14b

{Moed Katan 23a continues}

ואם אין לו בנים מותר לישא אשה אחרת לאלתר מפני פריה ורביה הניחה לו בנים קטנים מותר לישא לאלתר מפני פרנסתן
And if he has no sons, it is permitted to marry another woman immediately, because of being fruitful and multiplying. If she left him young children, it is permitted for him to marry immediately because of their sustenance.

Yerushalmi:
ירושלמי בפרק החולץ ליבמתו
חוץ מן האלמנה מפני האיבול וכמה איבול ל' יום הדא דאיתמר בנשים אבל באנשים ג' רגלים
ביש לו בנים אבל אין לו בנים מותר מיד
וה"מ כשיש לו מי שישמשנו אבל אין לו מי שישמשנו מותר מיד
וה"מ בשאין לו בנים קטנים אבל אם יש לו בנים קטנים מיד מותר
כהדא מעשה שמתה אשתו של ר' טרפון ועד שהוא בבית הקברות אמר לאחותה לכי גדלי בני אחותיך ואע"פ שכנסה לא הכירה עד שעברו עליו ל' יום
Yerushalmi, in perek hacholetz livimto:
Except for {marrying} a widow because of the mourning. And how much is the mourning? 30 days. This is what is stated for women, but for men, three Festivals. Where he has sons, but if he does not have sons, it is permitted immediately.
And these words are where he has someone to attend to his needs, but if he does not have someone to attend to his needs, it is permitted immediately.
And these words are where he has no young children, but if he has young children, it is permitted immediately.
Like that incident in which the wife of Rabbi Tarfon died and while he was still in the cemetery he said to her sister, "go and raise the children of your sister." And even though he married her, he did not recognize her {and have relations with her} until 30 days had passed.

מעשה שמתה אשתו של יוסף הכהן ואמר לאחותה בבית הקברות לכי פרנסי בני אחותיך ואעפ"כ לא בא עליה אלא לזמן מרובה

אמר רב פפא לאחר שלשים יום

{Moed Katan 23a resumes}
There was in incident in which the wife of Yosef the kohen died, and he said to her sister in the cemetery, "go and sustain your sister's children," {thus proposing} and even though he did not have relations with her for a long time.
What is meant by "a long time?"
Rav Pappa said: After 30 days.

אין לו בנים מותר לישא אשה אחרת לאלתר מפני ביטול פו"ר
וכמה בנים יהיו לו ויהא אסור לישא לאלתר
כדתנן לא יבטל אדם מפריה ורביה אא"כ יש לו בנים
בש"א שני זכרים ובה"א זכר ונקבה
שנא' זכר ונקבה בראם
וקי"ל כב"ה
"If he has no sons, it is permitted to marry another woman immediately because of the nullification of being fruitful and multiplying."
And how many children would he have such that it would be prohibited for his to marry immediately?
Like we learnt {in a Mishna}: One should not nullify {and stand off from fulfilling} from being fruitful and multiplying unless he has children. Bet Shammai say: Two males. And Bet Hillel say: A male and a female. For it is stated {Bereishit 5}:
ב זָכָר וּנְקֵבָה, בְּרָאָם; וַיְבָרֶךְ אֹתָם, וַיִּקְרָא אֶת-שְׁמָם אָדָם, בְּיוֹם, הִבָּרְאָם. 2 male and female created He them, and blessed them, and called their name Adam, in the day when they were created.
And we establish like Bet Hillel.

היו לו בנים ומתו והיו להן בנים כבר קיים מצות פריה ורביה
דת"ר בני בנים הרי הן כבנים
ולא שנא ברא לברתא ול"ש ברתא לברא או ברתא לברתא או ברא לברא בכולהו קיים מצות פו"ר ודוקא תרי מתרי אבל תרי מחד ברא לא
If he had children and they died, and they {the children} had children, he has already fulfilled the precept of being fruitful and multiplying. For the Sages learnt {in a brayta}: Grandchildren are like children.
And it does not matter if it is a son to a daughter or a daughter to a son, or a daughter to a daughter or a son to a son, in all of them he has fulfilled being fruitful and multiplying/ And specifically two {grandchildren} from two {children, one each}, but two from one son, no.

ת"ר כל ל' יום לגיהוץ אחד כלים חדשים ואחד כלים ישנים יוצאין מתחת המכבש
רבי אומר לא אסרו אלא בכלים חדשים בלבד
ר' אלעזר בר"ש אומר לא אסרו אלא כלים חדשים לבנים בלבד

וקי"ל כרבי אליעזר בר"ש דהא רבא נפק בהימיינותא רומייתא סומקתי חדתי כר' אליעזר בר"ש
The Sages learnt {in a brayta}: All thirty days for pressing {clothing is forbidden}, whether new clothing or old clothing, coming out from the presser.
Rabbi says: They only forbade new clothing.
Rabbi Eleazar beRabbi Shimon says: They only forbade new white clothing.

And we establish like Rabbi Eleazar beRabbi Shimon, for Rava went out in a new red Roman girdle like Rabbi Eleazar beRabbi Shimon.


תניא באבל רבתי כל שלשים יום אסור בתספורת אחד ראשו ואחד זקנו ואחד כל שער שיש בו
והאשה מותרת בנטילת שער לאחר שבעה
They learnt in Evel Rabbati: All thirty days he is forbidden in trimming, whether the hair of his head, of his beard, or of any hair that he has. And a woman is permitted in taking off hair after 7.

וגרסינן בפרק החולץ בענין
רבי יוסי אומר כל הנשים יתארסו חוץ מן האלמנה מפני האיבול וכמה איבול שלשים יום
אמר רב חסדא ק"ו ומה במקום שאסרו לספר ולכבס מותר ליארס ל' יום של איבול שמותר לספר ולכבס אינו דין שמותר ליארס
ושמעת מינה שהאשה מותרת בנטילת שער לאחר שבעה כדקתני באבל רבתי
And we learn in perek hacholetz about the matter: Rabbi Yossi says: All women may be betrothed except for the widow because of the mourning. And how much is mourning? Thirty days.
Rav Chisda said: As a kal vachomer -- If in an instance that the forbade to trim hair and to wash clothing it is permitted to betroth, the thirty days of mourning in which it is permitted to trim hair and to wash clothing, then certainly is is permitted to betroth.
And we deduce from this that a women is permitted in taking off hair after 7 as is taught in Evel Rabbati.

ת"ר מי שמתו מוטל לפניו אוכל בבית אחר אין לו בית אחר אוכל בבית חבירו אין לו בית חבירו עושה מחיצה ואוכל אין לו דבר לעשות מחיצה מחזיר את פניו ואוכל ואינו מיסב ואוכל ואינו אוכל בשר ואינו שותה יין ואינו מברך ואינו מזמן ואין מברכין עליו ואין מזמנין עליו ופטור מק"ש ומן התפילה
The Sages learnt {in a brayta}: One whose dead lies before him eats in another house. If he has no other house, he eats in his friend's house. If he has no friend's house, he makes a partition and eats. If he has nothing to make a partition, he should turn his face and eat. And he does not recline and eat, and he does not eat meat or drink wine, and does not bless and does not lead in a a mezuman, and they do not bless upon him {hamotzi} and they do not make a mezuman with him, and he is exempt from reading the Shema and from prayer.
