָּסֶף; וְלוֹ-תִהְיֶה לְאִשָּׁה, תַּחַת אֲשֶׁר עִנָּהּ--לֹא-יוּכַל שַׁלְּחָהּ, כָּל-יָמָיו. {ס} 29 then the man that lay with her shall give unto the damsel's father fifty shekels of silver, and she shall be his wife, because he hath humbled her; he may not put her away all his days. {S}
a woman fit for him.

{Ketubot 40a}
Gemara:
And let a positive commandment {of marrying this woman he slept with} come and push off the negative commandment?
When do we say that the positive commandment comes and pushes off a negative commandment? Such as circumcision where there is leprosy, where it is not possible to fulfill the positive commandment. However, here, if she says "I do not want him," do we come to the positive command at all?

Mishna:
An orphaness who was betrothed and then divorced:
Rabbi Eleazar says: The rapist is liable and the seducer is exempt.

Gemara:
Rav Ada bar Ahava said: The halacha is like Rabbi Eleazar.
{Indeed,} Rav called Rabbi Eleazar the happiest of the wise men.

Mishna:

What is "embarrassment" {which is paid}? All is according to the embarrasser and the embarrassee.
Blemish -- we see her as if she were a maidservant, how much she was worth than and how much she is worth now.
A fine is equivalent for every person.
And anything that has a set Biblical amount is equivalent in all people.

{Ketubot 40b}

Anywhere there is a sale there is no fine, and anywhere there is a fine, there is no sale.
A female minor has a sale and does not have a fine.
A maiden {naarah} has a fine and does not have a sale.
A mature woman has neither sale nor fine.

Gemara:

How do we evaluate her?
The father of Shmuel said: We estimate how much a man would want to give, between a virgin maidservant and a non-virgin maidservant, to marry her off to his slave who gives his master satisfaction.

and she does not have a sale. These are the words of Rabbi Meir. For Rabbi Meir said: Anywhere there is a sale there is no fine and anywhere there is a fine there is no sale.
And the Sages say: A female minor, from 3 years and a day until she matures has a fine.

{But, this implies:} A fine, yes, a sale, no!? Say, "even" a fine in an instance of sale {being valid}.

To explain: Where a sale would be valid. That is to say, from 3 years and a day until she brings two hairs, she has a sale and she has a fine, but when she brings two hairs until she matures, she has a fine but she does not have a sale. For we establish that a Hebrew maidservant goes out from the domain of her master with signs {of puberty}.

{Ketubot 29b}

But are these {maidens} entitled to a fine? Read here {Devarim 22:29}:

Rif Ketubot 13a {Ketubot 28a continues; 28b-29a}

{Ketubot 28a continues}

"I remember regarding the woman Plonit":
What is the reason? Since most women are married when virgins, this is a simple revealing of the matter.

"And that the man Ploni went out of school to immerse for his teruma":
But let us be concerned lest he was the slave of a kohen? This supports Rabbi Shimon ben Levi, who said that it is forbidden for a man to teach his slave Torah.

{Ketubot 28b}
"To immerse for his teruma":
With regard to Rabbinic teruma {is such testimony believed}.

"And that he divided...":
And perhaps he was the slave of a kohen? He holds like the opinion that we do not distribute {teruma} to a slave unless his master is with him.

"And that the place is a bet haperas {where there is a plowed over grave}":
Bet haperas is Rabbinic.

"and until here we would walk on Shabbat":
He holds that techum {Shabbat limits} are Rabbinic.

"And he is not believed to say 'there was a path of Ploni in this place.'":
What is the reason? This is the taking out of money and he is not believed.

Mishna:

And these are the maidens {naarot} who have to them a fine {if a man violated them}:
If one had intercourse with a bastardess, a Netina {female descendant of Gibeonite converts}, a female Cuthean, a convertess, a captive woman, a maidservant who were redeemed, converted, or freed when younger than 3 years and a day.
If one had intercourse with his sister, his father's sister, his mother's sister, his wife's sister, his brother's wife, his father's brother's wife, or a menstruant, they all receive the aforementioned fine -- for even though they {=these sins} are all punishable by karet {Divine "cutting off"}, they
do not have to them court-administered death penalty.

Gemara:
{All these cases where they receive a fine is when they are virgins. Therefore,}
This that we stated in the Mishna "one who had intercourse with his brother's wife" we find such as where his brothers had sons and he betrothed a naarah and then died. Alternatively, his maternal brother who betrothed a young girl and died; or he divorced her; such that she is not subject to chalitza and yibbum, and he is punishable for them with karet.
And his father's brother's wife as well, where his father's brother betrothed a naarah and then died.

A naarah yes, a minor no {to recieving the fine}. Who is the Tanna?
Rav Yehuda cited Rav: It is Rabbi Meir, for they learnt {in a brayta}: A minor, from 3 years and a day until she brings forth two {pubic} hairs, she has a sale {that the father might sell her as a Hebrew maidservant} but she has no fine. And when she brings forth two hairs until she matures, she has a fine.

If one redeems a captive woman and testifies about her, he may marry her, for a man will not cast his money into the water.

If he merely testifies about her, he may not marry her, lest he cast his eyes upon her {and that was the reason for his testimony}.

They learnt {in a brayta}: Even so, he designated a house for her in his courtyard, and when she went out, she went out at the head of her children, and when she entered, she entered after her children.
And these words were by a woman taken captive, for by a captive woman they were lenient, but by a divorced woman, no.

{Ketubot 28a}
and if he was a kohen, she should not dwell with him in the same alleyway. There was such an incident and they said that a small village is judged to be the same as a neighborhood.
Who is pushed off before whom? She is pushed off from before him by a courtyard that is both of theirs, and certainly a rented courtyard, for a man's moving is more difficult than a woman's. But in her own courtyard, he is pushed off from before her.

Rav Pappa said: We place them in cherem.
Rav Huna son of Rav Yehoshua said: We lash them.
Rav Nachman said: They teach in Evel Rabbati {=masechet Semachot}: Where are these words said? Where she was divorced from full marriage, but if she was divorced from betrothal, she is paid even directly, for his heart is not haughty with her, and she does not recognize his winks and hints.
And these words are where they are not familiar with one another, but if they are familiar with one another, even from betrothal she is only repaid via others.

And these are believed to testify when they are older on what they saw when they were younger.
A man is believed to say "this is my father's handwriting; and this is my teacher's handwriting; and this is my brother's handwriting; I recall regarding the woman Plonit that she went out {at the time of marriage} in a litter with her head uncovered {and thus was a virgin at the time}; and about the man Plonit that he went out from school to immerse to eat his teruma {and is thus a kohen} and that he used to take his share with us at the threshing floor; and that this place was a bet haperas {where there was a ploughed over grave}."

And we deduce from this of Rav Ashi that when they testify after a time, there is no distinction between death and divorce, who they contradict one another, she may not marry and if she remarried she shall not go out.
And the halacha is not like Rabbi Menachem beRabbi Yossi, not by death nor by divorce, for we establish like Rav Ashi, for he is the latest.

The Sages learnt {in a brayta}: Two who say she was betrothed and two say that she was not betrothed, she should not remarry, and if she remarried, she should not go out.
Two say that she was divorced and two say she was not divorced, she should not remarry, and if she did remarry she should go out.
What is the difference between the former and latter parts {of the brayta}?
Rav Pappa said: Translate is as being about a single witness. A single witness says she was betrothed and a single witness says she was not betrothed -- both of them are testifying about a {previously} unattached woman, and this one who says that she was betrothed is only a single person, and the words of a single person do not stand where there are two {since both said she was initially unattached}. In the latter case, one witness says she was divorced and one witness says she was not divorced. Both of them are testifying about a married woman, and this one who says that she was divorced is only a single person, and the words of a single person do not stand where there are two.

Rav Ashi said: In truth, they are two and two, and reverse it -- two say "we have seen that she was betrothed" and two say "we have not seen that she was betrothed," she should not remarry, and if she remarried, she should go out.
What is the reason? "We have not seen her" is not a proof.
And even though they all dwell in a single courtyard, we do not say that if she was betrothed, there would have been a "voice" to the matter, because people are wont to betroth quietly.
The latter case, two say "we have seen that she was divorced" and two say "we have not seen that she was divorced," she should not remarry and if she remarried, she should not go out. Because people are wont to get divorced in private.

{Ketubot 22a}
Mishna:
If she says "I was taken captive but I am pure," she is believed, for the mouth that binds is the mouth that releases.
And if there were witnesses that she was taken captive and she says "I am pure," she is not believed.
And if the witnesses came after she was remarried, she should not go out.

{Ketubot 23a}
Gemara:
The father of Shmuel said: Not that she actually remarried, but rather once she was permitted to remarry, even though she did not remarry.
But is says "she should not go out." That is, she shall not go out of her initial permittedness.

The Sages learnt {in a brayta}: "I was taken captive but am pure, and I have witnesses that I am pure," we do not say that we should wait until the witnesses come, but rather we permit her immediately. If they permitted her to remarry and afterwards witnesses came that she was taken captive, she should not go out. And if witnesses to her impurity came, even if she has several sons, she should go out.

Rabbi Zera said: I heard this matter from Rabbi Abba, and if not for Rabbi Abbi of Acco, I would have forgotten it. Three who sat to confirm a contract and one of them died, they must write "in a group of three sitting together we were, and one is no more."
And Rav Nachman said: And if it was written in it "in a court of law," more is not necessary.
And perhaps it was a presumptuous bet din? Like that of Shmuel, for Shmuel said: Two who judged, their judgment is judgment but they are called a presumptuous bet din.
Where it is written in it "a bet din of Rav Ashi." And perhaps a Bet din of Rav Ashi holds like Shmuel? That it is written in it "as Rav Ashi told us, and we told to Rav Ashi."
From this statement we deduce that the halacha is not like Shmuel who said that if two judged, their judgment is judgment.

Mishna:
A woman who said "I was a married woman but now am divorced," she is believed, for the mouth that bound is the mouth that released.
And if there were witnesses that she was a married woman and she says "I am now divorced," she is not believed.

Gemara:
The Sages learnt {in a brayta}: If she said "I am a married woman" and she retracts and says "I am an unmarried woman," she is not believed. And if she gives a plausible justification for her words, she is believed.
And there was an incident by a certain women who was great in beauty and men were jumping to betroth her, and she said to them "I am betrothed." After days, she stood and betrothed herself. The Sages said to her: What did you see {to do this}? She said to them: Initially, men who were inappropriate were coming to me, and I told them that I was already betrothed. Now that appropriate men are coming to me, I stood and betrothed myself. And this law was brought by Rabbi Acha the officer of the palace before the Sages in Usha and they said: If she gave a plausible justification for her words, she is believed.

Shmuel inquired of Rav: If she says "I am impure" and retracts and says "I am pure," what?
He said to him: Even in this, if she gives a plausible justification for her words, she is believed.
{Ketubot 22b}
He learned it from him 40 times, and even so, Shmuel did not act in practice so for himself.

The Sages learnt {in a brayta}: Two say he {=the husband} died and two say that he did not die; two say she was divorced and two say she was not divorced; she may not remarry, and if she did marry she should not divorce.
Rabbi Menachem beRabbi Yossi says: The should divorce.
Rabbi Menachem beRabbi Yossi said: When do I say that she should divorce? At a time where witnesses came and afterwards she married, but if she married and afterwards witnesses came, she should not divorce.

{But} they are two against two -- one who has intercourse with her would be liable to an aham taluy {because of the doubt}!
Rav Sheshet said: Such that she married one of her witnesses.
But then she herself is liable to an asham taluy! Where she says "I am certain."

Rabbi Yochanan said: Two say he died and two say he did not die, she should not remarry and if she remarried, she should not divorce; two say she was divorced and two says she was not divorced, she should not remarry and if she remarried she should divorce.
What is the difference between the former case and the latter case?
Rava said: Rabbi Yochanan saw {=agreed with} the words of Rabbi Menachem by divorce and he did not see it by death.
What is the reason? Death, she cannot contradict him {if he comes back}, while by divorce, she can contradict him.

And even though Rav Hamnuna said that the woman who says to her husband "you have divorced me" is believed, because of a presumption that a woman would not act brazenly before her husband, these words are where there are no witnesses that support her, but where there are witnesses who support her, she would indeed be so brazen.
Rav Ashi {our gemara: Assi} said: Such as where they {=witnesses} said "he died now; he divorced now." As for death, it is not possible to prove but divorce is possible to prove, for we say to her, if it is indeed the case, show your get.

Rif Ketubot 9a {Ketubot 21b} Complaint Against A Robber Judge

9a

that it be written for he sake, but by other documents, no, for Rabbi Assi cited Rabbi Yochanan: A document that he borrowed upon and payed back, he may not return and borrow using it again, for his assets under lien were already forgiven. The reason is that the lien was forgiven, but for falsehood we do not worry. And this segment also exists in Gittin in perek Kol haGet.

{Ketubot 21b}

Rabbi Abba cited Rav Huna who cited Rav: Three who sat to confirm a contract and a complaint is lodged against one of them on the grounds of robbery before they signs, they testify about his that he has repented and then he signs, for they are then all sitting as one. Once they sign, they may not testify about him that he has repented, for they are not then three sitting together, for at the time these two signed, he was not joined with them, and it is as if they were sitting alone.

And specifically a complaint about robbery cancels the combination, but a complaint about a genealogical flaw which was now {after the signing} resolved that he is valid, since from the beginning he was valid, this is merely a revealing of matters, and it does not cancel his ability to join.
And a complaint about robbery as well, we only say this where two testified that he is a robber, and two come and testify that he repented, such that they do not contradict the first pair, but if two others come and say that he is not a robber, such that they contradict the first set, he may not sign at all, for it is an instance of two against two, and the man is doubtfully invalid, and therefore they should not have him sign at all, and should not take out money based on his mouth.
And a proof to the matter is this which the Sages learnt {in a brayta}: Two who were signed on a contract and then died, and then two {others} come and say that it is their {=the deceased's} handwriting, but that they were forced ... or their handwriting came from another place, they are not believed. And we object "and do we collect with it? Why they are two against two." Thus it is evident that we do not say that we put the man in his presumed initial state {of being a righteous person} and then take out money based on his say-so.

Rif Ketubot 8b {Ketubot 21b}

8b

{Ketubot 21b}

We deduce from this three things:
We deduce from this that a witness may become a judge by a Rabbinic matter.
And we deduce that judges who recognize the signatures of the witnesses, we do not need to testify {about it} before them.
And we deduce from this that judges who do not recognize the signatures of the wirnesses, we are required to testify before each and every one {who does not recognize}.

Rav Pappa said: This judge's attestation which is written before the witnesses give evidence about their signatures is invalid, because it looks like falsehood.
And the halacha is not like Rav Pappa, from that which we learn in this masechet in perek hakotev that we do not hold like Rav Pappa, for Rav Nachman said: Rabbi Meir was wont to say, "even if he found it in the garbage, if he signed it and gave it to her, it is valid." And even the Sages do not argue on Rabbi Meir except by divorces of women, where we require
