Rif Bava Kamma 35b {98b - 100b}

35b


{Bava Kamma 98b}
ושיברן פטור
מ"ט אומן קונה בשבח כלי
ואסקא רבא דכ"ע אין אומן קונה בשבח כלי
ושמעינן מיניה דליתא לדרב אסי אלא חייב לשלם דמי שידה
וכן הלכתא:
and then {after constructing them} broke them, he is exempt.
What is the reason? A craftsman acquires title to the increase in the vessel.
{Bava Kamma 99a}
And Rava concludes: All agree that a craftsman does not acquire title to the increase in the vessel.
And we deduce from this that we do not rule like Rav Assi, but rather he is liable to pay the value of the box.
And so is the halacha.

{Bava Kamma 99b}
תנו רבנן המוליך חטיו לטוחן ולא לתתן ועשאן סובין או מורסן חייב לשלם קמח לנחתום ועשאו פת ניפולין בהמה לטבח וניבלה חייב מפני שהוא כנושא שכר:
The Sages learnt {in a brayta}: If one brought wheat to be ground and the miller omitted to moisten it and he made it into branflour or coarse bran, or if flour to a baker and he made out of it bread which crumbled, or an animal to a slaughterer and he rendered it nevelah, he is liable, for he is like a worker who receives hire.

אמר רבי יוחנן טבח אומן שקלקל חייב
והוא דעבד בשכר דאמר רבי זירא הרוצה שיתחייב לו טבח יקדים לו דינר:
אבל אומן דעביד בחנם פטור
כי ההוא גברא דאתא לקמיה דרבי יוחנן ואמר ליה זיל אייתי ראיה דמומחית לתרנגולי ופטירת:
Rabbi Yochanan said: An expert slaughterer who did not carry out the slaughter properly would be liable to pay.
And this is where he worked for hire. For Rabbi Zera said: If one wants the slaughterer to become liable to him, he should give him a dinar beforehand.
But an expert who works for free is exempt. Like the certain person who came before Rabbi Yochanan, and he said to him, "Go and bring evidence that you are skilled to slaughter hens, and I will declare you exempt."

המראה דינר לשולחני ונמצא רע
תני חדא אומן ה"ז פטור הדיוט ה"ז חייב
ותניא אידך בין אומן בין הדיוט חייב
אמר רב פפא כי תניא ההיא אומן הרי זה פטור כגון דנכו ואיסור דלא צריכי למיגמר כלל:
If one showed a dinar to a moneychanger {who recommended it as good} and it was found to be bad:
One Tannaitic source taught: An expert, he is exempt; a normal person, he is liable.
And another brayta: Whether an expert or a normal person, he is liable.

Rav Pappa said: When that brayta taught that an expert is exempt, it is such Dancho and Issar {Rashi: renowned experts} who need no instruction at all. {See parshablog post on this translation, which I believe to be incorrect.}

ההיא איתתא דאחזיא ליה דינרא לרבי חייא אמר לה שפירא הוא לסוף אתאי אמרה ליה אזלי אחויתיה ואמרו לי דסניא הוא ולא קא נפיק לי
א"ל לרב זיל חלפיה ניהלה וכתוב אפינקסך דין עסק ביש:
There was a certain woman who showed a dinar to Rabbi Chiyya. He said to her: It is fine. In the end, she came and said to him: I went and showed it around, and they said to me that it is a bad one, and I could not use it.
He said to Rav: Go and switch it for her, and write in the register that this was a bad business.

והא רבי חייא לא צריך למגמר
ר' חייא לפנים משורת הדין הוא דעבד כדתני רב יוסף
והודעת להם זה בית חייהם
את הדרך זה גמילות חסדים
ילכו זה ביקור חולים.
בה זו קבורה.
ואת המעשה זה הדין.
אשר יעשון זה לפנים משורת הדין.
But surely Rabbi Chiyya needed no instruction? {And thus would not be liable in this error he made?} Rabbi Chiyya was conducting himself further than the requirements of the law, as Rav Yosef taught: {Shemot 18:20
כ וְהִזְהַרְתָּה אֶתְהֶם, אֶת-הַחֻקִּים וְאֶת-הַתּוֹרֹת; וְהוֹדַעְתָּ לָהֶם, אֶת-הַדֶּרֶךְ יֵלְכוּ בָהּ, וְאֶת-הַמַּעֲשֶׂה, אֲשֶׁר יַעֲשׂוּן. 20 And thou shalt teach them the statutes and the laws, and shalt show them the way wherein they must walk, and the work that they must do.
}

"and shalt show them" -- {Bava Kamma 100a} this is the source of their livelihood;
"the way" -- this is deeds of lovingkindness;
"they must walk" -- this is the visitation of the sick;
"wherein" -- this is burial;
"and the work" -- this is the law;
"that they must do" -- this is further than the requirements of the law.

רשב"ל אחוי דינרא לרבי אלעזר אמר ליה מעליא הוא אמר חזי דעלך קא סמיכנא
א"ל אמאי דאי משתכח בישא בעינא לשלומי לך והא את הוא דאמרת מאן דדאין דינא דגרמי ר"מ
מאי לאו ר"מ ולא סבירא לך כוותיה
א"ל לא ר"מ וסבירא לן כוותיה
דתנן מחיצת הכרם שנפרצה אומרים לו גדור נתייאש ממנה ולא גדרה הרי זה קידש וחייב באחריותו:
Rabbi Shimon ben Lakish showed a dinar to Rabbi Eleazar. He told him it was fine. He {=Resh Lakish} said: See that I am relying upon you.
He said to him: Why? That if it is found bad I would have to exchange it? But it is you who said that the one who maintains that we judge the law of indirect consequences is Rabbi Meir? Does this not mean that it is {only} Rabbi Meir and we do not maintain like him?
He said to him: No, it is Rabbi Meir, and we do hold like him. For they learnt {tnan}: If the fence of a vineyard {near a field of crops} is broken through, {Bava Kamma 100b} we say to him {the owner of the vineyard} "fence in." But if he abandons it and does not fence in, he would render the produce proscribed and would incur full responsibility.

שמעינן מינה דהדיוט לא מיחייב לשלומי עד דמודע ליה דעליה קא סמיך דאי לא מודע ליה מצי א"ל לא ידענא דעלי קא סמכת ואי מוכחא דעליה קא סמיך לא צריך לאודועיה
We deduce from this that a normal person is not liable to pay until he is informed that one is relying upon him. For if he does not inform him of this, he is able to say to him, I did not know that you were relying upon me. And if it is apparent that one is relying upon him, one need not {explicitly} inform him.

Mishna:
נתן צמר לצבע והקדיחתו היורה נותן לו דמי צמרו
צבעו כעור אם השבח
IF WOOL WAS GIVEN TO A DYER AND THE CAULDRON BURNT IT, HE WOULD HAVE TO PAY THE OWNER THE VALUE OF HIS WOOL.
BUT IF HE DYED IT KA'UR, THEN IF THE INCREASE IN VALUE
